l presente saggio si propone d’inquadrare la posizione della persona disabile all’inte... more l presente saggio si propone d’inquadrare la posizione della persona disabile all’interno dell’ordinamento costituzionale italiano, evidenziando l’incidenza dei princìpi personalistico, pluralistico e solidaristico. A tal proposito, si fanno propri gli orientamenti dominantidella scienza medica e di quella sociale, sottolineando come la loro introiezione giuridica concorra alla tutela costituzionale della persona in indagine. A fronte dell’esame di detti orientamenti, e in ragione dell’affermazione del cosiddetto “modello biopsicosociale” (che sonda la disabilità in termini cumulativamente biologici, psicologici e sociali), si contesta la disorganicità della normativa italiana e si pone l’accento sul ruolo giocato dalla Corte costituzionale nello sviluppo del citato modello. Infine, si prospettano alcune soluzioni – legislative e interpretative – circa la definizione di paradigmi giuridici (ma anche definitori) che garantiscano tutela effettiva alla persona disabile.

Una scolarizzazione inidonea negherebbe dignità sociale ai portatori di handicap, legittimando distinzioni personali non compatibili con l’essenza democratica dell’ordinamento. Il nucleo indefettibile dell’inclusione – che risiede nei livelli essenziali delle prestazioni sociali – è diretta emanazione di quella dignità e tende alla ricomposizione delle diseguaglianze socio-economiche. Si erge pertanto a diritto incomprimibile e non soggiace alle statuizioni di cui all’art. 81 Cost. La cogenza di questo minimum constitutional guarantee deve tradursi in politiche di bilancio che valorizzino il vòlto personalista della disabilità e lo elevino a vincolo budgetario positivo. In altri termini, i livelli essenziali parafrasano lo stato di bisogno dei soggetti più vulnerabili e non possono essere assoggettati ad alcun vaglio di sostenibilità finanziaria: il legislatore è obbligato a salvaguardarli e non può addurre la loro inattuazione all’indisponibilità di risorse, ratione fortiori se il bilancio include spese evitabili e suntuarie.

Giuseppe DI PANGRAZIO Premessa e avvio dei lavori La riunione del tavolo tematico che, come da programma, prende avvio alle ore 11: 00 muove da alcune basilari premesse. Innanzitutto, l'idea della costante necessità di adeguamenti della macchina organizzativa della Regione Abruzzo nel contesto di "multilevel governance" europeo. Si tratta di esigenza immanente a ogni istituzione politico-sociale (come si è autorevolmente e diffusamente sostenuto: "res publica semper reformanda est"), acuita nella congiuntura presente dalla circostanza per cui le dinamiche nazionali e regionali non possono assolutamente prescindere da quelle di scala europea (a loro volta sempre più oggetto di profondo ripensamento, specie dopo la vicenda "Brexit"). In secondo luogo, la convinzione del forte collegamento tra l'esigenza di costante autoriforma che dev'essere presente a livello regionale e l'obiettivo si intercettare e utilizzare al meglio quei fondi europei (quali POR FESR-FSE), che oggi rappresentano una delle risorse principali per "far crescere" i territori. Inoltre, l'evidenza di un'attenta considerazione dei riflessi sull'autonomia regionale delle modifiche costituzionali in itinere. Più in particolare, a quest'ultimo riguardo, si muove dalla convinzione che la riforma costituzionale che sarà a breve sottoposta a ratifica referendaria è da leggere non come "minaccia" all'autonomia dell'ente, ma come stimolo e occasione da cogliere per quel che si può indicare (con un poco elegante, ma espressivo neologismo) come l'"efficientamento" della macchina regionale (vale a dire il miglioramento dell'"output" complessivo dell'istituzione regionale tramite la ricerca e l'implementazione, nella trama del quadro normativo vigente, di opportune modalità sia organizzative sia funzionali). Ma anche laddove la riforma costituzionale non dovesse essere confermata nel voto referendario previsto per il prossimo autunno, resterebbe comunque forte, come accennato, l'esigenza per la Regione di procedere ad adeguamenti e messa a punto (ripensamento) di aspetti molteplici del suo modo d'essere e d'agire (riforme istituzionali). La Regione Abruzzo, al pari delle altre entità regionali europee, è investita da una serie di crisi (da quella della rappresentanza politica a quella economica) e da una serie di sfide (da quella dello stallo del processo di integrazione europea a quella dei processi di globalizzazione), rispetto alle quali deve dar prova-da un lato, tenendo ben presenti le proprie specificità storico-geografiche ed economico-sociali e, dall'altro, di Il presente resoconto è a cura di Romano ORRÙ e di Giampiero DI PLINIO.
