Em maio de 2005 o Grupo Europeu de Responsabilidade Civil apresentou os “Principios de Direito Eu... more Em maio de 2005 o Grupo Europeu de Responsabilidade Civil apresentou os “Principios de Direito Europeu da Responsabilidade Civil” (PETL), os quais, desde entao, foram expandidos e atualizados. Seu proposito pratico e o de produzir algo que possa ser util como base para o aperfeicoamento e a harmonizacao da responsabilidade civil na Europa, identificando os principios comuns aos diferentes sistemas de responsabilidade civil la existentes e, se ja nao existem tais principios, ou se os principios comuns existentes nao forem considerados satisfatorios, propondo melhores e possiveis solucoes. Este artigo demonstra, ainda que brevemente, o impacto dos PETL na legislacao nacional, na jurisprudencia e no ensino juridico de varios paises europeus, bem como elucida alguns de seus aspectos especificos. Mantendo uma abordagem critica, o trabalho apresenta o “sistema exivel” adotado pelos PETL, utilizado pelo Grupo como uma forma de introduzir a necessaria exibilidade sem cair em uma vacuidade ...
O presente artigo trata do instituto da recuperação judicial de empresa instituído pela Lei n. 11... more O presente artigo trata do instituto da recuperação judicial de empresa instituído pela Lei n. 11.101/2005, buscando apontar as razões pelas quais a concepção falimentar do decreto-lei 7.661/45 não servia mais para o adequado tratamento da empresa em crise. Aponta-se a preservação da empresa como o preceito normativo norteador da axiologia recuperatória. Procura-se demonstrar, entretanto, que a intenção preservacionista da lei não deixa de lado o interesse dos credores, na medida em que atingir o pagamento dos credores ainda permanece sendo o objetivo da recuperação de empresa. A preservação da empresa, como fundamento da recuperação judicial é apontada a partir da necessidade de se alinhar os interesses dos credores aos interesses externos decorrentes da função social da empresa.
This article essentially intends to contribute with the current doctrinal discussion regarding th... more This article essentially intends to contribute with the current doctrinal discussion regarding the institute of punitive damages, as it is known in its Anglo-Saxon origins. For this purpose, the study is divided in two parts: in a brief first moment, one dedicates himself to clarify the components of the institute itself - detailing its definition and characteristics, functions, and disambiguating it from the punitive function ascribed to noneconomic damages under Brazilian law. The second half concentrates on the analysis of the institute in relation to Brazilian legal system - specifically with a detailed diagnosis of how it has been used by the Santa Catarina Court of Appeals.

First, there is great uncertainty about the nomenclature used to designate the institute, especially when confronted with the term “ilicitude” in latin languages, generating a comparison between objective wrongfulness and subjective wrongfulness. The contrast between formal wrongfulness and material wrongfulness will help the reader to assess the content of the institute. The present work also aims to identify the operative locus of wrongfulness (which is in the fact that caused the damage), as well as the method of effectively verifying the existence of wrongfulness in a certain conduct, exploring the content of the theory of the violation of a duty of care and the theory of wrongfulness based on the result. Finally, the role of wrongfulness as a requirement of Tort Law is pointed out.
This article aims to analyze the civil liability of the suppliers for damages resulting from the ... more This article aims to analyze the civil liability of the suppliers for damages resulting from the use of medicines or drugs in Brazil, pointing out some emblematic decisions of the Brazilian Superior Court of Justice (STJ). The conclusion is that the Court, in cases involving pharmaceuticals refers to the different categories of defective products (conception, manufacture or information) as the main element to identify the duty to indemnify consumers.
The problem that involves interventions in the subjective rights, especially the profit of interv... more The problem that involves interventions in the subjective rights, especially the profit of intervention, has been receiving special attention of the brazilian doctrine. Thus, in order to contribute to possible solutions tothe Brazilian legal system, this article aims to portray another legal system, the portuguese legal system, which for almost four decades has been debating the problem, providing a deeper understanding to the issue. Therefore, the deductive method is the research methodology used throughout the article. It is possible toconclude that Portuguese legal scholars have largely stand for the categorization of the profit of intervention within the scope of theunjustified enrichment, but they diverge on the possibility of its restitution, and specific lawson immaterial rights have inserted the profit of intervention as a way for calculating damages.

The principle of Compétence - Compétence establishes the prerogative of the arbitrators to conduct the initial analysis of its jurisdiction and is observed in art. 8º of the Brazilian arbitration law. Nevertheless, there are some occasions when the principle of Compétence -Competence is relativized, sometimes by the arbitration law, sometimes by legal precedentes, wich enforces, in some areas, the state jurisdiction. Regarding corporate law, instead, the Courts have strength to give maximum effect to the principle of Compétence - Compétence.
