Adorno und Herbert Marcuse war in den sechziger Jahren erstmals in der deutschen Nachkriegsgeschichte ins Bewustsein einer breiteren sozialwissenschaftlichen Offentlichkeit getreten, gefordert nicht zuletzt dadurch, das sie mit der Studentenbewegung fur einen kurzen Zeitraum auch im Zentrum aktueller gesellschaftspolitischer Diskussionen uber die Moglichkeiten einer neuen Verbindung zwischen radikaler Gesellschaftstheorie bzw. -kritik und emanzipatorischer oder gar revolutionarer Praxis gestanden hatte.1 Dies bildete die Voraussetzung dafur, das sie in den siebziger Jahren im Gefolge der einsetzenden Akademisierung von Marxismus und linker Gesellschaftskritik zunehmend zum Gegenstand intensiver wissenschaftlicher Forschung werden konnte. Es entstand neben Gesamtdarstellungen, die die wechselvolle Geschichte des am Frankfurter Institut fur Sozialforschung in den letzten Jahren der Weimarer Republik aus dem Kreis um Max Horkheimer entstandenen Kritischen Theorie rekonstruierten,2 eine Vielzahl von Studien und Monographien zur Entwicklung einzelner ihrer Vertreter.3 Daruber hinaus begann man, unter eher systematischen Gesichtspunkten Grundannahmen oder bestimmte Konzepte der Kritischen Theorie auf ihre Tragfahigkeit und Nutzlichkeit fur aktuelle wissenschaftliche Bedurfnisse und Fragestellungen hin zu befragen. So wurde beispielsweise versucht, aus ihrer fruhen Theoriephase ein Paradigma einer interdisziplinaren Sozialforschung zu destillieren4 oder sie als Vorstufe zu einer kommunikationstheoretisch fundierten Gesellschaftstheorie darzustellen.5 Andere Autoren zielten darauf ab, die Bedeutung der Kritischen Theorie fur die Analyse von Kapitalismus und Faschismus6 oder — besonders im Hinblick auf ihre eher an der,Peripherie’ des Instituts angesiedelten Vertreter wie Franz Neumann oder Otto Kirchheimer — fur die Politik- und Rechtswissenschaf ten einzuschatzen.7

Berucksichtigt man allein seine publizierten Schriften, so stehen Auseinandersetzungen mit politischen Parteien und Neuen Sozialen Bewegungen, mit politischer Bildung, Demokratie, Terrorismus oder Herrschaftspraktiken der DDR neben der Beschaftigung mit konservativer Kulturkritik und kritischer Gesellschaftstheorie, dem politischen Denken Carl Schmitts, Luhmanns Systemtheorie oder mit Rudi Dutschkes politischer Anthropologie. Wie Rousseau den Anspruch erhebt, im Contrat social die Prinzipien des Staatsrechts neu begrundet zu haben, so sollte die Fortsetzung der Institutions politiques auch die Grundlagen des Volkerrechts und der internationalen Beziehungen vollig neu bestimmen, bezeichneter sie doch als »Matiere toute neuve et ou les principes sont encore a etablir« (CS, 431, Anm.).

Jahrhundert zu einer internationalen Rechts- und Friedensordnung entwickelt wurden, das Projekt einer „weltbürgerlichen Transformation des Naturzustandes zwischen den Staaten in einen Rechtszustand“. Der vorliegende Beitrag untersucht, wie sich Habermas an diese Tradition anschließt und worin die Spezifik seiner Vorschläge besteht, Recht und Frieden unter veränderten historischen Bedingungen wie auch mit revidierten theoretischen Konzepten zu sichern. Abschließend werden Probleme und Defizite von Habermas’ Reformulierung der Kategorien der Analyse wie auch seiner Strategie einer „Konstitutionalisierung des Völkerrechts“ benannt.
