It is because of the high financing needs of the people who have not been reached by the banks. The existence of lending fintech is getting stronger with the issuance of the Financial Service Authority Regulation Number 77 of 2018 concerning Information Technology-Based Money Lending and Borrowing Services. Until August 2019, there were 127 lending fintech registered in the Financial Service Authority. Unfortunately, there is still a problem concerning protecting consumers who make loan transactions with fintech companies, along with the rise of illegal fintech companies. ABSTRAKSejak diamandemennya Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama dengan Undan... more ABSTRAKSejak diamandemennya Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama dengan Undang-Undang Nomor 3 Tahun 2006, kompetensi absolut peradilan agama diperluas. Pasal 55 Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah memperkuat kewenangan peradilan agama dalam menyelesaikan sengketa perbankan syariah. Polemik muncul ketika Penjelasan Pasal 55 ayat (2) juga memberikan kewenangan kepada peradilan umum menyelesaikan sengketa perbankan syariah. Masalah ini lalu diajukan judicial review ke Mahkamah Konstitusi. Menurut Mahkamah Konstitusi, Penjelasan Pasal 55 ayat (2) bertentangan dengan UUD NRI RI 1945 dan tidak mempunyai kekuatan hukum mengikat. The first category is through litigation, namely in Islamic courts (al-qaḍāʾ or adjudication), and the second is through amicable means such as negotiation, conciliation and compromise (naṣīḥah or sincere advice), mediation (ṣulḥ), arbitration (taḥkīm), mediation along with arbitration (ṣulḥ and taḥkīm), an ombudsman (muḥtasib), expert determination (Mufti’s fatwā, pl. fatāwā), etc. These mechanisms are called alternative dispute resolution (ADR) that refers to a range of dispute resolution processes which are alternative to traditional litigation. Over time, the term ADR is now coming to mean ‘appropriate dispute resolution’ or the most appropriate resolution process in the given circumstances.
