In the first section of this article, the authors first discuss the most relevant aspects of both... more In the first section of this article, the authors first discuss the most relevant aspects of both international arbitration and soft law. A brief comparative analysis between hard law and soft law is presented. The importance of soft law in international arbitration has lead a proliferation of these kind of instruments at the disposal of the arbitral community, which use them as reference in order to decide on some situations that might affect the arbitration process. Nowadays, some of those instruments are widely used. Furthermore, back in 2019, the Spanish Arbitration Club (Club Español del Arbitraje) launched an updated version of its Code of Best Practices which deals with the some of the most controversial topics in international arbitration. The second section of this article analyses the most pivotal aspects of the Code, that is, recommendations for other participants of the arbitration process such as arbitrators, counsels, experts and funders. Moreover, some reference to other parallel soft law instruments are made when appropriate. Finally, it is concluded that the Code is a modern instrument that respond to the needs of the arbitration users and constitutes a contribution to the Ibero-American arbitration community.
