DESARROLLO DEL COMERCIO: OBLIGACIONES MERCANTILES: Son el elemento fundamental de un área o rama del derecho Comercio DERECHO ROMANO: Los romanos consideraban al comercio primitivo. Romanos eran eminentemente imperialistas. Por lo que los pueblos realizaron esta actividad. Los romanos aplicaban la fuerza, por lo que no se hacía necesaria una legislación hacia el comercio. Los pueblos conquistados por los romanos seguían haciendo sus actividades, es así como los pueblos comerciantes trabajaban y lograban perfeccionarse en su área. LA EDAD MEDIA: Acá tiene cada vez más fuerza el comercio el cual se entiende como una actividad con la Idea de satisfacer necesidades, la cual con la medida en la que se le da valor al dinero toma una distinción y ya no es solo con la finalidad de satisfacer necesidades sino que se le suma a la definición "A cambio de una retribución económica" (tener una "ganancia" no es un elemento fundamental). En la medida que en la Edad Media proliferaron los reyes a través de la fuerza se le dio valor al dinero, el cual era obligatorio recibir. Monarca le daba valor al dinero, este lo regulaba; el dinero pasa a tener una fuerza obligatoria. Con el tiempo nacen personas que se dedican especialmente a la actividad del comercio (comerciantes) "Aquel que teniendo la capacidad de contratar hace del comercio su actividad habitual". Especialización: COMERCIANTES, es la persona que se dedica o se especializa en la actividad del comercio. El que es capaz de contratar ejerce el comercio como actividad habitual. Actividad de los comerciantes provoca conflictos: Lo más común en la época era la agricultura para lo cual se crea competencia y con esto conflictos debido a que comienzan a existir más cantidad de negocios y cadenas más grandes (el producto pasa por más de una mano hasta llegar al consumidor final y todos estos son comerciantes). Estos conflictos eran más comunes entre comerciantes por lo cual sintieron la necesidad de agruparse para protegerse, ayudarse y obtener mejores condiciones en agrupaciones llamadas gremios, los cuales comenzaron a tener un rol más activo en la resolución de dichos conflictos. Necesidad de agruparse: GREMIOS, esto para protegerse, obtener mejores condiciones, ayudarse mutuamente. Los gremios, este lugar de encuentro, los comerciantes encontraron esta posibilidad de sentirse más resguardados, por lo que estos gremios empezaron a tener un rol más decisivo en la actividad de los comerciantes. Aquí los comerciantes comenzaron a resolver sus conflictos. Entidad comienza a resolver conflictos: Fallos, decisiones ¿Qué sucede con esas decisiones?: las personas no están obligados a respetarlas. Los que si aceptaban esos fallos, lo que producen al repetirse en el tiempo es la costumbre. Las decisiones de los gremios no son vinculantes en un principio ya que no tienen la misma fuerza obligatoria que la ley, no tenían un carácter obligatorio por lo cual el que no cumplía quedaba "vetado" del gremio pero estos fallos comienzan a tomar fuerza obligatoria y es la antecesora de la costumbre debido a la falta de leyes que regulaban estas materias. ¿En qué momento la costumbre pasa a ser ley y tiene fuerza obligatoria para todos los comerciantes? Cuando el Rey le da ese reconocimiento (fuerza obligatoria) pasa a tener el rango de Ley. Gremios-Costumbre-Ley-Rey. La costumbre se transforma en ley cuando se le da fuerza obligatoria lo que en este caso es por obra del rey y por ende esta se remite a TODO COMERCIANTE INDEPENDIENTE de que si este se encontraba o no en un gremio (tiene rango de ley). 1° legislación con fuerza en materia mercantil se dio en Italia, España y Alemania:
