Under the Australian National Registration and Accreditation Scheme an objective of the National... more Under the Australian National Registration and Accreditation Scheme an objective of the National Law is “to provide for the protection of the public, by ensuring that only health practitioners who are suitably trained and qualified to practice in a competent and ethical manner are registered.” What is curious however is that patients and their families generally figure very little in the regulatory scheme. For the most part, after lodging the notification, their involvement in what follows, as the investigation and final resolution of a notification proceeds, is negligible. Except for those matters which are retained by the health complaints entities, or when matters are referred to a panel or tribunal hearing, patients or their families are seldom involved directly in the resolution of a notification. This is because, similar to the criminal justice system, the regulator stands in the shoes of the patient.
As a result many an opportunity for healing for both patient and practitioner is lost in the absence of a process that allows them to meet safely to speak about what occurred and how the harm that was suffered could or should be remedied. It is proposed that using aspects of processes such as mediation, and restorative engagement that come from the criminal justice system and the Defence Abuse Response Taskforce, another model for managing notifications could be created that would be suitable for health practitioner regulation. Such a model would be particularly congruent with “right touch regulation”.
Structured meetings between patients or their families and the practitioner could be utilised to improve understanding between the protagonists and lead to positive outcomes that would; be perceived as less punitive, increase public protection, improve systems and enable emotional healing, while at the same time decreasing costs and the time taken to finalise a notification.
