Un derecho fundamental de los usuarios de aplicaciones informáticas es que puedan conocer las pol... more Un derecho fundamental de los usuarios de aplicaciones informáticas es que puedan conocer las políticas de privacidad (PP) que tales aplicaciones establecen, en particular es relevante que conozcan acerca del tratamiento que aceptan sobre el uso de sus datos. No obstante, estas PP son muy extensas y escritas en un lenguaje administrativo-jurídico y comercial, lo que dificulta su lectura y comprensión. El objetivo de este artículo es resumir automatizadamente las PP de cinco aplicaciones de redes sociales (Facebook, Twitter, TikTok, Snapchat e Instagram) en español, a través de técnicas extractivas y abstractivas. Para ello se utilizan tres aproximaciones de representación desde el Procesamiento de Lenguaje Natural, estas son: Teoría de Grafos, TF-IDF y Gensim. This unique collection includes approximately 1,000 constitutional documents, human rights declarations and drafts of constitutions collected from archives and libraries from around the world by the German Research Foundation.

This article reviews the exercise of legislative power delegated from the 1833 Constitution to th... more This article reviews the exercise of legislative power delegated from the 1833 Constitution to the present. In the XIX century its use responds to broad authorizations from Congress, which include Congressional Legislative Power. In the XX century, rules of legislative force and effect were born as practice praeter constitutionem in 1927 and continue to operate as broad authorizations to regulate with the status of law and not as precise mandate. Its main initial use between 1927 and 1932 (control of public expenditure and reorganization of the public administration) is maintained throughout the past century. Its incorporation to the Constitution in 1970 and then to that of 1980, tries to reinforce its commission character. However, in practice, the delegation continues to function as an authorization to regulate matters of administrative organization with legislative force and effect.
This article reviews the birth of the legislative delegation in Chile in a constitutional regime ... more This article reviews the birth of the legislative delegation in Chile in a constitutional regime that rejected their inclusion in the fundamental law. The delegation of legislative power to the President of the Republic arises in the context of the implementation of a presidentialism and strong social problems. It is also inserted in the purpose of reorganizing the budget rules. The analysis of the delegatory laws (1927-1932) reveals the parliamentary will to authorize the use of legislative power by the President for the execution of his political program in areas that are –real or apparently– reserved to the law. Notwithstanding a couple of exceptions, Congress does not mandate the President with the regulation of a speci c area or subject. Therefore, it can be concluded that, in its origin, more than a delegation of legislative power there is a broad authorization to use the legislative power in matters of interest to the government of President Ibáñez.

The work shows that the emergency powers that formed the basis to issue legislative decrees, were used only circumstantially for that end. Behind legislative decrees issued during the period there is no shared diagnosis about a problem in the ordinary legislative process. Therefore, birth of legislative decrees does not answer to a rational solution to a need identified by the political class.In 1874 these emergency powers were replaced by a restrictive regime of limitation of rights.

From the traditional doctrine about the weakness of presidentialism as the basis of a democratic ... more From the traditional doctrine about the weakness of presidentialism as the basis of a democratic regime this paper presents a possible way to understand where a presidentia-lism exhibits a reasonably functioning as a democracy. A case study focused on the co-legislative powers granted to the President in Chile reveals that his constitutional powers not generate a unique decision-making power on the priority to have the various bills of interest to be discussed and voted on Congress. The rules and conventions in parliamentary procedural generate a favorable bargaining power to congressmen and thus force the President to build consensus. In these terms, the paper attempts to clarify the relative position of President and Congress in the agenda setting process.

Equality of votes is one of the grounds for democratic constitutionalism. This equality can be al... more Equality of votes is one of the grounds for democratic constitutionalism. This equality can be altered due to a bad configuration of the electoral territories for congressmen elections. In the case of Chile, the legislation uses the commune as territorial unit; this, together with other political decisions, has generated differences that allow having six times the effective value of the vote. This lecture will examine the current situation of the Chilean electoral system in relation to this matter and the compared experiences in order to give some ideas that may reduce inequality in voting without affecting other contents of the regulation in force.
