2d 67
Petitioners is here on appeal from an order of the trial court dismissing his
petition for a writ of habeas corpus.
It is his contention that the Kansas state trial court was without jurisdiction to
accept his plea of guilty for failure to comply with the requirements of
G.S.Kansas, 1949, 62-1304, relative to an accused's right to be informed that he
is entitled to assistance of counsel.
The record shows, and petitioner admits, that he signed and read a written
waiver, stating that he was informed of his right to counsel, but did not desire to
be represented. He thus competently waived counsel and intelligently entered
his plea-- these are the essential requirements of due process of law, as we
understand it. The judgment of the trial court must therefore be affirmed.
