Penjualan energi listrik panas bumi oleh PGE melalui Perjanjian jual beli listrik (PJBL) selama ini masih didominasi oleh PLN selaku pembeli. Hal tersebut karena PGE tidak mempunyai infrastruktur kelistrikan berupa jaringan transmisi untuk menunjang adanya penjualan langsung. Sejak terbitnya Permen ESDM No 1 Tahun 2015, maka hambatan PGE untuk melakukan penjualan langsung dapat diatasi. Permen tersebut memberikan payung hukum bagi adanya open access dalam bentuk power wheeling / pemanfaatan bersama jaringan transmisi listrik milik badan usaha transmisi tenaga listrik. Dengan adanya skema open access ini maka PGE berpeluang untuk melakukan penjualan langsung energi listrik panas bumi kepada captive market di Indonesia. A. PENDAHULUAN Hak asasi anak merupakan bagian dari hak asasi manusia yang termuat dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dari sisi kehidupan berbangsa dan bernegara, anak adalah masa depan bangsa dan generasi penerus bangsa, sehingga setiap anak berhak atas kelangsungan hidup, tumbuh, dan berkembang, berpartisipasi serta berhak atas perlindungan dari tindak kekerasan dan diskriminasi serta hak sipil dan kebebasan. Hasil Proyeksi Sensus Penduduk 2010, penduduk Indonesia diperkirakan mencapai 243,8 juta jiwa pada 2011, dan sekitar 33,9 persen diantaranya adalah anak-anak usia 0-17 tahun. Hal ini menunjukkan bahwa berinvestasi untuk anak adalah berinvestasi untuk sepertiga lebih penduduk Indonesia. Salah satu aspek penting untuk melihat kualitas anak adalah dari sisi pendidikan. Hasil Susenas 2011 menunjukkan bahwa anak usia 5-17 tahun yang berstatus sekolah sebesar 80,29 persen. Meskipun persentase anak usia sekolah yang masih bersekolah cukup tinggi, namun kualitas dari anak tersebut juga harus ditingkatkan demi terciptanya Sumber Daya Manusia yang berkualitas di masa mendatang. Sebagai generasi penerus bangsa, hak-hak anak untuk dapat hidup, tumbuh dan berkembang nyatanya masih belum menunjukkan adanya pemenuhan dan perlindungan hak. Hal ini dibuktikan dengan masih banyaknya kasus keracunan yang menimpa anak-anak sebagai akibat dari buruknya kualitas jajanan di sekolahnya. BPOM menyebutkan, lebih dari 99% anak sekolah mengonsumsi Pangan Jajanan Anak Sekolah (PJAS) untuk memenuhi kebutuhan energinya saat berada di sekolah. Hasil pengawasan BPOM pada tahun 2013 juga menunjukkan bahwa pangan jajanan anak sekolah (PJAS) yang memenuhi syarat hanya sekitar 80,79% dari sampel PJAS yang diuji. Sedangkan sisanya yang mencapai 19,21% tidak memenuhi syarat karena penyalahgunaan bahan berbahaya serta cemaran mikroba dan atau bahan tambahan pangan yang melebihi batas. Bila dikaitkan dengan keberadaan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, anak-anak pada kasus tersebut merupakan konsumen yang telah dilanggar hak-haknya. Hak-hak konsumen yang dilanggar pada kasus tersebut adalah hak konsumen seperti yang tercantum dalam Pasal 4 Undang-Undang Perlindungan Konsumen yaitu hak atas kenyamanan, keamanan, dan keselamatan dalam mengkonsumsi barang dan/atau jasa. Anak-anak sebagai konsumen yang mengkonsumsi barang dan/atau jasa seharusnya memperoleh metode perlindungan yang khusus mengingat anak-anak dalam melakukan hubungan hukum seharusnya masih memerlukan perwalian. Disisi lain kepentingan pelaku usaha juga harus diperhatikan karena pelaku usaha juga mempunyai hak untuk memperoleh penghidupan yang layak. Berdasarkan hal tersebut, maka penulis mempunyai suatu solusi yang dapat menjadi metode alternatif perlindungan dan pendidikan konsumen anak-anak berupa program “Kawasan Konsumen Anak” atau “KAKAK”. KAKAK adalah suatu program dimana mengefektifkan peran sekolah dalam menyelenggarakan perlindungan dan pendidikan konsumen secara sekaligus. Disisi lain KAKAK juga mampu untuk mengakomodir hak anak sebagai konsumen dan juga hak pelaku usaha. Apabila konsumen anak-anak telah memperoleh pemenuhan hak berupa perlindungan dan pendidikan konsumen yang baik, maka merupakan suatu keniscayaan bahwa akan tercipta suatu generasi konsumen cerdas dan mandiri di Indonesia.
