Luth # 1375 Date / Time followed by the activity: Below Notes are from Sergeant Luth # 1375 November 28, 2007: Case assigned for investigation by Chief Hendershott and given Internal Affairs number of 08 080. April 28, 2008 at approximately 1326 hours: Lieutenant Seagraves will send binder with Chief Young for Tuesday or Wednesday, (Felbab portion may not be complete). April 28, 2008 at approximately 1337 hours: Lieutenant Seagraves called back concerned about her place in the investigation (if principal or witness, or lead) April 28, 2008 at approximately 1406: Will bring book. April 29, 2008 at approximately 1045 hours: Book brought in by Young turned over to Luth. My notes: Monday, May 12, 2008 at approximately 1200 hours: Sergeant Luth turned over the Admin Case (08 080) to me. He provided me a white three ring binder containing documents provided to him from Lieutenant Seagraves (through Deputy Chief Young). Also provided me with a disc marked on the outside as 08 080. CD contains list of questions drafted by Luth. Also scanned in images of memos on other matter. Did not read the memos on the other matter pending authorization. Also contains audio recordings of phone contact between Luth and Seagraves. Tuesday, May 20, 2008 at approximately 0840 hours: I met with Chief Freeman in his office regarding clarification on this investigation. I asked Chief Freeman to describe the goal of the investigation. Chief Freeman explained that the goal was to determine if cases were not worked when they could have been and should have been. Chief Freeman explained that he was not so concerned about the decision of what cases were to be turned over or who made that decision. Chief Freeman suggested that the investigation be initiated with Captain Whitney and then worked downward. Chief Freeman was asked about providing Captain Whitney with a notice and Garrity. Chief Freeman stated that he should be provided this information, although he was likely not a principal. Monday, June 02, 2008 at approximately 1400 hours: I made telephone contact with Captain Whitney and advised him that I would need to meet with him to conduct an interview. We agreed to meet at his office on Tuesday, June 3, 2008 at approximately 0930 hours for the interview to be conducted. This call was not audio recorded. I reached Captain Whitney at a contact telephone number of (602) 876 4817. Tuesday, June 03, 2008 at approximately 0930 hours: I conducted an interview with Captain S. Just so you are awareLieutenant Burden called me a few ago-in reference to an El Mirage case that Detective Weege had. I did not have an answer for him and he asked about the log book that I had which I turned over to IA. I told him that I had a copy but I did not want to say anything because of my situation- So if he calls that is what he is asking about. I am not sure if the case that he is looking for is even one of the items that is outlined in that book. Talk to you soon (unfortunately) No offense! Kim Wednesday, June 18, 2008 at approximately 1355 hours: I attempted to contact Lieutenant Seagraves in reference to scheduling an interview with her. I received her voice mail at her work contact telephone number. I left a message identifying myself and requesting a call back. I then called her cellular telephone and received no answer. Wednesday, June 18, 2008 at approximately 1404 hours: I sent Lieutenant Seagraves another E mail about scheduling an interview with her. I wrote the following text: Hi Kim, Please call me when you can about setting something up. Hopefully for tomorrow (anytime, at your place Cave Creek / Carefree if OK with you). Thanks, Bruce Monday, June 23, 2008 at approximately 0851 hours: Lieutenant Seagraves called my cellular telephone and confirmed our appointment for 1300 hours, today at District 7 (Cave Creek, Carefree) for an interview. Monday, June 23, 2008 at approximately 1340 hours: I conducted an audio recorded interview with Lieutenant Seagraves at District 7 headquarters. Tuesday, June 24, 2008 at approximately 0900 hours: I met with Chief Freeman to brief him on the interview of Lieutenant Seagraves. I expressed that she took actions when realizing that DRs were not being sent to SVU and that she had a general list of cases from El Mirage but, not a specific list of cases turned over to El Mirage. Chief Freeman expressed that Chief Knight was meeting with El Mirage today to discuss their concerns and might have additional information for me later. I advised that I would be requesting the open DRs from Lieutenant Seagraves list to be produced by records and that I would review those records after they were produced. Tuesday, June 24, 2008 at approximately 1500 hours: I provided records with a list of DRs that I need pulled and copied in reference to this investigation, for the review regarding status and amount of investigation conducted.
