Tre lezioni dal caso Taormina: il ruolo della società civile come strumento di empowerment dei so... more Tre lezioni dal caso Taormina: il ruolo della società civile come strumento di empowerment dei soggetti discriminati La recente decisione del Tribunale di Bergamo del 6 agosto, con la quale un notissimo avvocato è stato condannato per discriminazione sul lavoro delle persone omosessuali, rappresenta la prima applicazione in Italia della normativa europea in materia di discriminazione per orientamento sessuale. L'Autore illustra tre specifiche ragioni per cui il caso merita attenzione, da cui gli operatori del diritto possono trarre spunto per una implementazione della lotta alla discriminazione secondo i canoni evidenziati anche dalla Corte di Giustizia. The recent decision of the Bergamo Tribunal (6/08/2014), in which a very well-known Italian lawyer has been condemned for discriminatory conduct towards homosexuals, represents the first application in Italy of the prohibition of discrimination on grounds of sexual orientation as provided under EU Law. The Author highlights three relevant reasons for which the case is worth attention. He argues that legal pratictioners in the field shall draw on such reasons to properly implement a strategy against discrimination designed according to the parameters established by the Court of Justice of the European Union.

This article aims at providing a legal assessment of relevant human rights and antidiscrimination... more This article aims at providing a legal assessment of relevant human rights and antidiscrimination provisions to point out how current legal standards solve some of the potential conflicts that may arise between religious collective freedom and sex and sexual orientation equality laws. Such analysis will be carried in regard to the case law of the ECtHR and the statutory provisions of the UK Equality Act 2010, as well as their application before the ECtHR and domestic courts in the UK. This assessment will shed light on the difficulties that traditional legal instruments demonstrate when it comes to frame the scope of the right to religious collective freedom. The paper will also consider whether alternative, non-litigious, means of dispute resolutions, focused on the willingness of both sides to collaborate and recognise each other identity, may provide a better strategy to reconcile the tension.
