La Suisse ne constitue pas une particularité et les réformes juridiques suisses en matière d’illégitimité illustrent des processus repérables sur le continent, qui se déroulent selon des rythmes et des modalités différentes1. L’analyse de ces réformes juridiques démontre que leurs enjeux dépassent la situation particulière des enfants illégitimes : elles remettent en question les relations entre ordre familial et ordre social, le contrôle des autorités civiles et religieuses sur les comportements sexuels, les visions du rôle de l’Etat, les rapports de pouvoir entre les sexes et les catégories sociales.
Après une brève présentation de la procédure de recherche en paternité, adoptée durant toute l’époque moderne (16e-19e siècle), cet article se concentre sur les modifications juridiques intervenues au cours du 19e siècle, en raison des changements démographiques, mais aussi sous l’effet d’une réflexion économique et politique nouvelle sur la gestion de la pauvreté, la propriété, les droits individuels et le rôle de l’Etat.

Tous sont confrontés au processus de déclin de la fécondité maritale, qui suscite de nouvelles préoccupations relatives à la dépopulation et à la dégénérescence. Avec la prise de conscience médicale de la gravité et de la contagiosité des maladies vénériennes, ces inquiétudes prennent la dimension d’un péril national. La nécessité de contrer ces dangers autorise un discours respectable sur la sexualité, qui devient l’objet d’un savoir à diffuser, voire à enseigner dans les écoles. Bien plus qu’une information, l’éducation sexuelle est davantage comprise comme l’imposition de normes, en particulier l’abstinence prémaritale, très largement prônée. Un tel consensus pourrait favoriser la mise en place de projets; or, malgré la profusion de discours, les réalisations concrètes restent rares et controversées, surtout dans le cadre scolaire. Comment expliquer ces difficultés? Cet article analyse les dynamiques entre le niveau transnational (conférences, congrès) et le niveau local, en comparant les discours et mobilisations autour de l’éducation sexuelle dans deux cantons suisses francophones (Vaud et Genève). Nous attachons une attention particulière à la manière dont ces projets sont légitimés scientifiquement et sur quelles disciplines leurs défenseurs s’appuient; nous examinons aussi le rôle du genre dans ces mobilisations, étant donné que les femmes et les féministes s’invitent dans ces débats.

Cette etude comparative portant sur les villes de Lausanne et Fribourg adopte le point de vue des individus en y integrant une perspective de genre. Basee sur des entretiens en histoire orale avec des personnes qui etaient parents et mariees a Fribourg et Lausanne durant la periode etudiee, cette recherche se concentre sur deux aspects particuliers touchant au role des femmes dans la formation familiale, reinterrogeant des suppositions ou des presupposes de la recherche. D’abord, a l’oppose de l’idee d’une emancipation des modeles traditionnels, le modele de la mere au foyer est plus pregnant que jamais dans cette periode. Pour autant, cela n’empeche nullement les femmes d’etre proactives dans le domaine de la contraception. Ainsi, ce n’est pas par volonte d’emancipation que les femmes elargissent leur domaine de competence a la sexualite, mais plutot, paradoxalement, par leur adhesion au modele traditionnel de la mere au foyer disponible et competente pour ses enfants.
