The objective of this article, focusing on indigenous justice, legal pluralism and selfdeterminat... more The objective of this article, focusing on indigenous justice, legal pluralism and selfdetermination based on field research and analysis that investigates the interface between the state criminal justice system and indigenous justice systems, is to propose that national and international legislation referring to differentiated indigenous rights are a first step on a path to make them effective. The hypothesis is that experiences that open areas of legal and criminal autonomy for indigenous peoples under the framework of legal pluralism are only implemented when indigenous leaders and lawyers exercise their protagonism to bring them into effect. Using the ethnographic method, interviews were carried out with indigenous people in the prisons of Boa Vista, Roraima, and with agents of the prison system, indigenous lawyers, public defenders, police officers and a judge, from 2008 until the beginning of the pandemic in 2020, in addition to examining prison records. The article focusses on indigenous protagonism in Roraima, which aims to create internal mechanisms to deal with conflicts, such as councils of indigenous leaders at the local level, and the commitment of the Indigenous Council of Roraima (CIR) to create Internal Indigenous Regiments, so that communities can resolve internal conflicts and avoid sending indigenous people to overcrowded and violent prisons. Other initiatives include the creation, in 2015, of a jury with in the Raposa Serra do Sol Indigenous Land, and the reactivation, in 2019, by the Court of Justice of Roraima of the first Indigenous Conciliation Pole in Brazil, installed in 2015, which aims to help resolve internal conflicts without relying on the national justice system. According to current legislation, the incarceration of indigenous people should not happen. The conclusions highlight the fundamental role of indigenous protagonism in decolonizing the judicial system and fully bringing into effect indigenous rights.

Abordo o papel do pesquisador, refletindo sobre como essas pesquisas podem contribuir para a redefinição da política indigenista governamental através de leituras indigenistas dos seus resultados por parte dos funcionários administrativos. Na segunda parte do trabalho, chamo atenção à necessidade de tomar em consideração o fato de que tanto as interpretações daqueles índios que têm voz, quanto as dos antropólogos, refletem a sua posição dentro de um contexto maior de diferenciais de poder.

The article aims to demonstrate the susceptibility to death that certain Amazonian peoples are fa... more The article aims to demonstrate the susceptibility to death that certain Amazonian peoples are facing, as a consequence of their particular migratory demography, which instead of being curbed, have been exponentially intensified by the outbreak of Sars-CoV-19. The article offers an account of the “pendular migrations” and “return migrations” that the indigenous and black rural populations of that region carry out as a result of daily labor displacements, in the search for medical-hospital assistance and the consolidation of political and legal visibility within the cities. In a second effort, directly related to the previous one, we articulate the interference of the viral threat not on the contingency of population flow, but on the dangerous intensification of people circulation between the territorial nuclei of the “first habitation” and the average Amazonian cities, where, as a rule, these peoples maintain “second residences” and to where they regularly transmigrate. This article examines affirmations of differentiated Indigenous rights that are present in nation... more This article examines affirmations of differentiated Indigenous rights that are present in national and international legislation in the State of Roraima, Brazil, through significant efforts by Indigenous political movements, including activities by Indigenous lawyers. By creating internal mechanisms for solving conflicts, such activists contribute significantly to realising rights present in the Federal Constitution (1988) and the Indian Statute (Law 6.001/1973), and in international legislation such as the International Labour Organisation (ILO) Convention 169 (1989). These mechanisms include the setting up, by the Indigenous Council of Roraima (CIR) and local Indigenous leader councils, of written customary laws (regimentos internos) as an alternative for solving conflicts to avoid sending people to violent and overcrowded prisons.
