In una delle sue storicamente più complete de- nominazioni a carattere definitorio il Sovrano Mil... more In una delle sue storicamente più complete de- nominazioni a carattere definitorio il Sovrano Militare Ordine di Malta si definisce come Sovrano Militare Ordine Hospedaliero di San io- vanni Gerosolimitano detto di Cipro di Rodi e di Malta. Nomen, quest’ultimo, che ne ricorda non solo alcune tra le caratteristiche fondanti e fondamentali, bensì anche alcune delle tappe- della Sua storia quasi millenaria caratterizzatesi temporalmente per l’esercizio da parte di quest’Ordine delle proprie prerogative Sovrane su quei territori. Ora l’Ordinamento ed il Diritto Melitense hanno origine con la nascita stessa del Sovrano Ordine in Terrasanta ad opera del suo fondatore Frà Gerardo Sasso di Scala il quale nel fondare il proprio nuovo Ordine prese a modello le regole della tradizione Benedettina e Agostiniana, da questo momento fondante (che storicamente si attesta nella prima metà del XI secolo d.C.) in poi, l’evoluzione giuridi- co-ordinamentale prende la propria direzione.

La loro configurazione giuridica non è nella sostanza modificata dai tempi del Beato Fra’ Gerardo Sasso. In breve senza miles non vi può essere l’Ordine perché i Cavalieri sono milies, i quali per loro natura sono militari in un senso ed in una dimensione che ha una radice comune e punti di assoluta vicinanza con le Forze Armate così come punti di chiara e sostanziale differenza.
