DEED OF GRANT OF PERPETUAL RIGHT OF WAY
KNOW ALL MEN BY THESE PRESENTS:
This Deed of Grant of Perpetual Right of Way is made and entered into this ___ day of _____ 2015 by and between: Vxxxxxxx, married to xxxxxxxxxxxx, Filipino, of legal age and a resident of xxxxxxxxxxxxxxx, hereinafter referred to as the GRANTORS ; and xxxxxxxxxxxxxx, hereinafter referred to as the GRANTEE, a government-owned and controlled corporation duly created and existing under and by virtue of the laws of the Republic of the Philippines, with principal office at xxxxxxxxxxxxxxxxx and represented in this Act by its General Manager, xxxxxxxxxx, who is authorized and empowered for this purpose under and by virtue of Board Resolution No. _____, s. xxxxpassed by its Board of Directors in a regular meeting dated ______________________ a copy of which is hereto attached as Annex A and hereby made an integral part hereof, Witnesseth: WHEREAS, the GRANTORS are the registered owners of certain private road lots in xxxxxxxxxx covered by TCT No. ___________, copy of which is attached herein as Annex B and forming an integral part hereof. WHEREAS, the GRANTEE is xxxxxxxxxxxxx WHEREAS, the residents of xxxxxxxxx, including the GRANTORS, requested xxxxxxxxxxx from the GRANTEE and for the GRANTEE to provide such xxxxxxxx the GRANTEE has to use the private road lot of the GRANTORS to xxxxxxxxxxxx; WHEREAS, the GRANTORS, agreed to the use of their property; NOW, THEREFORE, for and in consideration of the foregoing premises, the parties hereto have agreed as follows: 1. The GRANTORS hereby grant and constitute in favor of the GRANTEE a perpetual and permanent right of way on its property more specifically identified in the map herein attached as Annex C and forms an integral part hereof, and, by these presents do grant and convey unto said GRANTEE, its successors and assigns, an easement and right-of-way, perpetually and permanently, for the GRANTEEs benefit and convenience xxxxxxxxxxxxxxx 2. This right of way herein granted includes the right of the GRANTEE to use the subject roads of the GRANTORS to xxxxxxxxxxx and the right of ingress and egress of the GRANTEEs crew and employees and vehicles without charge or compensation. 3. GRANTORS reserve the right to use the land within the above described easement area for purposes not inconsistent with GRANTEE's use of such property, provided such use shall not, in the sole judgment of GRANTEE, interfere with the exercise by GRANTEE of the rights hereby granted.
GRANTORS hereby bind themselves, their heirs and legal representatives, to
warrant and forever defend all and singular the above-described and rights unto the GRANTEE, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof until all of said lines shall be abandoned, and in that event the right-of-way shall cease and all rights herein granted shall terminate and revert to GRANTORS or their heirs, successors or assigns.
