Turkiye’de imar uygulamalarindan kaynaklanan sorunlarin cozumunde bir yol haritasi olusturabilmek amaciyla Ingiltere ve Turkiye ornekleri incelenmistir. Imar planlarinin uygulama araclari ile karsilasilan sorunlar, Imar Kanunu, 1982 Anayasa’si, Şehir ve Ulke Planlamasi Kanunlari gibi farkli yasal duzenlemeler kapsaminda, degerlendirilmistir. Planlamanin Ingiltere’de cok ayrintili ve uzun bir surecte yapilmasi nedeniyle sorunlarin daha az goruldugu, Turkiye’de ise planlarin daha kisa vadeli oldugu saptanmistir. In the effort to examine local governments within a country, the first place to look at would be ... more In the effort to examine local governments within a country, the first place to look at would be the constitution of that state. Constitutions usually provide us with important information about local governments; on their types, competencies, revenues and various other characteristics. This study aims to compare the clauses devoted to local governments in the constitutions of 23 European Union (EU) member states and Turkey. While there are certain studies concerned with how local governments are worded within constitutions, these are generally singular cases focusing on one country alone. This chapter aims to provide comparative and informative information on local governments in the constitutions of the related states by categorizing the most commonly stipulated clauses.

Turkey is a democratic, secular and social state governed by the rule of law. The Turkish State is an indivisible whole with a territory and nation. The provisions of the first three articles are specially protected by Article 4, which forbids parliamentary amendment of the first three articles. Free and competitive elections based on universal participation (Article 67), the existence of more than one freely organized political party, and respect for fundamental human rights and freedoms all reflect the basic features of this modern liberal democracy. The constitution of 1982 vests legislative authority in the 550 elected deputies of Turkey’s Grand National Assembly. The legislative authority of parliament cannot be delegated to any other branch of government. All members enjoy parliamentary privileges such as freedom of speech and freedom...
