En la era digital, la práctica legal está experimentando una transformación significativa impulsa... more En la era digital, la práctica legal está experimentando una transformación significativa impulsada por el manejo del conocimiento y el análisis de datos. Este artículo explora cómo estas herramientas innovadoras podrían y están revolucionando la admisión de demandas, un proceso crítico en cualquier sistema judicial.
El manejo del conocimiento, a través de la digitalización y organización de grandes volúmenes de información de índole juídica, permite a los abogados acceder y utilizar sentencias similares y normativa de manera más eficiente, los sistemas de gestión de casos y bases de datos electrónicas facilitan la identificación de patrones en la jurisprudencia y la optimización de estrategias legales.
El análisis de datos, por su parte, introduce una capa adicional de precisión en la admisión de demandas, dado que mediante el uso de algoritmos y técnicas avanzadas de análisis de datos, los abogados pueden clasificar o sugerir leyes y jurisprudencia que oriente o vincule, pronosticar resultados con base en problemas así como evaluar riesgos, mejorando así la toma de decisiones informadas. Este enfoque basado en datos no solo agiliza el proceso, sino que también incrementa la transparencia y equidad en el sistema judicial.
En México, la integración de estas tecnologías presenta tanto oportunidades como desafíos; de manera inicial la adaptación exitosa requiere una infraestructura tecnológica robusta, capacitación continua de los profesionales del derecho y un marco regulatorio que garantice la privacidad y seguridad de la información.
Este artículo pretende ofrecer una visión comprehensiva sobre las ventajas y retos asociados con la administración del conocimiento y el análisis de datos en la admisión de demandas, destacando su potencial para transformar la práctica legal y contribuir a un sistema de justicia más eficiente y justo.

The need for Knowledge Management (KM) has been drastically increasing so organizations may meet ... more The need for Knowledge Management (KM) has been drastically increasing so organizations may meet the high level of complex business change, dynamics and uncertainty. This research, quantitative and qualitative, approaches the challenge of the KM in the Mexican organization, since a large number of them do not have a standardized model from which they can obtain benefits in order they can achieve higher revenue, increase the employee collaboration and innovation, which impacts not only in the organization´s productivity, competitiveness but in the country one. We propose a model for the Mexican organization to allow them to identify and take advantage of the suitable knowledge and aligned it with their business strategy. The theoretical frame is based in the best practices emitted by international organizations such as the OECD, researchers and leaders in this expertise area and research line, also based in the diverse actual models for KM. We sustain our new proposed model in a descriptive and transactional study based in 250 Mexican institutions, we found that large companies have already an incipient and isolated knowledge management implementation, nevertheless; companies within 50 and 1000 employees are immediate candidates for KM due to their market position, services they offer and their search to obtain a value added service or product with shorter production cycles, and also due their need to innovate using their own explicit knowledge, most of the has no use for KM. The KM goal may vary in the companies, the analysis showed the pertinence to evaluate and measure the benefit and return of investment when they pretend to implement a KM solution, and must add a positive value to the organization to the Mexican Organization. The proposed model, ADSA, includes four stages: analysis, design, solution, appreciation. Each one it is logically aligned to the business requirement a knowledge based value generation, always following up the social and technical enablers. A properly used knowledge management strategy will impact positively in a higher revenue or profit, and also contributes in the generation of collective intelligence, that cans impulse the construction, and sustain for Mexico´s knowledge economy.

Alongside the assessment, the research shows the main concerns in regards KM for IT to design an international point of view strategy with local market overview to gain value for its IT operation. Mexican banks has different philosophy based in their country's head quarter origin: European, North American or Mexican, which also change the value perception they must obtain form their IT departments, going from uptime service to new process improvement; most of them agreed the main reason to move forward to a KM policy is to increase value for their internal customers, manage the ageing of managerial in which collective work it is important within the IT to preserve experience.

This research aims to understand the way the KM and collective intelligence (CI) influence, or not, towards value added generation for Information Technology (IT) departments in banking industry. Mexico has a consolidated banking system; for commercial banking has a large influence from European banks in terms of business approach, and most of this banks has been part of acquisitions and merges, other cluster is composed by small banks are part of the new generation banks raised from retailers. The IT departments in Mexico, has suffered many changes: From mainframe operations to open systems operation, from manual process to highly automated processes, from local policies to global policies, and they move for tacit to explicit knowledge when possible. The ageing in managerial positions is growing, and there is a age divide not only in regards experience from IT management, but also for corporate culture, tradition, business alignment and even regional culture. Highly experience people are leaving their position to new or foreign managers. Mexico's major banks have origin in Spain, England, USA, Canada, so relocation for business purposes in foreign related banks is a policy, mainly for managerial positions, and IT departments are not the exception; which turns into a functional, authority-status hierarchies, time availability barriers to interact in short term with collaborators, and share knowledge. Merges and acquisitions, as a context, has generated a high rotation level in mid IT department positions, with the effect of constant changes, and not all involved workers document, or explicit their knowledge, in a tide effect the knowledge come and gone in those area. Collective work it is important within this area, actual banks in Mexico outsource part of their operation to third parties, and this third parties may or may not rotate its personal, with the effect of constant change in culture, leadership style, process or task arrangement, due trust to share knowledge with others who may turn into a competitor. Knowledge management and collective intelligence without the proper technological infrastructure that allows groups, teams, areas or regions to share the knowledge is a difficult task; the fact to be part of IT department does not ensure the availability or desire to share the knowledge and work collectively to solve all issues using technology to make it explicit. This research aims to analyze relationships within IT departments are influenced by cultural contexts, social or structural, which determines the strength of collective intelligence commitment to add value for their department, a internal knowledge bonding, and perhaps its perception, as result, is adding more value for external than internal customer. The research include Mexico´s top seven banks, which holds 68% commercial bank market share

To plan and promote strategies, to improve the sport, fostering respect, equity and inclusion, will improve the organization’s members integration capability and collaboration, where the cornerstone is the human element, whether as an athlete, coach or official, to support and promote the organization’s operation and development. This article explores and analyze several papers reports from academia, regulators and sports entities under Mexico’s context, towards its adoption in a proper and ethical way to improve organizational development through the sport.

En México autores como Mendoza (2007), Murillo ( 2002), Ballesca (2007), Ávalos y Hernández (2006), Batís Lazo y Wood (1999) han analizados los sucesos históricos y los factores institucionales que han distinguido el contexto de la banca y otras empresas con origen en otras naciones.
Sin embargo, en la revisión de literatura no se hallaron referencias a una métrica que consolide la visión operativa de la administración del conocimiento y la inteligencia colectiva en áreas operativas y sustantivas para México. Si bien algunos de los estudios incluyen el plano tecnológico no se observa el detalle del factor ejecución conocimiento-colectividad.
A medida que el libro avanza, profundiza en la importancia de la administración en el contexto legal contemporáneo, poniendo especial énfasis en cómo los abogados pueden aplicar principios de administración en su práctica; este enfoque práctico se extiende a lo largo del libro, donde se exploran competencias generales de administración y se detalla el proceso administrativo en un contexto legal.
Uno de los aspectos más destacados del libro es su tratamiento de técnicas y herramientas específicas, como la técnica ALONSO para el análisis de problemas, el desarrollo organizacional, y diversos estilos de liderazgo; el libro también aborda temas cruciales como la administración del tiempo, la gestión de proyectos, y herramientas modernas como SCRUM y de apoyo como el Cuadro de Mando Integral.
Más allá de la gestión de proyectos, la obra se adentra en habilidades esenciales para cualquier profesional del derecho, como el liderazgo, la negociación, el manejo de conflictos, y la administración del conocimiento; además, introduce conceptos de LegalTech, destacando cómo la tecnología está redefiniendo la práctica jurídica a nivel mundial.
