This article argues that, rather than representing isolated initiatives, these proposals have a deeper objective of restructuring labour systems rather than simply deregulating them. Based on historical analysis, labour sociology, and political economy, the article examines how neoliberal governments, through specific labour reforms, aim to reconfigure the labour-capital conflict. The article analyses changes in labour legislation during neoliberal cycles in Argentina, from the initial phase of 1976-2001 to the current government of Milei. To highlight the foundational nature of these reforms, the article introduces the concept of “neoliberal labour law,” contrasting it with the labour law that prevailed in the post-war period from the 1940s to the 1970s. While the article mainly focuses on the Argentine case, its findings have broader implications for global discussions on labour law, making thee key contributions. First, it challenges predominant understandings of labour law only as that of its expansion period (1940-1970) and, instead, highlights its different trajectories and tempoalities. Second, it underscores the centrality of neoliberalism as a political, economic, and legal project in shaping social order and, specifically, the labour-capital conflict. Finally, it presents the current right-wing populist shift as a continuation rather than merely a break with the previous neoliberal phase.

However, the debate primarily follows a naturalistic approach, heavily reliant on an orthodox account of human rights as universal moral claims for all individuals. This article challenges this approach, arguing that it frames the debate in an antagonistic and compartmentalized manner, where the two legal domains are seen as distinct and homogeneous. By adopting a political approach, the article proposes framing the interactions between these legal realms through the notion of legal-conflict constellations, wherein labour-capital conflicts manifest as specific social problems that may be addressed, wholly or partially, through rights discourse. The article makes three key contributions. First, it situates the debate within the broader context of the reshaping of labour law under neoliberalism. Second, it sheds light on the prevailing naturalistic approach and its shortcomings. Third, it proposes a political approach to the debate, advancing a framework to explore the intricate links between these legal fields.

While traditionally labour law scholarship has been skeptical of courts´ ability to protect labour rights, recent years have witnessed a return to examining constitutions and the role of courts in the field. The article introduces the concept of “Transformative Labour Law in Latin America,” which seeks to reintroduce the struggles between labour and capital into a legal discourse that can address the challenges faced by labour regulation in the region. By employing a methodology that combines constitutional theory and socio-legal literature, the article highlights the productive interactions between social processes and legal provisions. The article is organized into five sections, beginning with an introduction that provides context for the study (I). Subsequent sections examine key features characterizing Latin American labour markets and identify challenges facing labour law (II), introduce transformative constitutionalism in Latin America as a conceptual framework for analyzing labour-capital relations through the law (III), and outline the key components of transformative labour law in the region (IV) before concluding with final remarks (V).

À cette occasion, la juridiction internationale régionale a déclaré pour la première fois la justiciabilité directe et autonome du droit de grève. Il s’agit d’une étape importante non seulement pour le système interaméricain des droits de l’homme, mais aussi compte tenu des discussions sur le sujet au sein de l’OIT et d’autres systèmes régionaux des droits de l’homme. Dans cet article, nous rappelons le contexte dans lequel cette décision a été adoptée, puis nous examinons le raisonnement de la CIDH, ainsi que les points de désaccord entre les juges. Enfin, nous tirons quelques conclusions générales concernant l’impact éventuel de cette décision.
Una de las intervenciones más importantes de la Corte Suprema de Justicia de Argentina en materia... more Una de las intervenciones más importantes de la Corte Suprema de Justicia de Argentina en materia laboral en el período 2003-2014 se produjo en casos de igualdad y no discriminación en el trabajo. Estas sentencias reconocieron una protección robusta a los derechos fundamentales en las relaciones entre privados (específicamente, laborales) y establecieron estándares claros para su aplicación en sentencias posteriores. Sin embargo, a partir de los cambios en la composición de la Corte que comenzaron en 2014 y se consolidaron en 2016, se sucedieron una serie de pronunciamientos que atentan contra la construcción jurisprudencial proteccionista de la etapa anterior. El objetivo general de este trabajo es analizar estas sentencias, identificando líneas de continuidad y ruptura entre ambos períodos. Se desarrollan dos tesis principales: i) A partir de 2014 la Corte Suprema modificó su jurisprudencia sobre igualdad y no discriminación en las relaciones laborales en cruce con la libertad sindical, dando paso a un giro restrictivo en la materia; ii) En estos nuevos pronunciamientos, la argumentación del máximo tribunal no resulta suficiente para desarmar la arquitectura en clave protectoria construida en la etapa anterior. Para desarrollar ambos argumentos nos servimos del análisis documental, de modo de revisitar el debate teórico y los pronunciamientos jurisprudenciales de la época reseñada.
Objetivo: Este artículo aborda las discusiones en torno a la reformulación del derecho del trabaj... more Objetivo: Este artículo aborda las discusiones en torno a la reformulación del derecho del trabajo desde una perspectiva particular: la necesidad de establecer una articulación feminista-sindical. Metodología: Nos servimos del análisis documental para reconstruir los debates teóricos acerca de la refundación del derecho laboral, que se vienen desarrollando desde hace tres décadas y su revigorización en el marco del lugar que ocupó la disciplina en las respuestas a la crisis sociolaboral desatada por la pandemia de COVID-19. Resultados y discusión: Nuestro argumento principal sostiene que para repensar el derecho del trabajo es imprescindible posicionarse desde una mirada histórica, que recupere la razón de ser de esta porción del ordenamiento jurídico-laboral. A partir de esa localización, tomamos las críticas feministas para problematizar dos ejes fundantes del derecho colectivo del trabajo: la noción de "interés colectivo" y la huelga. Aporte: La conclusión general del artículo señala la importancia de retomar los presupuestos de origen del derecho del trabajo (conflicto social, acción colectiva y respuesta institucional) para ensayar posibles reconfiguraciones de la disciplina en la actualidad. En ese sentido, sostenemos que un derecho del trabajo de/para el siglo XXI, que pretenda mantener y expandir los horizontes tuitivos, debe partir de una alianza constitutiva feminista-sindical.

Este trabajo rastrea la utilización que de las normas de la Organización Internacional del Trabaj... more Este trabajo rastrea la utilización que de las normas de la Organización Internacional del Trabajo (OIT) y de las decisiones de sus órganos de control realizó la Corte Suprema de Justicia de Argentina (csjn) a la hora de resolver casos sobre derecho laboral. La tesis del trabajo sostiene que la aplicación de la normativa internacional permitió, por un lado, sofisticar la argumentación jurídica de las sentencias a través del establecimiento de vasos comunicantes entre el derecho internacional y el derecho interno; por otro lado, brindar una protección más robusta a los derechos laborales. Para ello, desarrollamos un análisis cruzado de la argumentación desplegada por la csjn en tres pronunciamientos nodales en materia de protección a derechos laborales fundamentales, en el período 2003-2014: (1) libertad sindical, (2) igualdad y no discriminación y (3) derechos de las mujeres. Finalizamos el trabajo resaltando tres estándares hermenéuticos que se desprenden de las sentencias a la hora de abordar la adjudicación judicial de derechos laborales. Asimismo, ponemos de resalto los hilos de continui-dad de las sentencias en los años posteriores e identificamos algunos interrogantes no resueltos por el tribunal.

Este artículo analiza una medida que fue adoptada en Argentina en forma previa a la pandemia de C... more Este artículo analiza una medida que fue adoptada en Argentina en forma previa a la pandemia de COVID-19, pero que adquirió nuevas luces a partir de ella: el establecimiento de la duplicación indemnizatoria mediante DNU 34/2019 y posteriores prórrogas y modificaciones. El recorrido comienza con una somera reconstrucción de la discusión teórica de fondo (II); luego, realiza un mapeo de los antecedentes de esta medida y el contexto en el que se adoptó (III); posteriormente, aborda el desarrollo normativo y sus especificidades (IV); para, por último, plantear algunos interrogantes suscitados a partir del impacto de esta medida en el escenario sociolaboral en Argentina (V). Las conclusiones trazan reflexiones finales y bosquejan algunos ejes de discusión a futuro.

La primera sección revisa las discusiones sobre el reconocimiento del derecho de huelga en el ámbito de la OIT. La segunda sección aborda el desarrollo de la Corte IDH en la materia a través de la Opinión Consultiva OC-27/21 y la sentencia recaída en el caso “Extrabajadores del Organismo Judicial vs. Guatemala”, al tiempo que enfatiza las potencialidades y señala algunos nudos críticos en la argumentación del tribunal regional. A la luz de estos hallazgos, la tercera sección demuestra que asistimos a un proceso de creciente interamericanización del derecho de huelga. Las conclusiones ponen de resalto algunos desafíos futuros y recuperan la importancia de estos avances para la consolidación de un Ius Constitutionale Commune respecto de los derechos laborales en América Latina y el Caribe.
El artículo examina los principios rectores del Derecho Laboral, que en general sólo brindan prot... more El artículo examina los principios rectores del Derecho Laboral, que en general sólo brindan protección a personas individuales sin considerar responsabilidades de cuidado hacia terceras personas, ni situaciones de desigualdad estructural o violencias cotidianas, con el objetivo de proponer una nueva lectura de los principios fundamentales del Derecho del Trabajo, buscando dar contenido al principio de igualdad y salvando las actuales distancias entre igualdad formal y material. A su vez, analiza las obligaciones estatales en materia laboral, particularmente referidas a derechos sindicales, desde una perspectiva de género y en base al caso argentino. En primer lugar (i) se presentan algunas reflexiones para contextualizar las relaciones de género en el mundo del trabajo, con especial énfasis en Argentina, para luego abordar (ii) las obligaciones de los Estados en materia de control e inspección de las relaciones laborales, (iii) el cuidado como un obstáculo para la participación plena de las mujeres en el trabajo, (iv) las acciones positivas y su compatibilización con la autonomía sindical, (v) y las formas de abordaje de las violencias en el trabajo. Aunque derogada por el gobierno de facto de 1955, la reforma de 1949 representa un hito fundamental de la historia constitucional argentina que, a más de 70 años, sigue presentando numerosos interrogantes. Uno de ellos es la pregunta acerca del rol de las mujeres y el reconocimiento de sus derechos en este proceso. Este trabajo indaga en las peticiones que los colectivos de mujeres hicieron llegar a la asamblea constituyente de 1949 para hacer conocer sus reclamos y solicitudes. Nuestra investigación recupera las voces de las mujeres que, aunque silenciadas por el discurso oficial, estuvieron presentes en todas las etapas del proceso constituyente. Buscamos aportar, por una parte, una perspectiva de género y “desde abajo” a la historia constitucional de Argentina y, por otra, un diálogo con la historia de las mujeres desde una perspectiva histórico-jurídica, ofreciendo un análisis sobre un acervo documental inexplorado a la fecha.

La tesis principal sostiene que la justicia laboral reproduce dinámicas de dominación sexista, al no adecuar los parámetros de abordaje judicial a los estándares internacionales vigentes en materia de protección de los derechos de las mujeres. Para ello se analizará una muestra de jurisprudencia de la Cámara Nacional de Apelaciones del Trabajo, en la que se atenderá a dos cuestiones principales: las concepciones de violencia contra las mujeres en los ámbitos del trabajo y la configuración del cuadro probatorio y distribución de las cargas de prueba. Luego, se contrastarán estoshallazgos con los principales aportes del feminismo jurídico y los estándares vigentes en materia de derechos humanos de las mujeres.

También se analizarán el significado y los contenidos de las orientaciones y políticas de transición justa, en particular de las directrices de la OIT en la materia y su aplicación en el proceso de transición energética española. Asimismo, se describirá el proceso dinámico abierto para la transición justa con la iniciativa internacional "Acción Clímática para el Empleo", lanzada por Naciones Unidas en la Conferencia Climática de Nueva York y presentada oficialmente en la COP25.

Nuestra tesis principal sostiene que la mirada de género es el enfoque invisible en los procesos de transferencia de conocimiento jurídico-laboral, en tanto esta disciplina es estudiada como si fuese neutral en términos de género. Desarrollaremos nuestro argumento en cuatro secciones principales. En primer lugar, contextualizaremos los procesos de enseñanza del Derecho del Trabajo (I). Luego, pasaremos revista a los principales aportes de la teoría feminista para pensar el vínculo entre género y trabajo (II). En tercer lugar, analizaremos los programas de las cátedras y los principales manuales correspondientes a la materia "Elementos del Derecho del Trabajo" (III). Por último, esbozaremos algunas propuestas (IV) que delinean las conclusiones finales en torno a los desafíos de la enseñanza del Derecho Laboral con perspectiva de género.

Nuestro argumento central sostiene que la distinción entre las resoluciones de primera y segunda instancia se funda en una cuestión de marco: mientras el primer decisorio partió de un paradigma individualista de igualdad como no discriminación, la sentencia de segunda reencuadró el caso en una noción robusta de igualdad como no sometimiento o no dominación. Demostraremos que este reencuadre impactó en tres sentidos principales: en la determinación de la disputa normativa, en la valoración de la prueba para la construcción de la argumentación jurídica y en las respuestas remediales. Palabras clave: movilización legal; derecho laboral; igualdad como no-sometimiento; derechos fundamentales; perspectiva de género. Abstract This paper explores the case "Erica Borda" resolved by the National Chamber of Labour Appeals on discrimination against women in access to the labour market of public transport in the metropolitan area. Our main thesis argues that the distinction in the rulings of first and second instance is based on a framework issue: while the first decision was based on an individualist paradigm of equality as non-discrimination, the second sentence re-framed the case in a robust notion of equality as non-subjection or non-domination. We will demonstrate that this reframing impacted in three main approaches: in the determination of the normative dispute, in the evaluation of the evidence for the construction of the legal argumentation of the sentences and in the remedial responses.

Metodología: Nos servimos del análisis documental para reconstruir los debates teóricos acerca de la refundación del derecho laboral, que se vienen desarrollando desde hace tres décadas y su revigorización en el marco del lugar que ocupó la disciplina en las respuestas a la crisis sociolaboral desatada por la pandemia de COVID-19. Resultados y discusión: Nuestro argumento principal sostiene que para repensar el derecho del trabajo es imprescindible posicionarse desde una mirada histórica, que recupere la razón de ser de esta porción del ordenamiento jurídico-laboral. A partir de esa localización, tomamos las críticas feministas para problematizar dos ejes fundantes del derecho colectivo del trabajo: la noción de "interés colectivo" y la huelga. Aporte: La conclusión general del artículo señala la importancia de retomar los presupuestos de origen del derecho del trabajo (conflicto social, acción colectiva y respuesta institucional) para ensayar posibles reconfiguraciones de la disciplina en la actualidad. En ese sentido, sostenemos que un derecho del trabajo de/para el siglo XXI, que pretenda mantener y expandir los horizontes tuitivos, debe partir de una alianza constitutiva feminista-sindical.

Este trabajo rastrea la utilización que de las normas de la Organización Internacional del Trabaj... more Este trabajo rastrea la utilización que de las normas de la Organización Internacional del Trabajo (OIT) y de las decisiones de sus órganos de control realizó la Corte Suprema de Justicia de Argentina (csjn) a la hora de resolver casos sobre derecho laboral. La tesis del trabajo sostiene que la aplicación de la normativa internacional permitió, por un lado, sofisticar la argumentación jurídica de las sentencias a través del establecimiento de vasos comunicantes entre el derecho internacional y el derecho interno; por otro lado, brindar una protección más robusta a los derechos laborales. Para ello, desarrollamos un análisis cruzado de la argumentación desplegada por la csjn en tres pronunciamientos nodales en materia de protección a derechos laborales fundamentales, en el período 2003-2014: (1) libertad sindical, (2) igualdad y no discriminación y (3) derechos de las mujeres. Finalizamos el trabajo resaltando tres estándares hermenéuticos que se desprenden de las sentencias a la hora de abordar la adjudicación judicial de derechos laborales. Asimismo, ponemos de resalto los hilos de continui-dad de las sentencias en los años posteriores e identificamos algunos interrogantes no resueltos por el tribunal.

Este artículo analiza una medida que fue adoptada en Argentina en forma previa a la pandemia de C... more Este artículo analiza una medida que fue adoptada en Argentina en forma previa a la pandemia de COVID-19, pero que adquirió nuevas luces a partir de ella: el establecimiento de la duplicación indemnizatoria mediante DNU 34/2019 y posteriores prórrogas y modificaciones. El recorrido comienza con una somera reconstrucción de la discusión teórica de fondo (II); luego, realiza un mapeo de los antecedentes de esta medida y el contexto en el que se adoptó (III); posteriormente, aborda el desarrollo normativo y sus especificidades (IV); para, por último, plantear algunos interrogantes suscitados a partir del impacto de esta medida en el escenario sociolaboral en Argentina (V). Las conclusiones trazan reflexiones finales y bosquejan algunos ejes de discusión a futuro.

La primera sección revisa las discusiones sobre el reconocimiento del derecho de huelga en el ámbito de la OIT. La segunda sección aborda el desarrollo de la Corte IDH en la materia a través de la Opinión Consultiva OC-27/21 y la sentencia recaída en el caso “Extrabajadores del Organismo Judicial vs. Guatemala”, al tiempo que enfatiza las potencialidades y señala algunos nudos críticos en la argumentación del tribunal regional. A la luz de estos hallazgos, la tercera sección demuestra que asistimos a un proceso de creciente interamericanización del derecho de huelga. Las conclusiones ponen de resalto algunos desafíos futuros y recuperan la importancia de estos avances para la consolidación de un Ius Constitutionale Commune respecto de los derechos laborales en América Latina y el Caribe.
El artículo examina los principios rectores del Derecho Laboral, que en general sólo brindan prot... more El artículo examina los principios rectores del Derecho Laboral, que en general sólo brindan protección a personas individuales sin considerar responsabilidades de cuidado hacia terceras personas, ni situaciones de desigualdad estructural o violencias cotidianas, con el objetivo de proponer una nueva lectura de los principios fundamentales del Derecho del Trabajo, buscando dar contenido al principio de igualdad y salvando las actuales distancias entre igualdad formal y material. A su vez, analiza las obligaciones estatales en materia laboral, particularmente referidas a derechos sindicales, desde una perspectiva de género y en base al caso argentino. En primer lugar (i) se presentan algunas reflexiones para contextualizar las relaciones de género en el mundo del trabajo, con especial énfasis en Argentina, para luego abordar (ii) las obligaciones de los Estados en materia de control e inspección de las relaciones laborales, (iii) el cuidado como un obstáculo para la participación plena de las mujeres en el trabajo, (iv) las acciones positivas y su compatibilización con la autonomía sindical, (v) y las formas de abordaje de las violencias en el trabajo. Aunque derogada por el gobierno de facto de 1955, la reforma de 1949 representa un hito fundamental de la historia constitucional argentina que, a más de 70 años, sigue presentando numerosos interrogantes. Uno de ellos es la pregunta acerca del rol de las mujeres y el reconocimiento de sus derechos en este proceso. Este trabajo indaga en las peticiones que los colectivos de mujeres hicieron llegar a la asamblea constituyente de 1949 para hacer conocer sus reclamos y solicitudes. Nuestra investigación recupera las voces de las mujeres que, aunque silenciadas por el discurso oficial, estuvieron presentes en todas las etapas del proceso constituyente. Buscamos aportar, por una parte, una perspectiva de género y “desde abajo” a la historia constitucional de Argentina y, por otra, un diálogo con la historia de las mujeres desde una perspectiva histórico-jurídica, ofreciendo un análisis sobre un acervo documental inexplorado a la fecha.

La tesis principal sostiene que la justicia laboral reproduce dinámicas de dominación sexista, al no adecuar los parámetros de abordaje judicial a los estándares internacionales vigentes en materia de protección de los derechos de las mujeres. Para ello se analizará una muestra de jurisprudencia de la Cámara Nacional de Apelaciones del Trabajo, en la que se atenderá a dos cuestiones principales: las concepciones de violencia contra las mujeres en los ámbitos del trabajo y la configuración del cuadro probatorio y distribución de las cargas de prueba. Luego, se contrastarán estoshallazgos con los principales aportes del feminismo jurídico y los estándares vigentes en materia de derechos humanos de las mujeres.

En el presente artículo analizaremos la evolución del proceso de incorporación del concepto de "t... more En el presente artículo analizaremos la evolución del proceso de incorporación del concepto de "transición justa" en la agenda climática derivada del Convenio Marco de Naciones Unidas sobre Cambio Climático y de su significado como un pilar fundamental de los procesos de transición energética y de reconversión ecológica; así como del rol de las instituciones multilaterales y de los interlocutores sociales, principalmente sindicales, en este proceso. También se analizarán el significado y los contenidos de las orientaciones y políticas de transición justa, en particular de las directrices de la OIT en la materia y su aplicación en el proceso de transición energética española. Asimismo, se describirá el proceso dinámico abierto para la transición justa con la iniciativa internacional "Acción Clímática para el Empleo", lanzada por Naciones Unidas en la Conferencia Climática de Nueva York y presentada oficialmente en la COP25.

El objetivo de este trabajo es realizar un abordaje exploratorio sobre las formas en que se enseñ... more El objetivo de este trabajo es realizar un abordaje exploratorio sobre las formas en que se enseña Derecho del Trabajo en la Facultad de Derecho de la Universidad de Buenos Aires, desde una perspectiva feminista. Nuestra tesis principal sostiene que la mirada de género es el enfoque invisible en los procesos de transferencia de conocimiento jurídico-laboral, en tanto esta disciplina es estudiada como si fuese neutral en términos de género. Desarrollaremos nuestro argumento en cuatro secciones principales. En primer lugar, contextualizaremos los procesos de enseñanza del Derecho del Trabajo (I). Luego, pasaremos revista a los principales aportes de la teoría feminista para pensar el vínculo entre género y trabajo (II). En tercer lugar, analizaremos los programas de las cátedras y los principales manuales correspondientes a la materia "Elementos del Derecho del Trabajo" (III). Por último, esbozaremos algunas propuestas (IV) que delinean las conclusiones finales en torno a los desafíos de la enseñanza del Derecho Laboral con perspectiva de género.

Nuestro argumento central sostiene que la distinción entre las resoluciones de primera y segunda instancia se funda en una cuestión de marco: mientras el primer decisorio partió de un paradigma individualista de igualdad como no discriminación, la sentencia de segunda reencuadró el caso en una noción robusta de igualdad como no sometimiento o no dominación. Demostraremos que este reencuadre impactó en tres sentidos principales: en la determinación de la disputa normativa, en la valoración de la prueba para la construcción de la argumentación jurídica y en las respuestas remediales. Palabras clave: movilización legal; derecho laboral; igualdad como no-sometimiento; derechos fundamentales; perspectiva de género. Abstract This paper explores the case "Erica Borda" resolved by the National Chamber of Labour Appeals on discrimination against women in access to the labour market of public transport in the metropolitan area. Our main thesis argues that the distinction in the rulings of first and second instance is based on a framework issue: while the first decision was based on an individualist paradigm of equality as non-discrimination, the second sentence re-framed the case in a robust notion of equality as non-subjection or non-domination. We will demonstrate that this reframing impacted in three main approaches: in the determination of the normative dispute, in the evaluation of the evidence for the construction of the legal argumentation of the sentences and in the remedial responses.

El recorrido comienza con una definición de la segregación horizontal (que a menudo es concebida únicamente en términos económicos) desde una perspectiva jurídico-laboral, como una pieza central del derecho al trabajo. Luego, se exploran los leading case en la materia en Argentina. Finalmente, el capítulo traza algunas coordenadas acerca del marco global de la discusión: los debates sobre un derecho del trabajo en clave feminista-sindical para el siglo XXI.

En este trabajo nos proponemos efectuar algunos aportes que combinan nuestras diferentes trayecto... more En este trabajo nos proponemos efectuar algunos aportes que combinan nuestras diferentes trayectorias (jurídico-laboral, por una parte y en ciencias sociales, por la otra) en relación con un objeto de estudio común (el derecho del trabajo en clave feminista), para pensar en torno a una pregunta central: ¿Qué matices puede aportar el derecho del trabajo a la reforma judicial feminista? Así, este capítulo representa un hilo de continuidad de un texto anterior en el que indagamos sobre las implicancias de una RJF y el lugar que el derecho del trabajo ocupa en esta propuesta (Lerussi y Lobato, 2021). El recorrido es el siguiente: en la próxima sección reponemos los ejes centrales que establecimos en dicho artículo ubicando la propuesta de una RJF en el centro de lo que consideramos una discusión de mayor alcance: un debate sobre qué justicia queremos. En el segundo apartado avanzamos sobre dos ejes medulares que estructuran el derecho del trabajo y que, a nuestro modo de ver, enfatizan y potencian aspectos sustanciales a una RJF: la igualdad y no discriminación, y la acción colectiva. Finalmente, recapitulamos los tópicos centrales de este trabajo y apuntamos dos asuntos transversales a una RJF: la relevancia de la escucha en el poder judicial y el rol de la enseñanza del derecho.

El presente capítulo se propone desarrollar los estándares vigentes en el derecho internacional d... more El presente capítulo se propone desarrollar los estándares vigentes en el derecho internacional de los derechos humanos (derecho internacional del trabajo incluido) y de la normativa doméstica, a fines de proporcionar herramientas útiles para desplegar en la argumentación jurídica en casos de violencia laboral contra las mujeres. El recorrido se estructura en cuatro apartados principales. En primera instancia, haremos un repaso sobre los principales insumos teóricos que conectan las situaciones de desigualdad estructural con las dinámicas de violencia laboral. En segundo lugar, nos referiremos a la Ley de Protección Integral a las Mujeres (Ley n.º 26485), que representa el instrumento por antonomasia en la materia en el ámbito argentino. Luego, abordaremos el Convenio n.º 190 de la OIT, por ser el primer tratado internacional que regula las situaciones de violencia laboral, con especial énfasis en los casos de violencia de género. Finalmente, reconstruiremos los estándares vigentes de aplicación a los litigios laborales, a través de un repaso por los principales avances en el derecho internacional de derechos humanos, en diálogo con la legislación interna. Todo ello nos permitirá finalizar el trabajo con algunas reflexiones.
