The Jefferson Parish Council of Jefferson Parish, Louisiana, met in regular
session on Wednesday, October 7, 2015 at ten (10:00) oclock a.m. in the Kenner
City Park Pavilion, Kenner, Louisiana.
Mr. Christopher L. Roberts, Chairman of the Jefferson Parish Council presided,
called the meeting to order. Mr. Roberts requested a moment of silence for
accident victims on I-10, Mr. Young requested a moment of silence for Janet
Gray former employee of Jefferson Parish who recently died from cancer.
Eula A. Lopez recited a prayer. Mr. Al Morella lead everyone in the Pledge of
Allegiance to the Flag of the United States of America.
The Chairman then requested the Parish Clerk to call the roll. The following
members were present: Christopher L. Roberts, Chairman, and Councilmembers:
Ricky Templet, Paul D. Johnston, Mark Spears, Elton M. Lagasse, Ben Zahn,
and Ms. Cynthia Lee-Sheng.

The Chairman called upon the Honorable John F. Young, Jr., Parish President to
address the Council at this time.
The next item of business was adoption of the consent agenda.
It was on motion of Mr. Templet and seconded by Mr. Roberts that the Consent
Agenda be adopted.
Vote on the adoption of the foregoing motion resulted as follows:

On motion of Mr. Roberts, seconded by Mr. Lagasse, the following action
on Summary No. 24294 of an ordinance authorizing the defeasance of all
outstanding bond indebtedness of Jefferson Parish Hospital District No. 1,
Parish of Jefferson, State of Louisiana; approving an escrow deposit agreement
and authorizing its execution; retaining an escrow agent; providing for notice
of defeasance and notice of redemption of all outstanding bond indebtedness is
hereby cancelled.

On motion of Mr. Roberts, seconded by Mr. Lagasse, the following action on
Summary No. 24314 of an ordinance amending or rescinding Ordinance No.
18515; codified as Chapter 7, Animals and Fowl, Article II, Animal Control
and Welfare, Section 7-5 of the Code is hereby deferred until October 21, 2015.

On motion of Mr. Roberts, seconded by Mr. Lagasse the following action
on Summary No. 24315 of an ordinance dedicating the funds received as
reimbursement for lost tax revenues as a result of the BP Oil Spill to a 5% cost
of living increase retroactive to January 1, 2015 with a portion of the balance
after the cost of living increase to be divided in proportions between the Council
District Improvement/Assistant Funds and the General Fund is hereby deferred
until October 21, 2015.

A resolution accepting the lowest responsible bid of JJH Construction, LLC,
Bid No. 50-114114, in the amount of $128,433.20, for the Jefferson Highway
Pocket Park to include the installation of a paver labyrinth, concrete sidewalks,
drainage and new landscape and irrigation for the Jefferson Parish Public Works
Department Parkways. (Council District 2)
WHEREAS, Jefferson Parish received 6 valid bids on September 10, 2015 for the
Jefferson Highway Pocket Park to include the installation of a paver labyrinth,
concrete sidewalks, drainage and new landscape and irrigation for the Jefferson
Parish Public Works Department Parkways.; and,
WHEREAS, JJH Construction, LLC, submitted the lowest responsible bid
under Proposal No. 50-114114 at the total cost of $128,433.20; and,
WHEREAS, Linfield, Hunter and Junius, Inc. has reviewed the bids and has
recommended that award of contract be made to JJH Construction, LLC.
NOW, THEREFORE, BE IT RESOLVED, by the Jefferson Parish Council, the
governing authority of said Parish:
SECTION 1. That the lowest responsible bid of JJH Construction, LLC., Bid No.
50-114114, in the amount of $128,433.20, for the Jefferson Highway Pocket Park
to include the installation of a paver labyrinth, concrete sidewalks, drainage and
new landscape and irrigation for the Jefferson Parish Public Works Department
Parkways, be and is hereby accepted.

hundred and eighty six dollars and fifty cents ($184,886.50) for the two-year

as needed basis, for carnival and special events for the years of 2016 and 2017,

WHEREAS, the lowest responsible bid received for Proposal No. 50-00114069,
was Friedrichs Custom Mfg., Inc.; the cost associated with the barricades and
gates will not exceed $184,886.50 for a total cost of one hundred eighty four
thousand eight hundred and eighty six dollars and fifty cents ($184,886.50) for
the two-year contract.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority for said Parish:
SECTION 1. That the lowest responsible bid of Friedrichs Custom Mfg.,

WHEREAS, the lowest responsible bid was received by CASCO INDUSTRIES,
INC. in the amount of $27,800.00; and
WHEREAS, maximum expenditures shall not exceed $35,000.00 for the Two
years, for a supply of insulated fire boots.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the lowest responsible bid of CASCO INDUSTRIES, INC.
under Bid Proposal No. 50-00114187 for a Two year contract for a supply of
insulated fire boots for the Jefferson Parish East Bank Consolidated Fire
Department, at the bid tabulation price of $27,800.00, be and is hereby accepted.
SECTION 2: That the term of this contract shall commence upon the adoption
date of this resolution and that payment is hereby authorized for services
associated with this contract upon adoption of this Resolution.
SECTION 3: That costs related to the above are to be charged to Account No.
22100-2921-7234.2 of the Department of Fire.
SECTION 4: That maximum expenditures shall not exceed $35,000.00 for the
Two year(s), by a factor of more than 10% without amendment to the contract
authorized by resolution of the Council.
SECTION 5: That the Council Chairman or, in his absence, the Vice-Chairman
be and is hereby authorized to execute any and all documents necessary to give
full force and effect to this resolution.

RESOLUTION NO. 125777
A resolution rejecting the only responsible bid received for Bid No. 50-113956
and authorizing re-advertisement of a replacement bid, for a two-year contract
of shirts and caps to be ordered on an as-needed basis for all departments and
agencies within Jefferson Parish. (Parishwide).
WHEREAS, the bid received was considerably over-budget; and
WHEREAS, re-advertising and re-issuing the bid will allow additional vendors
to respond.

protection levee system to U-1R, all more clearly shown on the map entitled
U-1 Districts and Fairfield Overlay District dated June 24, 2015; to amend
the official future land use map for Fairfield, all more clearly shown on the map
entitled Fairfield Future Land Use dated June 24, 2015; and to provide for
related matters. (Council District 3)
WHEREAS, Ordinance No. 21939, which adopted the Comprehensive Plan on
August 6, 2003, requested and authorized the Planning Department to draft and
submit to the Parish Council those amendments to the Jefferson Parish Code of
Ordinances, including all chapters, codes, regulations, policies, procedures and
plans that are needed to implement and administer the Comprehensive Plan;
and,
WHEREAS, Sec. 25-101 Vision statement of the comprehensive plan identifies
key initiatives to enhance the quality of life of Jefferson Parish, including that
the parish Capitalize on the Tournament Players Club golf course by promoting
development of high quality planned developments on the West Bank that will
attract residents from throughout the region and stimulate business growth; and
WHEREAS, the Jefferson EDGE economic development strategy further
promotes Churchill/Fairfield with the statement that this area of the Parish
provides the greatest opportunity for growth; and
WHEREAS, one of the tasks identified in Sec. 25-407 Plan implementation
table of the Comprehensive Plan and in Objective 1.1.3 of the Jefferson EDGE
economic development strategy is the preparation of sub-area plans for specific
areas of the parish; and
WHEREAS, given its importance to the economic development of the parish,
the Churchill/Fairfield area warrants a sub-area plan; and
WHEREAS, over $66 million in public investment from the TPC Louisiana
golf course, the Churchill Technology Park, and the Patrick F. Taylor School
and Conference Center already has been invested in Churchill/Fairfield, with
an anticipated investment of at least $15 million in additional public fund to
establish a branch of Delgado Community College; and
WHEREAS, in 2013 the Parish and JEDCO undertook initial rebranding of
the Churchill/Fairfield area and determined that the existing development has
laid the groundwork for future high quality development; and
WHEREAS, the Westbank Strategic Plan: Rebranding Report recommended
that the Parish complete the wetland delineation of the Churchill/Fairfield area,
pursue a FEMA map amendment, create and adopt a master land use plan, and
address development regulations for the area; and
WHEREAS, the Parish is completing the wetland delineation, is pursuing the
FEMA map amendment, and partnered with the Regional Planning Commission
(RPC) to develop a Fairfield strategic plan; and
WHEREAS, the Parish Council authorized the planning process, called for an
evaluation of zoning, and established interim standards and a moratorium in
the Churchill/Fairfield area, by Resolution No. 122220 adopted on January 15,
2014 and extended by Resolution No. 124021adopted on December 10, 2014; and
WHEREAS, RPC Project H.010170JP, DOTD Project No. H.010170 resulted in
the Proposed Strategic Plan: Fairfield Planning Area, dated October 2014; and
WHEREAS, during the planning process, a planning management committee
met with Fairfield property owners and other stakeholders throughout 2014 to
develop the strategic plan; and
WHEREAS, the Fairfield Strategic Plan outlines certain action items that are
necessary to effect positive, high quality development in Fairfield; and
WHEREAS, the plans recommendations reiterate the need to evaluate existing
zoning, particularly the U-1 Unrestricted District that comprises eighty
percent of the Churchill/Fairfield area, and support the adoption of a planned
development district that offers flexibility for unique approaches to development
and development pattern standards that provide certainty for innovative
approaches to development; and
WHEREAS, since its initial adoption and mapping in 1958, the U-1 zoning
district has been considered a holding zone to be rezoned upon determination
by the planning director that changes have been accomplished which will allow
development and use of the area; and
WHEREAS, the planning director has determined that significant development
has been accomplished in the Fairfield/Churchill area, and, further, that the U-1
is ill-suited to realize planning goals for high-quality development because it
allows almost all uses, ranging from residential to industrial, without providing
standards to ensure that uses are compatible, appropriately sited, and well
designed; and
WHEREAS, the planning director has determined that revisions are warranted
to the U-1 district mapped inside of the hurricane protection levee and that a
zoning overlay that reflects the standards of the revised U-1 is also needed to
cover land not zoned U-1, so that future development in the Churchill/Fairfield
area meets planning goals; and
WHEREAS, altogether, nearly $700,000 in federal and local planning funds
have been expended on the rebranding report, wetland delineation, and strategic
planning for Fairfield, and this public investment in planning coupled with the
public investment in land, buildings, and facilities in Fairfield create a reasonable
expectation that the citizens of Jefferson Parish will realize benefits of smart
growth and best practices for the growth and development of the parish; and
WHEREAS, the Planning Director of this Parish has caused to be duly advertised
as prescribed by law, a public hearing in connection with the Fairfield strategic
plan text and future land use map amendments and the related zoning text and
map amendments; and
WHEREAS, a public hearing was held by the Planning Advisory Board, in
accordance with law. Now, therefore,
THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Chapter 25, Planning and Development, Article VI,
Comprehensive Plan, Sec. 25-253, Land use categories, is hereby amended to
read as follows:
Sec. 25-253. Land use categories.
The land use categories shown on the future land use map are identified
according to the predominant use or maximum level of intensity intended for
that category of land use. When a category designates a maximum percentage
of residential mix, that percentage shall apply to the entire geographic area
designated as said category and forming a cohesive neighborhood unit, business
district, or transportation node. These categories are described below:
(1) Environmentally-based mixed use (EBM). The environmentally-based
mixed use category allows a variety of development options that range from
conservation subdivisions to low intensity recreational and low intensity
hospitality uses in support of eco-tourism. Some recreational uses may serve as
transitional uses prior to conversion to higher intensity development patterns.
Average net density is one (1) dwelling unit per acre and average gross density
is 0.2 dwelling units per acre, but smaller lot sizes are allowed with clustering.
(2) Low density residential (LDR).
a. The low-density residential land use category includes single-family,
detached-unit residential development at a maximum net density of four (4)
dwelling units per acre.
b. In the area subject to the Fairfield strategic plan pursuant to Sec. 25-463
Fairfield of this article, the low-density residential land use category includes
single-family detached and attached residential lots that receive full urban
services at an average net density of six (6) dwelling units per acre and an
average gross density of four (4) dwelling units per acre.
(3) Low-medium density residential (LMR). The low-medium density residential
land use category includes single-family detached-unit residential development
at a maximum net density of nine (9) dwelling units per acre.
(4) Medium density residential (MDR). The medium density residential land use
category includes single-family detached, two-family, three-family, and fourfamily dwellings, townhouses, and condominiums at a maximum net density of
twenty-five (25) dwelling units per acre.
(5) High density residential (HDR). The high density residential land use
category includes townhouses, condominiums, and multi-family apartments up
to a maximum net density of sixty-five (65) dwelling units per acre.
(6) Low intensity commercial (LIC). The low intensity commercial land use
category identifies the more traditional suburban neighborhood and community
oriented retail, services and offices developed at a residential scale. This use
should be developed at the same scale and maintain visual compatibility with
adjacent residential neighborhoods. Properties identified as low intensity
commercial have less intensive employee/acre ratio and rarely exceed two (2)
stories.
(7) High intensity commercial (HIC). The high intensity commercial land use
classification identifies regional commercial centers, employment centers, and
other intensively developed centers and corridors where commercial land uses
predominate.
(8) Neighborhood mixed-use (NMU). The neighborhood mixed-use land use
category designates compact, mixed-use development with a mix of residential
unit types, including single-family dwellings and multi-family residential
development, and neighborhood-based low-intensity retail and professional
offices within walking distance and with convenient access to transit. The
neighborhood mixed use category accommodates a land use mix containing a
maximum of ninety (90) percent residential mix with commercial and civic areas
comprising not more than ten (10) percent of the gross acreage and buildings
generally 1-2 stories in height. The areas of residential mix and commercial and
civic uses include parks and open spaces generally occupying at least twenty
(20) percent of the area. The maximum permitted residential density is twelve
(12) dwelling units per acre with an average net density of eight (8) dwelling
units per acre or an average gross density of 5.6 dwelling units per acre. Average
floor area ratio (FAR) is 0.3 per net acre and 0.03 per gross acre.

b. Entry. Where an entry appears in the zoning district columns of Table 333.50-1. for a general use (for example 2520) and also for a more specific use
(for example 2521) within the same classification, the more specific code and its
entry shall govern.

parking spaces or fraction thereof and planted with one (1) class A tree or two
(2) class B trees, a minimum caliper of two (2) inches and height of twelve (12)
feet at planting, as identified on the approved plant list. No parking space shall
be separated from a tree by more than ninety (90) feet; perimeter landscaping
may be used to meet this requirement. Distance may be increased by combining
or grouping interior islands up to a maximum of one hundred eighty (180) feet.
E. Existing natural vegetation may be used to meet the requirements for a
landscape planting area if it provides complete visual screening and equivalent
planting units as determined by the Parish landscape architect;
Sec. 33-3.58.6.6. Parking, loading, and clear vision areas. See Article XXXV,
Off-street parking, loading, and clear vision area regulations in Chapter 40,
Zoning of this Code.
Sec. 33-3.58.7. Signs.
A. Generally. Article XXXVI, General sign regulations in Chapter 40 Zoning
of this Code shall supplement these standards and apply for any standards that
are not provided in this section. To the extent of any inconsistency between the
regulations in Chapter 40 and the standards in this section, this section shall
govern. For these purposes, business shall mean LBCS function codes 1200,
1330, 2000, 3000, 4100 except 4171, 4200, 5100-5400, 6130, 6140, 6510-6540,
6700, and 7000.
B. Detached signs. Each development site upon which a business is located may
have one (1) detached sign, subject to the following standards.
1. Generally.
a. A detached sign may include an electronic variable message (EVM) sign not
exceeding fifty (50) percent of the allowable detached sign area or one hundred
(100) square feet, whichever is less, in accordance with EVM sign regulations
in Article XXXVI General sign regulations in Chapter 40 Zoning of this Code,
except that an EVM sign shall be located a minimum of one hundred fifty (150)
feet from any one-, two-, three-, or four-family residential zoning district or use
and only one (1) detached EVM sign shall be permitted on a development site.
b. A detached sign shall be located in a landscape area of one hundred (100)
square feet, except that the planning director may reduce this area to meet
requirements for parking or clear vision area.
c. A business located on a corner lot may have a second detached sign on the
secondary frontage, provided that the second sign shall not exceed one half the
allowable sign area of the primary sign.
d. A development site that exceeds four hundred (400) linear feet of frontage
along a street classified as a minor arterial or higher on the Jefferson Parish
Thoroughfare Plan and has a building or buildings with multiple tenants may
have one (1) additional detached sign for each additional four hundred (400)
linear feet or fraction thereof of street frontage, on condition that a minimum
distance of four hundred (400) feet measured radially is provided between the
detached signs and no sign exceeds one hundred (100) square feet.
e. No detached sign shall be located within seventy-five (75) feet of a residential
district or use.
2. Monument. One (1) monument sign not exceeding twelve (12) feet in height
and one (1) square foot per linear foot of street frontage up to a maximum of
one hundred (100) square feet in area is allowed per development site on a street
classified as a minor arterial or higher on the Jefferson Parish Thoroughfare
Plan. On other streets, a monument sign shall be limited to ten (10) feet in height
and fifty (50) square feet.
3. Pole. Instead of a monument sign, development sites that front on U.S.
Highway 90 may have one (1) pole sign not exceeding twenty (20) feet in height
and one (1) square foot per linear foot of street frontage up to a maximum of two
hundred (200) square feet in area. The sign shall be set back a minimum of ten
(10) feet from a property line, except that for each foot of setback greater than
ten (10) feet measured from the front property line, the height of the sign may
increase by one (1) foot but shall not exceed a total height of thirty (30) feet.
The area of a sign for a multi-tenant retail or services use may increase by an
additional twenty (20) square feet for each tenant over ten (10) tenants.
C. Attached signs. Each business may have attached signs, subject to the
following standards:
1. Wall, projecting, hanging, or awning. Each business having a direct entry to
a sidewalk or exterior walkway may have the following signs attached to the
building:
a. One (1) wall or projecting sign not exceeding one (1) square foot per linear
foot of building width, or unit width for a multi-tenant building, along a street
frontage per development site, but shall not exceed one hundred (100) square feet
of sign area. A projecting sign may extend up to ten (10) feet from a building but
shall not create a hazard for pedestrians.
b. One (1) hanging sign limited in area to six (6) square feet is allowed to hang
from the underside of a balcony or arcade. Hanging signs must be located at least
eight (8) feet above ground level measured from the bottom of the sign to the
surface of the sidewalk or exterior walkway.
c. Awnings are encouraged to provide shade and protection from rain. In addition
to a wall or projecting sign, one (1) awning sign is allowed not exceeding twenty
(20) square feet and not located more than eight (8) feet above ground level
measured from the bottom of the sign to the surface of the sidewalk or exterior
walkway. If an awning sign is used in place of a wall or projecting sign, the area
shall not exceed the lesser of the allowable wall or projecting sign area or forty
(40) percent of vertical area of the awning on which the sign is located.
d. A business located on a corner lot or within the corner unit of a multi-tenant
building may have a total of two (2) wall, projecting, or hanging signs provided
that:
(1) The total area of all wall, projecting, and hanging signs shall not exceed
one hundred fifty (150) percent of the allowable sign area measured along the
building face that contains the main entrance of the business;
(2) No more than one (1) wall, projecting, or hanging sign shall be located on
each street-facing building faade;
(3) Neither wall or projecting sign shall exceed one hundred (100) square feet of
total sign area and neither hanging sign shall exceed six (6) square feet of total
sign area; and
(4) When the main entrance of the building is located on a building corner, the
permitted sign area shall be measured along the building face associated with
the building address.
2. Canopy. A canopy as defined in this chapter may have one (1) sign not
exceeding twenty (20) square feet on each side facing a street, not to exceed
two (2) signs.
3. Window. Window signs may be etched in or applied to the glass or hung inside
the building, provided that no window sign shall occupy more than twenty-five
(25) percent of a window opening. Any sign etched into, applied to, or hung
within four (4) feet of the inside pane of a window shall be considered a window
sign.
4. Building directory. For buildings with multiple businesses lacking direct
entry from a sidewalk or exterior walkway at ground level, a single building
directory sign not exceeding six (6) square feet in area may be attached to a wall
within eight (8) feet of the buildings primary entry.
5. Address and building name. Addresses shall comply with Sec. 8-3-108 Survey
and street address in Article III Preliminary and other building requirements
of Chapter 8 Buildings and building regulations of this Code, and shall not be
considered part of a sign unless the address is a portion of a business name. The
name of the building may be built into or attached to the wall of the building
or may be a part of a monument sign, but not both wall and monument, and
shall not exceed eight (8) square feet in area, which shall not be included in the
computation of sign area.
6. Directional. Directional signs, limited in area to six (6) square feet each,
giving directions to motorists, bicyclists, or pedestrians regarding the location
of parking areas, access, or ingress or egress, shall be allowed as accessory
signs and not included in computation of allowable sign area. A free-standing
directional sign shall not exceed six (6) feet in height.
7. Menu.
a. A restaurant or snack bar may have a single portable menu sign measuring
four (4) square feet or less but such sign shall not obstruct pedestrian access.
b. Drive-through food services may have one (1) menu board per drive-through
lane, and each menu board shall not:
(1) Exceed forty-eight (48) square feet in area and eight (8) feet in height;
(2) Be located within twenty (20) feet of a property line abutting a residential use
or district or within the first twenty (20) feet of the front of the development site;
(3) Be visible from the street upon which the primary access to the building is
located; and
(4) Have a sound system that produces noise that intrudes into surrounding
development, in accordance with Sec. 20-102 Noise in Chapter 20 Offenses and
miscellaneous provisions, Article V Offenses against public peace, of this Code.
D. Signs for other uses. For sign standards for religious, educational, public,
and institutional uses (LBCS function codes 1321-1323, 4171, 5500, 6121-6126,
6200, 6300, 6400, 6561-6568, 6600, and 6800), see Sec. 40-80 Sign regulations
in Chapter 40 of this Code.
E. Prohibited signs. The following signs shall be prohibited:
1. Flashing signs and signs with animated and scintillating lights;
2. Off-premise signs.
Sec. 33-3.58.8. Development approval.
A. Site plan required. In accordance with Article 2, Sec. 33-2.25. Site Plan of this
UDC, a site plan is required where the application:
1. Requires a conditional use permit;
2. Requires landscaping or buffering;
3. Requests approval of a new commercial or industrial development;

proposed settlement; and
WHEREAS, the Jefferson Parish Council desires to settle this matter amicably:

SECTION 1. That the Parish Attorney is hereby authorized to agree to the

A resolution authorizing and approving Change Order No. 1 to the contract with
Pete Vicari General Contracting, LLC for an additional $30,912.28, and adding
77 calendar days to the contract, which contract, dated February 18, 2015, is for
the HVAC project at Bright, Cleary, and Lakeshore playgrounds, Proposal No.
50-111738, Contract No. 55-00014826. Work associated with this Change Order
is within the original scope of the project. (Council District 5)
WHEREAS, work including moving an electrical feeder underground instead
of overhead, relocating existing underground utilities, and adding tongue and
groove treated plywood over existing deck account for the additional costs; and
WHEREAS, additional days are needed for the work listed above, weather-delay
days, and for a delay in receiving the building permit; and
WHERAS, there have been no previously recorded Change Orders associated
with this project; and
WHEREAS, the net total of Change Order No. 1 amounts to an increase to
the contract in the amount of $30,912.28 and the total of Change Order No.
1 represents a 2% increase to the contract amount from $1,572,000.00 to
$1,602,912.28.
NOW, THEREFORE, BE IT RESOLVED, by the Jefferson Parish Council of

WHEREAS, the public purpose of this Project is to assist the elderly citizens
of Jefferson Parish in securing equal opportunity and receiving services in
the areas of health, employment, and recreation, advancing the quality of life
initiative in Jefferson Parish for senior citizens, pursuant to the Jefferson Parish
Charter Sec. 1.01(14) and 1.01(15);
WHEREAS, the Parish of Jefferson has a reasonable expectation of receiving
value from the services described in detail: the Jefferson Council on Aging shall
provide services and information to the elderly of Jefferson Parish in the areas of
housing information, transportation, physical and mental health, employment,
institutional care information, wholesome nutrition, recreation, community
services, educational services and other community services, which will
enhance the welfare and livelihood of the senior citizens of Jefferson Parish that
is at least equivalent to the annual consideration described in this Agreement;
WHEREAS, the Jefferson Council on Aging, Inc., and the Parish of Jefferson
initially entered into a Cooperative Endeavor Agreement on December 1, 1982,
pursuant to Resolution No. 46007 adopted on the 6th day of October, 1982,
concerning the provision of Senior Center Facilities in the unincorporated areas
of Jefferson Parish. The agreement was amended to include the Senior Centers
in Bridge City and Marrero at Estelle, via Resolution No. 102015 adopted on
the 29th day of September, 2004, and Amendment No. 1 to the Cooperative
Endeavor Agreement dated the 11th day of October, 2004;
WHEREAS, the Jefferson Council on Aging, Inc., and the Parish of Jefferson
also entered into a contract for services dated January 16, 1992, adopted by
Resolution No. 68524 on February 27, 1991, concerning payment by the Parish
of Jefferson to the Jefferson Council on Aging, Inc., from the General Fund of
the Parish for services to be rendered by the Jefferson Council on Aging, Inc., for
developing and implementing plans for counseling, employment opportunities,
and improvement of the health, social, religious and recreational welfare of the
elderly in Jefferson Parish and other services on behalf of the elderly in Jefferson
Parish;
WHEREAS, the Jefferson Council on Aging, Inc., performed services
effectively and has honored its commitments to the Parish of Jefferson and the
elderly residing in Jefferson Parish;
WHEREAS, the term of this Agreement shall commence on October 29, 2015,
and end on midnight of the date immediately preceding the first anniversary;
and
WHEREAS, the transfer or expenditure of public funds or property is not a
gratuitous donation; and
WHEREAS, the citizens of Jefferson Parish will benefit from the efforts of these
parties working together.
NOW THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, State of Louisiana:
SECTION 1. That the Cooperative Endeavor Agreement between Jefferson
Parish and the Jefferson Council on Aging, Inc. for provision of Senior Center
Facilities be and is hereby ratified.
SECTION 2. That the term of this Agreement shall commence on October 29,
2015.
SECTION 3. That all costs associated with this Agreement from the funds
collected from the mill property tax and credited to the Jefferson Community
Senior Service Fund are to be charged to Budget Account No. 22560-3556-1147675; all costs associated with this agreement from the general funds are to be
charged to Budget Account No. 10010-0850-7675.
SECTION 4. That the Chairman of the Jefferson Parish Council, or in his
absence the Vice-Chairman, be and is hereby authorized to execute any and all
documents necessary to give full force and effect to this resolution.

I (Lapalco Boulevard to 12th Street) to include the installation of a decorative
steel wall and foundation, concrete landscape curbs, lighting, drainage and new
landscape and irrigation for the Jefferson Parish Public Works Department
Parkways. (Council District 3)
WHEREAS, Jefferson Parish received 7 valid bids on September 10, 2015 for
the Manhattan Boulevard Beautification Project, Phase I (Lapalco Boulevard to
12th Street) to include the installation of a decorative steel wall and foundation,
concrete landscape curbs, lighting, drainage and new landscape and irrigation
for the Jefferson Parish Public Works Department Parkways; and,
WHEREAS, Hard Rock Construction, LLC, submitted the lowest responsible
bid under Proposal No. 50-114115 at the total cost of $392,698.36; and,
WHEREAS, Linfield, Hunter and Junius, Inc. has reviewed the bids and has
recommended that award of contract be made to Hard Rock Construction, LLC.
NOW, THEREFORE, BE IT RESOLVED, by the Jefferson Parish Council, the
governing authority of said Parish:
SECTION 1. That the lowest responsible bid of Hard Rock Construction, LLC,
Bid No. 50-114115, in the base bid amount of $382,698.36 plus two stainless
steel pelican monuments (Alternate #1) in the amount of $10,000 for a total
of $392,698.36, for the Manhattan Boulevard Beautification Project, Phase I
(Lapalco Boulevard to 12th Street) to include the installation of a decorative

Right-of-Way lease agreement between Jefferson Parish and Area 54, LLC
relative to and in compliance with the Jefferson Parish Comprehensive Zoning
Ordinance for the Commercial Parkway Overlay Zone, and to provide for related
matters. (Council District No. 5).
WHEREAS, Area 54, LLC is the owner of certain real immovable property
located at Lot 67-A, Metairieville Subdivision, bearing a municipal address
212 Veterans Memorial Boulevard, located in the Parish of Jefferson, State of
Louisiana (hereinafter referred to as Lessees Property); and
WHEREAS, Jefferson Parish is the owner of that portion of the Veterans
Memorial Boulevard Right-of-Way located adjacent to Lessees Property,
measuring approximately 13,866 square feet; and
WHEREAS, the owner, Area 54, LLC, desires to lease from Jefferson Parish
approximately 5,577 square feet of that right-of-way to comply with and satisfy
the provisions of the Jefferson Parish Comprehensive Zoning Ordinance for the
Commercial Parkway Overlay Zone; and
WHEREAS, Wayne Sandoz and Associates, Inc. has previously appraised the
right-of-way measuring approximately 13,866 square feet, as having a total lease
value of $3,792.36.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the
governing authority of the Parish:
SECTION 1. That the annual Right-of-Way lease agreement between Jefferson
Parish and Area 54, LLC for that portion of the Veterans Memorial Boulevard
Right-of-Way measuring approximately 5,577 square feet and located adjacent
to the real immovable property located at Lot 67-A, Metairieville Subdivision,
bearing a municipal address 212 Veterans Memorial Boulevard, located in the
Parish of Jefferson, State of Louisiana, for and in consideration of the payment
and receipt of the sum of $3,792.36, is hereby authorized and ratified.
SECTION 2. That the term for said lease agreement shall be annual and
will renew automatically unless sooner terminated by either party, is hereby
authorized and ratified.
SECTION 3. That the rental payments for the above mentioned property shall
be deposited into Budget Account No. 22220-0000-5832, is hereby authorized
and ratified.
SECTION 4. That the Council Chairman, or in his absence the Vice-Chairman,

2. The persons or firms under consideration shall have at least a Professional in
Charge of the Project who is a professional engineer who shall be registered as
such in the State of Louisiana with a minimum of five (5) years experience; and
3. The persons or firms under consideration shall have at least one employee who
is a professional engineer registered as such in Louisiana in the field or fields of
expertise required for the project. A subcontractor may meet this requirement
only if the advertised Project involves more than one discipline.
SECTION 4. That only those persons or firms receiving an overall cumulative
score of at least seventy percent (70%) or greater (equal or more than 84), of
the total possible points for all categories to be assigned by the participating
Technical Evaluation Committee members shall be deemed qualified to perform
engineering tasks.
SECTION 5. That the cost of these services will be negotiated with the Jefferson
Parish Department of Capital Projects.
SECTION 6. That no work associated with this project shall be authorized
by Jefferson Parish until the sub-award authorizing the federal funds is fully
executed.
SECTION 7. That proper account lines will be established when the sub-award
authorizing federal fund is executed by both parties.

WHEREAS, Ochsner Clinic Foundation has closed the existing public bus-stop
and has requested that the Jefferson Parish Transit Department place a new
public bus-stop at the new location, situated on the property of Ochsner Health
System located at Lot 63, Sq. 8, Live Oak Place Subdivision, at the corner of
Jefferson Highway and Betz Avenue, being the width of 20 feet frontage of said
lot on Jefferson Highway, by a depth of 25 feet; and
WHEREAS, the residents of Jefferson Parish will benefit from this arrangement.
NOW, THEREFORE, BE IT RESOLVED BY THE JEFFERSON PARISH
COUNCIL acting as governing authority of said Parish:
SECTION 1. That the Easement Agreement with Ochsner Health System for
the location of a public bus-stop, to be located on Lot 63, Sq. 8 Live Oak Place
Subdivision, at the corner of Jefferson Highway and Betz Avenue, being the
width of 20 feet frontage of said lot on Jefferson Highway, by a depth of 25 feet,

A resolution ratifying the Cooperative Endeavor Agreement between the Parish
of Jefferson and LSU Agricultural Center to provide for use of the LaSalle Park
Garden to host two Open House events and to provide volunteers once per week
for maintenance of the Park Garden. (Council District 2)
WHEREAS, Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides
that for a public purpose, the State and its political subdivisions or political
corporations may engage in cooperative endeavors with each other or with any
other private association, corporation or individuals; and
WHEREAS, the Jefferson Parish is authorized by Section 1.01(15) of the
Jefferson Parish Charter to enter into this Agreement for development and
administration of recreational facilities; and
WHEREAS, the public purpose of the project is described as: to promote
cultural and educational initiatives for the citizens of Jefferson Parish through
educating the public on the various planting seasons; and
WHEREAS, Jefferson Parish has a reasonable expectation of receiving a benefit
or value from an enhanced quality of life as well as a more educated citizen
which is at least equivalent to the use of LaSalle Park Garden provided for in
this Agreement; and
WHEREAS, the transfer or expenditure of public funds or property is not a
gratuitous donation; and
WHEREAS, the citizens of Jefferson Parish will benefit from the efforts of these
parties working together; and
WHEREAS, Jefferson Parish desires to cooperate with LSU Agricultural Center
in the implementation of the project as hereinafter provided.
NOW, THEREFORE, BE IT RESOLVED by the Parish Council of Jefferson
Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the Cooperative Endeavor Agreement between the Parish of
Jefferson and LSU Agricultural Center to provide for use of the LaSalle Park
Garden to host two Open House events and to provide volunteers once per week
for maintenance of the Park Garden is hereby ratified.
SECTION 2. That there is no direct cost associated with this agreement.
SECTION 3. That the term of this agreement shall commence upon the execution
of the agreement.

and the Parish of Jefferson to secure $70,000.00 in Capital Outlay Cash towards
Latigue Street Roadway Improvements, FP&C Project No. 50-J26-14-02
(Council District 3).
WHEREAS, Act 26 of the 2015 Regular Session of the Louisiana Legislature
(Act) contains a cash appropriation for Jefferson Parish, entitled Latigue Street
Roadway Improvements, Planning and Construction (Jefferson), in the amount

The Parish of Jefferson is hereby soliciting the submittal of a Statement of
Qualifications (TEC Professional Services Questionnaire) from persons or firms
interested and qualified to provide professional engineering services related to
the Rehabilitation of the Cleary and West Napoleon Lift Station.
General
Specific Scope of Services includes providing Plans & Specifications and
Supplemental Services for the Rehabilitation of the Cleary and West Napoleon
Lift Station.
The project is expected to require the following supplemental services:
Surveying and Geotechnical Investigation.
The persons or firms submitting a Statement of Qualifications (TEC Professional
Services Questionnaire) must identify all sub-consultant firms which they expect
to use to provide professional services, and submit a Statement of Qualifications
(TEC Professional Services Questionnaire) for each sub-consultant firm. (Refer
to Jefferson Parish Code Ordinance, Section 2-928).
Compensation
Compensation for the required design services will be determined by applying
the construction cost estimate (including a 15% contingency), as prepared by
the persons or firms and approved by Jefferson Parish, to Curve A of the 1981
Edition of the Consulting Engineering Guide for the engagement of engineering
services (ASCE Manual No. 45).
All costs associated with this project shall be subject to Jefferson Parish review
and approval.
Minimum Requirements for Selection
1. The persons or firms under consideration shall have at least one (1) principal
who is a professional engineer and shall be registered as such in Louisiana;
2. The persons or firms under consideration shall have at least a Professional
in Charge of the Project who is a registered professional engineer who shall be
registered as such in the State of Louisiana with a minimum of five (5) years
experience; and
3. The persons or firms under consideration shall have at least one employee who
is a professional engineer registered as such in Louisiana in the field or fields of
expertise required for the project. A subcontractor may meet this requirement
only if the advertised Project involves more than one discipline.
Evaluation Criteria
The following criteria will be used to evaluate each firm submitting a Statement
of Qualifications:
(1) Professional training and experience in relation to the type of work required
for the engineering services. (Maximum points awarded shall be 35).
(2) Size of firm considering the number of professional and support personnel
required to perform the type of engineering tasks, including project evaluation,
project design, drafting of technical plans, development of technical
specifications and construction administration. (Maximum points awarded shall
be 10).
(3) Capacity for timely completion of newly assigned work, considering the
factors of type of engineering task, current unfinished workload, and person or
firms available professional and support personnel. (Maximum points awarded
shall be 20).
(4) Past Performance by person or firm on projects of or similar comparable size,
scope, and scale. Assertions of fault by a person or firm, which shall include
time delays, cost over-runs, and or design inadequacies in prior work completed
for the Parish shall be evidenced by substantiating documentation provided
by the Director of Public Works for the requesting department or the Director
of Sewerage and received by the Chairman of the Evaluation Committee
a minimum of two (2) weeks prior to the scheduled date of the Technical
Evaluation Committee meeting. (Maximum points awarded shall be 10).
(5) Location of the principal office where work will be performed. Preference
shall be given to persons or firms with a principal business office at which the
work will be performed as follows: (1) Jefferson Parish, including municipalities
located within Jefferson Parish (15 points); (2) Neighboring Parishes of
the Greater New Orleans Metropolitan Region, which includes Orleans,
Plaquemines, St. Bernard, St. Charles and St. Tammany Parishes (12 Points); (3)
Parishes other than the foregoing (10 Points); (4) Outside the State of Louisiana
(6 Points). (Maximum points awarded shall be 15).
(6) Adversarial legal proceedings between the Parish and the person or firm
performing professional services, in which the Parish prevailed, or any ongoing
adversarial legal proceedings between the parish and the person or firm
performing professional services excluding those instances or cases where the
person or firm was added as an indispensable party, or where the person or firm

Interested persons are hereby notified that the Parish of Jefferson has applied to
the Federal Emergency Management Agency (FEMA) through the Port Security
Grant Program for funding to assist with the construction of a proposed Boat
Launch Ramp to be built on the west bank of the Mississippi River, located
at Mile Marker 97.1 Gretna, Louisiana 70053 (Latitude: 29.918501, Longitude:
-90.066562), across the river from the Port of New Orleans on the east bank.
The project will involve the construction of a boat ramp to be built on the river
batture, between the Gretna Ferry Landing and the Gretna Amphitheater. This
is a 2 acre site on the batture of the Mississippi River that has seen extensive
disturbance during the construction of the ferry landing and amphitheater.
The boat launch will connect to an existing road through flood gate and will
extend from the elevated ferry parking deck down across the batture into the
Mississippi River. The launch will be a pile supported bridge deck to extend into
the water at the minus 5 foot contour. The launch will be an elevated structure
above the existing grade of the batture beginning at existing elevated parking
deck, at elevation 18.3 NAVD. Approximately 22 piles will be driven to a depth
of up to 75 feet. Pile driving is estimated to disturb approximately 100 square
feet of the existing ground surface.
A Programmatic Environmental Assessment (PEA) for Grant Programs
Directorate Programs was prepared and a Finding of No Significant Impact
(FONSI) was issued in July 2010 (http://www.fema.gov/media-library/assets/
documents/18407?id=4143), in accordance with the National Environmental
Policy Act of 1969 (NEPA), the Council for Environmental Quality (CEQ)
regulations implementing regulations of NEPA (40 CFR Parts 1500 1508),
the National Historic Preservation Act, and the implementing regulations of
FEMA (44 CFR Parts 9 and 10). FEMAs environmental planning and historic
preservation review concluded that all environmental areas of concern are
appropriately accounted for in the PEA with the exception of floodplain impacts.
A Draft Tiered Site-Specific Environmental Assessment (SEA) has been
prepared in accordance with the July 2010 PEA to focus on Executive Order
11988 requirements and floodplain impacts of the proposed project.
The Draft SEA summarizes the purpose and need, alternatives, affected
environment, and potential environmental consequences for the proposed action.
The Draft SEA is available for comment and can be viewed and downloaded
from FEMAs website at http://www.fema.gov/media-library/assets/documents.
A copy of the document can also be viewed Monday through Friday, between
8:30 AM and 4:30 PM, at the Joseph S. Yenni Government Building, located at
1221 Elmwood Park Blvd., Jefferson, LA 70123 and at the General Government
Building, located at 200 Derbigny Street, Gretna, LA 70053.
This notice also serves as the Early Public Notice for a Proposed Activity
in the 100-Year Floodplain. This notice is provided pursuant to 44 CFR Part
9.12, (Floodplain Management and Protection of Wetlands), and FEMAs
implementing regulation for Executive Order 11988, Floodplain Management,
concerning FEMAs funding assistance for activities within and/or affect a
floodplain. According to the Preliminary Flood Insurance Rate Map Community
Panel 22051C0220F, with the effective date November 9, 2012, the proposed
project site is located within Flood Zone AE; defined as Base Flood Elevations
determined.

The comment period will end 15 days from the initial notice publication date
of October 29, 2015. Written comments on the Draft SEA or the proposed
work in the floodplain can be mailed, emailed, or faxed to the contact below.
