El presente trabajo pretende contribuir a la discusión que han motivado estas sentencias, pero desde la ciencia del derecho procesal, revisando, en general, cuál es la naturaleza de la acción de protección, cuál es el efecto de cosa juzgada que generan sus sentencias, los problemas de concursos de acciones, y los efectos erga omnes de sus fallos. en que e... more La sentencia condenatoria penal pronunciada en un juicio abreviado o en uno simplificado en que existió admisión de responsabilidad del imputado, no resulta una vía idónea para el descubrimiento de la verdad en el proceso y, por ello, no es aplicable la norma del art. 178 CPC que permite hacer valer la sentencia condenatoria penal en el juicio civil de indemnización de perjuicios. Esto, porque se trata de una verdad consensuada, no adversarial ni tampoco fruto de un juicio jurisdiccional. Sin embargo, la admisión de los hechos en el juicio abreviado, por parte del imputado, podrá ser considerada como una confesión extrajudicial en el proceso civil, bajo determinadas circunstancias.
Resumen: la Ley Orgánica de Procedimiento de Expropiaciones –Decreto Ley N° 2186 de 1978- estable... more Resumen: la Ley Orgánica de Procedimiento de Expropiaciones –Decreto Ley N° 2186 de 1978- establece el mecanismo procesal que permite materializar la garantía constitucional de indemnización íntegra como consecuencia de las expropiaciones por utilidad pública llevadas a cabo por el Estado. Como manifestación esencial de dicha garantía, esta ley permite al administrado reclamar judicialmente del monto consignado provisionalmente por el Estado, y por lo tanto, rendir prueba en ese proceso. La ley otorga un valor preponderante a la prueba pericial, dado el carácter eminentemente técnico del objeto de dicho proceso, la que según la ley debe ser apreciada según las reglas de la sana crítica. En la primera parte de este trabajo se analizarán críticamente las reglas procesales que regulan esta prueba, desde el punto de vista de los derechos del administrado, para luego analizar qué características del informe pericial debieran ser consideradas por el sentenciador del fondo al momento de valorar la esa prueba según las reglas de la sana crítica. El último apartado estará destinado a revisar si las eventuales infracciones en la aplicación de la regla de la sana crítica admite el control de la Corte Suprema por la vía del recurso de casación en el fondo.

El primer es si esa figura corresponde a un remedio para el concurso de acciones y de normas. El segundo de ellas se refiere a su finalidad, vinculada con los deberes de buena fe y la teoría de los actos propios. El tercero propone que esta excepción abarca no sólo los casos en que exista perfecta identidad entre dos o más procesos, sino también aquellos casos de procesos conexos y en que uno es prejudicial a otro. This article addresses three points regarding the exception of the Litis pendentia in the Chilean Civil Process. The first one questions whether this legal construct is a remedy for the merging of actions and regulations. The second one refers to its aim, which is linked to the duties of good faith and the theory of the estoppel. The third point proposes that this exception not only addresses cases with a perfect identity between two or more processes, but also those cases with connected processes in which one is given priority ruling before the other.

En este trabajo se explica y fundamenta que la consecuencia procesal de esta infracción normativa es la incompetencia absoluta del tribunal civil respectivo. Asimismo, se expondrá acerca de las sanciones disciplinarias que nuestra jurisprudencia ha venido aplicando en forma consistente durante los últimos años para reprimir estas conductas.

Esta prevalencia encuentra su fundamento en el análisis razonado de las coincidencias fácticas y dogmáticas entre los elementos del ilícito penal absuelto y del ilícito civil que se imputa en juicio. This article analyzes the breadth and limits to the application of Article 179 of the Chilean Civil Code of Procedure, which describes the res judicata effect of a criminal acquittal and dismissal, in which prevails the civil defendant’s constitutional right of double jeopardy over the victim’s interest in obtaining just and fair compensation. The prevalence can be found in reasoned analysis of the factual and dogmatic similarities between the elements of the criminal offense and the elements of the civil breach.
