I have a first degree in quantity surveying from the University of Reading UK, a postgraduate diploma in Accounting and Finance, a Masters degree in Architecture specialising in Building Economics and Management from University College London, and another Masters degree in Construction Law and Arbitration from Kings College London. I am doing my PhD at the University of Auckland, New Zealand.
Professional qualifications
I am a Fellow and Past-President of the Institution of Surveyors Malaysia, Fellow (Chartered Builder) and past Vice-President of the Chartered Institute of Building Malaysia Branch, and Fellow and past Vice-Chairman of the Chartered Institute of Arbitrators Malaysia Branch. I am also a member of the Association for Project Management and the Royal Institution of Chartered Surveyors (Chartered Surveyor). I am a probationer of the New Zealand Institute of Quantity Surveyors and the Australian Institute of Quantity Surveyors. Apart from that I am a member of the Society of Construction Law UK, New Zealand, and Malaysia and an associate of the Commonwealth Association of Legislative Counsel. I am also an Accredited Mediator on the panel of the Construction Industry Development Board Malaysia.
Industry and academic experience
I have over 23 years combined experience as a professional in the construction industry and as an academic. My areas of expertise include construction project management, construction contracts, dispute resolution, modern legal drafting, and quantity surveying.
Within the construction industry, I have been involved as a professional in the areas of construction project management, cost management, quantity surveying, construction contracts consultancy and dispute resolution including arbitration, adjudication, and mediation. I have also acted as expert witness in arbitration and the courts. I have worked in both the United Kingdom and Malaysia. My last two primary industry positions were as director of a couple of international project management and construction contracts consultancies of British origin – the Beard Dove group and more recently the High-Point Rendel group of companies.
The range of types of projects I have been involved in include offices, hotels, banks, apartments and condominiums, housing developments, mixed developments, university campuses, sports complexes (including the National Sports Complex project for the 1998 Kuala Lumpur Commonwealth Games), factories, hospitals, interior fitting out works, refurbishment works, infrastructure projects and some oil and gas sector work.
Within academia I have lectured in New Zealand, the United Kingdom and Malaysia. My main areas of lectures are in construction law, contract administration and practice, dispute resolution, project management, building economics, feasibility and cost planning, and estimating. I am now a Senior Lecturer at Massey University, Albany, Auckland, New Zealand. Earlier I served as Senior Lecturer at Leeds Metropolitan University UK and Adjunct Associate Professor on the Masters course at Technology University of Malaysia. I have also taught on a part time basis at two other universities in Malaysia over a ten-year period.
Other speaking engagements
I have spoken at over 100 conferences and seminars primarily on construction contracts, dispute resolution, and project management in the United Kingdom, Malaysia, Singapore, Brunei, Indonesia, Hong Kong, Japan, Australia, and New Zealand.
Contributions
I highlight here three notable contributions:
1. I served as the President of the Institution of Surveyors Malaysia leading the interest and well-being of society through the professional services of over 4,000 members in the areas of quantity surveying, property consultancy and valuation surveying, land surveying, and building surveying.
2. I drafted the ‘Model Terms of Construction Contract for Subcontract Work’ which was published by the Construction Industry Development Board Malaysia. The unique structure of the contract and the modern plain language drafting style was part of the reason the contract obtained the unprecedented endorsement of 14 construction industry related bodies in Malaysia. 3. I served as chair of the construction industry Working Group on Payment (WG 10), studying and developing the concept proposals for a Malaysian ‘Construction Industry Payment and Adjudication Act’. After seven years of effort the Malaysian government cabinet approved it in principle, but it has yet to be presented as a Bill in Parliament.
Current research interests
My current areas of research interests are:
(i) Adjudication as an alternative dispute resolution method in commonwealth jurisdictions with a focus on adjudication under the New Zealand Construction Contracts Act 2002
(ii) Modern plain language methods of drafting construction contracts and their effectiveness
