JOINDER OF CLAIMS STEP-BY-STEP

1) R.18 Joinder of Claims


a) R.18(a) Test: Party seeking relief from an opposing party may join with his original claim any additional claims he has against the opposing party. b) Notes: Kicks in once a valid claim is made (under any FRCP). Opposing parties exist when a claim is made by one against the other, even if theyre on the same side of the v. (crossclaim).

2) R.13 Compulsory Counterclaims


a) R.13(a) Test 1: Does the counterclaim arise out of the same transaction or occurrence that is the subject matter of the opposing partys claim? b) R.13(a) Test 2: The counterclaim does not require adding a party that the court cant assert jurisdiction over. c) Notes: Must assert counterclaim as soon as first claim is made if it fits tests.

3) R.13 Permissive Counterclaims


a) R.13(b) Test: Pleading may state any claim against an opposing party that is not compulsory. b) Notes: These claims could be separate actions as well.

4) R.13 Crossclaims
a) R.13(g) Test: Pleading may state as crossclaim any claim by one party against a coparty if the claim arises out of the transaction or occurrence that is the subject matter of the original action/counterclaim. b) Notes: Crossclaim may be for contribution/indemnification.
