Seit der Präsidentschaft Obamas kam es sowohl auf Bundesebene als auch in vielen Bundesstaaten zu Reformen, die sich insbesondere auf die Verringerung der Strafen fu?r minderschwere Drogendelikte konzentrierten. Als theoretische Grundlage dieses Fokus dient den ReformerInnen häufig eine Erzählung u?ber die Masseninhaftierung, die am prägnantesten von Michelle Alexander in ihrem Buch The New Jim Crow formuliert worden ist. Im Artikel wird eine Kritik an dieser Erzählung entwickelt und gezeigt, dass die Konzentration auf den »Krieg gegen die Drogen« ernsthaften Reformen des Systems der Strafjustiz im Weg steht.

Dies geschieht durch die Gegenüberstellung von den beiden einflussreichsten Anknüpfungen an das Ideologiekonzept von Karl Marx: der Ideologietheorie im Anschluss an Louis Althusser und der Ideologiekritik im Anschluss an die Kritische Theorie der Frankfurter Schule. Anfangs werden die verschiedenen Ideologiekonzepte im Werk von Karl Marx behandelt, um danach zu zeigen, wie diese in ideologietheoretischen und ideologiekritischen Rassismustheorien rezipiert und weiterentwickelt wurden. Sie ignoriert den wissenschaftstheoretischen Einschnitt in Marxens Werk, der sich durch einen Bruch mit dem philosophischen Paradigma seiner Frühschriften ausdrückt und verfehlt einen fundamentalen Aspekt seiner Ideologiekritik, den Michael Heinrich treffend als „Metakritik des neuzeitlichen Moraldiskurses“ bezeichnet hat. Zudem wird dieser Bruch auf ein genuin politisches Argument bezogen, dass Marx ab den späten 1840er Jahren in seinen Kritiken anderer gesellschaftskritischer Strömungen und Autoren entwickelt hat. Hier soll deutlich werden, dass Marx nicht nur durch wissenschaftliche, sondern auch taktisch-strategische Erwägungen in seinem Spätwerk bewusst von seinem bisherigen Modus immanenter Kritik Abschied genommen hat. Zu diesem Zweck werden die beiden einflussreichsten Anknüpfungen an das Ideologiekonzept von Karl Marx gegenübergestellt: die Ideologietheorie im Anschluss an Louis Althusser und die Ideologiekritik im Anschluss an Georg Lukács und die kritische Theorie der Frankfurter Schule. Die neomarxistische Debatte um eine analytische Bestimmung von Rassismus, die in den 1990er Jahren im deutschen Sprachraum geführt wurde, bildet hierfür den Rahmen, wobei auch rassismustheoretische Arbeiten aus der französischen und angelsächsischen Diskussion in die Analyse miteinbezogen wurden.
Im ersten Teil der Arbeit werden die verschiedenen Ideologiekonzepte im Werk von Karl Marx behandelt, um danach zu zeigen wie diese in ideologietheoretischen und ideologiekritischen Rassismustheorien rezipiert und weiterentwickelt wurden. Die Beiträge des Bandes widmen sich der Theoretisierung von Recht und Staat bei Karl Marx sowie der im Anschluss an diese entstandene Rechtstheorie des sowjetischen Juristen Eugen Paschukanis. Marx und Paschukanis ist gemein, dass sie versuchen das Recht und den Staat als soziale Formen kapitalistischer Gesellschaften anstatt als überhistorische Entitäten aufzufassen. Während sich bei Marx jedoch nur Ansätze einer solchen Rechts-und Staatstheorie finden lassen, hat sich Paschukanis an der expliziten Ausarbeitung einer solchen versucht, die jedoch oft auf Kritik stößt. Sowohl die gängigen Kritiken als auch das Potenzial von Paschukanis' Theorie wird im rezensierten Band thematisiert.

Ausgehend von einer materialistisch-staatstheoretischen Perspektive, wird der Zusammenhang von Staatenformierung, Kapitalismus und Rassenideologie diskutiert. Die anleitende These besteht darin, dass der Rassismus auch als Mittel im Kampf um die Form des Staates zwischen feudalen Eliten und den produzierenden Klassen verstanden werden muss. Anders gesagt: er war eine Ideologie, die gegen die Demokratisierung des Staates und zur Verteidigung von Standesprivilegien eingesetzt wurde.
