Diplomova prace je založena na analýze pojmenovavacich, syntaktických a textotvorných prostředků ... more Diplomova prace je založena na analýze pojmenovavacich, syntaktických a textotvorných prostředků platneho zakona c. 513/1991 Sb., tj. Obchodniho zakoniku. Pro praci s textem byl vytvořen automaticky oznackovaný korpus Zakonik v korpusovem rozhrani BONITO 2, což umožnilo aplikovat kvantitativni přistup k lexikalnimu a syntaktickemu rozboru celeho zakoniku. Pro detailnějsi analýzu syntaktických a textotvorných prostředků byl ze zakoniku vybran jeden usek textu (Cast III, Hlava III). Analýza Obchodniho zakoniku ukazala, že i když tento text patři k pravnimu jazyku, je zaroveň blizký i administrativnimu a odbornemu jazyku. Nasledujici jazykove rysy jsou spolecne pro jazyk Obchodniho zakoniku, pravni jazyk, administrativni jazyk a odborný jazyk: vysoký index opakovani slov, uživani terminů, slovnich spojeni a sablon, abstraktni vyjadřovani, syntakticka explicitnost, nominalizace, pasivni konstrukce, sekundarni předložky, spojovaci výrazy, propracovane horizontalni a vertikalni cleněni textu, tematicke linie, graficke symboly pro větsi přehlednost. Přitom nadměrne užiti genitivu adnominalniho je charakteristicke pouze pro administrativni jazyk a pravni jazyk, tedy i Obchodni zakonik. Pravni texty a analyzovaný zakon sbližuji nasledujici jazykove rysy: věty s výctovou strukturou, modalni slovesa a výrazy, užiti slovesa být v definicich, užiti instrumentalu v definicich, oznamovaci způsob dokonavých sloves a budouci cas trpneho rodu dokonavých sloves ve funkci imperativu, paralelni větne struktury, absence koheznich prostředků mezi větami, viceurovňove horizontalni cleněni textu. Nicmeně Obchodni zakonik ma svoje specifika hlavně zvýsený pocet maskulin životných a nadprůměrný pocet cizich slov. Zvýsený pocet maskulin životných podmiňuje i zvýsený výskyt dativu a zvýsený výskyt zajmen. Nadprůměrný pocet cizich slov ma za nasledek podprůměrný pocet adjektiv.
The article focusses on communication and discursive practices in private family proceedings with... more The article focusses on communication and discursive practices in private family proceedings with the aim of exploring procedural barriers obstructing court users from sharing their stories and having their voice heard. Drawing on survey and interview data in combination with the linguistically driven empirical method-ethnography of communication, the discussion illustrates the discrepancy between communicative aims of court users and communicative aims of individual procedural stages. The article expands on how information and narratives are currently elicited from court users and proposes how procedural changes could accommodate more effective elicitation strategies and enhance procedural justice tenets.

The difference is that a text is not dictated to students, but read out at normal speed. Students can only write the most important keywords. They have to re-create the text on their own. The presentation discusses the advantages of the method as well as potential problems students may face. It also proposes different ways in which grammar dictations can be used in class for developing students’ writing skill and language awareness. discursive practices in court pro... more : Focusing on adversarial legal settings, this Element explores discursive practices in court proceedings which often involve unrepresented parties – private family proceedings and small claims cases. Such proceedings present the main caseload of county and family courts but pose immense challenges when it comes to legal–lay communication. Drawing on court observations, alongside textual and interview data, the Element pursues three aims: (1) developing the methodological and theoretical framework for exploring discursive practices in legal settings; (2) establishing the link between legal–lay discourse and procedural justice; (3) presenting and contextualising linguistic phenomena as an inherent part of court research and practice. The Element illustrates how linguistic input can contribute to procedural changes and court reforms across different adversarial and non-adversarial legal settings. The exploration of discursive practices embedded in court processes and procedures consolidates and advances the existing court research conducted within the fields of socio-legal studies and forensic and legal linguistics.
