قد تؤولُ التطورات التي تشهدها تونس اليوم إلى تغيرات هامة في طبيعة العلاقة بين الضباط والسلطة المدنية. ففي 25 تموز/يوليو 2021، اتخذ رئيس الجمهورية التونسي قيس سعيد جملة من الإجراءات التي تعمل على تركيز السُلطة في يده، وتضمن له السيطرة على السلطات الثلاث في البلاد. مباشرةً بعد إعلان الرئيس عن هذه الإجراءات، كانت المؤسسة العسكرية من أوائل الجهات التي نفذت الإجراءات الجديدة.

On July 25, 2021, president Kais Saied announced measures that largely concentrate powers in his office, assuming control over the three branches of government. Immediately, the military was among the leading executors of the President's measures.
في ظل تصاعد قبضة الجيش على مقاليد السياسة وتوسعه في النشاط الاقتصادي في مصر، يبدو الحديث عن علاقا... more في ظل تصاعد قبضة الجيش على مقاليد السياسة وتوسعه في النشاط الاقتصادي في مصر، يبدو الحديث عن علاقات مدنية-عسكرية سليمة في المستقبل القريب أمراً في غاية الصعوبة. لكن، بالرغم من ذلك، قد يشكل الاقتصاد العسكري فرصة سانحة لنخب مدنية للتفاوض مع مؤسسة عسكرية نافذة على انتقال ديمقراطي، والتعامل معها بمنطق الاحتواء بدلاً من الصدام، في مسار طريق طويل نحو إخضاع الجيش واقتصاداته لسيطرة المدنيين.
فرضية حدوث انتقال ديمقراطي في مصر في المستقبل، بما يتضمنه من إنهاء لنظام سلطوي وإقامة بديل مدني ديمقراطي، تطرح تحدي إمكانية تعامل السلطات المدنية مع الاقتصاد العسكري، وإلى أي مدى يمكن النظر إلى هذا الاقتصاد باعتباره بطاقة يمكن التفاوض عليها مع مؤسسة عسكرية متطلعة إلى إبقاء صوت مسموع لها في السياسة.
والتعامل مع هذه التحديات ضروري في طريق الحوكمة الديمقراطية، وإخضاع الجيش للسيطرة المدنية، أو حتى الوصول إلى صيغة حكم بتوازن مدني-عسكري كما كان عليه الحال قبل 25 كانون الثاني/ يناير.
تحاول هذه الدراسة رسم صورة شبه واضحة عن أوضاع أماكن الاحتجاز في مصر، ومدي التزام السلطات بالمعايي... more تحاول هذه الدراسة رسم صورة شبه واضحة عن أوضاع أماكن الاحتجاز في مصر، ومدي التزام السلطات بالمعايير القانونية والدولية المتعلقة بحقوق المحتجزين. وذلك من خلال تحليل أقوال 300 محتجزًا أمام النيابة، في سبع قضايا تحتوي على وقائع عنف سياسي، وشهادتهم حول ما واجهوه من أنماط انتهاكات صارخة وإخلال واسع بحقوقهم داخل سبع أماكن احتجاز، في ظل تجاهل شديد من النيابة إزاء شكواهم حول أوضاع احتجازهم. تحرص السلطات المصرية على الدوام، أن تكون الرواية الرسمية عن أماكن الاحتجاز وأوضاع المحتجزين هي التأكيد على تمتع النزلاء بكافة حقوقهم القانونية، سواء فيما يخص الرعاية الصحية، أو الزيارة والتريض والمعاملة غير المهينة، وحتى تمكينهم من القراءة والتطور الذاتي، وهو الأمر الذي ينافي الحقيقة، وفقًا لتقارير حقوقية مستقلة. وبالرغم من الصعوبات التي تواجه المنظمات الحقوقية المصرية، وحتي الرسمية منها مثل المجلس القومي لحقوق الإنسان في الحصول على موافقات من وزارة الداخلية لزيارة أماكن الاحتجاز والتأكد من أن المحتجزين ينالون حقوقهم المكفولة بالقانون، إلا أن الشهادات الواردة من المحتجزين أنفسهم أو أسرهم أو محاميهم تكشف عن رؤية مغايرة عما تحاول السلطات ترويجه بهدف تحسين صورتها أمام الجهات الدولية والأممية، حيث تتنوع الانتهاكات داخل أماكن الاحتجاز على أيدي موظفين وأفراد أمن بالمخالفة للقوانين المحلية والمواثيق الدولية. في هذا التقرير تتبع الجبهة أنماط الانتهاكات داخل أماكن الاحتجاز المصرية، وتفاعل النيابة تجاه الانتهاكات والشكاوي من قبل المتهمين، من خلال قراءة وعرض لوثائق تتضمن شهادات 300 محتجزًا من بين 1057 متهمًا محبوسين في 7 قضايا تحتوي على وقائع عنف سياسي، والذين كانوا محتجزين في 7 أماكن احتجاز مختلفة، حيث استطاعت الجبهة أن تصل إلى شهاداتهم الشفهية الموثقة في محاضر التحقيقات وتجديد الحبس، والتي سجلت شكواهم للنيابة مما يعانونه داخل أماكن الاحتجاز. ينقسم هذا التقرير إلي ثلاثة أقسام رئيسية؛ الأول يسلط الضوء على بيانات وتفاصيل القضايا السبع المتهم على ذمتها المحتجزون الموثقة شهاداتهم، بما يتضمنه من سير القضية ووضعها النهائي، إلى جانب وقائع القضية وأعداد المتهمين والاتهامات الموجهة إليهم. في حين يركز القسم الثاني على دور النيابة وتفاعلها مع أوضاع المحتجزين والاستجابة لمطالبهم بتحسين أوضاع السجون ومحاسبة المتورطين في انتهاك حقوقهم هناك وذلك بالنظر لدورها في الإشراف القضائي على أماكن الاحتجاز. و يستعرض القسم الثالث أبرز أنماط الانتهاكات التي يتعرض لها الأشخاص داخل السجون، مثل الإهمال الطبي، والأحوال المعيشية غير الآدمية المتمثلة في التكدس وسوء التغذية، إلى جانب المعاملة القاسية أو المهينة، والتعسف في التمكين من الحق في الزيارة والتريض ومواصلة الدراسة.
The prisoners suffer increasing violations in Egypt today, especially in light of the persisting ... more The prisoners suffer increasing violations in Egypt today, especially in light of the persisting crisis of the Coronavirus (Covid-19) pandemic, since March 2020, isolated prisoners have been facing the outbreak of Coronavirus inside prisons, insomuch as the sham precautionary measures announced by the Ministry of Interior. In addition to the deteriorating health care system in prisons, and the Ministry of Interior’s insistence on the blackout policy regarding the current status of detainees, which was exacerbated by the interruption of their communication with the outside world in a scene that is closer to enforced disappearance, which led to adding new violations to the list of what they have been already suffering in Egyptian prisons.
The Egyptian authorities are keen on displaying their official version of places of detention, which denotes that the inmates enjoy all their legal rights, whether with regard to health care, visitation, exercise and non-degrading treatment, and even enabling them to read and develop themselves, which is contrary to the truth, according to independent human rights reports.
Despite the difficulties that Egyptian human rights organizations encounter, including even official ones such as the National Council for Human Rights, in obtaining approvals from the Ministry of Interior to visit places of detention and to ensure that detainees enjoy their rights which are guaranteed by law, the testimonies received from the detainees themselves, their families, or their lawyers reveal a conflicting narration to what the authorities are trying to promote with the aim of improving their image in front of international and UN agencies, as the violations inside places of detention vary at the hands employees and security personnel, breaching local laws and international covenants.
It is worth noting that during the universal periodic review at the Human Rights Council in November 2019, Egypt received 23 recommendations related to places of detention, 26 recommendations related to torture and cruel treatment, and in the same session, Egypt received 7 recommendations related to human rights violations by state officials.
This report attempts to paint a clear picture of the conditions of places of detention in Egypt, by shedding light on them in at least seven prisons, in which 1057 defendants were detained in seven cases relating to incidents of political violence. This report provides an analysis and presentation of documents that include the testimonies of 300 detainees, as the Egyptian Front was able to access their verbal testimonies which were documented in the reports of investigations and detention renewals, which cited their complaints to the prosecution of the violations they suffered inside places of detention.
This report is divided into three main sections: The first sheds light on the data and details of the seven cases of the detainees whose testimonies are documented, including the progress and final status of the case, as well as the facts of the case, the number of defendants and the charges against them. The second section focuses on the role of the prosecution and its interaction with the conditions of detainees and the response to their demands of improving prison conditions and holding accountable those involved in violations, given its role in judicial supervision of places of detention. The third section reviews the most prominent types of violations that people are subjected to in prisons, such as medical negligence, inhumane living conditions such as overcrowding and malnutrition, as well as cruel or degrading treatment, and intransigence in allowing them the right to visit, exercise, and continue studying.
This report arrives at several conclusions, the most prominent of which is that prisoners in Egypt are subjected to widespread and systematic violations by employees of the Ministry of Interior and with the knowledge of the Public Prosecution Office, as the testimonies – documented in official papers – reveal that detainees have been subjected to a large number of violations at the hands of the prison administration, most notably the lack of health care and poor living conditions, cruel and degrading treatment, abuse of basic rights such as the right to visitations and exercise, in addition to other violations. This is in the absence of judicial supervision to ensure that places of detention comply with international and legal standards for the rights of inmates.
In the years following July 2013 the judicial authorities began to issue death sentences excessiv... more In the years following July 2013 the judicial authorities began to issue death sentences excessively in cases where civilians were tried before military courts or before extraordinary chambers such as terrorism tribunals in civil courts. During this period, the authorities carried out executions in 13 cases involving acts of political violence, eight of which were before military courts and five cases before civil courts, the last of which was the executing of nine persons in the case commonly known as “the assassination of the Attorney General” which was widely condemned on local and international levels, raising the number of executed persons in more than five years ago to at least 47 people. In which the defendants faced – with the rest of convicts in these cases – gross violations, breaching the most basic standards of fair trial, which must be met, especially in the death penalty cases.
This report is divided in two main sections; The first section highlights the data of execution cases in 2018, the ones which have been carried out, and the ones which have exhausted judicial proceedings, and the ones where the death sentence was issued as a preliminary ruling, all of which according to the Egyptian Front’s monitoring of the death penalty during the year. While the second section highlights the most prominent violations the defendants were subjected to in 10 cases of execution in 2018. As most of the defendants encountered violations, the most conspicuous of which were enforced disappearances, physical and moral coercions to extort confessions, absence of lawyers in preliminary interrogation sessions, ignoring and delaying referral to forensics and lastly poor conditions in prisons.
The report based its monitoring of the death penalty data in 2018 on; various media and correspondence with lawyers. While it relied its analysis of violations against the defendants on the analysis of official records of the 10 cases where the defendants were preliminary sentenced to death during 2018, which are currently pending before the Court of Cassation or Military appeals.
فى السنوات التي تلت يوليو 2013 انطلقت يد السلطات القضائية في إصدار أحكام الإعدام في قضايا حوكم في... more فى السنوات التي تلت يوليو 2013 انطلقت يد السلطات القضائية في إصدار أحكام الإعدام في قضايا حوكم فيها مدنيون أمام محاكم عسكرية أو أمام دوائر استثنائية مثل دوائر الإرهاب في المحاكم المدنية. وقامت السلطات خلال تلك الفترة بتنفيذ أحكم الإعدام في 13 قضية تحتوي على وقائع عنف سياسي، ثمانية قضايا منها أمام القضاء العسكري وخمسة قضايا أمام القضاء المدني، والتى كان آخرها تنفيذ حكم الإعدام في تسعة أشخاص في القضية المعروفة إعلاميًا بقضية اغتيال النائب العام، والتى شهدت تنديدًا محليًا ودوليًا واسعًا، ليرتفع بذلك عدد الأشخاص المنفذ فيهم عقوبة الإعدام منذ أكثر من خمسة سنوات إلي 47 شخصًا على الأقل، حيث واجهوا فيها -مع باقي المحكوم عليهم في هذه القضايا- انتهاكات جسيمة أخلت بأبسط معايير المحاكمة العادلة، والواجب توافرها خاصة في القضايا المحكوم فيها بالإعدام. كانت قد أوصت 5 دول في الاستعراض الدوري الشامل للملف الحقوقي المصري في الدورة الثامنة والعشرين لمجلس حقوق الإنسان عام 2014 بالتصديق على البروتوكول الاختياري الثاني الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، والذي ينص على إلغاء عقوبة الإعدام، وهو ما رفضته مصر رفضًا قاطعًا . كما وُجهت لمصر 15 توصية تطالب بوقف اختياري فوري لتنفيذ أحكام الإعدام ووقف العمل بعقوبة الإعدام، و هو ما لم ترحب به مصر أيضًا.و أوصت 4 دول بضمان محاكمة المدنيين أمام محاكم مدنية ووقف المحاكمات العسكرية للمدنيين، والتي حظيت بالتأييد الجزئي لمصر،كما أوصت 8 دول مصر بالالتزام بضمانات المحاكمة العادلة وضمان إجراءات قضائية عادلة و منصفة تتفق مع المعايير الدولية وهو ما أيدته مصر. رغم ذلك، ينص القانون المصري على عشرات الجرائم التي تجعل الإعدام عقوبة لها، بما في ذلك، قانون العقوبات رقم 58 لسنة 1937 وتعديلاته، وقانون الأحكام العسكرية رقم 25 لسنة 1966 وقانون الأسلحة والذخائر رقم 394 لسنة 1954 وحتى قانون مكافحة المخدرات رقم 182 لسنة 1960، و لم تقم الدولة المصرية بإجراء أية تعديلات للحد من نطاق الجرائم التي يعاقب عليها بالإعدام.و رغم تأييد مصر الجزئي لوقف محاكمة المدنيين أمام محاكم عسكرية، أصدر الرئيس المصري القرار رقم 136 لسنة 2014 الذي يجعل من المنشآت الحيوية منشآت عسكرية، مما يتيح معاقبة جريمة الإعتداء على المنشآت العامة أمام محاكم عسكرية. ومن ناحية أخري، واجه المتهمين في قضايا الإعدام، وخاصة القضايا ذات الطابع السياسي، انتهاكات جسيمة أخلت بحقهم في الحصول على محاكمة العادلة، وذلك منذ لحظة القبض عليهم، وحتى إصدار الحكم. وعليه، يهدف هذا التقرير للتأكد من التزام السلطات التنفيذية والقضائية، بالمعايير الدولية، واحترام حقوق المتهمين المكفولة بالقوانين والدستور والمواثيق الدولية، خاصة في هذه القضايا، وهو ما يعد حال مخالفته إعدامًا تعسفيًا.
ينقسم هذا التقرير لقسمين رئيسين؛ القسم الأول يسلط الضوء على بيانات قضايا الإعدام في عام 2018، المنفذ فيها، والمستنفذة لإجراءات التقاضي، والمحكوم فيها بالإعدام بشكل أولي، وذلك وفق رصد أجرته الجبهة المصرية لعقوبة الإعدام خلال العام. في حين يستعرض الجزء الثاني أبرز أنماط الانتهاكات الحقوقية التي تعرض لها المتهمون في 10 قضايا محكوم فيها بالإعدام في 2018؛ حيث واجه غالبية المتهمين انتهاكات أبرزها الإخفاء القسري، والإكراه المادي والمعنوي للإدلاء باعترافات، وبدء النيابة جلسات التحقيق الأولي في غياب المحامين، وتجاهل ومماطلة النيابة إحالة المتهمين للطب الشرعي، وأخيرًا سوء الأوضاع في السجون.
اعتمد هذا التقرير في رصده لبيانات قضايا الإعدام خلال 2018 على وسائل الإعلام المختلفة والتواصل مع المحامين، في حين اعتمد على تحليل الانتهاكات التي تعرض لها المتهمين على تحليل الأوراق الرسمية لعشر قضايا محكوم فيها بشكل أولي بالإعدام خلال عام 2018، وجارى نظرها حاليًا أمام محكمة النقض أو الطعون العسكرية.
Egyptian Front for Human Rights, Committee for Justice and the Arab Foundation for Civil and Poli... more Egyptian Front for Human Rights, Committee for Justice and the Arab Foundation for Civil and Political Rights call on Egyptian authorities to halt the execution of further death sentences and to establish a moratorium on such punishment until a broad societal dialogue on that matter takes place, in line with Egypt’s international obligations.
According to documented cases presented in the joint report “Execution in Egypt”, in the period between 2013 and 2018, Egyptian civil and military courts issued hundreds of death sentences for defendants under criminal and political cases, bringing the total number to at least 2532 judicial rulings. The Egyptian authorities already proceeded in executing some of those death sentences bringing the total number of executions to at least 165 people during the given period.
Egyptian legislation provides for at least 78 articles authorizing the use of the death penalty as a punishment for 104 crimes, in a time where the world is heading towards abolishing the death penalty. Also, in situations where a death sentence is issued, many countries lean towards suspending those sentences. There are more than 160 UN member states, with different legal systems, traditions, cultures and religious background, who have either abolished or willingly suspended the death penalty, either by law or in practice or had it suspended for a period of more than 10 years. However, prisoners in a number of countries, including Egypt, still face the death penalty.
يتجه العالم نحو إنهاء عقوبة الإعدام وفي الحالات التي ما زالت تفرض بها العقوبة هناك توجه كبير نحو ... more يتجه العالم نحو إنهاء عقوبة الإعدام وفي الحالات التي ما زالت تفرض بها العقوبة هناك توجه كبير نحو وقف التنفيذ.، وحتى عام 2018 قامت 160 دولة بإلغاء أو تجميد العمل بعقوبة الإعدام إما في القانون أو في الممارسة العملية أو علقت تنفيذها لأكثر من عشر سنوات، بينما أبقت مصر على تطبيق العقوبة حيث يتيح ما لا يقل عن 78 نصًا في التشريعات المصرية للقضاة باستخدام عقوبة الإعدام كجزاء لـ 104 جريمة بالإعدام.
وبعد الثالث من يوليو 2013 ضربت مصر موجة من أعمال العنف استهدفت في جزء كبير منها قوات الجيش والشرطة وذلك في بعد قيام الجيش بعزل الرئيس الأسبق محمد مرسي، وما تبعه من قيام الجيش والشرطة بالفض الغاشم لاعتصام ميداني رابعة العدوية والنهضة والذي راح ضحيته أكثر من 1150 منهم، ومعظمهم في 5 وقائع منفصلة من القتل الجماعي للمتظاهرين . وفي المقابل قامت الحكومات المتعاقبة بشن حملة شرسة لقمع المعارضين وسن القوانين المقيدة للحقوق والحريات في غيبة البرلمان والتي أخلت في مجملها بضمانات المحاكمة العادلة وحقوق المتهمين، ومن ناحية أخرى توسع القضاء المصري في إصدار الأحكام القضائية المشددة على المعارضين على رأسها عقوبة الإعدام.
وبالرغم من صدور العديد من التوصيات من قبل المجتمع الدولي تجاه مصر من أجل وقف عقوبة الإعدام، وأبرزها في الاستعراض الدوري الشامل عام 2014حيث قدمت إلى مصر 30 توصية من قبل أعضاء مجلس حقوق الإنسان في الأمم المتحدة من أجل وقف عقوبة الإعدام ،كما طالب البرلمان الأوروبي وخمسة من المقررين الخواص في بيانات لهما الحكومة المصرية بوقف تنفيذ أحكام الإعدام في مصر كونها لا تراعي الحد الأدنى للحق في محاكمة عادلة ونزيهة، إلا أن المحاكم المصرية العسكرية والمدنية ما تزال تُصدر سنويًا مئات الأحكام بالإعدام على المتهمين في القضايا الجنائية أو السياسية ليصل عدد الأحكام الصادرة منذ 2013 وحتى فبراير 2019 إلى 2532 شخص على الأقل، كما استمرت السلطات المصرية في تنفيذ أحكام الإعدام ليصل عدد الأشخاص المنفذ فيهم أحكام الإعدام في هذه القضايا منذ 2013 وحتى فبراير 2019 إلي 165 شخص على الأقل .
ومن هنا، يهدف التقرير لتقييم توسع القضاء المصري في إصدار أحكام الإعدام، وخاصة في القضايا ذات الطابع السياسي بعد 2013، وذلك على الرغم من التوجه العالمي لإلغاء أو تجميد العمل بالعقوبة. كما يسعى التقرير لمحاولة التأكد من مدي التزام القضاء المصري بمعايير المحاكمة العادلة عندإصداره هذه الأحكام، وضمان عدم انتهاك حقوق المتهمين المكفولة بالدستور والقانون والمواثيق الدولية.
ينقسم هذا التقرير إلى ثلاثة أقسام رئيسة؛ القسم الأول يسلط الضوء على عقوبة الإعدام في إطار التشريعات والقوانين المصرية، من حيث عدد ونوعية الجرائم التي يعاقب عليها المشرع المصري بعقوبة الإعدام، ومسار القضية المحكوم فيها بالإعدام وضمانات المحاكمة النظرية فيها. فيما يسعى القسم الثاني لإعطاء نظرة حول إحصائيات وبيانات القضايا المحكوم على المتهمين فيها بالإعدام، خاصة في القضايا ذات الطابع السياسي منذ يوليو 2013وحتى ديسمبر 2018. فيما يحاول الجزء الثالث من التقرير تحليل أنماط الانتهاكات التي طالت حق المتهمين في الحصول على محاكمة لم يراع فيها ضمانات المحاكمة العادلة، في القضايا المنفذ والمؤيد فيها أحكام الإعدام على خلفية سياسية خلال تلك الفترة.
اعتمد هذا التقرير على مراجعة مواد القوانين المصرية المختلفة وتعديلاتها المرتبطة بعقوبة الإعدام، كما استند في توثيق الأرقام الخاصة بأحكام الإعدام على مراجعة الأحكام وأوامر الإحالة الصادرة في هذه القضايا، وفي سبيل تحليل أنماط الانتهاكات في تلك القضايا استندالتقرير إلي ما قدمه محامو المحكوم عليهم بالإعدام من مستندات ومذكرات تدعم موقف موكليهم في القضايا المنفذ والمؤيد فيها حكم الإعدام في كافة مراحل التقاضي، بالإضافة لما ساقته نيابة النقض في مذكراتها من أسباب لقبول أو رفض الطعون على أحكام الإعدام في هذه القضايا.
ونشدد في هذا التقرير المشترك على أنه يجب احترام الحق في النظر المنصف للقضايا والذي يشمل جميع الإجراءات والضمانات الخاصة بالمحاكمة العادلة المحددة وفقا المعايير الدولية والإفريقية. ويشمل هذا الحق الامتثال للمعايير الوطنية شريطة أن تتفق مع المعايير الدولية، حيث يكمن الحق في النظر المنصف للقضايا في صميم مفهوم المحاكمة العادلة.
ونظرا لاستحالة تصحيح أي خطأ يحدث في تطبيق عقوبة الإعدام بعد التنفيذ، يجب أن تُراعى قضايا عقوبة الإعدام بدقة جميع المعايير الدولية والإقليمية التي تحمي الحق في المحاكمة العادلة. ومن ثم، يستوجب الاحترام الكامل لجميع الحصانات ولضمانات صحة الإجراءات المحددة في المعايير الدولية المطبقة في المراحل السابقة على المحاكمة، وأثناء المحاكمة، وخلال مراحل الاستئناف.
ويطلق التقرير تحذيرًا حول تنفيذ أحكام الإعدام في ظل عدم مراعاة القضاء المصري الحد الأدنى من ضمانات المحاكمة العادلة في إجراءاتها وفي حيثياتها في القضايا محل التقرير، حيث أن غالبية المتهمين كانوا في عداد المختفين قسرًا، ناهيك عما تعرض له هؤلاء الأشخاص من تعذيب شديد لانتزاع اعترافات عن الوقائع المنسوبة إليهم.
وندعو المنظمات الدولية وآلياتها الاستشارية والقانونية إلى اتخاذ ما يكفي من الإجراءات للحفاظ على حياة المحكوم عليهم بالإعدام في مصر وضمان محاكمة عادلة لكل منهم تتوفر فيها الإجراءات القانونية السليمة، وإلزام النظام المصري باحترام حقوق الأنسان. كما ندعو السلطات المصرية إلى وقف تنفيذ أحكام الإعدام تمهيدا لإلغاء عقوبة الإعدام.
This manual presents documentation methodology of violations of the rights of the accused through... more This manual presents documentation methodology of violations of the rights of the accused through analyzing official documents of cases in Egyptian courts. It intends to monitor and analyze arbitrary measures and violations committed against the accused, especially in political cases, by judicial authorities and law enforcement personnel. Such measures violate rights guaranteed by the Constitution and International Conventions from the moment of arrest, through the process of investigation and trial, and until the accused is sentenced, after all litigation procedures established by Egyptian law are exhausted.
This documentation is important amid hardships that bodies and rights organizations face in absence of documents supporting the testimonies of victims and their families on violations committed against them. This makes it difficult to determine the responsibility of institutions and individuals involved as well as to accurately detect the imbalance in the judicial system during this period.
يقوم هذا الدليل بعرض مبسط لمنهجية توثيق انتهاكات حقوق المتهمين من خلال تحليل الأوراق الرسمية للقض... more يقوم هذا الدليل بعرض مبسط لمنهجية توثيق انتهاكات حقوق المتهمين من خلال تحليل الأوراق الرسمية للقضايا المنظورة أمام المحاكم المصرية. والمقصود بهذا التوثيق، هو العمل على رصد وتحليل الإجراءات التعسفية والانتهاكات التي يتعرض لها المتهمين، خاصة في القضايا السياسية، من قبل السلطات القضائية والأشخاص المكلفين بإنفاذ القانون، والتي تنتهك حقوقهم المكفولة بالدستور والمواثيق الدولية، وذلك من لحظة القبض عليهم، مرورًا بعملية التحقيق معهم ومحاكمتهم، انتهاءً بالحكم عليهم واستنفاذ كافة إجراءات التقاضي التي حددها القانون المصري.
تأتي أهمية هذا النوع من التوثيق في ظل صعوبات جمة تواجهها الهيئات والمنظمات العاملة على كشف مصير ضحايا انتهاكات حقوق الإنسان في حقبة سياسية مضت في ظل غياب وثائق تدعم شهادات الضحايا وذويهم حول ما تعرضوا له، وهو ما يجعل من الصعب تحديد مسئولية المؤسسات والأشخاص المتورطين، والكشف بدقة عن أوجه الخلل في مسار ومنظومة العدالة في هذه الفترة. أقرب نموذج لهذا ما عانته هيئة "الحقيقة والكرامة" في تونس والمسؤولة كشف انتهاكات حقوق الإنسان ومحاسبة المسئولين عنها في الفترة بين 1955- 2013. وتكشف تصريحات رئيسة الهيئة سهام بن سدرين عن مماطلة مؤسسة مثل المحكمة العسكرية في إمداد الهيئة بالوثائق والمستندات المتعلقة بشهادات الضحايا وحيثيات القضايا وهو ما كان له تأثير سلبي على عمل الهيئة.
ويمكن القول أن أهم أهداف هذا النوع من التوثيق هو رصد الانتهاكات الحقوقية الواردة في الأوراق الرسمية للقضية والمكتوبة بصيغة قانونية مجردة، وتحويلها إلى بيانات قابلة للإحصاء والتحليل والوصول لاستنتاجات وتوصيات بخصوص القضية، والتي عليها يمكن استخدام أدوات المناصرة بهدف تسليط الضوء على أنماط الانتهاكات ضد المتهمين في القضية. وتشجيع المهتمين في المجال الحقوقي من باحثين ومحامين على جميع أوراق القضايا التي يعملون بها والمنظورة أمام المحاكم المصرية بمختلف أنواعها، وهو ما سيفيدهم كما القائمين على تحليل هذه الأوراق وما بها من انتهاكات ضمن نطاق عملهم، كما أنه سيحفظ حقوق الضحايا فيما بعد، من خلال وجود وثائق رسمية تثبت تعرضهم لانتهاكات حقوقية.
يساعد هذا النوع من التوثيق أيضًا في إصغاء السمع لشهادات الضحايا أنفسهم عن الانتهاكات التي تعرضوا لها منذ لحظة القبض عليهم، عبر تحليل أقوالهم المثبتة في تحقيقات النيابة أو محاضر جلسات المحاكم، وهو ما يختلف عن الشهادات الواردة عن أقارب الضحايا أو محاميهم. يجعل هذا النوع من التوثيق أيضًا من عملية دحض الشهادات حول انتهاكات حقوق الإنسان أو ادعاء تزييفها أمرًا صعبًا، وذلك لاستنادها في الأساس على أقوال أو تقارير أو دفوع أثبتتها النيابة أو المحكمة في محاضرها الرسمية أثناء مرحلتي التحقيق والمحاكمة، كما يساعد التحليل الكامل لأوراق القضية والتفاعل تجاه الانتهاكات الواردة بها من زيادة صعوبة اتهامها بالانتقائية. فضلًا عن إعطائه نظرة أعمق وأكثر عمومية حول مسار القضية وطبيعة المعاملة الجنائية للمتهمين في قضايا معينة من خلال ما يواجهونه من اتهامات وانتهاكات وممارسات تعسفية من قبل جهات التحقيق والأشخاص المكلفين بإنفاذ القانون.

The first half of year 2018 has witnessed exacerbating apprehension and detention of politicians,... more The first half of year 2018 has witnessed exacerbating apprehension and detention of politicians, journalists, bloggers, and human rights activists against the backdrop of their political activism as well as expressing their opinions freely. This came in conjunction with el-Sisi's second presidential term. Egyptian Front was able to monitor the arrest of 144 person distributed over 7 cases where they were interrogated and accused by State Security Prosecution of publishing false news and joining a group established against the law. These charges are widely known to be loose and subject to the discretion of the investigation authorities. This occurred during when the House of Representatives passed a number of media and press regulation laws among which is the Cybercrime law. This law faced objections as it included a number of articles that restrict freedom of opinion and expression. Earlier, on the 28th of February, 2018, the public prosecutor assigned attorney generals and directors of public prosecution, each in their own area of specialization, to monitor false news published on social media by “Evil people who wants to jeopardize the security and safety of the country”, according to the statement issued by the public prosecution.
In response to these actions that reflect the authorities ‘pursuit of activists, the Spokesperson of the European External Action Service issued a statement on the 30th of May 2018 stating that the increase in the arrest of human rights defenders, political activists, and bloggers in Egypt is a worrying development.
Egyptian Front has monitored the arrest of 13 political activists, 2 bloggers, 9 journalists, 5 photojournalists, 2 film crew members, 2 lawyers, one researcher, 5 students, 3 among those who were shooting in a polling station, 4 among those who participated in Al Quds demonstrations in December 2017, 23 among those who protested against the increase in Metro tickets prices in May 2018. This in addition to others whom the organization was unable to identify their work as well as reasons of their arrest.
This report aims to examine the nature of these recent arrests through shedding the light on these 7 cases investigated by Supreme State Security Prosecution. The cases, in a chronological order, are as following: Case no. 977 for the year 2017 and cases no. 441, 467,482,621,718,734 for the year 2018. Also, Egyptian front was able to collect and present information related to the detainees -activists, journalists, and human rights defenders- held in pre-trial detention in the aforementioned cases. This in addition to examining the legislative context that accompanied the arrests as well as violations that jeopardized the rights of the accused as guaranteed by the constitution and international conventions.
شهد النصف الأول من عام 2018 تصعيدًا في عمليات القبض والاحتجاز من جانب الأجهزة الأمنية المصرية لعد... more شهد النصف الأول من عام 2018 تصعيدًا في عمليات القبض والاحتجاز من جانب الأجهزة الأمنية المصرية لعدد من السياسيين والصحفيين والمدونين والحقوقيين على خلفية نشاطهم وتعبيرهم عن رأيهم سلميًا وذلك بالتزامن مع بدء الفترة الرئاسية الثانية للسيسي. وتمكنت الجبهة المصرية من رصد إلقاء السلطات القبض على 144 شخصًا موزعين على 7 قضايا قامت نيابة أمن الدولة بالتحقيق معهم واتهامهم بنشر أخبار كاذبة والانضمام لجماعة أسست على خلاف القانون. وهي الاتهامات التي لا يخفي مدى كونها فضفاضة وخاضعة بشكل كبير لتقدير سلطات التحقيق. يأتي هذا في الوقت الذي أصدر فيه مجلس النواب حزمة من القوانين المتعلقة بالإعلام والصحافة ومنها الصحافة الإلكترونية، والتي شهدت عددًا من الاعتراضات لاحتوائها على نصوص مقيدة لحرية الرأي والتعبير. وكان النائب العام المصري قد أصدر في 28 فبراير 2018 قرارًا يكلف فيه المحامين العامين ورؤساء النيابة العامة،كل في دائرة اختصاصه، بمتابعة ما ينشر في وسائل الإعلام ومواقع التواصل الاجتماعي من أكاذيب وأخبار غير حقيقية يقوم ببثها "أهل الشر" للنيل من أمن وسلامة البلاد، وذلك على حد وصف بيان صادر من النيابة العامة. وتفاعلًا مع هذه الرسائل التي تكشف عنها توسع السلطات في الملاحقة القضائية والأمنية للنشطاء ، أصدرت الناطقة باسم وزيرة خارجية الاتحاد الأوروبي في 30 مايو 2018 بيانًا رأت فيه بأن تزايد احتجاز المدافعين عن حقوق الإنسان والناشطين السياسيين والمدونين في مصر يشكل تطوراً مقلقاً. وفي 5 يونيو 2018 عبرت المتحدثة باسم مفوض الأمم المتحدة السامي لحقوق الإنسان في بيان آخر عن قلقها من تزايد عمليات التوقيف والاستيقاف والاحتجاز لنشطاء مصريين، واعتبرته تصعيدًا لمحاولات قمع الحق في حرية التعبير والتنظيم والتجمع في البلاد. كانت الجبهة المصرية قد رصدت إلقاء الأجهزة الأمنية القبض علي 13 ناشط سياسي، 2 مدونين، 9 صحفيين، 5 مصورين صحفيين، 2 من طاقم الأفلام، 2 محامين، باحث، 5 طلاب، 3 قاموا بتصوير لجان انتخابات الرئاسة، 4 أشخاص قاموا بالنظاهر في مظاهرات القدس فى ديسمبر 2017 و23 للتظاهر احتجاجًا على ارتفاع أسعار تذاكر المترو فى مايو 2018، بالإضافة لآخرين، لم تتمكن المنظمة من التعرف على طبيعة عملهم والسبب المباشر للقبض عليهم.
يهدف هذا التقرير لفهم طبيعة عمليات القبض الأخيرة، من خلال تسليط الضوء على سبع قضايا قامت نيابة أمن الدولة العليا بالتحقيق فيها وهي بالترتيب الزمني: 977 لسنة 2017، 441، 467، 482 ،621 ،718، 734 لسنة 2018 حصر أمن دولة، ويعمل التقرير على استعراض بيانات خاصة بالمتهمين على ذمة هذه القضايا التي تمكنت الجبهة المصرية من جمعها، والتى تضم عددًا غير قليل من النشطاء والصحفيين والمدافعين عن حقوق الإنسان. بالإضافة لإلقاء النظر على السياق التشريعي المصاحب لعمليات القبض وما صاحبها من انتهاكات أخلت بحقوق المتهمين المكفولة بالدستور والمواثيق الدولية.
In October 12, 2017, 299 defendants - 203 detainees and 96 fugitives - were referred- by the Nort... more In October 12, 2017, 299 defendants - 203 detainees and 96 fugitives - were referred- by the Northern Military Prosecution in Cairo in case No. 64 of 2017, known as the Assistant Attorney General or the Case of Hasm Movement (HM) to- the Cairo Military Criminal Court. The Military Prosecution received the case file from the Supreme State Security Prosecution in March 2017 after investigations revealed that HM seeks to target a number of military facilities, police and foreign embassies.
According to the indictment, the prosecution charged 34 charges, most of which are distributed between murder, attempted murder, complicity and incitement, between 2014-2015, in six different governorates: Behera, Fayoum, Gharbia, Cairo, Damietta. The murder of 16 people and the killing of 15 others, most likely police officers and members of the armed forces, first and foremost brigadier general Adel Rajai commander of the Ninth Division, as well as the attempt to kill Assistant Attorney General Zakaria Abdel Aziz and Advisor Ahmed Abul Fotouh. finally, an attempt to assassinate the former Mufti of the Republic.
In the first analysis of the indictment, the unwarranted congestion of facts, in one case over a long period of time (two years), the events took place in different geographic locations. Not just that, but the dates of birth of the accused in the case show how young not a few among them.
A large number of accused in the case faced several violations of their rights guaranteed by the amended Constitution 2014, where many of them were subjected to enforced disappearance for long periods in the headquarters of the National Security Service, where they suffered various kinds of physical and moral coercion. In addition, the Public Prosecutor's Office did not allow a large number of accused to use the services of a private lawyer, nor did they transfer a large number of defendants immediately to the Department of forensic medicine after being alleged to have been subjected to torture in order to ascertain the accuracy of their statements. The case also included the lack of investigations and the reliance on anonymous information, in addition to the exposure of a number of children to violations in violation of international conventions and the Egyptian law of the child.
The report was based on an analysis of the violations of the rights of the accused in the case, which were confirmed in the Public Prosecution's investigations, with 130 out of the 243detainees who were interrogated by the State Security Prosecution before being referred to the Military Prosecution, The testimony of a number of relatives of the defendants in the case as well as testimonies of some of the attorneys.
تلت الإطاحة بالرئيس السابق محمد مرسى والمنتمى لجماعة الإخوان المسلمين فى 2013 زيادة فى أعداد المق... more تلت الإطاحة بالرئيس السابق محمد مرسى والمنتمى لجماعة الإخوان المسلمين فى 2013 زيادة فى أعداد المقبوض عليهم والمحبوسين على ذمة قضايا موجه لهم فيها اتهامات بارتكاب أعمال إرهابية تستهدف أمن واستقرار البلاد. وبدلًا من اضطلاع القضاء بدور الرقيب على أعمال السلطة التنفيذية والتأكد من التزام أفرادها بأحكام القانون والدستور، خاصة تجاه المتهمين، تظهر الأحكام الصادرة فى قضايا مماثلة عدم الاعتداد بالمخالفات والانتهاكات التي واجهها المتهمون فى هذه القضايا منذ لحظة القبض عليهم ومنها هذه القضية، والتى تؤدي - حال ثبوت صحتها - إلى الإخلال بضمانات المتهمين فى الحصول على محاكمة عادلة.
ويمكن القول بأن هذه القضية تعتبر نموذجًا صارخًا على الانتهاكات التي يمكن حدوثها فى قضية واحدة، حيث إحالة عشرات المتهمين فى قضية واحدة إلى القضاء العسكري بعد إخفائهم لفترات طويلة وتعذيبهم والتحقيق معهم بدون محام وتصوير اعترافاتهم ونشرها وتجاهل شكواهم عن أوضاعهم كمحبوسين فى سجن شديد الحراسة 2.
وكانت نيابة شمال القاهرة العسكرية قد أحالت فى الثانى عشر من أكتوبر 2017 عدد 296 متهمًا - 216 منهم محبوسين و 80 هاربين- فى القضية 64 لسنة 2017 والمعروفة إعلاميًا باسم قضية " النائب العام المساعد" أو " قضية حركة حسم " إلى محكمة جنايات شمال القاهرة العسكرية. وكانت النيابة العسكرية قد تسلمت ملف القضية من نيابة أمن الدولة العليا فى شهر مارس 2017 بعد أن كشفت التحقيقات عن سعى التنظيم لاستهداف عدد من المنشآت التابعة للقوات المسلحة والشرطة والسفارات الأجنبية.
وفقًا لقرار الاتهام، وجهت النيابة 34 اتهامًا يتوزع أغلبها بين القتل و الشروع فى قتل والاشتراك بالاتفاق والتحريض، عن وقائع تمت فى الفترة بين العام 2014 -2016 ، فى 6 محافظات مختلفة هم: البحيرة، والفيوم، والغربية، والقاهرة، ودمياط، والجيزة. وتتلخص وقائع القضية فى قتل 16 شخص والشروع فى قتل 15 آخرين أغلبيتهم من ضباط وأفراد الشرطة وعدد من أفراد القوات المسلحة على رأسهم قائد الفرقة التاسعة مدرع العميد عادل رجائى، بالاضافة الى محاولة قتل النائب العام المساعد زكريا عبدالعزيز والمستشار أحمد أبو الفتوح. وأخيرًا محاولة اغتيال على جمعة المفتي السابق للجمهورية.
استند هذا التقرير فى تحليل الانتهاكات التي تعرض لها المتهمين فى القضية على أوراق تحقيقات النيابة العامة مع 130 متهمًا محبوسًا من أصل 243 تم التحقيق معهم من قبل نيابة أمن الدولة قبل إحالتهم للنيابة العسكرية. كما تم الاستناد أيضًا إلى شهادات عدد من أهالى المتهمين والمحامين عن بعض المتهمين فى القضية.
This report seeks to open a discussion on police probation punishment in Egypt since it regarded ... more This report seeks to open a discussion on police probation punishment in Egypt since it regarded as a pattern of violations that Egyptian opposition face due to their political activism. According to law number 99 for the year 1945, persons sentenced to probation have to spend the period between sunrise and sunset in the police station. The execution of this penalty is associated with a set of violations among which are: restricting one’s ability to work, move, learn, or fulfil required duties towards their families.Also, persons under probation are in constant threat for renewed detention in case of violating probation conditions which makes the situation similar to when being imprisoned. The first part of the report focuses on the historical development of the police probation penalty while the second part presents a legal interpretation of this penalty. The third part presents a legal adaptation of the police probation penalty to political cases, and the fourth part refers to the set of violations that accompany the implementation of police probation in Egypt.

في ظل تصاعد قبضة الجيش على مقاليد السياسة وتوسعه في النشاط الاقتصادي في مصر، يبدو الحديث عن علاقا... more في ظل تصاعد قبضة الجيش على مقاليد السياسة وتوسعه في النشاط الاقتصادي في مصر، يبدو الحديث عن علاقات مدنية-عسكرية سليمة في المستقبل القريب أمراً في غاية الصعوبة. لكن، بالرغم من ذلك، قد يشكل الاقتصاد العسكري فرصة سانحة لنخب مدنية للتفاوض مع مؤسسة عسكرية نافذة على انتقال ديمقراطي، والتعامل معها بمنطق الاحتواء بدلاً من الصدام، في مسار طريق طويل نحو إخضاع الجيش واقتصاداته لسيطرة المدنيين.

تحاول هذه الدراسة رسم صورة شبه واضحة عن أوضاع أماكن الاحتجاز في مصر، ومدي التزام السلطات بالمعايي... more تحاول هذه الدراسة رسم صورة شبه واضحة عن أوضاع أماكن الاحتجاز في مصر، ومدي التزام السلطات بالمعايير القانونية والدولية المتعلقة بحقوق المحتجزين. وذلك من خلال تحليل أقوال 300 محتجزًا أمام النيابة، في سبع قضايا تحتوي على وقائع عنف سياسي، وشهادتهم حول ما واجهوه من أنماط انتهاكات صارخة وإخلال واسع بحقوقهم داخل سبع أماكن احتجاز، في ظل تجاهل شديد من النيابة إزاء شكواهم حول أوضاع احتجازهم. تحرص السلطات المصرية على الدوام، أن تكون الرواية الرسمية عن أماكن الاحتجاز وأوضاع المحتجزين هي التأكيد على تمتع النزلاء بكافة حقوقهم القانونية، سواء فيما يخص الرعاية الصحية، أو الزيارة والتريض والمعاملة غير المهينة، وحتى تمكينهم من القراءة والتطور الذاتي، وهو الأمر الذي ينافي الحقيقة، وفقًا لتقارير حقوقية مستقلة. وبالرغم من الصعوبات التي تواجه المنظمات الحقوقية المصرية، وحتي الرسمية منها مثل المجلس القومي لحقوق الإنسان في الحصول على موافقات من وزارة الداخلية لزيارة أماكن الاحتجاز والتأكد من أن المحتجزين ينالون حقوقهم المكفولة بالقانون، إلا أن الشهادات الواردة من المحتجزين أنفسهم أو أسرهم أو محاميهم تكشف عن رؤية مغايرة عما تحاول السلطات ترويجه بهدف تحسين صورتها أمام الجهات الدولية والأممية، حيث تتنوع الانتهاكات داخل أماكن الاحتجاز على أيدي موظفين وأفراد أمن بالمخالفة للقوانين المحلية والمواثيق الدولية. في هذا التقرير تتبع الجبهة أنماط الانتهاكات داخل أماكن الاحتجاز المصرية، وتفاعل النيابة تجاه الانتهاكات والشكاوي من قبل المتهمين، من خلال قراءة وعرض لوثائق تتضمن شهادات 300 محتجزًا من بين 1057 متهمًا محبوسين في 7 قضايا تحتوي على وقائع عنف سياسي، والذين كانوا محتجزين في 7 أماكن احتجاز مختلفة، حيث استطاعت الجبهة أن تصل إلى شهاداتهم الشفهية الموثقة في محاضر التحقيقات وتجديد الحبس، والتي سجلت شكواهم للنيابة مما يعانونه داخل أماكن الاحتجاز. ينقسم هذا التقرير إلي ثلاثة أقسام رئيسية؛ الأول يسلط الضوء على بيانات وتفاصيل القضايا السبع المتهم على ذمتها المحتجزون الموثقة شهاداتهم، بما يتضمنه من سير القضية ووضعها النهائي، إلى جانب وقائع القضية وأعداد المتهمين والاتهامات الموجهة إليهم. في حين يركز القسم الثاني على دور النيابة وتفاعلها مع أوضاع المحتجزين والاستجابة لمطالبهم بتحسين أوضاع السجون ومحاسبة المتورطين في انتهاك حقوقهم هناك وذلك بالنظر لدورها في الإشراف القضائي على أماكن الاحتجاز. و يستعرض القسم الثالث أبرز أنماط الانتهاكات التي يتعرض لها الأشخاص داخل السجون، مثل الإهمال الطبي، والأحوال المعيشية غير الآدمية المتمثلة في التكدس وسوء التغذية، إلى جانب المعاملة القاسية أو المهينة، والتعسف في التمكين من الحق في الزيارة والتريض ومواصلة الدراسة.
The prisoners suffer increasing violations in Egypt today, especially in light of the persisting ... more The prisoners suffer increasing violations in Egypt today, especially in light of the persisting crisis of the Coronavirus (Covid-19) pandemic, since March 2020, isolated prisoners have been facing the outbreak of Coronavirus inside prisons, insomuch as the sham precautionary measures announced by the Ministry of Interior. In addition to the deteriorating health care system in prisons, and the Ministry of Interior’s insistence on the blackout policy regarding the current status of detainees, which was exacerbated by the interruption of their communication with the outside world in a scene that is closer to enforced disappearance, which led to adding new violations to the list of what they have been already suffering in Egyptian prisons.
The Egyptian authorities are keen on displaying their official version of places of detention, which denotes that the inmates enjoy all their legal rights, whether with regard to health care, visitation, exercise and non-degrading treatment, and even enabling them to read and develop themselves, which is contrary to the truth, according to independent human rights reports.
Despite the difficulties that Egyptian human rights organizations encounter, including even official ones such as the National Council for Human Rights, in obtaining approvals from the Ministry of Interior to visit places of detention and to ensure that detainees enjoy their rights which are guaranteed by law, the testimonies received from the detainees themselves, their families, or their lawyers reveal a conflicting narration to what the authorities are trying to promote with the aim of improving their image in front of international and UN agencies, as the violations inside places of detention vary at the hands employees and security personnel, breaching local laws and international covenants.
It is worth noting that during the universal periodic review at the Human Rights Council in November 2019, Egypt received 23 recommendations related to places of detention, 26 recommendations related to torture and cruel treatment, and in the same session, Egypt received 7 recommendations related to human rights violations by state officials.
This report attempts to paint a clear picture of the conditions of places of detention in Egypt, by shedding light on them in at least seven prisons, in which 1057 defendants were detained in seven cases relating to incidents of political violence. This report provides an analysis and presentation of documents that include the testimonies of 300 detainees, as the Egyptian Front was able to access their verbal testimonies which were documented in the reports of investigations and detention renewals, which cited their complaints to the prosecution of the violations they suffered inside places of detention.
This report is divided into three main sections: The first sheds light on the data and details of the seven cases of the detainees whose testimonies are documented, including the progress and final status of the case, as well as the facts of the case, the number of defendants and the charges against them. The second section focuses on the role of the prosecution and its interaction with the conditions of detainees and the response to their demands of improving prison conditions and holding accountable those involved in violations, given its role in judicial supervision of places of detention. The third section reviews the most prominent types of violations that people are subjected to in prisons, such as medical negligence, inhumane living conditions such as overcrowding and malnutrition, as well as cruel or degrading treatment, and intransigence in allowing them the right to visit, exercise, and continue studying.
This report arrives at several conclusions, the most prominent of which is that prisoners in Egypt are subjected to widespread and systematic violations by employees of the Ministry of Interior and with the knowledge of the Public Prosecution Office, as the testimonies – documented in official papers – reveal that detainees have been subjected to a large number of violations at the hands of the prison administration, most notably the lack of health care and poor living conditions, cruel and degrading treatment, abuse of basic rights such as the right to visitations and exercise, in addition to other violations. This is in the absence of judicial supervision to ensure that places of detention comply with international and legal standards for the rights of inmates.

During this period, the authorities carried out executions in 13 cases involving acts of political violence, eight of which were before military courts and five cases before civil courts, the last of which was the executing of nine persons in the case commonly known as “the assassination of the Attorney General” which was widely condemned on local and international levels, raising the number of executed persons in more than five years ago to at least 47 people. In which the defendants faced – with the rest of convicts in these cases – gross violations, breaching the most basic standards of fair trial, which must be met, especially in the death penalty cases.
This report is divided in two main sections; The first section highlights the data of execution cases in 2018, the ones which have been carried out, and the ones which have exhausted judicial proceedings, and the ones where the death sentence was issued as a preliminary ruling, all of which according to the Egyptian Front’s monitoring of the death penalty during the year. While the second section highlights the most prominent violations the defendants were subjected to in 10 cases of execution in 2018. As most of the defendants encountered violations, the most conspicuous of which were enforced disappearances, physical and moral coercions to extort confessions, absence of lawyers in preliminary interrogation sessions, ignoring and delaying referral to forensics and lastly poor conditions in prisons.
The report based its monitoring of the death penalty data in 2018 on; various media and correspondence with lawyers. While it relied its analysis of violations against the defendants on the analysis of official records of the 10 cases where the defendants were preliminary sentenced to death during 2018, which are currently pending before the Court of Cassation or Military appeals.
فى السنوات التي تلت يوليو 2013 انطلقت يد السلطات القضائية في إصدار أحكام الإعدام في قضايا حوكم في... more فى السنوات التي تلت يوليو 2013 انطلقت يد السلطات القضائية في إصدار أحكام الإعدام في قضايا حوكم فيها مدنيون أمام محاكم عسكرية أو أمام دوائر استثنائية مثل دوائر الإرهاب في المحاكم المدنية. وقامت السلطات خلال تلك الفترة بتنفيذ أحكم الإعدام في 13 قضية تحتوي على وقائع عنف سياسي، ثمانية قضايا منها أمام القضاء العسكري وخمسة قضايا أمام القضاء المدني، والتى كان آخرها تنفيذ حكم الإعدام في تسعة أشخاص في القضية المعروفة إعلاميًا بقضية اغتيال النائب العام، والتى شهدت تنديدًا محليًا ودوليًا واسعًا، ليرتفع بذلك عدد الأشخاص المنفذ فيهم عقوبة الإعدام منذ أكثر من خمسة سنوات إلي 47 شخصًا على الأقل، حيث واجهوا فيها -مع باقي المحكوم عليهم في هذه القضايا- انتهاكات جسيمة أخلت بأبسط معايير المحاكمة العادلة، والواجب توافرها خاصة في القضايا المحكوم فيها بالإعدام. كانت قد أوصت 5 دول في الاستعراض الدوري الشامل للملف الحقوقي المصري في الدورة الثامنة والعشرين لمجلس حقوق الإنسان عام 2014 بالتصديق على البروتوكول الاختياري الثاني الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، والذي ينص على إلغاء عقوبة الإعدام، وهو ما رفضته مصر رفضًا قاطعًا . كما وُجهت لمصر 15 توصية تطالب بوقف اختياري فوري لتنفيذ أحكام الإعدام ووقف العمل بعقوبة الإعدام، و هو ما لم ترحب به مصر أيضًا.و أوصت 4 دول بضمان محاكمة المدنيين أمام محاكم مدنية ووقف المحاكمات العسكرية للمدنيين، والتي حظيت بالتأييد الجزئي لمصر،كما أوصت 8 دول مصر بالالتزام بضمانات المحاكمة العادلة وضمان إجراءات قضائية عادلة و منصفة تتفق مع المعايير الدولية وهو ما أيدته مصر. رغم ذلك، ينص القانون المصري على عشرات الجرائم التي تجعل الإعدام عقوبة لها، بما في ذلك، قانون العقوبات رقم 58 لسنة 1937 وتعديلاته، وقانون الأحكام العسكرية رقم 25 لسنة 1966 وقانون الأسلحة والذخائر رقم 394 لسنة 1954 وحتى قانون مكافحة المخدرات رقم 182 لسنة 1960، و لم تقم الدولة المصرية بإجراء أية تعديلات للحد من نطاق الجرائم التي يعاقب عليها بالإعدام.و رغم تأييد مصر الجزئي لوقف محاكمة المدنيين أمام محاكم عسكرية، أصدر الرئيس المصري القرار رقم 136 لسنة 2014 الذي يجعل من المنشآت الحيوية منشآت عسكرية، مما يتيح معاقبة جريمة الإعتداء على المنشآت العامة أمام محاكم عسكرية. ومن ناحية أخري، واجه المتهمين في قضايا الإعدام، وخاصة القضايا ذات الطابع السياسي، انتهاكات جسيمة أخلت بحقهم في الحصول على محاكمة العادلة، وذلك منذ لحظة القبض عليهم، وحتى إصدار الحكم. وعليه، يهدف هذا التقرير للتأكد من التزام السلطات التنفيذية والقضائية، بالمعايير الدولية، واحترام حقوق المتهمين المكفولة بالقوانين والدستور والمواثيق الدولية، خاصة في هذه القضايا، وهو ما يعد حال مخالفته إعدامًا تعسفيًا.
ينقسم هذا التقرير لقسمين رئيسين؛ القسم الأول يسلط الضوء على بيانات قضايا الإعدام في عام 2018، المنفذ فيها، والمستنفذة لإجراءات التقاضي، والمحكوم فيها بالإعدام بشكل أولي، وذلك وفق رصد أجرته الجبهة المصرية لعقوبة الإعدام خلال العام. في حين يستعرض الجزء الثاني أبرز أنماط الانتهاكات الحقوقية التي تعرض لها المتهمون في 10 قضايا محكوم فيها بالإعدام في 2018؛ حيث واجه غالبية المتهمين انتهاكات أبرزها الإخفاء القسري، والإكراه المادي والمعنوي للإدلاء باعترافات، وبدء النيابة جلسات التحقيق الأولي في غياب المحامين، وتجاهل ومماطلة النيابة إحالة المتهمين للطب الشرعي، وأخيرًا سوء الأوضاع في السجون.
اعتمد هذا التقرير في رصده لبيانات قضايا الإعدام خلال 2018 على وسائل الإعلام المختلفة والتواصل مع المحامين، في حين اعتمد على تحليل الانتهاكات التي تعرض لها المتهمين على تحليل الأوراق الرسمية لعشر قضايا محكوم فيها بشكل أولي بالإعدام خلال عام 2018، وجارى نظرها حاليًا أمام محكمة النقض أو الطعون العسكرية.
Egyptian Front for Human Rights, Committee for Justice and the Arab Foundation for Civil and Poli... more Egyptian Front for Human Rights, Committee for Justice and the Arab Foundation for Civil and Political Rights call on Egyptian authorities to halt the execution of further death sentences and to establish a moratorium on such punishment until a broad societal dialogue on that matter takes place, in line with Egypt’s international obligations.
According to documented cases presented in the joint report “Execution in Egypt”, in the period between 2013 and 2018, Egyptian civil and military courts issued hundreds of death sentences for defendants under criminal and political cases, bringing the total number to at least 2532 judicial rulings. The Egyptian authorities already proceeded in executing some of those death sentences bringing the total number of executions to at least 165 people during the given period.
Egyptian legislation provides for at least 78 articles authorizing the use of the death penalty as a punishment for 104 crimes, in a time where the world is heading towards abolishing the death penalty. Also, in situations where a death sentence is issued, many countries lean towards suspending those sentences. There are more than 160 UN member states, with different legal systems, traditions, cultures and religious background, who have either abolished or willingly suspended the death penalty, either by law or in practice or had it suspended for a period of more than 10 years. However, prisoners in a number of countries, including Egypt, still face the death penalty.
يتجه العالم نحو إنهاء عقوبة الإعدام وفي الحالات التي ما زالت تفرض بها العقوبة هناك توجه كبير نحو ... more يتجه العالم نحو إنهاء عقوبة الإعدام وفي الحالات التي ما زالت تفرض بها العقوبة هناك توجه كبير نحو وقف التنفيذ.، وحتى عام 2018 قامت 160 دولة بإلغاء أو تجميد العمل بعقوبة الإعدام إما في القانون أو في الممارسة العملية أو علقت تنفيذها لأكثر من عشر سنوات، بينما أبقت مصر على تطبيق العقوبة حيث يتيح ما لا يقل عن 78 نصًا في التشريعات المصرية للقضاة باستخدام عقوبة الإعدام كجزاء لـ 104 جريمة بالإعدام.
وبعد الثالث من يوليو 2013 ضربت مصر موجة من أعمال العنف استهدفت في جزء كبير منها قوات الجيش والشرطة وذلك في بعد قيام الجيش بعزل الرئيس الأسبق محمد مرسي، وما تبعه من قيام الجيش والشرطة بالفض الغاشم لاعتصام ميداني رابعة العدوية والنهضة والذي راح ضحيته أكثر من 1150 منهم، ومعظمهم في 5 وقائع منفصلة من القتل الجماعي للمتظاهرين . وفي المقابل قامت الحكومات المتعاقبة بشن حملة شرسة لقمع المعارضين وسن القوانين المقيدة للحقوق والحريات في غيبة البرلمان والتي أخلت في مجملها بضمانات المحاكمة العادلة وحقوق المتهمين، ومن ناحية أخرى توسع القضاء المصري في إصدار الأحكام القضائية المشددة على المعارضين على رأسها عقوبة الإعدام.
وبالرغم من صدور العديد من التوصيات من قبل المجتمع الدولي تجاه مصر من أجل وقف عقوبة الإعدام، وأبرزها في الاستعراض الدوري الشامل عام 2014حيث قدمت إلى مصر 30 توصية من قبل أعضاء مجلس حقوق الإنسان في الأمم المتحدة من أجل وقف عقوبة الإعدام ،كما طالب البرلمان الأوروبي وخمسة من المقررين الخواص في بيانات لهما الحكومة المصرية بوقف تنفيذ أحكام الإعدام في مصر كونها لا تراعي الحد الأدنى للحق في محاكمة عادلة ونزيهة، إلا أن المحاكم المصرية العسكرية والمدنية ما تزال تُصدر سنويًا مئات الأحكام بالإعدام على المتهمين في القضايا الجنائية أو السياسية ليصل عدد الأحكام الصادرة منذ 2013 وحتى فبراير 2019 إلى 2532 شخص على الأقل، كما استمرت السلطات المصرية في تنفيذ أحكام الإعدام ليصل عدد الأشخاص المنفذ فيهم أحكام الإعدام في هذه القضايا منذ 2013 وحتى فبراير 2019 إلي 165 شخص على الأقل .
ومن هنا، يهدف التقرير لتقييم توسع القضاء المصري في إصدار أحكام الإعدام، وخاصة في القضايا ذات الطابع السياسي بعد 2013، وذلك على الرغم من التوجه العالمي لإلغاء أو تجميد العمل بالعقوبة. كما يسعى التقرير لمحاولة التأكد من مدي التزام القضاء المصري بمعايير المحاكمة العادلة عندإصداره هذه الأحكام، وضمان عدم انتهاك حقوق المتهمين المكفولة بالدستور والقانون والمواثيق الدولية.
ينقسم هذا التقرير إلى ثلاثة أقسام رئيسة؛ القسم الأول يسلط الضوء على عقوبة الإعدام في إطار التشريعات والقوانين المصرية، من حيث عدد ونوعية الجرائم التي يعاقب عليها المشرع المصري بعقوبة الإعدام، ومسار القضية المحكوم فيها بالإعدام وضمانات المحاكمة النظرية فيها. فيما يسعى القسم الثاني لإعطاء نظرة حول إحصائيات وبيانات القضايا المحكوم على المتهمين فيها بالإعدام، خاصة في القضايا ذات الطابع السياسي منذ يوليو 2013وحتى ديسمبر 2018. فيما يحاول الجزء الثالث من التقرير تحليل أنماط الانتهاكات التي طالت حق المتهمين في الحصول على محاكمة لم يراع فيها ضمانات المحاكمة العادلة، في القضايا المنفذ والمؤيد فيها أحكام الإعدام على خلفية سياسية خلال تلك الفترة.
اعتمد هذا التقرير على مراجعة مواد القوانين المصرية المختلفة وتعديلاتها المرتبطة بعقوبة الإعدام، كما استند في توثيق الأرقام الخاصة بأحكام الإعدام على مراجعة الأحكام وأوامر الإحالة الصادرة في هذه القضايا، وفي سبيل تحليل أنماط الانتهاكات في تلك القضايا استندالتقرير إلي ما قدمه محامو المحكوم عليهم بالإعدام من مستندات ومذكرات تدعم موقف موكليهم في القضايا المنفذ والمؤيد فيها حكم الإعدام في كافة مراحل التقاضي، بالإضافة لما ساقته نيابة النقض في مذكراتها من أسباب لقبول أو رفض الطعون على أحكام الإعدام في هذه القضايا.
ونشدد في هذا التقرير المشترك على أنه يجب احترام الحق في النظر المنصف للقضايا والذي يشمل جميع الإجراءات والضمانات الخاصة بالمحاكمة العادلة المحددة وفقا المعايير الدولية والإفريقية. ويشمل هذا الحق الامتثال للمعايير الوطنية شريطة أن تتفق مع المعايير الدولية، حيث يكمن الحق في النظر المنصف للقضايا في صميم مفهوم المحاكمة العادلة.
ونظرا لاستحالة تصحيح أي خطأ يحدث في تطبيق عقوبة الإعدام بعد التنفيذ، يجب أن تُراعى قضايا عقوبة الإعدام بدقة جميع المعايير الدولية والإقليمية التي تحمي الحق في المحاكمة العادلة. ومن ثم، يستوجب الاحترام الكامل لجميع الحصانات ولضمانات صحة الإجراءات المحددة في المعايير الدولية المطبقة في المراحل السابقة على المحاكمة، وأثناء المحاكمة، وخلال مراحل الاستئناف.
ويطلق التقرير تحذيرًا حول تنفيذ أحكام الإعدام في ظل عدم مراعاة القضاء المصري الحد الأدنى من ضمانات المحاكمة العادلة في إجراءاتها وفي حيثياتها في القضايا محل التقرير، حيث أن غالبية المتهمين كانوا في عداد المختفين قسرًا، ناهيك عما تعرض له هؤلاء الأشخاص من تعذيب شديد لانتزاع اعترافات عن الوقائع المنسوبة إليهم.
وندعو المنظمات الدولية وآلياتها الاستشارية والقانونية إلى اتخاذ ما يكفي من الإجراءات للحفاظ على حياة المحكوم عليهم بالإعدام في مصر وضمان محاكمة عادلة لكل منهم تتوفر فيها الإجراءات القانونية السليمة، وإلزام النظام المصري باحترام حقوق الأنسان. كما ندعو السلطات المصرية إلى وقف تنفيذ أحكام الإعدام تمهيدا لإلغاء عقوبة الإعدام.
This manual presents documentation methodology of violations of the rights of the accused through... more This manual presents documentation methodology of violations of the rights of the accused through analyzing official documents of cases in Egyptian courts. It intends to monitor and analyze arbitrary measures and violations committed against the accused, especially in political cases, by judicial authorities and law enforcement personnel. Such measures violate rights guaranteed by the Constitution and International Conventions from the moment of arrest, through the process of investigation and trial, and until the accused is sentenced, after all litigation procedures established by Egyptian law are exhausted.
This documentation is important amid hardships that bodies and rights organizations face in absence of documents supporting the testimonies of victims and their families on violations committed against them. This makes it difficult to determine the responsibility of institutions and individuals involved as well as to accurately detect the imbalance in the judicial system during this period.

تأتي أهمية هذا النوع من التوثيق في ظل صعوبات جمة تواجهها الهيئات والمنظمات العاملة على كشف مصير ضحايا انتهاكات حقوق الإنسان في حقبة سياسية مضت في ظل غياب وثائق تدعم شهادات الضحايا وذويهم حول ما تعرضوا له، وهو ما يجعل من الصعب تحديد مسئولية المؤسسات والأشخاص المتورطين، والكشف بدقة عن أوجه الخلل في مسار ومنظومة العدالة في هذه الفترة. أقرب نموذج لهذا ما عانته هيئة "الحقيقة والكرامة" في تونس والمسؤولة كشف انتهاكات حقوق الإنسان ومحاسبة المسئولين عنها في الفترة بين 1955- 2013. وتكشف تصريحات رئيسة الهيئة سهام بن سدرين عن مماطلة مؤسسة مثل المحكمة العسكرية في إمداد الهيئة بالوثائق والمستندات المتعلقة بشهادات الضحايا وحيثيات القضايا وهو ما كان له تأثير سلبي على عمل الهيئة.
ويمكن القول أن أهم أهداف هذا النوع من التوثيق هو رصد الانتهاكات الحقوقية الواردة في الأوراق الرسمية للقضية والمكتوبة بصيغة قانونية مجردة، وتحويلها إلى بيانات قابلة للإحصاء والتحليل والوصول لاستنتاجات وتوصيات بخصوص القضية، والتي عليها يمكن استخدام أدوات المناصرة بهدف تسليط الضوء على أنماط الانتهاكات ضد المتهمين في القضية. وتشجيع المهتمين في المجال الحقوقي من باحثين ومحامين على جميع أوراق القضايا التي يعملون بها والمنظورة أمام المحاكم المصرية بمختلف أنواعها، وهو ما سيفيدهم كما القائمين على تحليل هذه الأوراق وما بها من انتهاكات ضمن نطاق عملهم، كما أنه سيحفظ حقوق الضحايا فيما بعد، من خلال وجود وثائق رسمية تثبت تعرضهم لانتهاكات حقوقية.
يساعد هذا النوع من التوثيق أيضًا في إصغاء السمع لشهادات الضحايا أنفسهم عن الانتهاكات التي تعرضوا لها منذ لحظة القبض عليهم، عبر تحليل أقوالهم المثبتة في تحقيقات النيابة أو محاضر جلسات المحاكم، وهو ما يختلف عن الشهادات الواردة عن أقارب الضحايا أو محاميهم. يجعل هذا النوع من التوثيق أيضًا من عملية دحض الشهادات حول انتهاكات حقوق الإنسان أو ادعاء تزييفها أمرًا صعبًا، وذلك لاستنادها في الأساس على أقوال أو تقارير أو دفوع أثبتتها النيابة أو المحكمة في محاضرها الرسمية أثناء مرحلتي التحقيق والمحاكمة، كما يساعد التحليل الكامل لأوراق القضية والتفاعل تجاه الانتهاكات الواردة بها من زيادة صعوبة اتهامها بالانتقائية. فضلًا عن إعطائه نظرة أعمق وأكثر عمومية حول مسار القضية وطبيعة المعاملة الجنائية للمتهمين في قضايا معينة من خلال ما يواجهونه من اتهامات وانتهاكات وممارسات تعسفية من قبل جهات التحقيق والأشخاص المكلفين بإنفاذ القانون.
يستهدف هذا الدليل في الأساس الباحثين والمحامين وطلاب كليات الحقوق المهتمين بتوثيق ورصد انتهاكات حقوق الإنسان التي يتعرض لها المتهمين في القضايا المنظورة أمام المحاكم المصرية، كما يستهدف الدليل أيضًا العاملين في مجال حملات المناصرة، والمنظمات المهتمة بأعمال توثيق وحفظ الذاكرة والإنصاف لضحايا انتهاكات حقوق الإنسان.
The first half of year 2018 has witnessed exacerbating apprehension and detention of politicians,... more The first half of year 2018 has witnessed exacerbating apprehension and detention of politicians, journalists, bloggers, and human rights activists against the backdrop of their political activism as well as expressing their opinions freely. This came in conjunction with el-Sisi's second presidential term. Egyptian Front was able to monitor the arrest of 144 person distributed over 7 cases where they were interrogated and accused by State Security Prosecution of publishing false news and joining a group established against the law. These charges are widely known to be loose and subject to the discretion of the investigation authorities. This occurred during when the House of Representatives passed a number of media and press regulation laws among which is the Cybercrime law. This law faced objections as it included a number of articles that restrict freedom of opinion and expression. Earlier, on the 28th of February, 2018, the public prosecutor assigned attorney generals and directors of public prosecution, each in their own area of specialization, to monitor false news published on social media by “Evil people who wants to jeopardize the security and safety of the country”, according to the statement issued by the public prosecution.
In response to these actions that reflect the authorities ‘pursuit of activists, the Spokesperson of the European External Action Service issued a statement on the 30th of May 2018 stating that the increase in the arrest of human rights defenders, political activists, and bloggers in Egypt is a worrying development.
Egyptian Front has monitored the arrest of 13 political activists, 2 bloggers, 9 journalists, 5 photojournalists, 2 film crew members, 2 lawyers, one researcher, 5 students, 3 among those who were shooting in a polling station, 4 among those who participated in Al Quds demonstrations in December 2017, 23 among those who protested against the increase in Metro tickets prices in May 2018. This in addition to others whom the organization was unable to identify their work as well as reasons of their arrest.
This report aims to examine the nature of these recent arrests through shedding the light on these 7 cases investigated by Supreme State Security Prosecution. The cases, in a chronological order, are as following: Case no. 977 for the year 2017 and cases no. 441, 467,482,621,718,734 for the year 2018. Also, Egyptian front was able to collect and present information related to the detainees -activists, journalists, and human rights defenders- held in pre-trial detention in the aforementioned cases. This in addition to examining the legislative context that accompanied the arrests as well as violations that jeopardized the rights of the accused as guaranteed by the constitution and international conventions.
شهد النصف الأول من عام 2018 تصعيدًا في عمليات القبض والاحتجاز من جانب الأجهزة الأمنية المصرية لعد... more شهد النصف الأول من عام 2018 تصعيدًا في عمليات القبض والاحتجاز من جانب الأجهزة الأمنية المصرية لعدد من السياسيين والصحفيين والمدونين والحقوقيين على خلفية نشاطهم وتعبيرهم عن رأيهم سلميًا وذلك بالتزامن مع بدء الفترة الرئاسية الثانية للسيسي. وتمكنت الجبهة المصرية من رصد إلقاء السلطات القبض على 144 شخصًا موزعين على 7 قضايا قامت نيابة أمن الدولة بالتحقيق معهم واتهامهم بنشر أخبار كاذبة والانضمام لجماعة أسست على خلاف القانون. وهي الاتهامات التي لا يخفي مدى كونها فضفاضة وخاضعة بشكل كبير لتقدير سلطات التحقيق. يأتي هذا في الوقت الذي أصدر فيه مجلس النواب حزمة من القوانين المتعلقة بالإعلام والصحافة ومنها الصحافة الإلكترونية، والتي شهدت عددًا من الاعتراضات لاحتوائها على نصوص مقيدة لحرية الرأي والتعبير. وكان النائب العام المصري قد أصدر في 28 فبراير 2018 قرارًا يكلف فيه المحامين العامين ورؤساء النيابة العامة،كل في دائرة اختصاصه، بمتابعة ما ينشر في وسائل الإعلام ومواقع التواصل الاجتماعي من أكاذيب وأخبار غير حقيقية يقوم ببثها "أهل الشر" للنيل من أمن وسلامة البلاد، وذلك على حد وصف بيان صادر من النيابة العامة. وتفاعلًا مع هذه الرسائل التي تكشف عنها توسع السلطات في الملاحقة القضائية والأمنية للنشطاء ، أصدرت الناطقة باسم وزيرة خارجية الاتحاد الأوروبي في 30 مايو 2018 بيانًا رأت فيه بأن تزايد احتجاز المدافعين عن حقوق الإنسان والناشطين السياسيين والمدونين في مصر يشكل تطوراً مقلقاً. وفي 5 يونيو 2018 عبرت المتحدثة باسم مفوض الأمم المتحدة السامي لحقوق الإنسان في بيان آخر عن قلقها من تزايد عمليات التوقيف والاستيقاف والاحتجاز لنشطاء مصريين، واعتبرته تصعيدًا لمحاولات قمع الحق في حرية التعبير والتنظيم والتجمع في البلاد. كانت الجبهة المصرية قد رصدت إلقاء الأجهزة الأمنية القبض علي 13 ناشط سياسي، 2 مدونين، 9 صحفيين، 5 مصورين صحفيين، 2 من طاقم الأفلام، 2 محامين، باحث، 5 طلاب، 3 قاموا بتصوير لجان انتخابات الرئاسة، 4 أشخاص قاموا بالنظاهر في مظاهرات القدس فى ديسمبر 2017 و23 للتظاهر احتجاجًا على ارتفاع أسعار تذاكر المترو فى مايو 2018، بالإضافة لآخرين، لم تتمكن المنظمة من التعرف على طبيعة عملهم والسبب المباشر للقبض عليهم.
يهدف هذا التقرير لفهم طبيعة عمليات القبض الأخيرة، من خلال تسليط الضوء على سبع قضايا قامت نيابة أمن الدولة العليا بالتحقيق فيها وهي بالترتيب الزمني: 977 لسنة 2017، 441، 467، 482 ،621 ،718، 734 لسنة 2018 حصر أمن دولة، ويعمل التقرير على استعراض بيانات خاصة بالمتهمين على ذمة هذه القضايا التي تمكنت الجبهة المصرية من جمعها، والتى تضم عددًا غير قليل من النشطاء والصحفيين والمدافعين عن حقوق الإنسان. بالإضافة لإلقاء النظر على السياق التشريعي المصاحب لعمليات القبض وما صاحبها من انتهاكات أخلت بحقوق المتهمين المكفولة بالدستور والمواثيق الدولية.
In October 12, 2017, 299 defendants - 203 detainees and 96 fugitives - were referred- by the Nort... more In October 12, 2017, 299 defendants - 203 detainees and 96 fugitives - were referred- by the Northern Military Prosecution in Cairo in case No. 64 of 2017, known as the Assistant Attorney General or the Case of Hasm Movement (HM) to- the Cairo Military Criminal Court. The Military Prosecution received the case file from the Supreme State Security Prosecution in March 2017 after investigations revealed that HM seeks to target a number of military facilities, police and foreign embassies.
According to the indictment, the prosecution charged 34 charges, most of which are distributed between murder, attempted murder, complicity and incitement, between 2014-2015, in six different governorates: Behera, Fayoum, Gharbia, Cairo, Damietta. The murder of 16 people and the killing of 15 others, most likely police officers and members of the armed forces, first and foremost brigadier general Adel Rajai commander of the Ninth Division, as well as the attempt to kill Assistant Attorney General Zakaria Abdel Aziz and Advisor Ahmed Abul Fotouh. finally, an attempt to assassinate the former Mufti of the Republic.
In the first analysis of the indictment, the unwarranted congestion of facts, in one case over a long period of time (two years), the events took place in different geographic locations. Not just that, but the dates of birth of the accused in the case show how young not a few among them.
A large number of accused in the case faced several violations of their rights guaranteed by the amended Constitution 2014, where many of them were subjected to enforced disappearance for long periods in the headquarters of the National Security Service, where they suffered various kinds of physical and moral coercion. In addition, the Public Prosecutor's Office did not allow a large number of accused to use the services of a private lawyer, nor did they transfer a large number of defendants immediately to the Department of forensic medicine after being alleged to have been subjected to torture in order to ascertain the accuracy of their statements. The case also included the lack of investigations and the reliance on anonymous information, in addition to the exposure of a number of children to violations in violation of international conventions and the Egyptian law of the child.
The report was based on an analysis of the violations of the rights of the accused in the case, which were confirmed in the Public Prosecution's investigations, with 130 out of the 243detainees who were interrogated by the State Security Prosecution before being referred to the Military Prosecution, The testimony of a number of relatives of the defendants in the case as well as testimonies of some of the attorneys.
تلت الإطاحة بالرئيس السابق محمد مرسى والمنتمى لجماعة الإخوان المسلمين فى 2013 زيادة فى أعداد المق... more تلت الإطاحة بالرئيس السابق محمد مرسى والمنتمى لجماعة الإخوان المسلمين فى 2013 زيادة فى أعداد المقبوض عليهم والمحبوسين على ذمة قضايا موجه لهم فيها اتهامات بارتكاب أعمال إرهابية تستهدف أمن واستقرار البلاد. وبدلًا من اضطلاع القضاء بدور الرقيب على أعمال السلطة التنفيذية والتأكد من التزام أفرادها بأحكام القانون والدستور، خاصة تجاه المتهمين، تظهر الأحكام الصادرة فى قضايا مماثلة عدم الاعتداد بالمخالفات والانتهاكات التي واجهها المتهمون فى هذه القضايا منذ لحظة القبض عليهم ومنها هذه القضية، والتى تؤدي - حال ثبوت صحتها - إلى الإخلال بضمانات المتهمين فى الحصول على محاكمة عادلة.
ويمكن القول بأن هذه القضية تعتبر نموذجًا صارخًا على الانتهاكات التي يمكن حدوثها فى قضية واحدة، حيث إحالة عشرات المتهمين فى قضية واحدة إلى القضاء العسكري بعد إخفائهم لفترات طويلة وتعذيبهم والتحقيق معهم بدون محام وتصوير اعترافاتهم ونشرها وتجاهل شكواهم عن أوضاعهم كمحبوسين فى سجن شديد الحراسة 2.
وكانت نيابة شمال القاهرة العسكرية قد أحالت فى الثانى عشر من أكتوبر 2017 عدد 296 متهمًا - 216 منهم محبوسين و 80 هاربين- فى القضية 64 لسنة 2017 والمعروفة إعلاميًا باسم قضية " النائب العام المساعد" أو " قضية حركة حسم " إلى محكمة جنايات شمال القاهرة العسكرية. وكانت النيابة العسكرية قد تسلمت ملف القضية من نيابة أمن الدولة العليا فى شهر مارس 2017 بعد أن كشفت التحقيقات عن سعى التنظيم لاستهداف عدد من المنشآت التابعة للقوات المسلحة والشرطة والسفارات الأجنبية.
وفقًا لقرار الاتهام، وجهت النيابة 34 اتهامًا يتوزع أغلبها بين القتل و الشروع فى قتل والاشتراك بالاتفاق والتحريض، عن وقائع تمت فى الفترة بين العام 2014 -2016 ، فى 6 محافظات مختلفة هم: البحيرة، والفيوم، والغربية، والقاهرة، ودمياط، والجيزة. وتتلخص وقائع القضية فى قتل 16 شخص والشروع فى قتل 15 آخرين أغلبيتهم من ضباط وأفراد الشرطة وعدد من أفراد القوات المسلحة على رأسهم قائد الفرقة التاسعة مدرع العميد عادل رجائى، بالاضافة الى محاولة قتل النائب العام المساعد زكريا عبدالعزيز والمستشار أحمد أبو الفتوح. وأخيرًا محاولة اغتيال على جمعة المفتي السابق للجمهورية.
استند هذا التقرير فى تحليل الانتهاكات التي تعرض لها المتهمين فى القضية على أوراق تحقيقات النيابة العامة مع 130 متهمًا محبوسًا من أصل 243 تم التحقيق معهم من قبل نيابة أمن الدولة قبل إحالتهم للنيابة العسكرية. كما تم الاستناد أيضًا إلى شهادات عدد من أهالى المتهمين والمحامين عن بعض المتهمين فى القضية.
This report seeks to open a discussion on police probation punishment in Egypt since it regarded ... more This report seeks to open a discussion on police probation punishment in Egypt since it regarded as a pattern of violations that Egyptian opposition face due to their political activism. According to law number 99 for the year 1945, persons sentenced to probation have to spend the period between sunrise and sunset in the police station. The execution of this penalty is associated with a set of violations among which are: restricting one’s ability to work, move, learn, or fulfil required duties towards their families.Also, persons under probation are in constant threat for renewed detention in case of violating probation conditions which makes the situation similar to when being imprisoned. The first part of the report focuses on the historical development of the police probation penalty while the second part presents a legal interpretation of this penalty. The third part presents a legal adaptation of the police probation penalty to political cases, and the fourth part refers to the set of violations that accompany the implementation of police probation in Egypt.

قد تؤولُ التطورات التي تشهدها تونس اليوم إلى تغيرات هامة في طبيعة العلاقة بين الضباط والسلطة المدنية. ففي 25 تموز/يوليو 2021، اتخذ رئيس الجمهورية التونسي قيس سعيد جملة من الإجراءات التي تعمل على تركيز السُلطة في يده، وتضمن له السيطرة على السلطات الثلاث في البلاد. مباشرةً بعد إعلان الرئيس عن هذه الإجراءات، كانت المؤسسة العسكرية من أوائل الجهات التي نفذت الإجراءات الجديدة.
فرضية حدوث انتقال ديمقراطي في مصر في المستقبل، بما يتضمنه من إنهاء لنظام سلطوي وإقامة بديل مدني ديمقراطي، تطرح تحدي إمكانية تعامل السلطات المدنية مع الاقتصاد العسكري، وإلى أي مدى يمكن النظر إلى هذا الاقتصاد باعتباره بطاقة يمكن التفاوض عليها مع مؤسسة عسكرية متطلعة إلى إبقاء صوت مسموع لها في السياسة.
والتعامل مع هذه التحديات ضروري في طريق الحوكمة الديمقراطية، وإخضاع الجيش للسيطرة المدنية، أو حتى الوصول إلى صيغة حكم بتوازن مدني-عسكري كما كان عليه الحال قبل 25 كانون الثاني/ يناير.
تحرص السلطات المصرية على الدوام، أن تكون الرواية الرسمية عن أماكن الاحتجاز وأوضاع المحتجزين هي التأكيد على تمتع النزلاء بكافة حقوقهم القانونية، سواء فيما يخص الرعاية الصحية، أو الزيارة والتريض والمعاملة غير المهينة، وحتى تمكينهم من القراءة والتطور الذاتي، وهو الأمر الذي ينافي الحقيقة، وفقًا لتقارير حقوقية مستقلة.
وبالرغم من الصعوبات التي تواجه المنظمات الحقوقية المصرية، وحتي الرسمية منها مثل المجلس القومي لحقوق الإنسان في الحصول على موافقات من وزارة الداخلية لزيارة أماكن الاحتجاز والتأكد من أن المحتجزين ينالون حقوقهم المكفولة بالقانون، إلا أن الشهادات الواردة من المحتجزين أنفسهم أو أسرهم أو محاميهم تكشف عن رؤية مغايرة عما تحاول السلطات ترويجه بهدف تحسين صورتها أمام الجهات الدولية والأممية، حيث تتنوع الانتهاكات داخل أماكن الاحتجاز على أيدي موظفين وأفراد أمن بالمخالفة للقوانين المحلية والمواثيق الدولية.
في هذا التقرير تتبع الجبهة أنماط الانتهاكات داخل أماكن الاحتجاز المصرية، وتفاعل النيابة تجاه الانتهاكات والشكاوي من قبل المتهمين، من خلال قراءة وعرض لوثائق تتضمن شهادات 300 محتجزًا من بين 1057 متهمًا محبوسين في 7 قضايا تحتوي على وقائع عنف سياسي، والذين كانوا محتجزين في 7 أماكن احتجاز مختلفة، حيث استطاعت الجبهة أن تصل إلى شهاداتهم الشفهية الموثقة في محاضر التحقيقات وتجديد الحبس، والتي سجلت شكواهم للنيابة مما يعانونه داخل أماكن الاحتجاز.
ينقسم هذا التقرير إلي ثلاثة أقسام رئيسية؛ الأول يسلط الضوء على بيانات وتفاصيل القضايا السبع المتهم على ذمتها المحتجزون الموثقة شهاداتهم، بما يتضمنه من سير القضية ووضعها النهائي، إلى جانب وقائع القضية وأعداد المتهمين والاتهامات الموجهة إليهم. في حين يركز القسم الثاني على دور النيابة وتفاعلها مع أوضاع المحتجزين والاستجابة لمطالبهم بتحسين أوضاع السجون ومحاسبة المتورطين في انتهاك حقوقهم هناك وذلك بالنظر لدورها في الإشراف القضائي على أماكن الاحتجاز. و يستعرض القسم الثالث أبرز أنماط الانتهاكات التي يتعرض لها الأشخاص داخل السجون، مثل الإهمال الطبي، والأحوال المعيشية غير الآدمية المتمثلة في التكدس وسوء التغذية، إلى جانب المعاملة القاسية أو المهينة، والتعسف في التمكين من الحق في الزيارة والتريض ومواصلة الدراسة.
The Egyptian authorities are keen on displaying their official version of places of detention, which denotes that the inmates enjoy all their legal rights, whether with regard to health care, visitation, exercise and non-degrading treatment, and even enabling them to read and develop themselves, which is contrary to the truth, according to independent human rights reports.
Despite the difficulties that Egyptian human rights organizations encounter, including even official ones such as the National Council for Human Rights, in obtaining approvals from the Ministry of Interior to visit places of detention and to ensure that detainees enjoy their rights which are guaranteed by law, the testimonies received from the detainees themselves, their families, or their lawyers reveal a conflicting narration to what the authorities are trying to promote with the aim of improving their image in front of international and UN agencies, as the violations inside places of detention vary at the hands employees and security personnel, breaching local laws and international covenants.
It is worth noting that during the universal periodic review at the Human Rights Council in November 2019, Egypt received 23 recommendations related to places of detention, 26 recommendations related to torture and cruel treatment, and in the same session, Egypt received 7 recommendations related to human rights violations by state officials.
This report attempts to paint a clear picture of the conditions of places of detention in Egypt, by shedding light on them in at least seven prisons, in which 1057 defendants were detained in seven cases relating to incidents of political violence. This report provides an analysis and presentation of documents that include the testimonies of 300 detainees, as the Egyptian Front was able to access their verbal testimonies which were documented in the reports of investigations and detention renewals, which cited their complaints to the prosecution of the violations they suffered inside places of detention.
This report is divided into three main sections: The first sheds light on the data and details of the seven cases of the detainees whose testimonies are documented, including the progress and final status of the case, as well as the facts of the case, the number of defendants and the charges against them. The second section focuses on the role of the prosecution and its interaction with the conditions of detainees and the response to their demands of improving prison conditions and holding accountable those involved in violations, given its role in judicial supervision of places of detention. The third section reviews the most prominent types of violations that people are subjected to in prisons, such as medical negligence, inhumane living conditions such as overcrowding and malnutrition, as well as cruel or degrading treatment, and intransigence in allowing them the right to visit, exercise, and continue studying.
This report arrives at several conclusions, the most prominent of which is that prisoners in Egypt are subjected to widespread and systematic violations by employees of the Ministry of Interior and with the knowledge of the Public Prosecution Office, as the testimonies – documented in official papers – reveal that detainees have been subjected to a large number of violations at the hands of the prison administration, most notably the lack of health care and poor living conditions, cruel and degrading treatment, abuse of basic rights such as the right to visitations and exercise, in addition to other violations. This is in the absence of judicial supervision to ensure that places of detention comply with international and legal standards for the rights of inmates.
This report is divided in two main sections; The first section highlights the data of execution cases in 2018, the ones which have been carried out, and the ones which have exhausted judicial proceedings, and the ones where the death sentence was issued as a preliminary ruling, all of which according to the Egyptian Front’s monitoring of the death penalty during the year. While the second section highlights the most prominent violations the defendants were subjected to in 10 cases of execution in 2018. As most of the defendants encountered violations, the most conspicuous of which were enforced disappearances, physical and moral coercions to extort confessions, absence of lawyers in preliminary interrogation sessions, ignoring and delaying referral to forensics and lastly poor conditions in prisons.
The report based its monitoring of the death penalty data in 2018 on; various media and correspondence with lawyers. While it relied its analysis of violations against the defendants on the analysis of official records of the 10 cases where the defendants were preliminary sentenced to death during 2018, which are currently pending before the Court of Cassation or Military appeals.
كانت قد أوصت 5 دول في الاستعراض الدوري الشامل للملف الحقوقي المصري في الدورة الثامنة والعشرين لمجلس حقوق الإنسان عام 2014 بالتصديق على البروتوكول الاختياري الثاني الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، والذي ينص على إلغاء عقوبة الإعدام، وهو ما رفضته مصر رفضًا قاطعًا . كما وُجهت لمصر 15 توصية تطالب بوقف اختياري فوري لتنفيذ أحكام الإعدام ووقف العمل بعقوبة الإعدام، و هو ما لم ترحب به مصر أيضًا.و أوصت 4 دول بضمان محاكمة المدنيين أمام محاكم مدنية ووقف المحاكمات العسكرية للمدنيين، والتي حظيت بالتأييد الجزئي لمصر،كما أوصت 8 دول مصر بالالتزام بضمانات المحاكمة العادلة وضمان إجراءات قضائية عادلة و منصفة تتفق مع المعايير الدولية وهو ما أيدته مصر.
رغم ذلك، ينص القانون المصري على عشرات الجرائم التي تجعل الإعدام عقوبة لها، بما في ذلك، قانون العقوبات رقم 58 لسنة 1937 وتعديلاته، وقانون الأحكام العسكرية رقم 25 لسنة 1966 وقانون الأسلحة والذخائر رقم 394 لسنة 1954 وحتى قانون مكافحة المخدرات رقم 182 لسنة 1960، و لم تقم الدولة المصرية بإجراء أية تعديلات للحد من نطاق الجرائم التي يعاقب عليها بالإعدام.و رغم تأييد مصر الجزئي لوقف محاكمة المدنيين أمام محاكم عسكرية، أصدر الرئيس المصري القرار رقم 136 لسنة 2014 الذي يجعل من المنشآت الحيوية منشآت عسكرية، مما يتيح معاقبة جريمة الإعتداء على المنشآت العامة أمام محاكم عسكرية.
ومن ناحية أخري، واجه المتهمين في قضايا الإعدام، وخاصة القضايا ذات الطابع السياسي، انتهاكات جسيمة أخلت بحقهم في الحصول على محاكمة العادلة، وذلك منذ لحظة القبض عليهم، وحتى إصدار الحكم. وعليه، يهدف هذا التقرير للتأكد من التزام السلطات التنفيذية والقضائية، بالمعايير الدولية، واحترام حقوق المتهمين المكفولة بالقوانين والدستور والمواثيق الدولية، خاصة في هذه القضايا، وهو ما يعد حال مخالفته إعدامًا تعسفيًا.
ينقسم هذا التقرير لقسمين رئيسين؛ القسم الأول يسلط الضوء على بيانات قضايا الإعدام في عام 2018، المنفذ فيها، والمستنفذة لإجراءات التقاضي، والمحكوم فيها بالإعدام بشكل أولي، وذلك وفق رصد أجرته الجبهة المصرية لعقوبة الإعدام خلال العام. في حين يستعرض الجزء الثاني أبرز أنماط الانتهاكات الحقوقية التي تعرض لها المتهمون في 10 قضايا محكوم فيها بالإعدام في 2018؛ حيث واجه غالبية المتهمين انتهاكات أبرزها الإخفاء القسري، والإكراه المادي والمعنوي للإدلاء باعترافات، وبدء النيابة جلسات التحقيق الأولي في غياب المحامين، وتجاهل ومماطلة النيابة إحالة المتهمين للطب الشرعي، وأخيرًا سوء الأوضاع في السجون.
اعتمد هذا التقرير في رصده لبيانات قضايا الإعدام خلال 2018 على وسائل الإعلام المختلفة والتواصل مع المحامين، في حين اعتمد على تحليل الانتهاكات التي تعرض لها المتهمين على تحليل الأوراق الرسمية لعشر قضايا محكوم فيها بشكل أولي بالإعدام خلال عام 2018، وجارى نظرها حاليًا أمام محكمة النقض أو الطعون العسكرية.
According to documented cases presented in the joint report “Execution in Egypt”, in the period between 2013 and 2018, Egyptian civil and military courts issued hundreds of death sentences for defendants under criminal and political cases, bringing the total number to at least 2532 judicial rulings. The Egyptian authorities already proceeded in executing some of those death sentences bringing the total number of executions to at least 165 people during the given period.
Egyptian legislation provides for at least 78 articles authorizing the use of the death penalty as a punishment for 104 crimes, in a time where the world is heading towards abolishing the death penalty. Also, in situations where a death sentence is issued, many countries lean towards suspending those sentences. There are more than 160 UN member states, with different legal systems, traditions, cultures and religious background, who have either abolished or willingly suspended the death penalty, either by law or in practice or had it suspended for a period of more than 10 years. However, prisoners in a number of countries, including Egypt, still face the death penalty.
وبعد الثالث من يوليو 2013 ضربت مصر موجة من أعمال العنف استهدفت في جزء كبير منها قوات الجيش والشرطة وذلك في بعد قيام الجيش بعزل الرئيس الأسبق محمد مرسي، وما تبعه من قيام الجيش والشرطة بالفض الغاشم لاعتصام ميداني رابعة العدوية والنهضة والذي راح ضحيته أكثر من 1150 منهم، ومعظمهم في 5 وقائع منفصلة من القتل الجماعي للمتظاهرين . وفي المقابل قامت الحكومات المتعاقبة بشن حملة شرسة لقمع المعارضين وسن القوانين المقيدة للحقوق والحريات في غيبة البرلمان والتي أخلت في مجملها بضمانات المحاكمة العادلة وحقوق المتهمين، ومن ناحية أخرى توسع القضاء المصري في إصدار الأحكام القضائية المشددة على المعارضين على رأسها عقوبة الإعدام.
وبالرغم من صدور العديد من التوصيات من قبل المجتمع الدولي تجاه مصر من أجل وقف عقوبة الإعدام، وأبرزها في الاستعراض الدوري الشامل عام 2014حيث قدمت إلى مصر 30 توصية من قبل أعضاء مجلس حقوق الإنسان في الأمم المتحدة من أجل وقف عقوبة الإعدام ،كما طالب البرلمان الأوروبي وخمسة من المقررين الخواص في بيانات لهما الحكومة المصرية بوقف تنفيذ أحكام الإعدام في مصر كونها لا تراعي الحد الأدنى للحق في محاكمة عادلة ونزيهة، إلا أن المحاكم المصرية العسكرية والمدنية ما تزال تُصدر سنويًا مئات الأحكام بالإعدام على المتهمين في القضايا الجنائية أو السياسية ليصل عدد الأحكام الصادرة منذ 2013 وحتى فبراير 2019 إلى 2532 شخص على الأقل، كما استمرت السلطات المصرية في تنفيذ أحكام الإعدام ليصل عدد الأشخاص المنفذ فيهم أحكام الإعدام في هذه القضايا منذ 2013 وحتى فبراير 2019 إلي 165 شخص على الأقل .
ومن هنا، يهدف التقرير لتقييم توسع القضاء المصري في إصدار أحكام الإعدام، وخاصة في القضايا ذات الطابع السياسي بعد 2013، وذلك على الرغم من التوجه العالمي لإلغاء أو تجميد العمل بالعقوبة. كما يسعى التقرير لمحاولة التأكد من مدي التزام القضاء المصري بمعايير المحاكمة العادلة عندإصداره هذه الأحكام، وضمان عدم انتهاك حقوق المتهمين المكفولة بالدستور والقانون والمواثيق الدولية.
ينقسم هذا التقرير إلى ثلاثة أقسام رئيسة؛ القسم الأول يسلط الضوء على عقوبة الإعدام في إطار التشريعات والقوانين المصرية، من حيث عدد ونوعية الجرائم التي يعاقب عليها المشرع المصري بعقوبة الإعدام، ومسار القضية المحكوم فيها بالإعدام وضمانات المحاكمة النظرية فيها. فيما يسعى القسم الثاني لإعطاء نظرة حول إحصائيات وبيانات القضايا المحكوم على المتهمين فيها بالإعدام، خاصة في القضايا ذات الطابع السياسي منذ يوليو 2013وحتى ديسمبر 2018. فيما يحاول الجزء الثالث من التقرير تحليل أنماط الانتهاكات التي طالت حق المتهمين في الحصول على محاكمة لم يراع فيها ضمانات المحاكمة العادلة، في القضايا المنفذ والمؤيد فيها أحكام الإعدام على خلفية سياسية خلال تلك الفترة.
اعتمد هذا التقرير على مراجعة مواد القوانين المصرية المختلفة وتعديلاتها المرتبطة بعقوبة الإعدام، كما استند في توثيق الأرقام الخاصة بأحكام الإعدام على مراجعة الأحكام وأوامر الإحالة الصادرة في هذه القضايا، وفي سبيل تحليل أنماط الانتهاكات في تلك القضايا استندالتقرير إلي ما قدمه محامو المحكوم عليهم بالإعدام من مستندات ومذكرات تدعم موقف موكليهم في القضايا المنفذ والمؤيد فيها حكم الإعدام في كافة مراحل التقاضي، بالإضافة لما ساقته نيابة النقض في مذكراتها من أسباب لقبول أو رفض الطعون على أحكام الإعدام في هذه القضايا.
ونشدد في هذا التقرير المشترك على أنه يجب احترام الحق في النظر المنصف للقضايا والذي يشمل جميع الإجراءات والضمانات الخاصة بالمحاكمة العادلة المحددة وفقا المعايير الدولية والإفريقية. ويشمل هذا الحق الامتثال للمعايير الوطنية شريطة أن تتفق مع المعايير الدولية، حيث يكمن الحق في النظر المنصف للقضايا في صميم مفهوم المحاكمة العادلة.
ونظرا لاستحالة تصحيح أي خطأ يحدث في تطبيق عقوبة الإعدام بعد التنفيذ، يجب أن تُراعى قضايا عقوبة الإعدام بدقة جميع المعايير الدولية والإقليمية التي تحمي الحق في المحاكمة العادلة. ومن ثم، يستوجب الاحترام الكامل لجميع الحصانات ولضمانات صحة الإجراءات المحددة في المعايير الدولية المطبقة في المراحل السابقة على المحاكمة، وأثناء المحاكمة، وخلال مراحل الاستئناف.
ويطلق التقرير تحذيرًا حول تنفيذ أحكام الإعدام في ظل عدم مراعاة القضاء المصري الحد الأدنى من ضمانات المحاكمة العادلة في إجراءاتها وفي حيثياتها في القضايا محل التقرير، حيث أن غالبية المتهمين كانوا في عداد المختفين قسرًا، ناهيك عما تعرض له هؤلاء الأشخاص من تعذيب شديد لانتزاع اعترافات عن الوقائع المنسوبة إليهم.
وندعو المنظمات الدولية وآلياتها الاستشارية والقانونية إلى اتخاذ ما يكفي من الإجراءات للحفاظ على حياة المحكوم عليهم بالإعدام في مصر وضمان محاكمة عادلة لكل منهم تتوفر فيها الإجراءات القانونية السليمة، وإلزام النظام المصري باحترام حقوق الأنسان. كما ندعو السلطات المصرية إلى وقف تنفيذ أحكام الإعدام تمهيدا لإلغاء عقوبة الإعدام.
This documentation is important amid hardships that bodies and rights organizations face in absence of documents supporting the testimonies of victims and their families on violations committed against them. This makes it difficult to determine the responsibility of institutions and individuals involved as well as to accurately detect the imbalance in the judicial system during this period.
تأتي أهمية هذا النوع من التوثيق في ظل صعوبات جمة تواجهها الهيئات والمنظمات العاملة على كشف مصير ضحايا انتهاكات حقوق الإنسان في حقبة سياسية مضت في ظل غياب وثائق تدعم شهادات الضحايا وذويهم حول ما تعرضوا له، وهو ما يجعل من الصعب تحديد مسئولية المؤسسات والأشخاص المتورطين، والكشف بدقة عن أوجه الخلل في مسار ومنظومة العدالة في هذه الفترة. أقرب نموذج لهذا ما عانته هيئة "الحقيقة والكرامة" في تونس والمسؤولة كشف انتهاكات حقوق الإنسان ومحاسبة المسئولين عنها في الفترة بين 1955- 2013. وتكشف تصريحات رئيسة الهيئة سهام بن سدرين عن مماطلة مؤسسة مثل المحكمة العسكرية في إمداد الهيئة بالوثائق والمستندات المتعلقة بشهادات الضحايا وحيثيات القضايا وهو ما كان له تأثير سلبي على عمل الهيئة.
ويمكن القول أن أهم أهداف هذا النوع من التوثيق هو رصد الانتهاكات الحقوقية الواردة في الأوراق الرسمية للقضية والمكتوبة بصيغة قانونية مجردة، وتحويلها إلى بيانات قابلة للإحصاء والتحليل والوصول لاستنتاجات وتوصيات بخصوص القضية، والتي عليها يمكن استخدام أدوات المناصرة بهدف تسليط الضوء على أنماط الانتهاكات ضد المتهمين في القضية. وتشجيع المهتمين في المجال الحقوقي من باحثين ومحامين على جميع أوراق القضايا التي يعملون بها والمنظورة أمام المحاكم المصرية بمختلف أنواعها، وهو ما سيفيدهم كما القائمين على تحليل هذه الأوراق وما بها من انتهاكات ضمن نطاق عملهم، كما أنه سيحفظ حقوق الضحايا فيما بعد، من خلال وجود وثائق رسمية تثبت تعرضهم لانتهاكات حقوقية.
يساعد هذا النوع من التوثيق أيضًا في إصغاء السمع لشهادات الضحايا أنفسهم عن الانتهاكات التي تعرضوا لها منذ لحظة القبض عليهم، عبر تحليل أقوالهم المثبتة في تحقيقات النيابة أو محاضر جلسات المحاكم، وهو ما يختلف عن الشهادات الواردة عن أقارب الضحايا أو محاميهم.
يجعل هذا النوع من التوثيق أيضًا من عملية دحض الشهادات حول انتهاكات حقوق الإنسان أو ادعاء تزييفها أمرًا صعبًا، وذلك لاستنادها في الأساس على أقوال أو تقارير أو دفوع أثبتتها النيابة أو المحكمة في محاضرها الرسمية أثناء مرحلتي التحقيق والمحاكمة، كما يساعد التحليل الكامل لأوراق القضية والتفاعل تجاه الانتهاكات الواردة بها من زيادة صعوبة اتهامها بالانتقائية. فضلًا عن إعطائه نظرة أعمق وأكثر عمومية حول مسار القضية وطبيعة المعاملة الجنائية للمتهمين في قضايا معينة من خلال ما يواجهونه من اتهامات وانتهاكات وممارسات تعسفية من قبل جهات التحقيق والأشخاص المكلفين بإنفاذ القانون.
يستهدف هذا الدليل في الأساس الباحثين والمحامين وطلاب كليات الحقوق المهتمين بتوثيق ورصد انتهاكات حقوق الإنسان التي يتعرض لها المتهمين في القضايا المنظورة أمام المحاكم المصرية، كما يستهدف الدليل أيضًا العاملين في مجال حملات المناصرة، والمنظمات المهتمة بأعمال توثيق وحفظ الذاكرة والإنصاف لضحايا انتهاكات حقوق الإنسان.
Egyptian Front was able to monitor the arrest of 144 person distributed over 7 cases where they were interrogated and accused by State Security Prosecution of publishing false news and joining a group established against the law. These charges are widely known to be loose and subject to the discretion of the investigation authorities.
This occurred during when the House of Representatives passed a number of media and press regulation laws among which is the Cybercrime law. This law faced objections as it included a number of articles that restrict freedom of opinion and expression. Earlier, on the 28th of February, 2018, the public prosecutor assigned attorney generals and directors of public prosecution, each in their own area of specialization, to monitor false news published on social media by “Evil people who wants to jeopardize the security and safety of the country”, according to the statement issued by the public prosecution.
In response to these actions that reflect the authorities ‘pursuit of activists, the Spokesperson of the European External Action Service issued a statement on the 30th of May 2018 stating that the increase in the arrest of human rights defenders, political activists, and bloggers in Egypt is a worrying development.
Egyptian Front has monitored the arrest of 13 political activists, 2 bloggers, 9 journalists, 5 photojournalists, 2 film crew members, 2 lawyers, one researcher, 5 students, 3 among those who were shooting in a polling station, 4 among those who participated in Al Quds demonstrations in December 2017, 23 among those who protested against the increase in Metro tickets prices in May 2018. This in addition to others whom the organization was unable to identify their work as well as reasons of their arrest.
This report aims to examine the nature of these recent arrests through shedding the light on these 7 cases investigated by Supreme State Security Prosecution. The cases, in a chronological order, are as following: Case no. 977 for the year 2017 and cases no. 441, 467,482,621,718,734 for the year 2018. Also, Egyptian front was able to collect and present information related to the detainees -activists, journalists, and human rights defenders- held in pre-trial detention in the aforementioned cases. This in addition to examining the legislative context that accompanied the arrests as well as violations that jeopardized the rights of the accused as guaranteed by the constitution and international conventions.
يأتي هذا في الوقت الذي أصدر فيه مجلس النواب حزمة من القوانين المتعلقة بالإعلام والصحافة ومنها الصحافة الإلكترونية، والتي شهدت عددًا من الاعتراضات لاحتوائها على نصوص مقيدة لحرية الرأي والتعبير. وكان النائب العام المصري قد أصدر في 28 فبراير 2018 قرارًا يكلف فيه المحامين العامين ورؤساء النيابة العامة،كل في دائرة اختصاصه، بمتابعة ما ينشر في وسائل الإعلام ومواقع التواصل الاجتماعي من أكاذيب وأخبار غير حقيقية يقوم ببثها "أهل الشر" للنيل من أمن وسلامة البلاد، وذلك على حد وصف بيان صادر من النيابة العامة.
وتفاعلًا مع هذه الرسائل التي تكشف عنها توسع السلطات في الملاحقة القضائية والأمنية للنشطاء ، أصدرت الناطقة باسم وزيرة خارجية الاتحاد الأوروبي في 30 مايو 2018 بيانًا رأت فيه بأن تزايد احتجاز المدافعين عن حقوق الإنسان والناشطين السياسيين والمدونين في مصر يشكل تطوراً مقلقاً. وفي 5 يونيو 2018 عبرت المتحدثة باسم مفوض الأمم المتحدة السامي لحقوق الإنسان في بيان آخر عن قلقها من تزايد عمليات التوقيف والاستيقاف والاحتجاز لنشطاء مصريين، واعتبرته تصعيدًا لمحاولات قمع الحق في حرية التعبير والتنظيم والتجمع في البلاد.
كانت الجبهة المصرية قد رصدت إلقاء الأجهزة الأمنية القبض علي 13 ناشط سياسي، 2 مدونين، 9 صحفيين، 5 مصورين صحفيين، 2 من طاقم الأفلام، 2 محامين، باحث، 5 طلاب، 3 قاموا بتصوير لجان انتخابات الرئاسة، 4 أشخاص قاموا بالنظاهر في مظاهرات القدس فى ديسمبر 2017 و23 للتظاهر احتجاجًا على ارتفاع أسعار تذاكر المترو فى مايو 2018، بالإضافة لآخرين، لم تتمكن المنظمة من التعرف على طبيعة عملهم والسبب المباشر للقبض عليهم.
يهدف هذا التقرير لفهم طبيعة عمليات القبض الأخيرة، من خلال تسليط الضوء على سبع قضايا قامت نيابة أمن الدولة العليا بالتحقيق فيها وهي بالترتيب الزمني: 977 لسنة 2017، 441، 467، 482 ،621 ،718، 734 لسنة 2018 حصر أمن دولة، ويعمل التقرير على استعراض بيانات خاصة بالمتهمين على ذمة هذه القضايا التي تمكنت الجبهة المصرية من جمعها، والتى تضم عددًا غير قليل من النشطاء والصحفيين والمدافعين عن حقوق الإنسان. بالإضافة لإلقاء النظر على السياق التشريعي المصاحب لعمليات القبض وما صاحبها من انتهاكات أخلت بحقوق المتهمين المكفولة بالدستور والمواثيق الدولية.
According to the indictment, the prosecution charged 34 charges, most of which are distributed between murder, attempted murder, complicity and incitement, between 2014-2015, in six different governorates: Behera, Fayoum, Gharbia, Cairo, Damietta. The murder of 16 people and the killing of 15 others, most likely police officers and members of the armed forces, first and foremost brigadier general Adel Rajai commander of the Ninth Division, as well as the attempt to kill Assistant Attorney General Zakaria Abdel Aziz and Advisor Ahmed Abul Fotouh. finally, an attempt to assassinate the former Mufti of the Republic.
In the first analysis of the indictment, the unwarranted congestion of facts, in one case over a long period of time (two years), the events took place in different geographic locations. Not just that, but the dates of birth of the accused in the case show how young not a few among them.
A large number of accused in the case faced several violations of their rights guaranteed by the amended Constitution 2014, where many of them were subjected to enforced disappearance for long periods in the headquarters of the National Security Service, where they suffered various kinds of physical and moral coercion. In addition, the Public Prosecutor's Office did not allow a large number of accused to use the services of a private lawyer, nor did they transfer a large number of defendants immediately to the Department of forensic medicine after being alleged to have been subjected to torture in order to ascertain the accuracy of their statements. The case also included the lack of investigations and the reliance on anonymous information, in addition to the exposure of a number of children to violations in violation of international conventions and the Egyptian law of the child.
The report was based on an analysis of the violations of the rights of the accused in the case, which were confirmed in the Public Prosecution's investigations, with 130 out of the 243detainees who were interrogated by the State Security Prosecution before being referred to the Military Prosecution, The testimony of a number of relatives of the defendants in the case as well as testimonies of some of the attorneys.
ويمكن القول بأن هذه القضية تعتبر نموذجًا صارخًا على الانتهاكات التي يمكن حدوثها فى قضية واحدة، حيث إحالة عشرات المتهمين فى قضية واحدة إلى القضاء العسكري بعد إخفائهم لفترات طويلة وتعذيبهم والتحقيق معهم بدون محام وتصوير اعترافاتهم ونشرها وتجاهل شكواهم عن أوضاعهم كمحبوسين فى سجن شديد الحراسة 2.
وكانت نيابة شمال القاهرة العسكرية قد أحالت فى الثانى عشر من أكتوبر 2017 عدد 296 متهمًا - 216 منهم محبوسين و 80 هاربين- فى القضية 64 لسنة 2017 والمعروفة إعلاميًا باسم قضية " النائب العام المساعد" أو " قضية حركة حسم " إلى محكمة جنايات شمال القاهرة العسكرية. وكانت النيابة العسكرية قد تسلمت ملف القضية من نيابة أمن الدولة العليا فى شهر مارس 2017 بعد أن كشفت التحقيقات عن سعى التنظيم لاستهداف عدد من المنشآت التابعة للقوات المسلحة والشرطة والسفارات الأجنبية.
وفقًا لقرار الاتهام، وجهت النيابة 34 اتهامًا يتوزع أغلبها بين القتل و الشروع فى قتل والاشتراك بالاتفاق والتحريض، عن وقائع تمت فى الفترة بين العام 2014 -2016 ، فى 6 محافظات مختلفة هم: البحيرة، والفيوم، والغربية، والقاهرة، ودمياط، والجيزة. وتتلخص وقائع القضية فى قتل 16 شخص والشروع فى قتل 15 آخرين أغلبيتهم من ضباط وأفراد الشرطة وعدد من أفراد القوات المسلحة على رأسهم قائد الفرقة التاسعة مدرع العميد عادل رجائى، بالاضافة الى محاولة قتل النائب العام المساعد زكريا عبدالعزيز والمستشار أحمد أبو الفتوح. وأخيرًا محاولة اغتيال على جمعة المفتي السابق للجمهورية.
استند هذا التقرير فى تحليل الانتهاكات التي تعرض لها المتهمين فى القضية على أوراق تحقيقات النيابة العامة مع 130 متهمًا محبوسًا من أصل 243 تم التحقيق معهم من قبل نيابة أمن الدولة قبل إحالتهم للنيابة العسكرية. كما تم الاستناد أيضًا إلى شهادات عدد من أهالى المتهمين والمحامين عن بعض المتهمين فى القضية.
The first part of the report focuses on the historical development of the police probation penalty while the second part presents a legal interpretation of this penalty. The third part presents a legal adaptation of the police probation penalty to political cases, and the fourth part refers to the set of violations that accompany the implementation of police probation in Egypt.
قد تؤولُ التطورات التي تشهدها تونس اليوم إلى تغيرات هامة في طبيعة العلاقة بين الضباط والسلطة المدنية. ففي 25 تموز/يوليو 2021، اتخذ رئيس الجمهورية التونسي قيس سعيد جملة من الإجراءات التي تعمل على تركيز السُلطة في يده، وتضمن له السيطرة على السلطات الثلاث في البلاد. مباشرةً بعد إعلان الرئيس عن هذه الإجراءات، كانت المؤسسة العسكرية من أوائل الجهات التي نفذت الإجراءات الجديدة.
فرضية حدوث انتقال ديمقراطي في مصر في المستقبل، بما يتضمنه من إنهاء لنظام سلطوي وإقامة بديل مدني ديمقراطي، تطرح تحدي إمكانية تعامل السلطات المدنية مع الاقتصاد العسكري، وإلى أي مدى يمكن النظر إلى هذا الاقتصاد باعتباره بطاقة يمكن التفاوض عليها مع مؤسسة عسكرية متطلعة إلى إبقاء صوت مسموع لها في السياسة.
والتعامل مع هذه التحديات ضروري في طريق الحوكمة الديمقراطية، وإخضاع الجيش للسيطرة المدنية، أو حتى الوصول إلى صيغة حكم بتوازن مدني-عسكري كما كان عليه الحال قبل 25 كانون الثاني/ يناير.
تحرص السلطات المصرية على الدوام، أن تكون الرواية الرسمية عن أماكن الاحتجاز وأوضاع المحتجزين هي التأكيد على تمتع النزلاء بكافة حقوقهم القانونية، سواء فيما يخص الرعاية الصحية، أو الزيارة والتريض والمعاملة غير المهينة، وحتى تمكينهم من القراءة والتطور الذاتي، وهو الأمر الذي ينافي الحقيقة، وفقًا لتقارير حقوقية مستقلة.
وبالرغم من الصعوبات التي تواجه المنظمات الحقوقية المصرية، وحتي الرسمية منها مثل المجلس القومي لحقوق الإنسان في الحصول على موافقات من وزارة الداخلية لزيارة أماكن الاحتجاز والتأكد من أن المحتجزين ينالون حقوقهم المكفولة بالقانون، إلا أن الشهادات الواردة من المحتجزين أنفسهم أو أسرهم أو محاميهم تكشف عن رؤية مغايرة عما تحاول السلطات ترويجه بهدف تحسين صورتها أمام الجهات الدولية والأممية، حيث تتنوع الانتهاكات داخل أماكن الاحتجاز على أيدي موظفين وأفراد أمن بالمخالفة للقوانين المحلية والمواثيق الدولية.
في هذا التقرير تتبع الجبهة أنماط الانتهاكات داخل أماكن الاحتجاز المصرية، وتفاعل النيابة تجاه الانتهاكات والشكاوي من قبل المتهمين، من خلال قراءة وعرض لوثائق تتضمن شهادات 300 محتجزًا من بين 1057 متهمًا محبوسين في 7 قضايا تحتوي على وقائع عنف سياسي، والذين كانوا محتجزين في 7 أماكن احتجاز مختلفة، حيث استطاعت الجبهة أن تصل إلى شهاداتهم الشفهية الموثقة في محاضر التحقيقات وتجديد الحبس، والتي سجلت شكواهم للنيابة مما يعانونه داخل أماكن الاحتجاز.
ينقسم هذا التقرير إلي ثلاثة أقسام رئيسية؛ الأول يسلط الضوء على بيانات وتفاصيل القضايا السبع المتهم على ذمتها المحتجزون الموثقة شهاداتهم، بما يتضمنه من سير القضية ووضعها النهائي، إلى جانب وقائع القضية وأعداد المتهمين والاتهامات الموجهة إليهم. في حين يركز القسم الثاني على دور النيابة وتفاعلها مع أوضاع المحتجزين والاستجابة لمطالبهم بتحسين أوضاع السجون ومحاسبة المتورطين في انتهاك حقوقهم هناك وذلك بالنظر لدورها في الإشراف القضائي على أماكن الاحتجاز. و يستعرض القسم الثالث أبرز أنماط الانتهاكات التي يتعرض لها الأشخاص داخل السجون، مثل الإهمال الطبي، والأحوال المعيشية غير الآدمية المتمثلة في التكدس وسوء التغذية، إلى جانب المعاملة القاسية أو المهينة، والتعسف في التمكين من الحق في الزيارة والتريض ومواصلة الدراسة.
The Egyptian authorities are keen on displaying their official version of places of detention, which denotes that the inmates enjoy all their legal rights, whether with regard to health care, visitation, exercise and non-degrading treatment, and even enabling them to read and develop themselves, which is contrary to the truth, according to independent human rights reports.
Despite the difficulties that Egyptian human rights organizations encounter, including even official ones such as the National Council for Human Rights, in obtaining approvals from the Ministry of Interior to visit places of detention and to ensure that detainees enjoy their rights which are guaranteed by law, the testimonies received from the detainees themselves, their families, or their lawyers reveal a conflicting narration to what the authorities are trying to promote with the aim of improving their image in front of international and UN agencies, as the violations inside places of detention vary at the hands employees and security personnel, breaching local laws and international covenants.
It is worth noting that during the universal periodic review at the Human Rights Council in November 2019, Egypt received 23 recommendations related to places of detention, 26 recommendations related to torture and cruel treatment, and in the same session, Egypt received 7 recommendations related to human rights violations by state officials.
This report attempts to paint a clear picture of the conditions of places of detention in Egypt, by shedding light on them in at least seven prisons, in which 1057 defendants were detained in seven cases relating to incidents of political violence. This report provides an analysis and presentation of documents that include the testimonies of 300 detainees, as the Egyptian Front was able to access their verbal testimonies which were documented in the reports of investigations and detention renewals, which cited their complaints to the prosecution of the violations they suffered inside places of detention.
This report is divided into three main sections: The first sheds light on the data and details of the seven cases of the detainees whose testimonies are documented, including the progress and final status of the case, as well as the facts of the case, the number of defendants and the charges against them. The second section focuses on the role of the prosecution and its interaction with the conditions of detainees and the response to their demands of improving prison conditions and holding accountable those involved in violations, given its role in judicial supervision of places of detention. The third section reviews the most prominent types of violations that people are subjected to in prisons, such as medical negligence, inhumane living conditions such as overcrowding and malnutrition, as well as cruel or degrading treatment, and intransigence in allowing them the right to visit, exercise, and continue studying.
This report arrives at several conclusions, the most prominent of which is that prisoners in Egypt are subjected to widespread and systematic violations by employees of the Ministry of Interior and with the knowledge of the Public Prosecution Office, as the testimonies – documented in official papers – reveal that detainees have been subjected to a large number of violations at the hands of the prison administration, most notably the lack of health care and poor living conditions, cruel and degrading treatment, abuse of basic rights such as the right to visitations and exercise, in addition to other violations. This is in the absence of judicial supervision to ensure that places of detention comply with international and legal standards for the rights of inmates.
This report is divided in two main sections; The first section highlights the data of execution cases in 2018, the ones which have been carried out, and the ones which have exhausted judicial proceedings, and the ones where the death sentence was issued as a preliminary ruling, all of which according to the Egyptian Front’s monitoring of the death penalty during the year. While the second section highlights the most prominent violations the defendants were subjected to in 10 cases of execution in 2018. As most of the defendants encountered violations, the most conspicuous of which were enforced disappearances, physical and moral coercions to extort confessions, absence of lawyers in preliminary interrogation sessions, ignoring and delaying referral to forensics and lastly poor conditions in prisons.
The report based its monitoring of the death penalty data in 2018 on; various media and correspondence with lawyers. While it relied its analysis of violations against the defendants on the analysis of official records of the 10 cases where the defendants were preliminary sentenced to death during 2018, which are currently pending before the Court of Cassation or Military appeals.
كانت قد أوصت 5 دول في الاستعراض الدوري الشامل للملف الحقوقي المصري في الدورة الثامنة والعشرين لمجلس حقوق الإنسان عام 2014 بالتصديق على البروتوكول الاختياري الثاني الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، والذي ينص على إلغاء عقوبة الإعدام، وهو ما رفضته مصر رفضًا قاطعًا . كما وُجهت لمصر 15 توصية تطالب بوقف اختياري فوري لتنفيذ أحكام الإعدام ووقف العمل بعقوبة الإعدام، و هو ما لم ترحب به مصر أيضًا.و أوصت 4 دول بضمان محاكمة المدنيين أمام محاكم مدنية ووقف المحاكمات العسكرية للمدنيين، والتي حظيت بالتأييد الجزئي لمصر،كما أوصت 8 دول مصر بالالتزام بضمانات المحاكمة العادلة وضمان إجراءات قضائية عادلة و منصفة تتفق مع المعايير الدولية وهو ما أيدته مصر.
رغم ذلك، ينص القانون المصري على عشرات الجرائم التي تجعل الإعدام عقوبة لها، بما في ذلك، قانون العقوبات رقم 58 لسنة 1937 وتعديلاته، وقانون الأحكام العسكرية رقم 25 لسنة 1966 وقانون الأسلحة والذخائر رقم 394 لسنة 1954 وحتى قانون مكافحة المخدرات رقم 182 لسنة 1960، و لم تقم الدولة المصرية بإجراء أية تعديلات للحد من نطاق الجرائم التي يعاقب عليها بالإعدام.و رغم تأييد مصر الجزئي لوقف محاكمة المدنيين أمام محاكم عسكرية، أصدر الرئيس المصري القرار رقم 136 لسنة 2014 الذي يجعل من المنشآت الحيوية منشآت عسكرية، مما يتيح معاقبة جريمة الإعتداء على المنشآت العامة أمام محاكم عسكرية.
ومن ناحية أخري، واجه المتهمين في قضايا الإعدام، وخاصة القضايا ذات الطابع السياسي، انتهاكات جسيمة أخلت بحقهم في الحصول على محاكمة العادلة، وذلك منذ لحظة القبض عليهم، وحتى إصدار الحكم. وعليه، يهدف هذا التقرير للتأكد من التزام السلطات التنفيذية والقضائية، بالمعايير الدولية، واحترام حقوق المتهمين المكفولة بالقوانين والدستور والمواثيق الدولية، خاصة في هذه القضايا، وهو ما يعد حال مخالفته إعدامًا تعسفيًا.
ينقسم هذا التقرير لقسمين رئيسين؛ القسم الأول يسلط الضوء على بيانات قضايا الإعدام في عام 2018، المنفذ فيها، والمستنفذة لإجراءات التقاضي، والمحكوم فيها بالإعدام بشكل أولي، وذلك وفق رصد أجرته الجبهة المصرية لعقوبة الإعدام خلال العام. في حين يستعرض الجزء الثاني أبرز أنماط الانتهاكات الحقوقية التي تعرض لها المتهمون في 10 قضايا محكوم فيها بالإعدام في 2018؛ حيث واجه غالبية المتهمين انتهاكات أبرزها الإخفاء القسري، والإكراه المادي والمعنوي للإدلاء باعترافات، وبدء النيابة جلسات التحقيق الأولي في غياب المحامين، وتجاهل ومماطلة النيابة إحالة المتهمين للطب الشرعي، وأخيرًا سوء الأوضاع في السجون.
اعتمد هذا التقرير في رصده لبيانات قضايا الإعدام خلال 2018 على وسائل الإعلام المختلفة والتواصل مع المحامين، في حين اعتمد على تحليل الانتهاكات التي تعرض لها المتهمين على تحليل الأوراق الرسمية لعشر قضايا محكوم فيها بشكل أولي بالإعدام خلال عام 2018، وجارى نظرها حاليًا أمام محكمة النقض أو الطعون العسكرية.
According to documented cases presented in the joint report “Execution in Egypt”, in the period between 2013 and 2018, Egyptian civil and military courts issued hundreds of death sentences for defendants under criminal and political cases, bringing the total number to at least 2532 judicial rulings. The Egyptian authorities already proceeded in executing some of those death sentences bringing the total number of executions to at least 165 people during the given period.
Egyptian legislation provides for at least 78 articles authorizing the use of the death penalty as a punishment for 104 crimes, in a time where the world is heading towards abolishing the death penalty. Also, in situations where a death sentence is issued, many countries lean towards suspending those sentences. There are more than 160 UN member states, with different legal systems, traditions, cultures and religious background, who have either abolished or willingly suspended the death penalty, either by law or in practice or had it suspended for a period of more than 10 years. However, prisoners in a number of countries, including Egypt, still face the death penalty.
وبعد الثالث من يوليو 2013 ضربت مصر موجة من أعمال العنف استهدفت في جزء كبير منها قوات الجيش والشرطة وذلك في بعد قيام الجيش بعزل الرئيس الأسبق محمد مرسي، وما تبعه من قيام الجيش والشرطة بالفض الغاشم لاعتصام ميداني رابعة العدوية والنهضة والذي راح ضحيته أكثر من 1150 منهم، ومعظمهم في 5 وقائع منفصلة من القتل الجماعي للمتظاهرين . وفي المقابل قامت الحكومات المتعاقبة بشن حملة شرسة لقمع المعارضين وسن القوانين المقيدة للحقوق والحريات في غيبة البرلمان والتي أخلت في مجملها بضمانات المحاكمة العادلة وحقوق المتهمين، ومن ناحية أخرى توسع القضاء المصري في إصدار الأحكام القضائية المشددة على المعارضين على رأسها عقوبة الإعدام.
وبالرغم من صدور العديد من التوصيات من قبل المجتمع الدولي تجاه مصر من أجل وقف عقوبة الإعدام، وأبرزها في الاستعراض الدوري الشامل عام 2014حيث قدمت إلى مصر 30 توصية من قبل أعضاء مجلس حقوق الإنسان في الأمم المتحدة من أجل وقف عقوبة الإعدام ،كما طالب البرلمان الأوروبي وخمسة من المقررين الخواص في بيانات لهما الحكومة المصرية بوقف تنفيذ أحكام الإعدام في مصر كونها لا تراعي الحد الأدنى للحق في محاكمة عادلة ونزيهة، إلا أن المحاكم المصرية العسكرية والمدنية ما تزال تُصدر سنويًا مئات الأحكام بالإعدام على المتهمين في القضايا الجنائية أو السياسية ليصل عدد الأحكام الصادرة منذ 2013 وحتى فبراير 2019 إلى 2532 شخص على الأقل، كما استمرت السلطات المصرية في تنفيذ أحكام الإعدام ليصل عدد الأشخاص المنفذ فيهم أحكام الإعدام في هذه القضايا منذ 2013 وحتى فبراير 2019 إلي 165 شخص على الأقل .
ومن هنا، يهدف التقرير لتقييم توسع القضاء المصري في إصدار أحكام الإعدام، وخاصة في القضايا ذات الطابع السياسي بعد 2013، وذلك على الرغم من التوجه العالمي لإلغاء أو تجميد العمل بالعقوبة. كما يسعى التقرير لمحاولة التأكد من مدي التزام القضاء المصري بمعايير المحاكمة العادلة عندإصداره هذه الأحكام، وضمان عدم انتهاك حقوق المتهمين المكفولة بالدستور والقانون والمواثيق الدولية.
ينقسم هذا التقرير إلى ثلاثة أقسام رئيسة؛ القسم الأول يسلط الضوء على عقوبة الإعدام في إطار التشريعات والقوانين المصرية، من حيث عدد ونوعية الجرائم التي يعاقب عليها المشرع المصري بعقوبة الإعدام، ومسار القضية المحكوم فيها بالإعدام وضمانات المحاكمة النظرية فيها. فيما يسعى القسم الثاني لإعطاء نظرة حول إحصائيات وبيانات القضايا المحكوم على المتهمين فيها بالإعدام، خاصة في القضايا ذات الطابع السياسي منذ يوليو 2013وحتى ديسمبر 2018. فيما يحاول الجزء الثالث من التقرير تحليل أنماط الانتهاكات التي طالت حق المتهمين في الحصول على محاكمة لم يراع فيها ضمانات المحاكمة العادلة، في القضايا المنفذ والمؤيد فيها أحكام الإعدام على خلفية سياسية خلال تلك الفترة.
اعتمد هذا التقرير على مراجعة مواد القوانين المصرية المختلفة وتعديلاتها المرتبطة بعقوبة الإعدام، كما استند في توثيق الأرقام الخاصة بأحكام الإعدام على مراجعة الأحكام وأوامر الإحالة الصادرة في هذه القضايا، وفي سبيل تحليل أنماط الانتهاكات في تلك القضايا استندالتقرير إلي ما قدمه محامو المحكوم عليهم بالإعدام من مستندات ومذكرات تدعم موقف موكليهم في القضايا المنفذ والمؤيد فيها حكم الإعدام في كافة مراحل التقاضي، بالإضافة لما ساقته نيابة النقض في مذكراتها من أسباب لقبول أو رفض الطعون على أحكام الإعدام في هذه القضايا.
ونشدد في هذا التقرير المشترك على أنه يجب احترام الحق في النظر المنصف للقضايا والذي يشمل جميع الإجراءات والضمانات الخاصة بالمحاكمة العادلة المحددة وفقا المعايير الدولية والإفريقية. ويشمل هذا الحق الامتثال للمعايير الوطنية شريطة أن تتفق مع المعايير الدولية، حيث يكمن الحق في النظر المنصف للقضايا في صميم مفهوم المحاكمة العادلة.
ونظرا لاستحالة تصحيح أي خطأ يحدث في تطبيق عقوبة الإعدام بعد التنفيذ، يجب أن تُراعى قضايا عقوبة الإعدام بدقة جميع المعايير الدولية والإقليمية التي تحمي الحق في المحاكمة العادلة. ومن ثم، يستوجب الاحترام الكامل لجميع الحصانات ولضمانات صحة الإجراءات المحددة في المعايير الدولية المطبقة في المراحل السابقة على المحاكمة، وأثناء المحاكمة، وخلال مراحل الاستئناف.
ويطلق التقرير تحذيرًا حول تنفيذ أحكام الإعدام في ظل عدم مراعاة القضاء المصري الحد الأدنى من ضمانات المحاكمة العادلة في إجراءاتها وفي حيثياتها في القضايا محل التقرير، حيث أن غالبية المتهمين كانوا في عداد المختفين قسرًا، ناهيك عما تعرض له هؤلاء الأشخاص من تعذيب شديد لانتزاع اعترافات عن الوقائع المنسوبة إليهم.
وندعو المنظمات الدولية وآلياتها الاستشارية والقانونية إلى اتخاذ ما يكفي من الإجراءات للحفاظ على حياة المحكوم عليهم بالإعدام في مصر وضمان محاكمة عادلة لكل منهم تتوفر فيها الإجراءات القانونية السليمة، وإلزام النظام المصري باحترام حقوق الأنسان. كما ندعو السلطات المصرية إلى وقف تنفيذ أحكام الإعدام تمهيدا لإلغاء عقوبة الإعدام.
This documentation is important amid hardships that bodies and rights organizations face in absence of documents supporting the testimonies of victims and their families on violations committed against them. This makes it difficult to determine the responsibility of institutions and individuals involved as well as to accurately detect the imbalance in the judicial system during this period.
تأتي أهمية هذا النوع من التوثيق في ظل صعوبات جمة تواجهها الهيئات والمنظمات العاملة على كشف مصير ضحايا انتهاكات حقوق الإنسان في حقبة سياسية مضت في ظل غياب وثائق تدعم شهادات الضحايا وذويهم حول ما تعرضوا له، وهو ما يجعل من الصعب تحديد مسئولية المؤسسات والأشخاص المتورطين، والكشف بدقة عن أوجه الخلل في مسار ومنظومة العدالة في هذه الفترة. أقرب نموذج لهذا ما عانته هيئة "الحقيقة والكرامة" في تونس والمسؤولة كشف انتهاكات حقوق الإنسان ومحاسبة المسئولين عنها في الفترة بين 1955- 2013. وتكشف تصريحات رئيسة الهيئة سهام بن سدرين عن مماطلة مؤسسة مثل المحكمة العسكرية في إمداد الهيئة بالوثائق والمستندات المتعلقة بشهادات الضحايا وحيثيات القضايا وهو ما كان له تأثير سلبي على عمل الهيئة.
ويمكن القول أن أهم أهداف هذا النوع من التوثيق هو رصد الانتهاكات الحقوقية الواردة في الأوراق الرسمية للقضية والمكتوبة بصيغة قانونية مجردة، وتحويلها إلى بيانات قابلة للإحصاء والتحليل والوصول لاستنتاجات وتوصيات بخصوص القضية، والتي عليها يمكن استخدام أدوات المناصرة بهدف تسليط الضوء على أنماط الانتهاكات ضد المتهمين في القضية. وتشجيع المهتمين في المجال الحقوقي من باحثين ومحامين على جميع أوراق القضايا التي يعملون بها والمنظورة أمام المحاكم المصرية بمختلف أنواعها، وهو ما سيفيدهم كما القائمين على تحليل هذه الأوراق وما بها من انتهاكات ضمن نطاق عملهم، كما أنه سيحفظ حقوق الضحايا فيما بعد، من خلال وجود وثائق رسمية تثبت تعرضهم لانتهاكات حقوقية.
يساعد هذا النوع من التوثيق أيضًا في إصغاء السمع لشهادات الضحايا أنفسهم عن الانتهاكات التي تعرضوا لها منذ لحظة القبض عليهم، عبر تحليل أقوالهم المثبتة في تحقيقات النيابة أو محاضر جلسات المحاكم، وهو ما يختلف عن الشهادات الواردة عن أقارب الضحايا أو محاميهم.
يجعل هذا النوع من التوثيق أيضًا من عملية دحض الشهادات حول انتهاكات حقوق الإنسان أو ادعاء تزييفها أمرًا صعبًا، وذلك لاستنادها في الأساس على أقوال أو تقارير أو دفوع أثبتتها النيابة أو المحكمة في محاضرها الرسمية أثناء مرحلتي التحقيق والمحاكمة، كما يساعد التحليل الكامل لأوراق القضية والتفاعل تجاه الانتهاكات الواردة بها من زيادة صعوبة اتهامها بالانتقائية. فضلًا عن إعطائه نظرة أعمق وأكثر عمومية حول مسار القضية وطبيعة المعاملة الجنائية للمتهمين في قضايا معينة من خلال ما يواجهونه من اتهامات وانتهاكات وممارسات تعسفية من قبل جهات التحقيق والأشخاص المكلفين بإنفاذ القانون.
يستهدف هذا الدليل في الأساس الباحثين والمحامين وطلاب كليات الحقوق المهتمين بتوثيق ورصد انتهاكات حقوق الإنسان التي يتعرض لها المتهمين في القضايا المنظورة أمام المحاكم المصرية، كما يستهدف الدليل أيضًا العاملين في مجال حملات المناصرة، والمنظمات المهتمة بأعمال توثيق وحفظ الذاكرة والإنصاف لضحايا انتهاكات حقوق الإنسان.
Egyptian Front was able to monitor the arrest of 144 person distributed over 7 cases where they were interrogated and accused by State Security Prosecution of publishing false news and joining a group established against the law. These charges are widely known to be loose and subject to the discretion of the investigation authorities.
This occurred during when the House of Representatives passed a number of media and press regulation laws among which is the Cybercrime law. This law faced objections as it included a number of articles that restrict freedom of opinion and expression. Earlier, on the 28th of February, 2018, the public prosecutor assigned attorney generals and directors of public prosecution, each in their own area of specialization, to monitor false news published on social media by “Evil people who wants to jeopardize the security and safety of the country”, according to the statement issued by the public prosecution.
In response to these actions that reflect the authorities ‘pursuit of activists, the Spokesperson of the European External Action Service issued a statement on the 30th of May 2018 stating that the increase in the arrest of human rights defenders, political activists, and bloggers in Egypt is a worrying development.
Egyptian Front has monitored the arrest of 13 political activists, 2 bloggers, 9 journalists, 5 photojournalists, 2 film crew members, 2 lawyers, one researcher, 5 students, 3 among those who were shooting in a polling station, 4 among those who participated in Al Quds demonstrations in December 2017, 23 among those who protested against the increase in Metro tickets prices in May 2018. This in addition to others whom the organization was unable to identify their work as well as reasons of their arrest.
This report aims to examine the nature of these recent arrests through shedding the light on these 7 cases investigated by Supreme State Security Prosecution. The cases, in a chronological order, are as following: Case no. 977 for the year 2017 and cases no. 441, 467,482,621,718,734 for the year 2018. Also, Egyptian front was able to collect and present information related to the detainees -activists, journalists, and human rights defenders- held in pre-trial detention in the aforementioned cases. This in addition to examining the legislative context that accompanied the arrests as well as violations that jeopardized the rights of the accused as guaranteed by the constitution and international conventions.
يأتي هذا في الوقت الذي أصدر فيه مجلس النواب حزمة من القوانين المتعلقة بالإعلام والصحافة ومنها الصحافة الإلكترونية، والتي شهدت عددًا من الاعتراضات لاحتوائها على نصوص مقيدة لحرية الرأي والتعبير. وكان النائب العام المصري قد أصدر في 28 فبراير 2018 قرارًا يكلف فيه المحامين العامين ورؤساء النيابة العامة،كل في دائرة اختصاصه، بمتابعة ما ينشر في وسائل الإعلام ومواقع التواصل الاجتماعي من أكاذيب وأخبار غير حقيقية يقوم ببثها "أهل الشر" للنيل من أمن وسلامة البلاد، وذلك على حد وصف بيان صادر من النيابة العامة.
وتفاعلًا مع هذه الرسائل التي تكشف عنها توسع السلطات في الملاحقة القضائية والأمنية للنشطاء ، أصدرت الناطقة باسم وزيرة خارجية الاتحاد الأوروبي في 30 مايو 2018 بيانًا رأت فيه بأن تزايد احتجاز المدافعين عن حقوق الإنسان والناشطين السياسيين والمدونين في مصر يشكل تطوراً مقلقاً. وفي 5 يونيو 2018 عبرت المتحدثة باسم مفوض الأمم المتحدة السامي لحقوق الإنسان في بيان آخر عن قلقها من تزايد عمليات التوقيف والاستيقاف والاحتجاز لنشطاء مصريين، واعتبرته تصعيدًا لمحاولات قمع الحق في حرية التعبير والتنظيم والتجمع في البلاد.
كانت الجبهة المصرية قد رصدت إلقاء الأجهزة الأمنية القبض علي 13 ناشط سياسي، 2 مدونين، 9 صحفيين، 5 مصورين صحفيين، 2 من طاقم الأفلام، 2 محامين، باحث، 5 طلاب، 3 قاموا بتصوير لجان انتخابات الرئاسة، 4 أشخاص قاموا بالنظاهر في مظاهرات القدس فى ديسمبر 2017 و23 للتظاهر احتجاجًا على ارتفاع أسعار تذاكر المترو فى مايو 2018، بالإضافة لآخرين، لم تتمكن المنظمة من التعرف على طبيعة عملهم والسبب المباشر للقبض عليهم.
يهدف هذا التقرير لفهم طبيعة عمليات القبض الأخيرة، من خلال تسليط الضوء على سبع قضايا قامت نيابة أمن الدولة العليا بالتحقيق فيها وهي بالترتيب الزمني: 977 لسنة 2017، 441، 467، 482 ،621 ،718، 734 لسنة 2018 حصر أمن دولة، ويعمل التقرير على استعراض بيانات خاصة بالمتهمين على ذمة هذه القضايا التي تمكنت الجبهة المصرية من جمعها، والتى تضم عددًا غير قليل من النشطاء والصحفيين والمدافعين عن حقوق الإنسان. بالإضافة لإلقاء النظر على السياق التشريعي المصاحب لعمليات القبض وما صاحبها من انتهاكات أخلت بحقوق المتهمين المكفولة بالدستور والمواثيق الدولية.
According to the indictment, the prosecution charged 34 charges, most of which are distributed between murder, attempted murder, complicity and incitement, between 2014-2015, in six different governorates: Behera, Fayoum, Gharbia, Cairo, Damietta. The murder of 16 people and the killing of 15 others, most likely police officers and members of the armed forces, first and foremost brigadier general Adel Rajai commander of the Ninth Division, as well as the attempt to kill Assistant Attorney General Zakaria Abdel Aziz and Advisor Ahmed Abul Fotouh. finally, an attempt to assassinate the former Mufti of the Republic.
In the first analysis of the indictment, the unwarranted congestion of facts, in one case over a long period of time (two years), the events took place in different geographic locations. Not just that, but the dates of birth of the accused in the case show how young not a few among them.
A large number of accused in the case faced several violations of their rights guaranteed by the amended Constitution 2014, where many of them were subjected to enforced disappearance for long periods in the headquarters of the National Security Service, where they suffered various kinds of physical and moral coercion. In addition, the Public Prosecutor's Office did not allow a large number of accused to use the services of a private lawyer, nor did they transfer a large number of defendants immediately to the Department of forensic medicine after being alleged to have been subjected to torture in order to ascertain the accuracy of their statements. The case also included the lack of investigations and the reliance on anonymous information, in addition to the exposure of a number of children to violations in violation of international conventions and the Egyptian law of the child.
The report was based on an analysis of the violations of the rights of the accused in the case, which were confirmed in the Public Prosecution's investigations, with 130 out of the 243detainees who were interrogated by the State Security Prosecution before being referred to the Military Prosecution, The testimony of a number of relatives of the defendants in the case as well as testimonies of some of the attorneys.
ويمكن القول بأن هذه القضية تعتبر نموذجًا صارخًا على الانتهاكات التي يمكن حدوثها فى قضية واحدة، حيث إحالة عشرات المتهمين فى قضية واحدة إلى القضاء العسكري بعد إخفائهم لفترات طويلة وتعذيبهم والتحقيق معهم بدون محام وتصوير اعترافاتهم ونشرها وتجاهل شكواهم عن أوضاعهم كمحبوسين فى سجن شديد الحراسة 2.
وكانت نيابة شمال القاهرة العسكرية قد أحالت فى الثانى عشر من أكتوبر 2017 عدد 296 متهمًا - 216 منهم محبوسين و 80 هاربين- فى القضية 64 لسنة 2017 والمعروفة إعلاميًا باسم قضية " النائب العام المساعد" أو " قضية حركة حسم " إلى محكمة جنايات شمال القاهرة العسكرية. وكانت النيابة العسكرية قد تسلمت ملف القضية من نيابة أمن الدولة العليا فى شهر مارس 2017 بعد أن كشفت التحقيقات عن سعى التنظيم لاستهداف عدد من المنشآت التابعة للقوات المسلحة والشرطة والسفارات الأجنبية.
وفقًا لقرار الاتهام، وجهت النيابة 34 اتهامًا يتوزع أغلبها بين القتل و الشروع فى قتل والاشتراك بالاتفاق والتحريض، عن وقائع تمت فى الفترة بين العام 2014 -2016 ، فى 6 محافظات مختلفة هم: البحيرة، والفيوم، والغربية، والقاهرة، ودمياط، والجيزة. وتتلخص وقائع القضية فى قتل 16 شخص والشروع فى قتل 15 آخرين أغلبيتهم من ضباط وأفراد الشرطة وعدد من أفراد القوات المسلحة على رأسهم قائد الفرقة التاسعة مدرع العميد عادل رجائى، بالاضافة الى محاولة قتل النائب العام المساعد زكريا عبدالعزيز والمستشار أحمد أبو الفتوح. وأخيرًا محاولة اغتيال على جمعة المفتي السابق للجمهورية.
استند هذا التقرير فى تحليل الانتهاكات التي تعرض لها المتهمين فى القضية على أوراق تحقيقات النيابة العامة مع 130 متهمًا محبوسًا من أصل 243 تم التحقيق معهم من قبل نيابة أمن الدولة قبل إحالتهم للنيابة العسكرية. كما تم الاستناد أيضًا إلى شهادات عدد من أهالى المتهمين والمحامين عن بعض المتهمين فى القضية.
