I explore the moral and philosophical arguments surrounding borders and immigration policy but my research interests cover a range of topics in contemporary philosophy of law, political, social and moral philosophy, with particular reference to the conceptions of justice and legitimacy present in liberal and democratic thought. I write about corruption, discrimination and nationalism. During my doctoral research I became greatly exposed to empirical information regarding immigration flows. As a result I became engaged with the practice and philosophy of social sciences in order to learn how to weigh up empirical data.

The aim of this paper is to offer a broad characterization of the kind of account that I believe ... more The aim of this paper is to offer a broad characterization of the kind of account that I believe cannot plausibly face conclusively the problem of the ethics of immigration restrictions in a non-ideal world at the level of the constitutional essentials. I argue that justice-based accounts of immigration controls fail to normatively evaluate what immigration controls do to outsiders subjected to them in non-ideal conditions, so judgments of justice by themselves tend to be overall bad for the interest of immigrants. I explain this by insisting that a prior question about the legitimacy of immigration controls have been overlooked by familiar accounts. A full account of the ethics of immigration suitable for guiding constitutional essentials should be able to connect distinct kinds of justice-based evaluations in order to ask both, what legitimacy requires from territorial institutional control as well as what justice requires from immigration policy.

La región se transformó intempestivamente en lo que va del siglo xxi. Aunque muchas de las dinámicas que se conjugan en la actualidad no son del todo novedosas, adoptan patrones, tendencias y formatos que desafían las miradas clásicas sobre ellas. La composición de los flujos se ha hecho crecientemente más heterogénea, desbordando ciertas categorías conceptuales con las que acostumbrábamos a observarlos y nos obliga a repensarlas. La direccionalidad de los flujos ha convertido a la mayoría de los países en receptores de población, junto a otros patrones de movilidad que incluyen retorno, tránsito, desplazamiento forzado, población atrapada y en espera, entre otros. In the face of this, I propose to take a step back and to realize that the general problem of borders—to determine what kind of borders liberal democracies ought to have—gives rise to two particular problems: first, to justify exclusive control over the administration of borders (the problem of legitimacy of borders) and, second, to specify how this control ought to be exercised (the problem of justice of borders). Resumen: En México no queda claro cuál debe ser el papel de la educación pública después de la tr... more Resumen: En México no queda claro cuál debe ser el papel de la educación pública después de la transición. ¿Debe continuar el proyecto de construcción nacional iniciado por el régimen priísta o debe abandonar todo contenido ideológico? Este trabajo comienza por preguntarse si para una democracia liberal como México es permisible inculcar contenidos ideológicos a través de la educación pública. A manera de simplificación me concentro en el caso de la enseñanza de la historia patria articulada mediante la ideología del nacionalismo revolucionario a través del libro de texto gratuito. Argumento que para una democracia liberal no es permisible inculcar el perfeccionismo cultural que parece implicar la enseñanza de la historia patria. Sin embargo espero que el argumenta pueda extenderse a otros casos similares de adoctrinamiento infantil. Abstract: After Mexican political transition, it is not clear what should be the role of public education. Should public education continue with the nation building process first conducted by the PRI's regime? Or should it instead abandon any ideological endeavor? This paper begins by asking if it is morally permissible for a liberal democracy like Mexico, to indoctrinate children using the schooling governmental apparatus. As a means of simplification I discuss only the case of history free text books where Mexican history seems to be still constructed around the ideology of the revolution-nationalism. I argue that it is not permissible for a liberal democracy to indoctrinate children with the kind of cultural perfectionism entrenched in the patriotic doctrinal history books. The hope is to extend my argument to similar cases of children endoctrination.
Economic crisis often causes a suppression of progressive ideals; sometimes it even causes a pain... more Economic crisis often causes a suppression of progressive ideals; sometimes it even causes a painful regression to discriminatory policies and to authoritarian institutions. Fear and xenophobia are used by abusive politicians as means to secure allegiances among the population, boost social cohesion and enforce compliance with the rule of law. Particularly nowadays there are some voices declaring the failure of multiculturalism, arguing instead for the need of a robust liberalism, based in a strong national identity. Following this it seems that a form of nationalism (defensible with liberal values) should ensure security, by actively fixing the problem of identity. It is hope that this will stopping permissibility regarding the non-‐compliance with liberal democratic values of citizens who come from a non-‐European cultural background. On my view this reveals a misleading account of the strengths of liberalism, the nature of extremism and the dimension of the challenge. I argue that liberal nationalism fails to supplement liberalism in moments of crisis because liberal nationalism fails to be liberal and nationalist enough. I argue that in the present circumstances a muscular liberalism is the one supplemented by multiculturalism and interpreted by a theory of minority rights. 1. The problem: a normative challenge of the crisis The British Prime minister claims multiculturalism has failed to liberal democracies. For him one of the most powerful and disturbing examples of multiculturalism's failure is the fact that terrorists are now recruited in liberal democracies, from our sons and neighbours, even within middle and upper educated classes. Why are there terrorist in free democratic societies? —he asks—. According to the prime minister, young British Muslims, for instance are driven to extremism mostly because they suffer a deep conflict of identity. Now, I am not going to pretend it's in any way surprising that nationalist sensibilities arise in the middle of a crisis. Creemos que el concepto de acto discriminatorio, como daño a los derechos, que ha permeado la lucha contra la discriminación durante el siglo xx, es reduccionista e insuficiente para afrontar este problema. Ese tipo de conceptos restringen el fenómeno estructural a un mero efecto agregativo de los actos discriminatorios de todas las personas, que no es diferente de la opresión. Argüimos que la discriminación estructural no se restringe a la opresión, sino que es un tipo especial de ésta, porque establece un mecanismo social e histórico de jerarquización y devaluación de distintos grupos sociales, por el significado social que se atribuye a sus características percibidas. colocamos de cabeza el esquema, lo que trae como consecuencia que el concepto de discriminación estructural sea central entre los distintos tipos de opresión. Una teoría de este tipo va más allá de los objetivos de un capítulo de libro porque parece requerir la elaboración de novo de una teoría normativa de las fronteras internacionales. Antes bien, de manera más modesta, trataré de perfilar el tipo de aproximación que pueda usarse para dar cuenta de la naturaleza, significado práctico y fundamentos de las fronteras internacionales apropiadas para Estados que tengan un carácter moral sustantivo. Para poder hacer esto de manera más o menos económica, intentare justificar una suerte de desiderata que identifique el núcleo teórico básico de lo que las fronteras deberían ser para el caso de las democracias liberales. La desiderata constituye una suerte de rúbrica que nos dice cómo debería verse una teoría mínima del diseño de fronteras internacionales y que por ello nos permitirá evaluar y comparar de manera preliminar distintos conceptos de fronteras.

Por la profundidad y amplitud de los temas tratados presentan un alto valor didáctico, en especial para estudiantes de posgrado, representando además un gran recurso también para especialistas. Este proceso de transformación social incesante en el que se encuentran las movilidades y migraciones ha sido identificado oportunamente por esta academia experta de la unam al proponer el abordaje de nuevos temas y aproximaciones teóricas y metodológicas para su comprensión e interpretación. Convencionalmente se cree que un problema central a resolver es que el neoliberalismo ha erosiona... more Convencionalmente se cree que un problema central a resolver es que el neoliberalismo ha erosionado el pacto fundacional de 1917. En este trabajo argumentamos que el principal problema no es la ideología neoliberal, sino la corrupción y la ausencia de una agenda anticorrupción transversal en dicho texto. Argumentamos que el daño que hace la corrupción no es solo de tipo moral, sino también jurídico. Y el tipo de daño jurídico que la corrupción llega a infringir puede tener el efecto de subvertir la validez y normatividad de un pacto constitucional. Este daño también tiene un trasfondo moral.

A continuación trataré de sugerir por que esos valores siguen siendo parte de la cultura política pública. En tercer lugar trataré de fundamentar normativamente la conveniencia de eliminar esos valores de la cultura política pública. Diré por qué los valores de una democracia liberal no son en general compatibles con el nacionalismo. Concluiré que estos valores deben ser removidos ,cuando menos de la educación pública para construir una cultura política pública de una democracia liberal. Pero para ello es necesario estudiar más a fondo estas actitudes y valores.

Saber si esto es moralmente permisible, correcto o siquiera deseable es un asunto misterioso por varias razones. Mientras el misterio se disipa, podemos comenzar por preguntarnos cosas más modestas. Los padres tienen la obligación de cultivar a sus hijos y procurar hacer de ellos mejores personas. ¿Es moralmente permisible o moralmente requerido que un padre haga uso de la intervención genética para mejorar las facultades y capacidades normales de sus hijos? Sospecho que la concepción estándar de autonomía diría que sí es moralmente permisible. Aunque no resuelvo concluyentemente la cuestión, documento una sospecha: Una concepción más rica de autonomía podría condenar esta práctica en términos de la responsabilidad que cada quien tiene de hacer algo valioso con su vida.
Muchas personas piensan que es justo excluir a los migrantes porque su presencia puede problemati... more Muchas personas piensan que es justo excluir a los migrantes porque su presencia puede problematizar la creación y sostenimiento de los Derechos Económicos, Sociales y Culturales de los ciudadanos (DESC). Esto significaría que los DESC son malos para los migrantes porque justifican su exclusión. Yo argumento sin embargo que esto es equivocado porque (i) los argumentos de la justicia en inmigración son inconcluyentes al no mostrar que existen derechos sobre el territorio y (ii) porque el criterio de justicia relevante para la inmigración no es la cooperación sino la pertenencia. La cooperación es un criterio sesgado que sólo toma en cuenta las demandas de justica de los ciudadanos. Pero una vez que la pertenencia nos permite vincular la migración con el desarrollo tenemos un escenario distributivo completo donde los migrantes no constituyen sólo un costo sino que son una manera necesaria en la que las democracias liberales crecen.

Muchos críticos han anotado que los conceptos usados para describir fenómenos sociales son inseparables de categorías de valor y que por este sesgo valorativo los investigadores sociales no pueden más que aceptar las limitaciones cognitivas del relativismo o adoptar un papel etnocentrista altamente pernicioso. Otros filósofos han sugerido que hay una tercera vía: adoptar una perspectiva crítica que sea suficientemente pluralista para dar cuenta del relativismo. Pero son incapaces de definir exactamente cómo se desarrolla esta alternativa. Yo argumento que estos autores fracasan en indicar cuál es el lugar apropiado del observador, porque no se percatan de que ese problema no es epistemológico sino moral.

Esta medida pone en juego la calidad migratoria de quienes utilizan ciertos servicios sociales, volviendo deportable a una parte de la población migrante. El artículo argumenta que la carga pública por sí misma no debería ser motivo suficiente para justificar la deportabilidad. En primer lugar, bajo cierta familia de teorías igualitarias, puede ser injusto construir a las personas como deportables con base en la necesidad que tienen de programas sociales; puesto que la razón de ser de estos es compensar efectos adversos de la mala suerte, dominación y explotación. En segundo lugar, puede resultar moralmente impermisible hacerlo por las consecuencias
adversas que la deportabilidad implica, dado que las contribuciones de las personas migrantes a la sociedad estadounidense son superiores al uso que estas realizan de servicios públicos, por lo que no puede considerárseles una carga pública. Finalmente, proponemos el concepto de carga pública justa, para permitir la valoración equitativa de las contribuciones de los migrantes en el país de destino.

concepto de discriminación estructural. Creemos que el concepto
de acto discriminatorio, como daño a los derechos, que ha permeado
la lucha contra la discriminación durante el siglo xx, es
reduccionista e insuficiente para afrontar este problema. Ese tipo
de conceptos restringen el fenómeno estructural a un mero efecto
agregativo de los actos discriminatorios de todas las personas, que
no es diferente de la opresión. Argüimos que la discriminación
estructural no se restringe a la opresión, sino que es un tipo especial
de ésta, porque establece un mecanismo social e histórico de
jerarquización y devaluación de distintos grupos sociales, por el
significado social que se atribuye a sus características percibidas. colocamos de cabeza el esquema, lo que trae como
consecuencia que el concepto de discriminación estructural sea
central entre los distintos tipos de opresión. A través suyo identificamos
los actos como discriminatorios, independientemente de si
hacen o no daño a los derechos de las personas, como sugieren las
posturas “dañistas”.
Para poder hacer esto de manera más o menos económica, intentare justificar una suerte de desiderata que identifique el núcleo teórico básico de lo que las fronteras deberían ser para el caso de las democracias liberales. La desiderata constituye una suerte de rúbrica que nos dice cómo debería verse una teoría mínima del diseño de fronteras internacionales y que por ello nos permitirá evaluar y comparar de manera preliminar distintos conceptos de fronteras.
