Wojna, prawo międzynarodowe i porządek światowy ‒ w polskiej recepcji intelektualnego dorobku Car... more Wojna, prawo międzynarodowe i porządek światowy ‒ w polskiej recepcji intelektualnego dorobku Carla Schmitta (1888‒1985) zbyt mało uwagi poświęcono dotychczas refleksji nad tymi zagadnieniami. Niezależnie bowiem od głębszej metafizycznej, teologicznej czy wręcz mitologicznej struktury myśli, kategorie Schmittowskie dają się pojąć jako pewien racjonalny sposób rozumowania o porządku światowym. Pojęcia te radzą sobie nawet wtedy, gdy pominiemy tło teologiczno-polityczne, a nawet więcej ‒ radzą sobie lepiej, jeśli nie zadamy sobie trudu rozwikłania prywatnej wiary Schmitta.
W książce Autor stara się zrozumieć niechęć Schmitta do: świata ujednoliconego, globalnej homogenizacji, doktryny wojny sprawiedliwej uzasadniającej wszelakie interwencje militarne i przemianę wojny w światową wojnę domową. Pokazuje, że Schmitt przejawia realistyczne podejście do świata ludzkiego oparte na pesymistycznej antropologii. Prawnik Schmitt walczy z teologiem w sobie i w pewnym sensie zwycięża: „świecka tradycja” ius publicum Europaeum okazuje się błogosławieństwem, umiarkowana deteologizacja przynosi historyczne korzyści.
Niezwykle interesujące i zbyt słabo zauważane przez badaczy jest to, jak bardzo Schmitt podkreśla napięcie między prawem a teologią i filozofią. Myśl Schmitta dostarcza niewątpliwie narzędzi, dzięki którym możliwa jest lepsza orientacja w problemach i wyzwaniach współczesnego świata.
Polski czytelnik otrzymuje w końcu koherentny, przejrzysty, drobiazgowy i erudycyjny tekst traktujący o myśli prawno-międzynarodowej Carla Schmitta.

Wokół myśli Karla Löwitha
W pracy stawiamy tezę, iż myśl Karla Löwitha umożliwia zrekonstruowanie związku łączącego nowoczesność, nihilizm oraz politykę. Nowoczesność przedstawiona jest jako epoka, którą charakteryzują narodziny świadomości historycznej rozstrzygającej o jej odmienności względem starożytności i średniowiecza. Analiza korzeni nowoczesnej świadomości historycznej i wiążącej się z nią historycznej dynamiki stanowi warunek wstępny uchwycenia kierunku rozwoju dziejów Europy. W tym celu Löwith wprowadza tezę o sekularyzacji, która umożliwia zrozumienie zarówno chrześcijańskich korzeni nowoczesności i niechrześcijańskich rezultatów jej rozwoju historycznego. Ambiwalencja chrześcijańskiego dziedzictwa Europy stanowi zatem klucz do zrozumienia związku nowoczesności i nihilizmu. Z jednej strony chrześcijaństwo – za sprawą ustanowienia specjalnej relacji Boga i człowieka – dokonuje wyniesienia człowieka ponad naturę i dowartościowuje historię; z drugiej – pozostaje ono eschatologicznym obwarowaniem wszelkiego procesu dziejowego, który nie może jawić się jako samoistna przestrzeń. Nihilistyczne konsekwencje nowoczesności Löwith kojarzy zatem z egzystencjalizmem, który nie jest w stanie uchwycić człowieka w miarodajnej relacji ani do Boga, ani do kosmosu, odnosząc go jedynie do tego, co przynosi ze sobą zdynamizowana nowoczesnością historia.

Modernity and What Has Been Lost comes out of a conference held at the Jagiellonian University in Kraków, Poland, on June 4–5, 2009 that sought to identify Leo Strauss’s intellectual background in re: the repudiation of a modern idea of homogenous, universal state (considered as an illegitimate synthesis of Jerusalem and Athens, i.e., the claims of Reason and Revelation). The world we live in, molded by science and historical relativism, may be described as hostile to human dignity or perfection, or abhorrent to those who love the search for wisdom. Straussian teaching consisted in the steady effort to reopen “the quarrel between the Ancients and the Moderns,” and refers to the esoteric way of writing practiced by the most profound thinkers of the past which has been apparently forgotten in the last three centuries. Strauss binds the concept of natural right with the question of maintenance of conditions for philosophizing, and it probably seems to him that such defense of philosophy is the highest task in our times.
However, one must be well aware that philosophizing always means a perilous way of life. Indeed, it may be destructive of the city (polis) itself as far as the city exists due to some crucial beliefs the philosopher might put in doubt. Reflecting on those issues, Strauss engaged in several highly important debates with his contemporaries, in an open way with, e.g., Carl Schmitt, Karl Löwith and Alexandre Kojève, and more tacitly with Martin Heidegger.

The aim of the present volume is to discuss the notion of constitution from the perspectives of history of political thought. Its scholarly intention is to go beyond the approach concentrating on the formal understanding of constitution and bring forward more complex historical and philosophic-political interpretations. Our point of departure was the need to revive the somehow neglected distinction between the idea of constitution as an act of conscious law-giving activity and the notion of constitution conceived as the set of fundamental political rules derived from the very nature of political regime and its historical development.

According to Carl Schmitt, an attempt to understand fundamental transformations within the ius ge... more According to Carl Schmitt, an attempt to understand fundamental transformations within the ius gentium involves an analysis of the evolution of the dominant concept of war, since the history of international law is, according to him, essentially the history of the concept of war. The aim of this article is to reconstruct Schmitt's understanding of the transformation of the dominant conception of war in the twentieth century: from a non-discriminatory concept embedded in Eurocentric international law and emerging from European modernity to a conception of war based on the resurgent doctrine of just war.

The paper aims to discuss the rarely acknowledged conceptual affinities between legal-political t... more The paper aims to discuss the rarely acknowledged conceptual affinities between legal-political thinking of Carl Schmitt and Karl Loewenstein. It may sound surprising given their different political leanings, as well as the concept of democracy inherent in the legal and political thought of the two thinkers, especially in their constitutional theories. For Schmitt democracy signifies identity between the rulers and the ruled, while for Loewenstein it is the very will of the people that has to be checked and tamed through the institution of representation. But when it comes to the defence of the existing political regime against the assault of its enemies and the understanding of the reasons of Weimar Republic's failure, they strongly agree. Schmitt identified and elaborated on the possibility of the Weimar Republic's enemies entering through the gate of legality and shutting its doors behind them. Loewenstein clearly sides with Schmitt that defending the constitution means defending its core or substance. The concept of militant democracy bears striking similarities with the conceptual world of Carl Schmitt: critique of the legalistic blindness, rejection of neutrality in public life, friend-enemy distinctions, legitimacy versus legality and the state of emergency.

The paper aims to present several fundamental issues in the debate between two prominent represen... more The paper aims to present several fundamental issues in the debate between two prominent representatives of the 20th-century theory of the state and law: Hans Kelsen (1881-1973) and Carl Schmitt (1888-1985), particularly including the dispute over the understanding of the constitution, protection of the constitutional order, and democracy. The article presents the theological and political background of the debate and the historical background defining the political context important for its understanding. The course of the dispute over the guardian of the constitution, which flared up in the interwar period in Weimar Germany, is also discussed in detail, with particular emphasis on the period between 1928 and 1932.

W artykule przedstawiono filozoficznopolityczne aspekty debaty, jak również tło historyczne określające kontekst polityczny istotny dla jej zrozumienia. Omówiono także przebieg sporu o strażnika konstytucji, który rozgorzał w okresie międzywojennym w Niemczech weimarskich, ze szczególnym uwzględnieniem okresu 1928–1932.

The paper discusses one of the most important debates on the meaning of constitutional adjudicati... more The paper discusses one of the most important debates on the meaning of constitutional adjudication in the 20 th century that engaged two eminent legal and political thinkers Hans Kelsen and Carl Schmitt. The paper focuses on the constitutional dispute over the guardianship of the constitution in the final years of Weimar's Germany and reconstructs the arguments of the two major protagonists in this dispute concerning the Weimar constitution and the fundamental question whether the guardian of the constitution is (or should be) the constitutional court or the president of the Reich. The debate highlights the complexity of the political problems of a democratic state, as well as the intricate relationship between law and state and has retained high level of topicality. The paper also pays attention to the philosophical-political premises that underlined the distinctly different views on the relationship between law and politics in the thought of Hans Kelsen and Carl Schmitt.

Totemism of the Modern State: On Hans Kelsen’s Attempt to Unmask Legal and Political Fictions and... more Totemism of the Modern State: On Hans Kelsen’s Attempt to Unmask Legal and Political Fictions and Contain Political Theology
This paper argues that the writings of Hans Kelsen deserve more attention from those engaged in the debate on secularization and political theology. His lifelong struggle with various forms of legal‐political metaphysics is an identifiable thread in many of his writings. Kelsen’s concern with the theological‐political issues found in the theory of the state (Staatslehre ) is far from being marginal. Kelsen claims that his theory aims at resolving the traditional dualism of law and state prevailing in the Staatslehre and contributes to an “uncompromising destruction of one of the most effective ideologies of legitimacy.” Kelsen maintains that the contents of this “ideology of legitimacy” derive from both political metaphysics and the deep‐seated ancient ways of thinking on nature and society. In order to illustrate this thesis, I propose calling this phenomenon “totemism of the modern state.”

Hans Kelsen on the Relation of the Theory of the State and Theology The paper pays attention to t... more Hans Kelsen on the Relation of the Theory of the State and Theology The paper pays attention to the theological-political themes in the thought of an Austrian lawyer and philosopher Hans Kelsen (1881-1973). It especially aims to explore one of the lesser known aspects of his legal theory that is the parallel-ism between theology and the Staatslehre. I attempt to reconstruct the numerous structural analogies between theology and the legal and political theory discussed in various Kelsen's works. By focusing on these analogies, I am trying to understand their place and meaning within Kelsen's Pure Theory of Law. I claim that they constitute a preliminary tough indispensable part of Kelsen's effort to construct a theory that completely identifies the state and the legal order and to do away with the influence of theology and metaphysics.

SUMMARY The aim of this paper is to make a case for the claim that Karl Löwith's thought is predominately preoccupied with one major philosophic– historical problem that may be broadly labelled existentialism. This notion is usually employed by Löwith in order to grasp the various phenomena and developments within the European (or Western) history in the modern age. I claim that the meaning assigned by Löwith to the notion of existentialism is inseparable from its political consequences. In other words, I attempt to reconstruct the notion of existentialism in Löwith's thought primarily as a political problem. By advancing this argument, I am inclined towards the view that Löwith's oeuvre deserves more careful reception from political theorists than it has yet received.

The article provides an introduction to the basic tenets of Carl Schmitt’s international thought. It discusses such notions as the nomos of the Earth, the development of Jus Publicum Europaeum and the non-discriminating concept of war. Schmitt’s thought attached particular importance to the transformations the concept of war has undergone in modern European history. This historical process is the major subject of our analysis, as well as some other accompanying problems related to the nature of modern state and modern international order.
Streszczenie
Artykuł stanowi wprowadzenie do podstawowych zagadnień związanych z problematyką międzynarodową w myśli Carla Schmitta. Zarysowane zostają pojęcie nomosu Ziemi, przekształcenia w obrębie Jus Publicum Europaeum oraz nieróżnicujące pojęcie wojny. Schmitt przypisuje szczególne znaczenie przemianie pojęcia wojny w nowożytnej historii Europy. Rzeczony proces historyczny jest głownym tematem tekstu wraz z pokrewnymi zagadnieniami odsyłającymi do natury nowożytnego państwa i ładu międzynarodowego.

The aim of the present volume is to discuss the notion of constitution from the perspectives of history of political thought. Its scholarly intention is to go beyond the approach concentrating on the formal understanding of constitution and bring forward more complex historical and philosophic-political interpretations. Our point of departure was the need to revive the somehow neglected distinction between the idea of constitution as an act of conscious law-giving activity and the notion of constitution conceived as the set of fundamental political rules derived from the very nature of political regime and its historical development.

This paper argues that the writings of Hans Kelsen deserve more attention from those engaged in the debate on secularization and political theology. His lifelong struggle with various forms of legal‐political metaphysics is an identifiable thread in many of his writings. Kelsen’s concern with the theological‐political issues found in the theory of the state (Staatslehre ) is far from being marginal. Kelsen claims that his theory aims at resolving the traditional dualism of law and state prevailing in the Staatslehre and contributes to an “uncompromising destruction of one of the most effective ideologies of legitimacy.” Kelsen maintains that the contents of this “ideology of legitimacy” derive from both political metaphysics and the deep‐seated ancient ways of thinking on nature and society. In order to illustrate this thesis, I propose calling this phenomenon “totemism of the modern state.”
SUMMARY The aim of this paper is to make a case for the claim that Karl Löwith's thought is predominately preoccupied with one major philosophic– historical problem that may be broadly labelled existentialism. This notion is usually employed by Löwith in order to grasp the various phenomena and developments within the European (or Western) history in the modern age. I claim that the meaning assigned by Löwith to the notion of existentialism is inseparable from its political consequences. In other words, I attempt to reconstruct the notion of existentialism in Löwith's thought primarily as a political problem. By advancing this argument, I am inclined towards the view that Löwith's oeuvre deserves more careful reception from political theorists than it has yet received.

The article provides an introduction to the basic tenets of Carl Schmitt’s international thought. It discusses such notions as the nomos of the Earth, the development of Jus Publicum Europaeum and the non-discriminating concept of war. Schmitt’s thought attached particular importance to the transformations the concept of war has undergone in modern European history. This historical process is the major subject of our analysis, as well as some other accompanying problems related to the nature of modern state and modern international order.
Streszczenie
Artykuł stanowi wprowadzenie do podstawowych zagadnień związanych z problematyką międzynarodową w myśli Carla Schmitta. Zarysowane zostają pojęcie nomosu Ziemi, przekształcenia w obrębie Jus Publicum Europaeum oraz nieróżnicujące pojęcie wojny. Schmitt przypisuje szczególne znaczenie przemianie pojęcia wojny w nowożytnej historii Europy. Rzeczony proces historyczny jest głownym tematem tekstu wraz z pokrewnymi zagadnieniami odsyłającymi do natury nowożytnego państwa i ładu międzynarodowego.

W książce Autor stara się zrozumieć niechęć Schmitta do: świata ujednoliconego, globalnej homogenizacji, doktryny wojny sprawiedliwej uzasadniającej wszelakie interwencje militarne i przemianę wojny w światową wojnę domową. Pokazuje, że Schmitt przejawia realistyczne podejście do świata ludzkiego oparte na pesymistycznej antropologii. Prawnik Schmitt walczy z teologiem w sobie i w pewnym sensie zwycięża: „świecka tradycja” ius publicum Europaeum okazuje się błogosławieństwem, umiarkowana deteologizacja przynosi historyczne korzyści.
Niezwykle interesujące i zbyt słabo zauważane przez badaczy jest to, jak bardzo Schmitt podkreśla napięcie między prawem a teologią i filozofią. Myśl Schmitta dostarcza niewątpliwie narzędzi, dzięki którym możliwa jest lepsza orientacja w problemach i wyzwaniach współczesnego świata.
Polski czytelnik otrzymuje w końcu koherentny, przejrzysty, drobiazgowy i erudycyjny tekst traktujący o myśli prawno-międzynarodowej Carla Schmitta.

Wokół myśli Karla Löwitha
W pracy stawiamy tezę, iż myśl Karla Löwitha umożliwia zrekonstruowanie związku łączącego nowoczesność, nihilizm oraz politykę. Nowoczesność przedstawiona jest jako epoka, którą charakteryzują narodziny świadomości historycznej rozstrzygającej o jej odmienności względem starożytności i średniowiecza. Analiza korzeni nowoczesnej świadomości historycznej i wiążącej się z nią historycznej dynamiki stanowi warunek wstępny uchwycenia kierunku rozwoju dziejów Europy. W tym celu Löwith wprowadza tezę o sekularyzacji, która umożliwia zrozumienie zarówno chrześcijańskich korzeni nowoczesności i niechrześcijańskich rezultatów jej rozwoju historycznego. Ambiwalencja chrześcijańskiego dziedzictwa Europy stanowi zatem klucz do zrozumienia związku nowoczesności i nihilizmu. Z jednej strony chrześcijaństwo – za sprawą ustanowienia specjalnej relacji Boga i człowieka – dokonuje wyniesienia człowieka ponad naturę i dowartościowuje historię; z drugiej – pozostaje ono eschatologicznym obwarowaniem wszelkiego procesu dziejowego, który nie może jawić się jako samoistna przestrzeń. Nihilistyczne konsekwencje nowoczesności Löwith kojarzy zatem z egzystencjalizmem, który nie jest w stanie uchwycić człowieka w miarodajnej relacji ani do Boga, ani do kosmosu, odnosząc go jedynie do tego, co przynosi ze sobą zdynamizowana nowoczesnością historia.

Modernity and What Has Been Lost comes out of a conference held at the Jagiellonian University in Kraków, Poland, on June 4–5, 2009 that sought to identify Leo Strauss’s intellectual background in re: the repudiation of a modern idea of homogenous, universal state (considered as an illegitimate synthesis of Jerusalem and Athens, i.e., the claims of Reason and Revelation). The world we live in, molded by science and historical relativism, may be described as hostile to human dignity or perfection, or abhorrent to those who love the search for wisdom. Straussian teaching consisted in the steady effort to reopen “the quarrel between the Ancients and the Moderns,” and refers to the esoteric way of writing practiced by the most profound thinkers of the past which has been apparently forgotten in the last three centuries. Strauss binds the concept of natural right with the question of maintenance of conditions for philosophizing, and it probably seems to him that such defense of philosophy is the highest task in our times.
However, one must be well aware that philosophizing always means a perilous way of life.
