En este proceso hemos puesto variados nombres al Estado: Estado Absoluto o Policial, Estado Liberal–Constitucional, Estado Social o Benefactor, Estado Cooperador, Estado Regulador, Estado Garante, Estado de Prevención. Actualmente, el Estado se encuentra exigido por nuevas circunstancias sociales y jurídicas, por lo que cabe preguntarse si él deberá mudar nuevamente de tipo y carácter. Ello, sin embargo, no excluye la posibilidad de que, en casos muy excepcionales, ciertos organos administrativos ejerzan jurisdiccion, pero entonces lafuncion es ejercida conforme a reglas jurisdiccionales que no son administrativas.

Luego, analiza las dificultades experimentadas en la implementación de esa política al interior de los estados miembros, utilizando para ello informes de organismos internacionales, así como hechos que derivan de casos resueltos por el Tribunal de Justicia de la Unión Europea y la Corte Europea de Derechos Humanos. Como conclusión, entre otras, se aprecia un comportamiento abiertamente divergente entre los distintos países miembros de la Unión Europea, causado principal pero no exclusivamente por las capacidades y recursos con que cuentan cada uno de ellos.The paper explains the refugee policy of the European Union, describing its elements and most important policy instruments. El artículo analiza la evolución de la institucionalidad pública chilena, que tiene a su cargo la... more El artículo analiza la evolución de la institucionalidad pública chilena, que tiene a su cargo la administración del sistema de concesiones de obras públicas y la fiscalización de los concesionarios. Se verifica un deficiente desarrollo de los organismos administrativos involucrados, así como en la manera en que se establecen y reparten las funciones y atribuciones públicas. Se concluye que la Dirección General de Concesiones de Obras Públicas es un organismo con un diseño inconcluso: parece encontrarse en tránsito hacia una institución fiscalizadora o agencia reguladora.
El presente artículo aborda como punto de partida a la Constitución chilena de 1980, vigente dura... more El presente artículo aborda como punto de partida a la Constitución chilena de 1980, vigente durante el régimen autoritario de Augusto Pinochet y que tras la reforma de 1989 permitió el restablecimiento de la democracia, no sin antes garantizar inmunidad a quienes dejaban el poder. El sistema electoral dejó de garantizar en ese momento la forma en que se ejerce y financia la política en Chile, pues se interesaron en no perder representación política, esto, mediante reformas electorales que paulatinamente aumentan en número.
