With a moral tradition strongly attached to Christian values, to which the idea of corporeal intangibility can be associated, to speak, in Brazil, of the ethicaljuridical limits of personal autonomy in regard to the uses of the human body is quite an arduous task, especially if one intends to thoroughly explore the topic of organ and tissue transplantation. In spite of possessing the largest public transplantation program in the world — the National Transplant System, which is totally structured on donations — the country has not been able to solve the problem of the dearth of organs. Resumo Neste artigo, sera analisado se as descobertas da neurociencia e da psicologia realizadas ... more Resumo Neste artigo, sera analisado se as descobertas da neurociencia e da psicologia realizadas nas ultimas decadas sobre a tomada de decisoes humanas impactaram a regulamentacao de comportamentos no Codigo Civil e no Codigo de Defesa do Consumidor. Mediante comparacao de alguns dispositivos dos mencionados diplomas legais, sera indagado ainda quais mecanismos (regime de invalidade, nudges, deveres de informacao) sao mais adequados para que uma compreensao cientificamente informada da conduta humana no âmbito juridico possa levar ao aperfeicoamento da tomada de decisoes nas citadas areas do direito privado. O artigo insere-se no campo de pesquisa de Direito e Sociedade e foi elaborado por meio da analise critica de dispositivos legais do Codigo Civil e do Codigo de Defesa do Consumidor a luz das novas descobertas sobre o processo decisorio humano. Throughout human history, cognition enhancement has not only been a constant, but also imperative... more Throughout human history, cognition enhancement has not only been a constant, but also imperative for our species evolution and well-being. However, philosophical assumptions that enhancing cognition by biomedical means goes against some immutable human nature, combined with the lack of conclusive data about its use on healthy individuals and long-term effects, can sometimes result in prohibitive approaches. In this context, the authors seek to demonstrate that cognition enhancement, whether by “natural” or biotechnological means, is essential to the emergence of personhood, and to existence of an autonomous life that is guided by a person’s own conception of the good. In order to do so, the main possibilities of enhancing cognition through biotechnologies, along with its benefits and potentialities, as well as its risks and limitations, will be presented.
