Lo scritto muove evidenziando il carattere transazionale di Internet che ha condotto a diverse riflessioni in merito alla sua governance. In questo scenario, gli autori si concentrano sul ruolo di ICANN, che è sicuramente di rilievo vista la sua capacità di influenzare l’architettura della rete. Partendo da tali premesse, il paper si concentra sulle principali narrazioni che negli anni si sono susseguite in materia di governance della Rete, con l’intento di darne una sintetica panoramica nel contesto storico in cui si sono inserite e di ricavarne uno strumento di lettura per le vicende attuali. Dato conto delle difficoltà definitorie, ci si soffermerà, quindi, sul concetto di Internet governance con particolare riferimento ai rapporti con gli Stati nazionali e i portatori di interesse privati, analizzandone brevemente il ruolo nel contesto presente e futuro di ICANN e del governo di Internet. Nelle conclusioni è infine lasciato spazio a delle riflessioni finalizzate a promuovere un approccio frazionato e partecipato all’Internet governance che sembra in grado di trovare più facilmente soluzioni condivise su singole scelte, e di ovviare ad alcune questioni che la concentrazione di interessi pubblici e privati, locali e universali, sembra oggi porre.
This paper addresses the transnational character of the Internet which has led to different considerations regarding its governance. The authors analyse the role of ICANN as a player able to influence the architecture of the network. In this framework, the paper focuses on the main theories that, over the years, scholars have proposed in relation to the Internet governance in order to provide a brief overview of the historical context in which they have been developed and understand the current events. Considering the difficulties in finding a definition of Internet governance, such concept is defined by referring to its relationships with States and private stakeholders, analysing, briefly, their role in the current and future context of ICANN and the Internet governance. Lastly, in the conclusions, the authors have promoted a discerned and participated approach to Internet governance, which would lead to find more easily shared solutions based on specific issues and to address the challenges which the concentration of public and private interests, local and global, poses today.

Lo scritto muove dal ruolo di primo piano svolto dai trasferimenti di dati nella società contempo... more Lo scritto muove dal ruolo di primo piano svolto dai trasferimenti di dati nella società contemporanea, e in particolare dall’impatto dei trasferimenti di dati verso stati terzi extra-UE sulla cornice normativa dell’Unione europea in materia di protezione dei dati personali. Si passano quindi in rassegna le disposizioni dettate dal nuovo Regolamento (UE) 679/2016 in riferimento ai trasferimenti di dati verso Paesi terzi e organizzazioni internazionali, dando conto della ratio sottesa a tali previsioni, delle modalità previste per il legittimo trasferimento dei dati, nonché dei principali profili di novità e discontinuità con le relative disposizioni della Direttiva 95/46/CE. In conclusione, si accennano infine possibili spunti evolutivi, in chiave internazionale, del regime di tutela dei dati personali, anche alla luce della natura intrinsecamente globale delle infrastrutture informatiche per mezzo delle quali enormi quantità di dati sono quotidianamente trasferite.

Su richiesta del Parlamento europeo, lo scorso 26 luglio la Grande sezione della Corte di giustiz... more Su richiesta del Parlamento europeo, lo scorso 26 luglio la Grande sezione della Corte di giustizia dell’Unione europea si è espressa, con proprio parere 1/15, circa la compatibilità del nuovo accordo previsto tra Canada e UE in materia di trasferimento di dati del codice di prenotazione (PNR) dei passeggeri aerei con il diritto dell’Unione europea. La Corte, chiamata a pronunciarsi sul trasferimento sistematico dei dati di PNR a un’autorità canadese, nonché sulla disciplina del loro trattamento, conservazione ed eventuale trasferimento ulteriore nel quadro della lotta contro il terrorismo e i reati gravi di natura transnazionale, ha concluso per l’incompatibilità dell’attuale formulazione dell’accordo con i diritti fondamentali garantiti dalla normativa dell’Unione. In particolare, le censure mosse dalla Corte riguardano la violazione dei principi di cui agli articoli 7, 8 e 52 della Carta di Nizza e investono i profili di chiarezza e determinatezza dei dati personali oggetto dell’accordo, i diritti individuali dei soggetti interessati dal trattamento di dati, i meccanismi di controllo del rispetto dell’accordo, i limiti al trattamento e ai trasferimenti ulteriori dei dati PNR.
