This report addresses complex issues related to discrimination on the grounds of gender identity and gender expression, as well as discrimination on grounds of sex vis-à-vis intersex people. The report also clarifies the definitions used in the context of trans discrimination, and the terms used by the community to represent the diversity within it. This study highlights the obstacles and negative attitudes faced by this community and the difficulties with regard legal recognition and rights. The report also extensively examines the influence of EU law, including case law, on trans discrimination and provides case studies of national legislation and case-law on gender identity and gender expression discrimination of some Member States where there are promising approaches which can and should serve as models for others to follow.
The intersex condition is explicable by science, and as such, is a straightforward issue of civil rights, not really a movement out to transform society. It is not really controversial, despite occasional prejudice depending on how sever the condition, in contrast to the gay or transgender movements which are indeed movements with political goals and are bound to face resistance, despite attempts to claim the 'battle' has now been 'won'.

The debate around the principle of equality and the theme of discrimination around sexual orientation has been one of the most relevant in the process of ensuring the spread of human rights. After ensuring a set of civil and political rights, several groups and social movements have warned political actors of the need to look at each citizen’s individuality and guarantee through legislation and daily practices, respect for that individuality. This process is being conducted around the dichotomy between the concepts of equality and difference. It is from this analysis of the two concepts that we come across the theme of the rights of the lesbian, gay, bisexual, transvestite, transexual and transgender (LGBTQ+) community. Amongst the various challenges faced while studying intersex matters, there is the defiant discussion of sexuality and gender. In this special issue there are certain dimensions of wholeness and integrity of the individual which cannot be ignored. One of these dimensions is the approach in human rights. However, every intersex child's birth confronts the family and the multidisciplinary team with a sticky situation. This article aims to analyze the process of developing a booklet for families with intersex children. The methodology of this article draws upon the collection of graduate research procedures for the development of the content. The interviews done in Salvador, Bahia, Brazil with intersex youth and adults, their families, health and social service agents such as psychologists and legal professionals were gathered together to create the booklet. The booklet is a mild form of communication for families of intersex children introducing them to scientific information. This work paves the way for further discussions concerning the principles of human rights and of the psychologist's role in its provision. Future directions include a matrix that fills the training practice and the research—an approach of professional experience in a mostly interdisciplinary perspective—with the family. Facing the challenges of the family with an intersexed child, the involvement of a psychologist in an interdisciplinary team is decisive and irreplaceable. The main purpose of this article is to analyze the interdisciplinary process of developing a booklet for families with intersex children. Intersexuality reveals the complex nature of gender and involves anatomy and sexual congenital reproduction that deviates from what is socially expected of men and women (Canguçu-Campinho, 2012; Canguçu-Campinho, Lima, & Souza, 2015). The features that define male and female bodies are mixed when it comes to the intersex body. It is understood that cultural contexts play a significant role in defining gender and sex. Bodies are perceived within cultural scripts that determine what sex "should" belong to, and consequently, what gender is expected. Seen as a cultural construction, gender is shaped by prevailing views that dictate the different ways to define oneself in the world.
Despite the majority of countries in the modern world recognizes the idea and principles of equality before the law, understanding of the idea of intersex equality differs from country to country, hence the diverse approach of lawmakers regarding the definition of rights and obligations towards sexes. Division of people into two opposite sexes (male and female) no longer endures the development trends of contemporary thought. Assigning sex to a newborn (state registration of assigned sex in the birth certificate) according to the primary sexual signs often becomes the cause of multiple traumas for this infant in the future, because it can be intersex. In most cases it is impossible to determine the sex of a newborn child based on the “principle of more likelihood” when it has the sexual organs that are characteristic to both sexes. Globally, the laws in majority of countries do not provide any other possibility to choose, and the infant is assigned either male or female sex, and the respective entry is made in the birth certificate. Relevant changes to the birth certificate or other documents/certificates are linked to the issues of surgery or sex reassignment in the future. Equality of people is of vital significance for the contemporary law of the modern world, which is impossible to observe if various people/newborns are already different from one another from the viewpoint of legal aspect of the entry made in the birth certificate. Opting for one of the two offers (male/female) may not necessarily be reflective of the reality that exist in case of both intersex and transgender persons. This article raises/analysis and offers a model, which ensures gender equality for the newborn. This model will also simplify the legal procedures related to sex reassignment.
