Judicial Independence and Shapiro Parties in a Hobbesian state of nature enter into a state primarily to feel a sense of safety and security. It is then the interest of the sovereign to hold as much legitimacy as possible. In Shapiro's Courts and Bingham's The Rule of Law, they argue that legitimacy is attained by a regime when a government instills the rule of law. In today's age, people want more from the state than just the Hobbesian sense of security. Now, people want to be treated fairly, in the sense that the individual will be treated fairly by the regime. In any society, conflicts are sure to arise. 1 Courts are usually seen as the institutions to resolve these conflicts.

Judicial independence is vital in order to run in a just regime and system of government. Judicial independence is generally defined as the need of the judiciary to be isolated from the influence of non-involved parties, namely other branches of government. Despite some complications, the American Judiciary has a great amount of judicial independence that enables the federal judiciary to progress our nation's values. The benefits of judicial independence can clearly be seen in the field of civil rights. Given that argument between parties will almost always arise, people in a society need a neutral arbiter to adjudicate their disputes. Even political philosophies that call for minimal to no institutional government, like the Libertarian one, call for a court system to be established for this exact reason. 1 Neutral and fair judgment that carries the force of the state is necessary for those ruled by the state to 2 attribute the state legitimacy. In the absence of neutral and fair judgment, the ruled will not have nearly any incentive to follow the law or principles of justice.
