De modo que, si bien podemos estar de acuerdo con FMQC de que un enunciado es justo si y sólo si no es arbitrario y es simétrico, no obstante, la no arbitrariedad no es un concepto claro en filosofía. Palabras clave: Justicia, arbitrariedad, problemas formales de la ética. ABSTRACT In this paper we give an account of FMQC's proposal regarding on what is a fair norm (Miró-Quesada Cantuarias, 2003). Then we list a number of unanswered problems by FMQC's proposal. Despite we would agree partially with FQMC's claim, the concept of non-arbitrariness is not philosophically clear.

Asimismo, exploramos parcialmente la idea de una solución sintáctica tomando como punto de partida que los imperativos carecen de valor de verdad. ABSTRACT In this paper we attack the Horn 2 of the Jørgensen's dilemma (prohibitive thesis), so we enforce horn1 (permissive thesis). Also, we explore partially the idea of a syntactical solution for a logic of imperatives based on the fact of the lack of truth value of imperatives.

La probabilidad negativa y la interpretación de la probabilidad La literatura acerca de la interp... more La probabilidad negativa y la interpretación de la probabilidad La literatura acerca de la interpretación de la probabilidad toma como base la noción estándar de la probabilidad que parte de la concepción elaborada en Lógica de Port-Royal (1662) y que logra su culminación en la axiomatización de Andréi Kolmogórov (1933). La discusión se ha centrado en ésta última hasta la actualidad, dejándose de lado otras nociones de probabilidad. Esta situación ha dado lugar a que se considere que la cuestión de la interpretación de la probabilidad es independiente de su axiomatización (Galavotti, 2005, p. 12). En se sentido, se sostiene que las divergencia entre las interpretaciones subjetiva y objetiva se entiende únicamente como una divergencia de concepción filosófica sin que tal hecho tenga alguna implicancia en la teoría estándar. En contra de esto, en este trabajo sostenemos que el conjunto de interpretaciones es dependiente de la axiomatización que se tenga en cuenta. Para ello primero mostraremos que es incorrecto sostener que haya una definitiva teoría (sea esta de la probabilidad) a la luz de la pluralidad de sistemas formales. En especial debe considerarse que el surgimiento de las geometrías no euclidianas pone sobre la mesa la cuestión de que cierta noción matemática (como el espacio) si bien puede ser previa a la teoría empero no es independiente. En segundo lugar, se conoce que dada una axiomatización ésta no sólo hace referencia a un solo objeto matemático en especial (por ejemplo, el número natural) sino que puede considerarse que hay otros objetos que no son números y que satisfacen las propiedades en cuestión tal como lo demostró Thoralf Skolem (1934) para la axiomatización de la Aritmética de Peano. Por tanto, no hay garantía de unicidad de la referencia de un sistema axiomático dado, lo cual a su turno implica que la cuestión de la interpretación no se circunscribe al sistema. A esta situación le llamamos la sobredeterminación ontológica de la teoría, y, como tal, es una cuestión ontológica. Esta cuestión es diferente de la pretendida neutralidad del sistema axiomático con relación a su interpretación (neutralidad hermenéutica). Para nosotros, y éste es nuestro tercer punto, el sistema axiomático no es neutral frente a la cuestión de la interpretación. En cuarto lugar, mostraremos que el cambio de la axiomatización en la teoría de la probabilidad puede importar la limitación de ciertas interpretaciones que surgen en principio con la axiomatización estándar. Tal es el caso de la reciente axiomatización de la probabilidad negativa (Kronz, 2007; de Barros, Oas, & Suppes, 2015). En ella se rechaza el axioma de la innegatividad de la probabilidad, esto es que la función de probabilidad puede tomar valores por debajo de cero. Por tanto, en esta teoría no estándar no es posible formular ciertas interpretaciones dentro de la clase de las objetivas, i.e., frecuentista, propensiva y lógica. En lugar de sugerir que se trata de un mero cambio de tema, nosotros sostenemos que no existe una razón suficiente para preferir la axiomatización estándar pues la probabilidad negativa tiene una serie de aplicaciones en la ciencia (i.e., ciencias cognitivas).

According to Donald Davidson (1967, 1969, 1973) Tarski's T scheme is applicable not only to forma... more According to Donald Davidson (1967, 1969, 1973) Tarski's T scheme is applicable not only to formalized languages but also to natural language (i.e. to descriptive and evaluative terms). On this basis, some legal scholars (e.g. Taruffo, 2005 [1992], Ferrer Beltrán, 2005) claim that T scheme is also applicable to legal language. In this paper we attack this claim, by counterclaiming that there are mistakes in the receception on the concept of semantic truth and we show that some features of legal language, i.e., context-dependency of meaning, lack of formality, imperative expressions, presuntive expressions, vagueness, non bivalence, and universality, do not allow the application of T scheme. As a consecuence, we claim that one cannot say if a legal sentence is true or false from a semantic point of view.

En este trabajo presentamos brevemente la lógica inductiva bayesiana objetiva, OBIL, propuesta por Jon Williamson (2017), y lo aplicamos a la argumentación jurídica, en especial, a la subsunción, a la presunción, a la analogía y a la ponderación. De modo que retomando la propuesta de Miró-Quesada Cantuarias (2000), se logra una mayor reducción metodológica que la planteada por él.

In the paper we briefly expose the objective Bayesian inductive logic, OBIL, proposed by Jon Williamson (2017), then we apply it to legal argumentations, especially to subsumption, presumption, analogy and balancing. Thus, picking up the Miró-Quesada Cantuarias’ proposal we achieve a mayor methodological reduction than him’s.

Aun así no agotan ni reducen la discusión filosófica a una mera cuestión formal, sino que siendo una cuestión previa, la potencian y enriquecen. Asimismo, los métodos formales fundamentan el principio de tolerancia en la filosofía, el cual formulamos en este trabajo. ABSTRACT In this work we claim that application of formal devices (logic and mathematics) into philosophy plays a roll according to epistemic values like clarity and distinctness. However, they do not reduce philosophy to a mere formal question, on the contrary they empower philosophy and enrich it. Also, formal devices support the principle of tolerance in philosophy, which we state in this paper.
