DOCKET ENTRIES:
On this the 25th day of December, 1920. Clara Smith Hamrnon, defendant herein, is And brought before the Justice by Buck Garrett, Sheriff of Carter County, Oklahoma. Attorney, County Brown, B. R. and, attorneys her Coakley there being present, fathers & t/e defendant is duly arraigned, the information being read to her by the County Attorney, the defendant enters her plea of "Not Guilty" to the charge of murder as The justice then asks if the State is ready for trial set out in the information. and the County Attorney announcos ready but, the defendant, by'her attorney, C. A. Coakley, v:eivos an acamining trial: It is therefore ordered and djudged that the defendant, Clara Smith Hammon, be committed to the custody of the Sheriff of Carter County, Oklahoma, for safe keeping to be held in custody pending action by the District Court of Carter County, Oklahoma, Hal M. Cannon, Justice of the Peace.

Hamon,from a certain loaded pistol,which ahe,the aaid Clara Smith Hanion,then and there,had and held in her hand,then and there,and thereby inflicting upon the body of him,the said Jake L.Hamon,a mortal wound of which he,the aaid Jake L.Hamon, then and there,languished and languishing,on or about the 26th day of November,1920,then and there,did die; that the said Clara Smith Hamon,in manner and form aforesaid,did, then and there,kill and murder the said Jake L.Hamon;
contrary to the form of the statutes, in such case made and provided, and against the peace and dignity of the State.

Ua-hers, is, by reason of having been employed by the defendant to represent her prior to his entering upon the duties as county attorney of said county, disqualified to prosecute said cause for and on behalf of the state, and- the court being fully advised in the premises, is of the. opinion that H. H. Brown, a neriber of the bar of the city of Ardnore, Carter County, Oklaho:.oa, duly and legally licensed to practice law in this state, is a fit and proper person to con duct tlie prosecution of this cause on behalf of the state; It is therefore ordered, adjudged and decreed by the court tnat the said .u. II. Brown be, and he is hereby appointed as provided by law, to prosecute the above named defendant for the crime of murder as charged against her, and that he be paid for his services as such prosecutor a resonnable^ f ee to be here after determined by this court. H. blanding at this time and that said H. h. Blanding is now inflicted with Diabetes InsipiduB, and that because of his said affliction the said H. H. Blanding is not able -;o travel, nor is he in the judgment of the affiant able to be away fron his home v/ith safety to hie health, and if he were required to attend the trial of the above cause in his preoent condition that such attendance ir. the opinio n of affiant would result in serious detriment to the health of the said II. R. Blanding and quite possibly imperil his life, ana that in the judgm ent of affiant the said ii. R. Blanding will not be able to travel or attead said trial for a period of twenty days at least and from the nature of his ailment it is more than probable that his condition will not show substantial im provement for a longer period than that.

GEBTLEMEN OP TH*3 JURY:
I.
The defendant, Clara Smith Hamon, is duly presented by an information filed in the District Court of Carter County, Oklahoma, on the 3d day of' January, 1921, charging said defendant, Clara Smith Hamon, with the crime of murder. is substantially alleged in said information that Clara Smith Hamon, did, in Carter County, and in the State of Oklahoma, on or about the 21st day of November, in the year of our Lord, One Thousand Nine Hundred and Twenty, then and there, wilfully, unlawfully and feloniously, with
a premeditated design to effect the death of one Jake L

Hamon, shoot and discharge metallic bullets into the body of him, the said Jake L. Hamon, from a certain loaded pistol, which she, the said Clara Smith Hamon, then and there, had and held in her hand, then and there and thereby inflicting upon the body of him, the said Jake L. Hamon, a mortal wound, of which he, the said Jake L. Hamon, then and there, languished and languishing, on or about the 26th day of November, 1920,
then and there, did die; that the said Clara Smith Hamon, in manner and form aforesaid, did, then and there, and murder the said Jake L. Hsmon.
II For a more complete description of the allegations contained in said information you will be permitted to take the sans with you in your retirement.

To the information filed against the defendant, Clara Smith Hamon, charging her with the crime of murder
she has entered her plea of not guilty and you are instructed that by a plea of not guilty the defendant is presumed to be innocent of the crime charged against her until her guilt is established to the satisfaction of the jury , beyond a reasonable doubt. YOU are instructed that the burd en is upon the State to prove every material allegation in said information necessary for the conviction of the defe ndant, beyond a reasonable doubt. If you are satisfied from all the facts and circumstances in KXH evidence, beyond a reasonable doubt, that the defendant is guilty of the unla wful killing of Jake L. Hamon, then you are instructed that the presumption of innocence with which the law clot hes the defendant no longer exists and it is your duty as Jurors, if you so believe, to convict her of one of the offenses applicable to the evidence herein submitte d to you.
You are instructed that the offense charged against the defendant, Clara Smith Hmmon, is what is known in Law as Homicide and that the law defining that crime is as follows, towit: Homicide is the killing of one human being by another and homicide is murder when perpetrated without authority of law and with a premeditated design t'o effect the death of the person killed.
You are instructed, Gentlemen of the Jury, that a design to effect death is inferred from the fact of the killing, unless the circumstances raise a reasonable doubt as to whether such a design existed and the design in order to make the crime of the degree of murder must have been premeditated and in this connection you are instructed that a premeditated design to effect death, sufficient to constitute the crime of murder, may be formed instantly befor e committing the act by which such design is carried into execution.
VI You are further instructed that homicide committed with the premeditated design to effect death is not the less murder because the perpetrator is in a state of auger , fear or excitement.

An assault is any wilful and unlawful attempt or offer with force or violence to do a corporal hurt to another.
IX Embraced in the information filed in this case is also the homicide known as Manslaughter in the first degree and also the homicide known as manslaughter in the second degree. '-
X Homicide is manslaughter in the first degree in the following cases: When perpetrated without a design to effect death by a person while engaged in the commission of a irisdemeanor. Second: When perpetrated without a design to First:

Second, ordinary xap caution and without any unlawful the heat of when committed by accident and misfortune, in ion, or passion, upon any sudden and sufficient provocat ntage, is upon a sudden combat, provided that no undue adva killing is taken nor any dangerous weapon used, and that the not done in a cruel or unusual manner.
XII that You are further instructed Gentlemen of the Jury person in the Homicide is justifiable when committed by any following cases: First: When resisting any attempt to murder such on. person or to commit any felony upon such pers
Second:
When committed in the lawful defense of
such person or when there is a reasonable ground to apprehend a design to commit a felony or to do some great personal injury and imminent danger of such design being accomplished by the person killed.
XIII You are instructed, Gentlemen of the Jury, that a felony, unler the laws of this State, is a crime which is or may be punishable with death or by imprisonment in the penitentiary. Y0 u are further instructed that every other
crime is a misdemeanor.

In this case, the defendant, Clara Smith Famon, in
support of her plea of not guilty claims as a Justification for said homicide, that she acted in self-defense of her person, that is, that the defendant, Olara Smith Hamon, pleads that she did the killing but that same was done to prevent the deceased from either killing her or doing her serious bodily harm. It is the right of every person to act in defense of her own person where she is assailed in such a way as to make it reasonably qppear to her that her life at the time was in imminent danger or that she was In imminent danger of serious personal injury.

You are therefore instructed, GenlOsmen of the Jury, that if you believe from the evidence in this case, as applied to these instructions, that in the County of Carter and State of Oklahoma, on or about the 21st day of November, 1920, that the defendant Clara Smith Hamon, did, wil fully, unlawfully and feloniously, and with a premeditated desi gn Jra to effect the death of one Jelce L. Hamon discharge metall ic bullets into the body of him, the said Jake L. Hamon, from a certain loaded pistol, which she, the said Clara Smith Hamo n, then anl there had and held in her hand and thereby inflicted a mortal wound lipon him, the said Jake L. Hamon, from the effect of which the slid Jake L. Hemon, languished and languishing, did, on or about the 26th day of November, 1920, die, then in such case you will find the defendant, Clara Smith Hamo n, guilty of murder and assess her punishment as you will be hereinafter directed.
You are further instructed
that if you should enter-
tain from the evidence, as applied to thes e instructions, a reasonable doubt that the defendant, Clara Smith Hamon, is guilty of murder, then you may next inquir e as to whether or not the defendant is guilty of manslaughter in the first degree as that orime has been defined to you in these instructions and if you believe from the evidence, 'bey ond a reasonable doubt, that the defendant, Clara Smith Hamon, in the County of Carter and State of Oklahoma, on or about the 21st day of November, 1920, did , unlawfully, wilfully and folono iusly and without any dadgn to effect the death of the said Jake L. Hamon and in the heat of passion, but in a cruel and unusual manner, or

Hamon, from a certain loaded pistol, which she, the said Cla ra Smith Hamon, then and there had and held in her hand and the reby inflicted a mortal wound upon him, the said Jake L. You are further instructed, Gen tlemen of the Jury, that if you should entertain from the evidence, as applied to these instructions, a reasonabl e doubt that the defendant Clara Smith Eamon, is guilty of manslaughter in the first degree, then you may next inquir e as to whether or not she is guilty of manslaughter in the second degree as that crime has been defined to you in instru ction number ten and if you believe from the evidence, beyond a reasonable doubt, that the defendant, Clara Smith Hamon, in the County of Carter and State of Oklahoma, on or abo ut the 21st day of November, 1920, did, unlawfully, uOJLtHy and feloniously by the culpable negligence of the said Clara Smi th Hamon, discharge metallic bullets into the body of him, the said Jake L. Hamon, languished and languishing, did, on or about the 26th day of November 1920, die, then in such case you will find the def endant, Clara Smith Hamon, guilty
of manslaughter in the second degree and fix her punishment as you will be hereinafter dir ected, unless you should believ e that such killing was done und er :such circumstances as consti tute an excusable or justifiable hom icide as those terms have been defined to you in these instru ctions.
XXII
You are further instructed, that if you believe from the evidence or have a reason able doubt uhereof as applied to these instructions, at the time of the killing, that is, at the time Clara Smith Ham on fired upon and shot the de ceased, Jake L. Hamon, that the said Jake I. Hamon by some act upo n his part then and there done made it reasonably agar to the defendant, Clara Smith Hamon, judging from the defendant's standpoint, that it was the purpose and intention of the deceased, Jake I. Hamon, to then and there kill her, the said Clara Smith Hamon, or do her serious personal injjrry, then you are instructed that the defendant, under such cir oumstances, had the right to act instantly in her self-de fense, event to the tafclng of the i life of the deceased if necessary or apparently neces sary under the rules hereinb e fore given you and if she did so and thereby killed the dec eased then under such circumstances you are instructed the homi cide Is Justifiable and you should find the defendant not guilt y. XXIII
In determining the question whe ther the defendant acted in the lawful self defense of her person as that rule has bee n given you you are instructed tha t such defense is founded upon the law of necessity or appare nt necessity end so long as the necessity or apparent necessity exists to shoot in one's self
defense the law gives her the rig ht to do so, but when the necessity or apparent necessity ceases then the right to act ceases. And as in this case, if the jury believe from tha evidence at the time the defend ant fired the fatal shot the deceased was in a position and had the ability to either kill or inflict serious personal injury upon the defendant and to prevent which it was nec essary or apparently necessary for her to shoot the deceased in the manner testified too aid that such shooting was done to prevent the life of & Clara Smith Hamon from being taken or serious personal injury being done her and that such shooting oo'ild not have been avoided in safety to the defendant, Clara Smith Hamon, but it was done to protect herself from imminent dangor, then under such circumstances die should be acquitted. XXIV You are instructed, Gentlemen of the Jury, that by the term reasonable doubt is such a doubt as a man of reasonable intelligence could give some goo d reason for entertaining if he were called upon to do so; it is not required that the state should prove guilt to a mat hematical certainty or a moral certainty or by evidence equivalent to absolute and positi ve proof or that produces an undoub ting and satisfactory convictio n of guilt and you are instructed that the rule requiring the jury to be satisfied of the gui lt of the defendant from the evidence beyond a reasonable dou bt, in order to warrant a conviction, is complied with if tak ing the testimony all together the jury are satisfied, beyond a reasonable doubt, that the defendant is guilty. The reason able doubt which you are permitted to entertain must be as to the guilt of the accused on the whole evidence and not as to any particular fact in the
oase.
bt A reasonable doubt, Gentlemen of the Jury, is adou a reason; founded upon reason; a doubt for which you can give
the lack a doubt growing out of the testimony in the case or tate in of testimony; a doubt which would cause you to hesi fanciful, the ordinary affairs of life. It is not a flimsy, and fictitious doubt which you could raise about anything everything. It means a reasonable doubt. If when all is t of the said and done you have such a doubt about the guil accused it is your duty to acquit her.

You are further instructed thr.t the prosecution has sought in this case to prove certain statements, which it is claimed the deceased made a short time prior to his death, as his dying declaration; and in this connection, you are instructed, that under the law, before these statements can "be considered by you, you must be able to find in the ' light of all the facts and circumstances appearing upon the trial that at the very time these statements were nade (if you find they were made) the deceased had given up all hope of recovery and believed that he would die; and evon should you find such statements were made, and under the conditions which render them admissable , you are to determine as to whether or not the deceased was correctly urulerstocd by the witnesses and what he said was corroctly detailed to them; and should you find all these facts in favor of the prosecution you are not bound to believe the facts stated In such dying declaration as true, but you should wAAgh such statements and consider th>>-/,_ together with all the other evidence in tho case.

If, upon a consideration of all the evidence, you conclude that any witness has wilf ully sworn falsely to any material fact involved in the trial , you mayfc, if you see fit, reject or treat as untrue the whole or any part of such witness 1 testimony, unless you shoul d find that said testimony is corroborated in whole or in part by other facts and circumstances. You are instructed that this rule is for your guidance and that it applies to each and every witness who has testified in this case.
XXVII If you find the defendant gutty of murder as charged in the information it is your duty to assess her punishment at death or by imprisonment at hard labor in the penitent iary for life. Should you find the defendant guilty of murde r it is your' duty to designate in your verdict whether such punis hment shall be by death or by imprisonment in the penitent iary at hard labor for life.
XXVIII
If you find the defendant gui lty of manslaughter in the first degree it is yonr dut y tc assess her punishment by imprisonment in the penite ntiary for any term of years not less than four years. And should you fidd the defendant guilty of manslaughter in the first iegree it is your duty to assess the punishment.

If you find the defendant guil ty of manslaughter in the second degree it is your duty to assess her punishment by imprisonment in the State penitentiary not more than 4 years and not less than 2 yea rs, or by imprisonment in the county jail not exceeding one year or by a finexjQt not exceeding One thousand dollars, or both such fine and imprisonment. J\nd should you find the defendant guilty of manslaugh ter in the second degree it is you r duty to assess the punishmen t. XXX

ZXXI
Forms of verdict will be furnished you for your convenience only and after you have elected one of your number foreman, you will have hin, for you, signant as foreman that form of verdict upon which you may agree, and you will as a body return it into Court. You must not cast lots or use any other method or means of chance in arriving at your verdict, but whatever verdict is rendered* must; be based upon the individual Judgment of the juror and concurred in by all of you.

In reaching your verdict, no consideration of sympathy, or passion or prejudice whould enter into your deliberations, or the faithful discharge of your duties as jurors, but you should carefully, impartially and faithfully return such a verdict as is warranted by the evidence, as measured by these instructions, under your oaths as jurors.

If after considerin g all of the eviden ce ani these instructions, whic h you will understa nd are to be consid ered by you as a whole, you have a reasonab le doubt of the gu ilt of the defendant, then you will acqu it her, but in the event, after consideratio n given to the evid ence in this case and these instructions , you do not entert ain a reasonable do ubt of the defendant's guilt as to any on e or more or all of the offenses herein su bmitted to you, th en you will return your verdict of guilty as to such offense of which you do no t entertain a reason able doubt, yet wh atever doubt may be tertained by you, enarising out of the evidence and these instructions, ns appl ied to it, such co ubt must be resolv ed in favor of the defend ant*
