    The parties agree as follows:
    1. The Project: Commissioner is commissioning a _______________
    _________ by the Artist. Subject matter is _______________________
    and the Commissioner understands that the Artist will do his/her best to
    reciprocate what the Commissioner wants, and that the Artist has a
    particular and unique style that may influence the commissioned work.
    2. Right of Refusal: It is the intent of this contract that the Artist creates
    artwork for the Commissioner and that the Commissioner will purchase.
    However, if, after the work is completed, the Commissioner does not wish
    to purchase any or all of the work, the Commissioner may refuse, on an
    individual basis, each created artwork. In that case, the Artist will retain
    the refused artwork and the nonrefundable deposit, free of any claims or
    interests of the Commissioner, and the Commissioner will owe no
    additional fees to the Artist. A refusal will not affect the purchase price of
    other created artworks in this project. If the commissioned work is
    anything other than a portable work, such as a wall mural or window
    mural, the Artist will retain the nonrefundable deposit, free of any claims
    or interests of the Commissioner.
    3. Copyright: Artist reserves the common-law copyright to all works
    commissioned by Commissioner that are created by the Artist, including
    all reproduction rights and the right to claim statutory copyright. No work
    may be reproduced by Commissioner without the prior written approval of
    Artist.
    4. Payment Amounts: Fees/selling price will be decided by the parties per
    individual artwork, with a minimum of $30.00 for each painting. Fee will
    be based upon canvas size and complexity of completed work, and will be
    consistent with other comparable works by Artist at the time of sale.
    Painting sizes will be mutually determined by the Artist and
    Commissioner. Artist and Commissioner agree that the amount owed to
    Artist is _______________________.

    5. Payment Terms: A nonrefundable deposit of one-third of the selling price


    is required before work commences. Payment in full is due upon receipt of
    artwork(s).
    In the case of a wall or window mural commission, payment installments will be
    made as follows:
    a. One-third nonrefundable deposit required to start.
    b. Full payment/ remaining balance due upon completion.
    *if Commissioner decides he/she wants more added to the wall or window
    commission upon completion by the artist, the Commissioner agrees to pay
    the artist an amount of $25.00 per hour until the added details are completed.
    6. Attorneys Fees: In any proceeding to enforce any part of this contract,
    the aggrieved party shall be entitled to reasonable attorneys fees in addition to
    any available remedy.
