Alacak temliki kurumu, özellikle ekonomik hayatın hızla gelişimi aşamalarında zamanla kendisine d... more Alacak temliki kurumu, özellikle ekonomik hayatın hızla gelişimi aşamalarında zamanla kendisine duyulan ihtiyaç artarak vazgeçilmez bir unsur haline gelmiştir. Ekonomik hukukî ilişkilerde bazı karışıklıkları azaltan, kişilerin elinde bazen bir kredi haline gelen ve bu yönüyle zamanla büyük hacimli ticari faaliyetlerde bir temel teşkil eden bir kurumdur. Bu çalışmamızda ilk olarak alacak temlikinin kavram olarak ne olduğu ve Türk hukuk sistemindeki yeri üzerinde durulacak, daha sonra hukukî özellikleri ve buradaki bazı tartışmalar yansıtılacaktır. Devamında hangi amaçlarla başvurulmasına bağlı olarak bu kurumun çeşitleri ve daha sonra her hukukî işlemde olduğu gibi bu işlemde de bulunan kurucu unsurlar nazara verilecektir. Bu ilk kısmın ardından bu kuruma olan ihtiyacın başlarda nasıl karşılanmaya çalışıldığı ve nihayetinde bu kurumun nasıl doğup geliştiği, bu zamandaki birçok devletin hukuk sisteminin ve kanunlarının temeli sayılabilecek Roma hukuku çerçevesinde değerlendirilecektir.

With his examination, he generally wants exact answers like a definition (for example in Euthyphro dialogue) but, unintentionally, he shows the ignorance and lack of knowledge of those who claim to be wise (Apology, 21c-e). In the court, he responded to a probable question about whether he will give up this examination or not that "the unexamined life is not worth living for men" (Apology, 38a). He makes this claim because of two reasons. First is that men should think, examine and try to find wisdom because this is their distinctive feature from other creations, and, especially and at least, men of Athens should do so. The second reason is that Socrates himself is ordered by the god to do those examinations, ergo, he can not break this important and vital command even when he faces death.

It divides his non-conformist ideas into four parts: his views on education system, combining religious and positive sciences, shortening the time of religious education; his criticisms and ideas about Ottoman government and their stance against freedom (Meşrutiyet); his opposition to Republician Turkish Government in the matter of revolutions which are, as he claims, carried out regardless the sensitivity of Muslim Turkish public; and lastly his differences among the other İslamic groups and movements in some İslamic issues, understandings and application.
