Seine erklärte Absicht war, nachzuweisen, „daß von allen bisher bekannten Auslegungen dieser Stellen diejenige, auf welcher unsere Auffassung der summarischen Cognition beruht, immer noch die probabelste ist"). Seine Auffassung war: „Der summarische Process beruht auf dem Princip der Prima-facie-Cognition, ermäßigt durch die Zulassung unverzüglich evidenter Defensionen"). Seine Quellenexegesen förderten dann auch überall den nach seiner Ansicht auf logischer Notwendigkeit beruhenden Grundsatz zutage, daß der Kläger „wenigstens die Voraussetzungen der Entstehung seines Klagrechts") beweisen müsse. Trotz dieser entschieden dogmatischen Interpretation der Texte ist Briegleb in vielen Punkten zu Ergebnissen gelangt, die die Mißachtung, mit welcher die spätere historische Forschung sie bedachte, nicht verdient haben. Die westeuropäische Forschung interessiert sich, durch Traditionen und Sprachschranken vielfach behindert, nur zögernd für diese terra incognita ; die einheimischen Gelehrten stehen — in der Regel vereinzelt — vor einer entmutigenden Fülle von Problemen, deren aussichtsreiche Bearbeitung die wissenschaftliche Kooperation zumindest der Forscher der südosteuropäischen Länder, darüber hinaus aber auch die Mithilfe der internationalen Byzantinistik verlangen würde. Wenn der Bulgare A n d r é e v und der Rumäne Çront gemeinsam eine Edition historischer juristischer Texte präsentieren, so möchte man hoffen, daß dieses Ereignis nicht vereinzelt bleibt, sondern den längst erforderlichen Beginn einer Periode übernationaler Zusammenarbeit der südosteuropäischen Rechtshistoriker markiert. Um die Position der von A n d r é e v und Çront publizierten Texte verdeutlichen zu können, muß man bis zu Stephan Dusan ( 1331—1355) zurückgehen. Der berühmte Zar der Serben hat einen Kodex hinterlassen, welcher, wie es scheint, Bestandteil einer dreiteiligen Kodifikation war. Diese enthielt, außer dem Kodex selbst, eine in altserbisch verfaßte Epitome des Syntagma von Blastares und eine ebenfalls auf altserbisch redigierte Sammlung, welche vor allem auf die νόμοι γεωργικοί gestützt ist, aber um andere byzantinische Quellen und slawisches Gewohnheitsrecht erweitert wurde. In der französischsprachigen Forschung wird diese Sammlung nach ihrem slawischen Titel ,,Loi de Justinien" genannt. Die gesamte dreiteilige altserbische Kompilation ist leider immer noch nicht kritisch ediert, und die wenigen fundierten Studien, die sich mit ihr beschäftigen, sind nahezu unzugänglich). In der Folgezeit (vermutlich im 16./17. Jh.) hat die erwähnte Kompilation eine Umarbeitung erfahren, welche zur Eliminierung der Syntagma-Epitome durch Aufteilung ihres Inhalts auf den Kodex Dusan und die „Loi de Justinien" führte. Die jüngeren Handschriften der Kodifikation des Dusan enthalten demgemäß nur noch zwei Sammlungen, den erweiterten Kodex Dusan und die erweiterte „Loi de Justinien". Diese erweiterte „Loi de Justinien", welche etwa zu einem Drittel aus Texten der alten „Loi" und zu zwei Dritteln aus Texten der Syntagma-Epitome besteht — beide Massen sind redaktionell überarbeitet, stellenweise auch modifiziert und ergänzt —, ist Gegenstand der Edition von Andréev . In der Handschrift (Nr. 293 der Nationalbibliothek von Sofia), nach welcher ediert wurde, trägt die Sammlung den Namen Cyaaut (Sudaz, „Loi de Jugement"). Die ältesten Manuskripte des Sudaz stammen aus dem 17. Jh. Es wird also ein überarbeitetes und relativ spätes Teilstück der aus dem 14. Jh. stammenden Kompilation von Dusan vorgelegt. Der Sudaz wird den Kaisern Konstantin und Justinian zugeschrieben. A n d r é e v möchte hierin nicht nur eine Anlehnung an die Autorität der beiden großen christlichen Kaiser sehen, sondern deutet die Bezeichnung zugleich als Indiz dafür,
