This article discusses the scope of this new system as well as the contents of a bill setting administrative procedures to enact it, in the light of lessons learned from experiences with Drug Treatment Courts in USA and UK, where this mechanism has operated with promising results for a number of years based on the “harm reduction” doctrine.

Plantea un conjunto de problemas organizacionales, epistemológicos, metodológicos y teóricos para discutir los desafíos más significativos en torno a la consolidación y continuidad de los avances actuales, e identifica nuevas complejidades que emergen en este campo al igual que posibles estrategias para lidiar con ellas. Para ello, esta revisión utiliza los métodos histórico, analítico y dialéctico. Los principales hallazgos indican avances concomitantes y sustanciales en el desarrollo de un corpus teórico, así como en la producción de nuevos conocimientos basados en la investigación socio-jurídica e histórica, empírica y documental. Simultáneamente, también confirma la presencia de visibles vacíos, baches y áreas desatendidas en la órbita del pensamiento y la investigación criminológica en la Colombia del presente. La recientemente aprobada reforma del articulo 49 de la Constitucion Politica de Colombia estable... more La recientemente aprobada reforma del articulo 49 de la Constitucion Politica de Colombia establecio un regimen de sancion y proteccion administrativa para consumidores de drogas ilicitas en el pais. Este articulo discute los alcances del nuevo regimen, al igual que el contenido de un proyecto de ley que fija los procedimientos administrativos para su desarrollo, a la luz de lecciones aprendidas a partir de las experiencias con los tribunales de tratamiento de drogas en Estados Unidos y el Reino Unido, donde este mecanismo opera con resultados promisorios desde hace varios lustros con base en la doctrina de “reduccion del dano”.

We argue that transnational criminal law has enacted a global rule by law enforcement agencies, a... more We argue that transnational criminal law has enacted a global rule by law enforcement agencies, at odds with the rule of law. Mutual legal assistance agreements (MLAA) allow exporting law enforcement practices without proper judicial oversight. Consequently defendants required in extradition are exposed to abuses, as illustrated here with extradition cases from Colombia to the United States of America (USA) in the past decades. Based on the critical review of documental and statistic information coming from official and independent sources in the U.S. and Colombia, this article pinpoints specific shortcomings that affect due process and fair trials in the case of extradited defendants. Concluding remarks underscore the need to check the global expansion of the law enforcement sector, purportedly justified in order to fight transnational criminal impunity. Its steady expansion is a main factor undermining the legitimacy of national law enforcement and justice systems, and a threat to the genuine protection of civil liberties.
