Prompted by the spirit of the new Truth and Reconciliation Commission, soon beginning its work in... more Prompted by the spirit of the new Truth and Reconciliation Commission, soon beginning its work in examining the legacy of the residential school system, this paper seeks to begin to reconcile the governance principles espoused by the Institute On Governance (following the UNDP) with Aboriginal governance traditions. After discussing fundamental elements of governance and good governance (I) it presents the Institute’s five governance principles (II), then probes their origins of the principles in international human rights law, Western political theory and Western historical experience (III). The paper explores some possible First Nations governance principles (IV), suggesting that the two, though distinct, are converging and in fact might complement and correct each other (V). The paper concludes with some thoughts on the requirements of genuine reconciliation.

This paper makes a case for taxation of First Nation communities by their governments. It does so... more This paper makes a case for taxation of First Nation communities by their governments. It does so from a governance standpoint, arguing that taxation is a governance issue and introducing tax regimes on reserve would enhance the legitimacy, direction, performance, accountability and fairness of First Nations governments. The paper draws on both fiscal theories of governance and public finance theory, but also on accounts of Aboriginal traditional practices, which suggest the prior existence of a web of accountability and sharing relationships akin to modern taxation. After presenting the current legislative and attitudinal terrain of First Nations taxation (I), the paper defines the terms it seeks to relate: namely, the tax relationship and five principles of good governance (II). It then addresses the link between taxation, service provision, and democratic governance in countries as varied as Tanzania, Zambia, and Argentina (III). Some scholars classify the arrangements as “mere” devolution; others debate whether they mark an emerging, more collaborative Crown/Indigenous relationship. There is also the pressing question of impact. Do tripartite service arrangements promote positive changes for affected First Nations and their members? This paper examines the character of these arrangements, as well as their impact on both services and relationships among the signatories. Analysing regional tripartite arrangements concluded over the past decade in First Nations policing, child welfare, and primary/secondary education, it then draws on evaluations, and scholarly and other “grey” literature to identify common challenges and successes.
