THE ABOVE-NAMED ORGANIZATION OR INDIVIDUAL (HEREINAFTER CALLED LESSEE)

AGREES TO INDEMNIFY AND HOLD HARMLESS THE LESSOR, ITS TRUSTEES, OFFICERS, AGENTS
AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, CAUSES OF
ACTIONS, SUITS AND LIABILITY OF EVERY KIND, INCLUDING ALL EXPENSES OF LITIGATION,
COURT COSTS AND ATTORNEY’S FEES, FOR USE OF THE PREMISES BY LESSEE UNDER THIS
AGREEMENT, REGARDLESS OF WHETHER SUCH INJURIES, DEATH OR DAMAGES ARE CAUSED IN
WHOLE OR IN PART BY THE NEGLIGENCE OF THE LESSOR, ITS TRUSTEES, OFFICERS, AGENTS
OR EMPLOYEES. IT IS THE EXPRESS INTENTION OF THE PARTIES HERETO. BOTH LESSOR AND
LESSEE, THAT THE INDEMNITY PROVIDED FOR IN THIS PARAGRAPH INCLUDES INDEMNITY BY
LESSEE TO INDEMNIFY AND PROTECT THE LESSOR, ITS TRUSTEES, OFFICERS, AGENTS AND
EMPLOYEES FROM THE CONSEQUENCES OF THEIR OWN NEGLIGENCE, WHETHER THAT
NEGLIGENCE IS THE SOLE OR A CONCURRING CAUSE OF THE INJURY, DEATH OR DAMAGE.

EXHIBIT “A” TO LEASE AGREEMENT
1. Only Village Grove residents may reserve the facilities.
2. Lessee must pay a NON-REFUNDABLE FEE of $40.00, which is payable to

Village Grove Community Association, Inc.
3. Lessee must deposit $300.00 with Village Grove when the reservation is made.
The check should be made payable to Village Grove Community Association, Inc.
Should any Village Grove Community property be damaged as a result of this
function, repair costs will be paid out of this deposit. The balance will be refunded
to the person who paid at the time the reservation was made. Cost in excess of the
deposit, if any, will be billed to the person by whom the reservation was made.
Payments must be made within thirty (30) days of receipt of the bill.
4. Lifeguard’s wages and clean-up fees will be paid directly to the Pool Company
(Gulf Coast Aquatics) providing lifeguards.
5. A minimum of two (2) lifeguards is required at each pool party. Lifeguard’s rates
are $25.00 per hour per guard.
6. The pool facility may only be reserved during the pool season, after normal pool
hours.
7. Organizers must be posted at the entry to the pool to identify party members.
8. No more than 150 people may be present at the party with a lifeguard ratio of one
guard to 20 guests.
9. Party members must comply with pool / park rules and regulations.
10. Lessee is for responsible for cleanup (i.e. removal of trash, clean tables, etc.) or a
cleaning charge will be deducted from the deposit.
11. Gulf Coast Aquatics requires two (2) weeks notice to schedule lifeguards for the
event.
