EL CONCEJO METROPOLITANO DE QUITO Visto el informe No. IC-O-2012-249 de 10 de septiembre de 2012,... more EL CONCEJO METROPOLITANO DE QUITO Visto el informe No. IC-O-2012-249 de 10 de septiembre de 2012, expedido por la Comisión de Propiedad y Espacio Público. CONSIDERANDO: Que, el artículo 31 de la Constitución de la República (Constitución) establece que: "Las personas tienen derecho al disfrute pleno de la ciudad y de sus espacios públicos, bajo los principios de sustentabilidad, justicia social, respeto de las diferentes culturas urbanas y equilibrio entre lo urbano y lo rural. El ejercicio del derecho a la ciudad se basa en la gestión democrática de ésta, en la función social y ambiental de la propiedad y de la ciudad, y en el ejercicio pleno de la ciudadanía."; Que, numeral 13 del artículo 83 de la Constitución establece que son deberes y responsabilidades de las ecuatorianas y ecuatorianos: "(...) 13. Conservar el patrimonio cultural y natural del país, y cuidar y mantener los bienes públicos."; Que, el artículo 9 de la Constitución señala que: "Las personas extranjeras que se encuentren en el territorio ecuatoriano tendrán los mismos derechos y deberes que las ecuatorianas, de acuerdo con la Constitución."; Que, los artículos 14 y 71 de la Constitución garantizan el derecho de los ciudadanos y ciudadanas a vivir en un ambiente sano y ecológicamente equilibrado; y consagran los derechos de la naturaleza; Que, los literales k) y m) del artículo 54, en concordancia con los literales k) y m) del artículo 84 del Código Orgánico de Organización Territorial, Autonomía y Descentralización (COOTAD), establecen como funciones del gobierno autónomo descentralizado municipal: "k) Regular, prevenir y controlar la contaminación ambiental en el territorio cantonal de manera articulada con las políticas ambientales nacionales (...)"; y, "m) Regular y controlar el uso del espacio público cantonal y, de manera particular, el ejercicio de todo tipo de actividad que se desarrolle en él (...)"; Que, el literal b) del artículo 55 del COOTAD establece como una de las competencias exclusivas del gobierno autónomo descentralizado municipal la de: "b) Ejercer el control sobre el uso y ocupación del suelo en el cantón."; Página 1 de 24
