This is a draft for a true and proper "people's" Constitution for an independent Australia. It is... more This is a draft for a true and proper "people's" Constitution for an independent Australia. It is based on hundreds of individual submissions from people all over Australia, some of whom had legal and political backgrounds. These submissions were solicited back in 1998/99 when Australia had a referendum to convert to a Republican system. The referendum failed because the Government at the time set the agenda and controlled the two options available - "Either accept what we offer or stick with the 19th century British Act we currently use."
This draft has also been supported by extensive research over many years and references to the author's 2015 book "The Australian Constitution as it is Actually Written".
To emphasise, this draft has been compiled independently of any direct legal or political control but is based on wide research of Australia's political and legal history over the past century.
This draft Constitution very clearly points out that it is entirely the creation of the people of Australia. After it is publicly discussed, amended and if eventually approved by the people at a nationwide referendum, it will become the people's property and never the property of the politicians or lawyers to do with as they wish.
This paper is the result of a project started in 1998 to create a genuine and up to date Constitu... more This paper is the result of a project started in 1998 to create a genuine and up to date Constitution for an independent Australia. Due to the pathetic level of ignorance surrounding what Australia currently uses as their Constitution, a 19th century British Act, and the general apathy relating to any discussion about constitutional issues, the paper has taken the novel approach of including random dialogue between two people in discussing issues as they are raised.
The paper comes in two parts. The first part is the explanation and rationale behind each Chapter of the draft Constitution.
The second part is the draft Constitution itself.
This draft is created as a philosophical document as much as it is a legal document. One of the intentions is to write a Constitution which any reasonably educated person can read and understand without needing a law degree.
The timing of this paper is aimed at filling a serious gap in the ongoing talk about Australia becoming a Republic when the current Queen of the UK either abdicates or dies. So far, there has only been an inordinate amount of talk about converting to a Republic but no one has taken the next step to spell out the details for such a change - until now, that is.
This paper offers a guideline to what hundreds of interested people would like to see if and when Australia ever chooses to become a truly, legally, independent nation.

It also defines the fundamental properties that any "money system" must have if it is to be universally accepted within a given society or nation. The paper also deals with the explanation of why the Parliament of a nation should be the only legitimate authority with the constitutional power to create, administer and distribute what the people will recognise as the nation's legal tender.

Its concept is unique in that it is written exclusively from the perspective of the people. Whilst the Constitution represents the Primary law of the nation, it is much more than a legal document - it is an expression of the will of the people in how that want their society to function. It is for the people to define what organisations they are prepared to create in the interest of maintaining a peaceful and harmonious society. Those organisations are there for the benefit of the people, the people are not there for the benefit of the organisations.

In this day and age, "money" is an essential tool for survival of a vast majority of the people, and as such, the creation and legitimising the token to be used as the nation's medium of exchange, is really an essential public purpose of any responsible Government.
