The Universal Declaration of Human Rights in the Case Law of the Court of Justice of the European... more The Universal Declaration of Human Rights in the Case Law of the Court of Justice of the European Union. – Starting from the evolution in the EU of the legal framework devoted to human rights protection, this essay focuses on the influence of the Universal Declaration on Human Rights on the judicial bodies of the European Union. The research is based on the Advocate General opinions and on the recent case-law of the Court of Justice, mainly in the field of the fight to terrorism, social policy and anti-discriminatory law, verifying the new trends in extensive interpretations and the influence that this change could lead to the International Community approach towards the Universal Declaration

Il contributo parte con la definizione del quadro giuridico attuale mediante il quale il diritto ... more Il contributo parte con la definizione del quadro giuridico attuale mediante il quale il diritto dell’Unione europea si occupa del tema del divieto di discriminazioni basate sull’età, per poi analizzare la giurisprudenza della Corte di giustizia a partire dal caso Mangold sino alle più recenti pronunce successive all’attuazione della direttiva 2000/78/CE. In particolare, dopo aver analizzato l’applicazione del principio di non discriminazione basata sull’età quale principio generale del diritto dell’Unione europea come derivante dagli strumenti giuridici di diritto internazionale, verranno approfondite le pronunce più recenti relative al problema dell’età massima per l’accesso ad attività lavorative e dell’età obbligatoria di pensionamento, per poi trarre alcune conclusioni relative al bilanciamento fra le diverse esigenze coinvolte e alle conseguenze del nuovo approccio da parte della Corte di giustizia

This paper analyses EU Regulation 1259/2010 (coming into force on June 21, 2012), which represent... more This paper analyses EU Regulation 1259/2010 (coming into force on June 21, 2012), which represents the first case of enhanced cooperation in the field of judicial cooperation in civil matters. It starts from the difficult reform process of EC Regulation 2201/2003 with particular reference to the 2006 proposal – strongly censured by many Member States – and then investigates EU Regulation 1259/2010 provisions applying to divorce and separation (inter alia, the choice of law and applicable law in its absence, the application of the law of the forum, the public policy exception). The author identifies lacks and problems of the new discipline – making a comparison with the new proposals on matrimonial property regimes and on the property consequences of registered partnerships – and underlines the necessity to reform EC Regulation 2201/2003 in order to coordinate a too composite discipline.

Using a critical analysies of the existing legal framework and its interpretative evolution in both the EU and Italian case-law, as well as, in the positions of the European Commission and the Italian Competition Authority (AGCM), the authors focus on the new role of professional associations as gatekeepers of the quality of the service (in order to protect the final users) and on the limits to their activity. The main reference is made to the legal professions (lawyers and notaries) and to the still existing restrictions to internal market rules as emerging from the recent directive n. 2018/958 on the proportionality test before adoption of new regulation of professions, in order to evaluate the future of professional regulation in domestic law

Le riflessioni sviluppate nel presente contributo intendono ricostruire gli aspetti essenziali de... more Le riflessioni sviluppate nel presente contributo intendono ricostruire gli aspetti essenziali del contesto giuridico inter/sovra-nazionale in cui si inserisce la questione della tutela dei rapporti genitoriali transnazionali, evidenziando in particolare come il coordinamento – oggi necessario ed inevitabile – della dimensione domestica con quella internazionale del diritto di famiglia non sia affatto operazione semplice, in particolare laddove le due entrino in aperto conflitto, inquadrando un medesimo rapporto in modo più o meno significativamente divergente. The paper aims at reconstructing the main aspects of the inter/supra-national legal context where the issue of protecting transnational parent-child relationships has emerged. Notably, it highlights how the necessary and inevitable coordination of the domestic and international dimensions of family law is by no means a simple operation, in particular where the two enter into open conflict, qualifying the same parent-child relationship in ways that diverge more or less significantly
I regolamenti dell’Unione europea in materia di famiglia (2201/2003 e 2019/1111) presentano ancor... more I regolamenti dell’Unione europea in materia di famiglia (2201/2003 e 2019/1111) presentano ancora problemi di applicativi quando si trovano ad affrontare situazioni che coinvolgono direttamente o potenzialmente autorità giurisdizionali di Stati terzi, sia sotto il profilo dello scioglimento del matrimonio, sia, a maggior ragione, per gli aspetti correlati alla responsabilità genitoriale. L’articolo si occupa di analizzare il coordinamento fra fonti dell’Unione europea e fonti sovranazionali (Convenzione dell’Aja sul divorzio (1970) e Convenzioni dell’Aja sulla protezione dei minori (1996) e sugli aspetti civili della sottrazione internazionale degli stessi (1980)) al fine di rilevare le incongruenze tuttora esistenti, facendo riferimento alla giurisprudenza della Corte di giustizia e a quella dei giudici nazionali che sono intervenute per cercare di colmare le lacune con risultati non sempre coerenti. Particolare attenzione viene data alle pronunce di corti francesi e inglesi, molto attive sul punto, per poi valutare se e come il nuovo regolamento 2019/1111 potrà porre rimedio all’attuale situazione.

The evaluations will also take into account Opinion 1/19 of the EU Court of Justice, the Council Decision 2017/865 on the signature of the Istanbul Convention and the draft decisions on the conclusion of that same agreement. In this context, reference will be made to the provisions of the directive dealing with the qualification of certain forms of violence against women (in particular the ones cybercrime) and to the risk of disputes by States that have not ratified or are raising problems about the implementation of the Istanbul Convention, seeking to assess the prospects for the future adoption of the proposed directive

Starting with the recent development that led the EU to ratify the Istanbul Convention with the decisions approved on 1st June 2023, the author examines the recent proposal for a directive on the topic, evaluating in particular its legal basis as proposed by the European Commission (Article 82.2 and Article 83.1 TFEU), taking into account Opinion 1/19 of the EU Court of Justice, and all the decisions that authorised signature and ratification of the Istanbul Convention and the possible alternatives. In this context, reference will be made to the provisions of the directive dealing with the qualification of certain forms of violence against women (in particular the ones connected to cybercrime) and to the risk of challenges by States that have not ratified or are raising problems about the implementation of the Istanbul Convention, seeking to assess the prospects for the future adoption of the proposed directive.

Starting from Directives 77/249 and 98/5, but with a reference also to the case-law and to the relevant framework on professional qualification recognition (Directive 89/48 and subsequent changes) and free movement of services (Directive 2006/123), the article focuses on the changes to the profession of “avvocato” in Italy and on the evolution still required in order to comply with the new requests from the European Commission.
