Quelle est la portée du droit de manifester? Quelle protection lui est offerte par la Charte canadienne des droits et libertés? Comment ce droit a-t-il interprété par les tribunaux canadiens et européens. Cet article cherche à offrir de l'éclairage sur cet enjeu actuel.
Dans cet essai, j'utilise l’exemple de la lutte pour les droits des femmes en Tunisie pour illust... more Dans cet essai, j'utilise l’exemple de la lutte pour les droits des femmes en Tunisie pour illustrer comment la perception de la culture en tant qu’ennemi des droits des femmes nuit à l’enracinement du discours des droits humains dans certains pays. Lorsqu’étudiée comme un concept fluide et dynamique, la culture devient un champ de transformation normative puissant pour l’avancement des droits humains. Je propose différentes pistes de solution, afin d’amener un changement social au niveau local, dans le respect de l’autonomie et de la culture des différentes communautés.
This essay compares the different institutional mechanisms that have been set up by three major f... more This essay compares the different institutional mechanisms that have been set up by three major federations – Australia, the United States and Canada - to accommodate aboriginal peoples’ claim to self-government in order to draw lessons that will help Canada in moving forward with the recognition and implementation of aboriginal self-government. I will compare those mechanisms through the theoretical lens of federalism, by looking at criteria such as the division of competences among constitutive units, central authority and aboriginal governing institutions, the design of the aboriginal governing structures, the objectives this design is meant to achieve, as well as the participation of aboriginal peoples within central and constitutive institutions. Through this exercise, I hope to identify ways in which the inherent flexibility of federalism will allow to fulfill and respect the right to internal self- determination and self-government of aboriginal peoples.
