EL DERECHO A LA CIUDAD EN LA JURISPRUDENCIA ARGENTINA, 2021
El Derecho a la Ciudad es clasificado un derecho humano emergente por cuanto es una aspiración de... more El Derecho a la Ciudad es clasificado un derecho humano emergente por cuanto es una aspiración de derechos que si bien no ha sido explícitamente recogido en textos jurídicos vinculantes, constituye una respuesta coherente y jurídicamente viable a los retos y necesidades de las sociedades contemporáneas (Saura Estapà, 2010). Particularmente, a nivel nacional, en Argentina no contamos con una legislación que regule al Derecho a la Ciudad expresamente como tal –como sí sucede a nivel provincial con la Ley de Acceso Justo al Hábitat N° 14449 de la provincia de Buenos Aires–, aunque la Constitución y diversos tratados internacionales con fuerza vinculante reconocen los derechos humanos que lo integran. Entonces, en este contexto en dónde se entiende al Derecho a la Ciudad como una respuesta jurídicamente viable a las necesidades de las sociedades contemporáneas, es que consideramos importante investigar si dicho derecho es expresamente reconocido por la jurisprudencia argentina y, en caso afirmativo, analizar el alcance que se le otorga. La identificación, revisión, resumen y el análisis de las resoluciones judiciales que reconocen el Derecho a la Ciudad es de gran utilidad ya que dicha información podrá ser utilizada “por el foro jurídico, el activismo, el estudiantado y la procuración e impartición de justicia, entre otros, para el diseño o promoción de estrategias políticas, jurídicas, sociales, o de cualquier otra índole, que promuevan los derechos humanos” (Suprema Corte de Justicia de la Nación de México y Women´s Link Worldwide, 2014, pág. 10). Para alcanzar el objetivo propuesto la metodología que se utilizó fue un análisis jurídico de tipo crítico. Se efectuó una investigación empírica exhaustiva acudiendo a fuentes directas a partir de la consulta de las causas judiciales a través de la utilización de las palabras claves como ‘Derecho a la Ciudad’ y ‘Ley 14449’ en diversos buscadores judiciales: el Sistema de Consultas Web del Poder Judicial de la Nación, el Sistema Argentino de Información Jurídica (SAIJ) y el Centro de Información Judicial (CIJ). A través de dicha investigación jurídica del tipo hermenéutica se buscó “(…) atribuir significado y contenido –alcance normativo– a la normatividad jurídica, donde alcanza a la jurisprudencia (Zorilla, 2011)” (Agudelo-Giraldo, 2018, pág. 29). Los resultados obtenidos permitieron visibilizar la problemática existente en cuanto al reconocimiento jurisprudencial del Derecho a la Ciudad.
RESUMEN En la presente investigación se indagan los orígenes del derecho a la ciudad y se revisan... more RESUMEN En la presente investigación se indagan los orígenes del derecho a la ciudad y se revisan las acepciones desarrolladas desde su instauración hasta la actualidad para luego poder realizar un análisis jurídico de sus fundamentos y contenido tanto en la normativa internacional como en la nacional (Argentina) para finalmente determinar la naturaleza de este derecho y establecer si es jurídicamente exigible en Argentina. La metodología utilizada es la investigación documental, ya que a partir de la revisión de las fuentes documentales se elaboran reflexiones descriptivas, analíticas y hermenéuticas en relación con el objeto específico de la investigación. Los resultados obtenidos permitieron visibilizar la problemática existente en cuanto a la exigibilidad del derecho a la ciudad, por lo que se procedió a elaborar una solución alternativa para su reclamo judicial en forma individual o colectiva en países, como Argentina, en los cuáles no se encuentra reconocido en instrumentos normativos vinculantes. Dado que su inobservancia podría derivar en una violación a la garantía constitucional de juez natural, a partir del análisis de diversas decisiones judiciales en la temática, nos proponemos responder ciertos interrogantes: la manda del artículo ¿responde realmente a la garantía de juez natural o simplemente a exigencias de orden administrativo? ¿El incumplimiento de alguno de los requisitos establecidos por el artículo 32 acarrea la nulidad del acto?

se lleva a cabo con posterio... more La justicia transicional es un proceso jurídico y administrativo que se lleva a cabo con posterioridad a situaciones de conflicto armado o de regímenes autoritarios, cuando transitan hacia la paz o hacia la democracia, con el propósito de tratar los delitos del régimen previo. Eiroa (2007) sostiene que el nuevo régimen tiene que decidir qué califica como delito y cómo sancionar a los delincuentes. También debe decidir qué califica como delito y cómo sancionar a los delincuentes. En tiempos postraumáticos es posible reconocer diferentes políticas de justicia transicional (Martín 2014; Osiel 2005; Slavin 2012). Entre los casos más estudiados se encuentra el caso argentino — que optó por la persecución penal (excepto el interregno en el que las leyes de punto final y obediencia debida y los indultos se consideraron aplicables) (Dukalskis 2011; Nino 1997) — y el sudafricano —que optó por la amnistía y la búsqueda de la verdad a través la Comisión de la Verdad y la Reconciliación (Minow 1998). En este contexto, Hilb (2013) ha planteado una provocativa tesis que, a partir de la comparación de ambas experiencias, señala una fuerte dicotomía entre el caso argentino y el sudafricano al sostener que es probable que en un caso —el de la Argentina— la resolución haya pagado un precio en Verdad; es probable que en otro caso —el de Sudáfrica— se haya pagado un precio en Justicia. La tesis de la autora tiene entre sus fundamentos la idea de que la verdad a la que puede accederse en el marco de los procesos penales es limitada e impide dar a luz “una verdad más compleja” (Hilb 2014). En contra, Tatián sostiene que “el proceso judicial no impide la verdad, ni la comprensión ni el arrepentimiento”. Además sostiene que no resulta evidente que los militares argentinos hubieran brindado un relato verídico ni que se hubieran arrepentido de sus crímenes de haberse producido un proceso semejante al de Sudáfrica, y ello lo argumenta diciendo “de hecho, cuando las leyes de punto final y obediencia debida se hallaban vigentes, se realizaron juicios por la verdad histórica sin que se obtuviera de ellos nada interesante ni diferente”. Más allá de qué posición se asuma en este debate, existe un elemento que llama la atención cuando se discute la naturaleza y el alcance la verdad en estos procesos. En ambos análisis, o bien se deja de lado a los Juicios por la Verdad (Hilb 2014) o se minimiza (por no decir “descarta”) su importancia (Tatián 2013). Los Juicios por la Verdad impulsados en 1998 en la Argentina, fueron una forma sui generis de procesos penales promovidos por familiares de víctimas del terrorismo de Estado, sobrevivientes y organismos de derechos humanos, que no buscaron la sanción penal de los responsables (lo que no era legalmente posible por entonces), sino que tenían como objetivo, tal como lo sostiene Emilio Crenzel (2014), elaborar una verdad polisémica que simultáneamente colaborara en sancionar lo que no puede ser perdonado y, a la vez, contribuyera a conocer lo que intelectual y políticamente no merece ser ignorado. El desarrollo de estos procesos permitió la recolección de pruebas que sirvieron de sustento para la realización de los juicios que, una vez restablecida la posibilidad del juzgamiento de los responsables de crímenes de lesa humanidad, fueron llevados adelante a lo largo y ancho de todo nuestro país. De igual modo, los Juicios por la Verdad permitieron a la sociedad el conocimiento de la identidad de víctimas y victimarios, el modus operandi, los hechos concretos y las circunstancias en que estos se produjeron, etc.. Para la elaboración del presente trabajo tomaremos el concepto de verdad expuesto por Mattarollo (2010) quien sostiene que es tanto aquella que tiene como objetivo el conocimiento de la verdad individual (la verdad sobre la suerte corrida por cada una de las víctimas) como el conocimiento de la verdad global (que se refiere a las estructuras y mecanismos de represión utilizados y al contexto político, económico y social). Estamos convencidos que el Juicio por la Verdad celebrado en Mar del Plata logró promover iniciativas de búsqueda y reconstrucción de la verdad, así como el establecimiento de políticas de memoria en todo el país. Su importancia no sólo radica en ello, sino también porque se constituyó en una herramienta de gran importancia para el posterior juzgamiento penal de los autores de los crímenes cometidos durante la última dictadura militar (cuando esto fue 'legalmente' posible), y para la reparación de las víctimas. Por todo lo señalado, sostenemos que el análisis de los Juicios por la Verdad es imprescindible porque su conocimiento posibilitará iluminar y estimular futuros estudios comparativos a escala nacional e internacional. Creemos que la verdad y la memoria son elementos esenciales para evitar la repetición de los errores del pasado.
El presente trabajo intentará responder al interrogante: ¿resulta ser equitativa la distribución ... more El presente trabajo intentará responder al interrogante: ¿resulta ser equitativa la distribución de la educación en Argentina? Para ello partimos del presupuesto de que el derecho a la educación integra con otros derechos el derecho a la ciudad. El derecho a la ciudad es un derecho humano emergente que conlleva aparejada la idea de un derecho colectivo cuyo eje resulta ser el respeto de los derechos humanos en todos los ámbitos-político, social, económico y medioambiental-y que aspira entre otras cosas a una ciudadanía democrática, liberadora, igualitaria, inclusiva, creadora de nuevos derechos y transformadora. En este contexto es que consideramos que contestar el interrogante "¿resulta ser equitativa la distribución de la educación en Argentina?", resulta esencial para establecer si existe una violación al derecho a la ciudad.

“un conjunto de facultades e instituciones que, en cada momento históri... more Los derechos humanos son “un conjunto de facultades e instituciones que, en cada momento histórico, concretan las exigencias de la dignidad, la libertad y la igualdad humanas, las cuales deben ser reconocidas positivamente por los ordenamientos jurídicos a nivel nacional e internacional” (Pérez Luño, 2005). En este contexto, el derecho a la educación es considerado un derecho humano fundamental, toda vez que el mismo resulta esencial para poder ejercitar todos los demás derechos. El artículo 75 inciso 19 de la Constitución Nacional Argentina, aprobado en la Convención Nacional Constituyente de 1994, establece que: “Corresponde al Congreso: (…) Sancionar leyes de organización y de base de la educación (…) que garanticen los principios de gratuidad y equidad de la educación pública estatal y la autonomía y autarquía de las universidades nacionales (…)” (Constitución Nacional Argentina, 1853). Ahora bien, el texto de la constitución no menciona los niveles de la educación que deben garantizar los principios de gratuidad y equidad, refiriéndose solo de manera generalizada a la “educación pública estatal”. Ante ello, y con respecto a los postgrados, surgieron distintas interpretaciones. Por su parte, la CONEAU entiende que “el posgrado es para las instituciones una posibilidad de generar recursos, particularmente importante en las universidades nacionales en las que las carreras de este nivel están fuera de la difundida gratuidad de los estudios, lo que permite la captación de fondos adicionales tanto para las instituciones como para los profesores” (CONEAU, 2002). Aquellos que siguen la postura adoptada por la CONEAU se basan en el inciso c) del artículo 59 de La Ley de Educación Superior Nº 24.521, que establece que las universidades: “ (…) c) Podrán dictar normas relativas a la generación de recursos adicionales a los aportes del Tesoro nacional, mediante la venta de bienes, productos, derechos o servicios, subsidios, contribuciones, herencias, derechos o tasas por los servicios que presten, así como todo otro recurso que pudiera corresponderles por cualquier título o actividad (…)” (Ley Nº 24.521 de Educación Superior, 1995) En esta línea podemos mencionar a de De la Fare y Lenz, quienes interpretan que “A diferencia del criterio de gratuidad que rige la formación de grado en las universidades de gestión estatal, el posgrado es arancelado y está comprendido dentro de la venta de servicios” (de la Fare, M. y Lenz, S., 2010). La temática ha sido de escaso tratamiento por parte de la doctrina. Cardozo ha problematizado sobre ello al preguntarse “¿Existe el derecho a la educación superior universitaria en el caso de los posgrados? ¿Cuál es el rol que el Estado debe tener en estos casos?” (Cardozo, G. 2013). Sin embargo, ellas fueron sólo preguntas planteadas sin desarrollo alguno. Por su parte, Etchichury ha hecho referencia al arancelamiento de los posgrados, explicando las posibles causas del mismo al decir que: “El art. 75 inc. 19 de la Constitución fija una gratuidad de extensión general (…) En general, suelen aducirse dos líneas para defender el cobro de aranceles en el nivel de posgrado. La primera enfatiza la necesidad de financiarlo con esas tasas, de obtener los recursos adicionales a través de esa vía (…) Esta falacia naturalista no resulta aceptable en la argumentación jurídica. El acto de incumplir no sirve para justificar el incumplimiento mismo. (…) La segunda línea argumental, en cambio, intenta reunir una base moral y anclarse en el principio de equidad. El planteo puede reconstruirse como sigue. El posgrado, en general, representa un beneficio simbólico y económico para quien lo cursa. Por lo tanto, no puede exigirse a toda la comunidad que lo financie a través del presupuesto. Además, muchas personas cursantes de posgrado provienen de los sectores de mayores ingresos. En conclusión, un beneficio individual para gente de clase media y alta debe ser costeado por quien lo disfruta. Así, quienes defienden el posgrado arancelado buscan dejar de lado los principios de gratuidad y progresividad. (…) No es el título de doctor lo que debe gravarse, sino las riquezas concretas obtenidas por cada profesional (…) el arancelamiento del posgrado (y, en menor medida, del nivel previo) resulta inconstitucional, aunque muy extendido. La aceptación de esta modalidad de financiamiento se ha generalizado, aunque sin dar cuenta de cómo dejar de lado (o reinterpretar) el mandato constitucional de gratuidad” (Etchichury, H. J., 2010). Es a partir de lo expuesto que nos proponemos establecer los alcances de los principios de equidad y gratuidad en la educación argentina a partir del análisis de: la regulación legal, el debate constituyente y la jurisprudencia de la Corte Suprema de Justicia de la Nación.

El desarrollo de estos procesos permitió la recolección de pruebas que sirvieron de sustento para la realización de los juicios que, una vez restablecida la posibilidad del juzgamiento de los responsables de crímenes de lesa humanidad, fueron llevados adelante a lo largo y ancho de todo nuestro país. De igual modo, los Juicios por la Verdad permitieron a la sociedad el conocimiento de la identidad de víctimas y victimarios, el modus operandi, los hechos concretos y las circunstancias en que estos se produjeron, etc.. Para la elaboración del presente trabajo tomaremos el concepto de verdad expuesto por Mattarollo (2010) quien sostiene que es tanto aquella que tiene como objetivo el conocimiento de la verdad individual (la verdad sobre la suerte corrida por cada una de las víctimas) como el conocimiento de la verdad global (que se refiere a las estructuras y mecanismos de represión utilizados y al contexto político, económico y social). Estamos convencidos que el Juicio por la Verdad celebrado en Mar del Plata logró promover iniciativas de búsqueda y reconstrucción de la verdad, así como el establecimiento de políticas de memoria en todo el país. Su importancia no sólo radica en ello, sino también porque se constituyó en una herramienta de gran importancia para el posterior juzgamiento penal de los autores de los crímenes cometidos durante la última dictadura militar (cuando esto fue 'legalmente' posible), y para la reparación de las víctimas. Por todo lo señalado, sostenemos que el análisis de los Juicios por la Verdad es imprescindible porque su conocimiento posibilitará iluminar y estimular futuros estudios comparativos a escala nacional e internacional. Creemos que la verdad y la memoria son elementos esenciales para evitar la repetición de los errores del pasado.
El presente trabajo intentará responder al interrogante: ¿resulta ser equitativa la distribución ... more El presente trabajo intentará responder al interrogante: ¿resulta ser equitativa la distribución de la educación en Argentina? Para ello partimos del presupuesto de que el derecho a la educación integra con otros derechos el derecho a la ciudad. El derecho a la ciudad es un derecho humano emergente que conlleva aparejada la idea de un derecho colectivo cuyo eje resulta ser el respeto de los derechos humanos en todos los ámbitos-político, social, económico y medioambiental-y que aspira entre otras cosas a una ciudadanía democrática, liberadora, igualitaria, inclusiva, creadora de nuevos derechos y transformadora. En este contexto es que consideramos que contestar el interrogante "¿resulta ser equitativa la distribución de la educación en Argentina?", resulta esencial para establecer si existe una violación al derecho a la ciudad.

“un conjunto de facultades e instituciones que, en cada momento históri... more Los derechos humanos son “un conjunto de facultades e instituciones que, en cada momento histórico, concretan las exigencias de la dignidad, la libertad y la igualdad humanas, las cuales deben ser reconocidas positivamente por los ordenamientos jurídicos a nivel nacional e internacional” (Pérez Luño, 2005). En este contexto, el derecho a la educación es considerado un derecho humano fundamental, toda vez que el mismo resulta esencial para poder ejercitar todos los demás derechos. El artículo 75 inciso 19 de la Constitución Nacional Argentina, aprobado en la Convención Nacional Constituyente de 1994, establece que: “Corresponde al Congreso: (…) Sancionar leyes de organización y de base de la educación (…) que garanticen los principios de gratuidad y equidad de la educación pública estatal y la autonomía y autarquía de las universidades nacionales (…)” (Constitución Nacional Argentina, 1853). Ahora bien, el texto de la constitución no menciona los niveles de la educación que deben garantizar los principios de gratuidad y equidad, refiriéndose solo de manera generalizada a la “educación pública estatal”. Ante ello, y con respecto a los postgrados, surgieron distintas interpretaciones. Por su parte, la CONEAU entiende que “el posgrado es para las instituciones una posibilidad de generar recursos, particularmente importante en las universidades nacionales en las que las carreras de este nivel están fuera de la difundida gratuidad de los estudios, lo que permite la captación de fondos adicionales tanto para las instituciones como para los profesores” (CONEAU, 2002). Aquellos que siguen la postura adoptada por la CONEAU se basan en el inciso c) del artículo 59 de La Ley de Educación Superior Nº 24.521, que establece que las universidades: “ (…) c) Podrán dictar normas relativas a la generación de recursos adicionales a los aportes del Tesoro nacional, mediante la venta de bienes, productos, derechos o servicios, subsidios, contribuciones, herencias, derechos o tasas por los servicios que presten, así como todo otro recurso que pudiera corresponderles por cualquier título o actividad (…)” (Ley Nº 24.521 de Educación Superior, 1995) En esta línea podemos mencionar a de De la Fare y Lenz, quienes interpretan que “A diferencia del criterio de gratuidad que rige la formación de grado en las universidades de gestión estatal, el posgrado es arancelado y está comprendido dentro de la venta de servicios” (de la Fare, M. y Lenz, S., 2010). La temática ha sido de escaso tratamiento por parte de la doctrina. Cardozo ha problematizado sobre ello al preguntarse “¿Existe el derecho a la educación superior universitaria en el caso de los posgrados? ¿Cuál es el rol que el Estado debe tener en estos casos?” (Cardozo, G. 2013). Sin embargo, ellas fueron sólo preguntas planteadas sin desarrollo alguno. Por su parte, Etchichury ha hecho referencia al arancelamiento de los posgrados, explicando las posibles causas del mismo al decir que: “El art. 75 inc. 19 de la Constitución fija una gratuidad de extensión general (…) En general, suelen aducirse dos líneas para defender el cobro de aranceles en el nivel de posgrado. La primera enfatiza la necesidad de financiarlo con esas tasas, de obtener los recursos adicionales a través de esa vía (…) Esta falacia naturalista no resulta aceptable en la argumentación jurídica. El acto de incumplir no sirve para justificar el incumplimiento mismo. (…) La segunda línea argumental, en cambio, intenta reunir una base moral y anclarse en el principio de equidad. El planteo puede reconstruirse como sigue. El posgrado, en general, representa un beneficio simbólico y económico para quien lo cursa. Por lo tanto, no puede exigirse a toda la comunidad que lo financie a través del presupuesto. Además, muchas personas cursantes de posgrado provienen de los sectores de mayores ingresos. En conclusión, un beneficio individual para gente de clase media y alta debe ser costeado por quien lo disfruta. Así, quienes defienden el posgrado arancelado buscan dejar de lado los principios de gratuidad y progresividad. (…) No es el título de doctor lo que debe gravarse, sino las riquezas concretas obtenidas por cada profesional (…) el arancelamiento del posgrado (y, en menor medida, del nivel previo) resulta inconstitucional, aunque muy extendido. La aceptación de esta modalidad de financiamiento se ha generalizado, aunque sin dar cuenta de cómo dejar de lado (o reinterpretar) el mandato constitucional de gratuidad” (Etchichury, H. J., 2010). Es a partir de lo expuesto que nos proponemos establecer los alcances de los principios de equidad y gratuidad en la educación argentina a partir del análisis de: la regulación legal, el debate constituyente y la jurisprudencia de la Corte Suprema de Justicia de la Nación.

Particularmente, a nivel nacional, en Argentina no contamos con una legislación que regule al Derecho a la Ciudad expresamente como tal –como sí sucede a nivel provincial con la Ley de Acceso Justo al Hábitat N° 14449 de la provincia de Buenos Aires–, aunque la Constitución y diversos tratados internacionales con fuerza vinculante reconocen los derechos humanos que lo integran.
Entonces, en este contexto en dónde se entiende al Derecho a la Ciudad como una respuesta jurídicamente viable a las necesidades de las sociedades contemporáneas, es que consideramos importante investigar si dicho derecho es expresamente reconocido por la jurisprudencia argentina y, en caso afirmativo, analizar el alcance que se le otorga.
La identificación, revisión, resumen y el análisis de las resoluciones judiciales que reconocen el Derecho a la Ciudad es de gran utilidad ya que dicha información podrá ser utilizada “por el foro jurídico, el activismo, el estudiantado y la procuración e impartición de justicia, entre otros, para el diseño o promoción de estrategias políticas, jurídicas, sociales, o de cualquier otra índole, que promuevan los derechos humanos” (Suprema Corte de Justicia de la Nación de México y Women´s Link Worldwide, 2014, pág. 10).
Para alcanzar el objetivo propuesto la metodología que se utilizó fue un análisis jurídico de tipo crítico. Se efectuó una investigación empírica exhaustiva acudiendo a fuentes directas a partir de la consulta de las causas judiciales a través de la utilización de las palabras claves como ‘Derecho a la Ciudad’ y ‘Ley 14449’ en diversos buscadores judiciales: el Sistema de Consultas Web del Poder Judicial de la Nación, el Sistema Argentino de Información Jurídica (SAIJ) y el Centro de Información Judicial (CIJ).
A través de dicha investigación jurídica del tipo hermenéutica se buscó “(…) atribuir significado y contenido –alcance normativo– a la normatividad jurídica, donde alcanza a la jurisprudencia (Zorilla, 2011)” (Agudelo-Giraldo, 2018, pág. 29).
Los resultados obtenidos permitieron visibilizar la problemática existente en cuanto al reconocimiento jurisprudencial del Derecho a la Ciudad.
se lleva a cabo con posterioridad a situaciones de conflicto armado o de regímenes autoritarios, cuando transitan hacia la paz o hacia la democracia, con el propósito de tratar los delitos del régimen previo. Eiroa (2007) sostiene que el nuevo régimen tiene que decidir qué califica como delito y cómo sancionar a los delincuentes. También debe decidir qué califica como delito y cómo sancionar a los delincuentes.
En tiempos postraumáticos es posible reconocer diferentes políticas de justicia transicional (Martín 2014; Osiel 2005; Slavin 2012). Entre los casos más estudiados se encuentra el caso argentino — que optó por la persecución penal (excepto el interregno en el que las leyes de punto final y obediencia debida y los indultos se consideraron aplicables) (Dukalskis 2011; Nino 1997) — y el sudafricano —que optó por la amnistía y la búsqueda de la verdad a través la Comisión de la Verdad y la Reconciliación (Minow 1998).
En este contexto, Hilb (2013) ha planteado una provocativa tesis que, a partir de la comparación de ambas experiencias, señala una fuerte dicotomía entre el caso argentino y el sudafricano al sostener que es probable que en un caso —el de la Argentina— la resolución haya pagado un precio en Verdad; es probable que en otro caso —el de Sudáfrica— se haya pagado un precio en Justicia.
La tesis de la autora tiene entre sus fundamentos la idea de que la verdad a la que puede accederse en el marco de los procesos penales es limitada e impide dar a luz “una verdad más compleja” (Hilb 2014). En contra, Tatián sostiene que “el proceso judicial no impide la verdad, ni la comprensión ni el arrepentimiento”. Además sostiene que no resulta evidente que los militares argentinos hubieran brindado un relato verídico ni que se hubieran arrepentido de sus crímenes de haberse producido un proceso semejante al de Sudáfrica, y ello lo argumenta diciendo “de hecho, cuando las leyes de punto final y obediencia debida se hallaban vigentes, se realizaron juicios por la verdad histórica sin que se obtuviera de ellos nada interesante ni diferente”. Más allá de qué posición se asuma en este debate, existe un elemento que llama la atención cuando se discute la naturaleza y el alcance la verdad en estos procesos. En ambos análisis, o bien se deja de lado a los Juicios por la Verdad (Hilb 2014) o se minimiza (por no decir “descarta”) su importancia (Tatián 2013).
Los Juicios por la Verdad impulsados en 1998 en la Argentina, fueron una forma sui generis de procesos penales promovidos por familiares de víctimas del terrorismo de Estado, sobrevivientes y organismos de derechos humanos, que no buscaron la sanción penal de los responsables (lo que no era legalmente posible por entonces), sino que tenían como objetivo, tal como lo sostiene Emilio Crenzel (2014), elaborar una verdad polisémica que simultáneamente colaborara en sancionar lo que no puede ser perdonado y, a la vez, contribuyera a conocer lo que intelectual y políticamente no merece ser ignorado.

Para la elaboración del presente trabajo tomaremos el concepto de verdad expuesto por Mattarollo (2010) quien sostiene que es tanto aquella que tiene como objetivo el conocimiento de la verdad individual (la verdad sobre la suerte corrida por cada una de las víctimas) como el conocimiento de la verdad global (que se refiere a las estructuras y mecanismos de represión utilizados y al contexto político, económico y social).
Estamos convencidos que el Juicio por la Verdad celebrado en Mar del Plata logró promover iniciativas de búsqueda y reconstrucción de la verdad, así como el establecimiento de políticas de memoria en todo el país. Su importancia no sólo radica en ello, sino también porque se constituyó en una herramienta de gran importancia para el posterior juzgamiento penal de los autores de los crímenes cometidos durante la última dictadura militar (cuando esto fue 'legalmente' posible), y para la reparación de las víctimas.
Por todo lo señalado, sostenemos que el análisis de los Juicios por la Verdad es imprescindible porque su conocimiento posibilitará iluminar y estimular futuros estudios comparativos a escala nacional e internacional.
Creemos que la verdad y la memoria son elementos esenciales para evitar la repetición de los errores del pasado.
“un conjunto de facultades e instituciones que, en cada momento histórico, concretan las exigencias de la dignidad, la libertad y la igualdad humanas, las cuales deben ser reconocidas positivamente por los ordenamientos jurídicos a nivel nacional e internacional” (Pérez Luño, 2005).
En este contexto, el derecho a la educación es considerado un derecho humano fundamental, toda vez que el mismo resulta esencial para poder ejercitar todos los demás derechos.
El artículo 75 inciso 19 de la Constitución Nacional Argentina, aprobado en la Convención Nacional Constituyente de 1994, establece que:
“Corresponde al Congreso: (…) Sancionar leyes de organización y de base de la educación (…) que garanticen los principios de gratuidad y equidad de la educación pública estatal y la autonomía y autarquía de las universidades nacionales (…)” (Constitución Nacional Argentina, 1853).
Ahora bien, el texto de la constitución no menciona los niveles de la educación que deben garantizar los principios de gratuidad y equidad, refiriéndose solo de manera generalizada a la “educación pública estatal”. Ante ello, y con respecto a los postgrados, surgieron distintas interpretaciones.
Por su parte, la CONEAU entiende que
“el posgrado es para las instituciones una posibilidad de generar recursos, particularmente importante en las universidades nacionales en las que las carreras de este nivel están fuera de la difundida gratuidad de los estudios, lo que permite la captación de fondos adicionales tanto para las instituciones como para los profesores” (CONEAU, 2002).
Aquellos que siguen la postura adoptada por la CONEAU se basan en el inciso c) del artículo 59 de La Ley de Educación Superior Nº 24.521, que establece que las universidades:
“ (…) c) Podrán dictar normas relativas a la generación de recursos adicionales a los aportes del Tesoro nacional, mediante la venta de bienes, productos, derechos o servicios, subsidios, contribuciones, herencias, derechos o tasas por los servicios que presten, así como todo otro recurso que pudiera corresponderles por cualquier título o actividad (…)” (Ley Nº 24.521 de Educación Superior, 1995)
En esta línea podemos mencionar a de De la Fare y Lenz, quienes interpretan que “A diferencia del criterio de gratuidad que rige la formación de grado en las universidades de gestión estatal, el posgrado es arancelado y está comprendido dentro de la venta de servicios” (de la Fare, M. y Lenz, S., 2010).
La temática ha sido de escaso tratamiento por parte de la doctrina. Cardozo ha problematizado sobre ello al preguntarse “¿Existe el derecho a la educación superior universitaria en el caso de los posgrados? ¿Cuál es el rol que el Estado debe tener en estos casos?” (Cardozo, G. 2013). Sin embargo, ellas fueron sólo preguntas planteadas sin desarrollo alguno.
Por su parte, Etchichury ha hecho referencia al arancelamiento de los posgrados, explicando las posibles causas del mismo al decir que:
“El art. 75 inc. 19 de la Constitución fija una gratuidad de extensión general (…) En general, suelen aducirse dos líneas para defender el cobro de aranceles en el nivel de posgrado. La primera enfatiza la necesidad de financiarlo con esas tasas, de obtener los recursos adicionales a través de esa vía (…) Esta falacia naturalista no resulta aceptable en la argumentación jurídica. El acto de incumplir no sirve para justificar el incumplimiento mismo. (…) La segunda línea argumental, en cambio, intenta reunir una base moral y anclarse en el principio de equidad. El planteo puede reconstruirse como sigue. El posgrado, en general, representa un beneficio simbólico y económico para quien lo cursa. Por lo tanto, no puede exigirse a toda la comunidad que lo financie a través del presupuesto. Además, muchas personas cursantes de posgrado provienen de los sectores de mayores ingresos. En conclusión, un beneficio individual para gente de clase media y alta debe ser costeado por quien lo disfruta. Así, quienes defienden el posgrado arancelado buscan dejar de lado los principios de gratuidad y progresividad. (…) No es el título de doctor lo que debe gravarse, sino las riquezas concretas obtenidas por cada profesional (…) el arancelamiento del posgrado (y, en menor medida, del nivel previo) resulta inconstitucional, aunque muy extendido. La aceptación de esta modalidad de financiamiento se ha generalizado, aunque sin dar cuenta de cómo dejar de lado (o reinterpretar) el mandato constitucional de gratuidad” (Etchichury, H. J., 2010).
Es a partir de lo expuesto que nos proponemos establecer los alcances de los principios de equidad y gratuidad en la educación argentina a partir del análisis de: la regulación legal, el debate constituyente y la jurisprudencia de la Corte Suprema de Justicia de la Nación.
