sign the bills into law. He is expected to sign. Cord chairman Johnson

After the Bill is signed, a selection
panel will be put in place and advertise for the vacant positions.
Seven commissioners, including
the chairman, will be appointed by
Uhuru. He will be given nine names
from which to choose six commissioners and two names from which
to pick the chair.
Before appointments, he will forward the names to Parliament for
vetting.
The President shall, within seven
days of receipt of the names under
sub-paragraph (4), forward the list of
nominees to the National Assembly
for approval in accordance with the
Public Appointments (Parliamentary
Approval) Act, the Bill states.
After the vetting, Uhuru is required
to appoint the commissioners within
seven days of receiving the names of
vetted nominees.
Already, IEBC has advertised for
the supply of 2017 ballot papers and
other sensitive electoral materials.
This has created a storm within the
opposition.

800 PEOPLE CHARGED
County officials
lead the pack in
graft cases EACC
Most of the 800 people charged with
graft are county officials, EACC deputy
secretary Michael Mubea has said.
We need to fight this negative vice
for Kenyans not to continue losing
funds, he said.
Mubea spoke in Homa Bay town
yesterday when the commission
launched the Corruption Risk
Assessment for the county.
He expressed concern over the
huge loss of funds in the counties.
Mubea said the procurement
department has the highest incidence
of corruption, followed by the county
Public Service boards, then the
salaries department.
Some officials inflate prices of
items then place orders, while some
demand bribes to offer applicants
jobs, he said.
I hope the newly launched
assessment programme will help
address these issues.

Former Cabinet minister Chris Murungarus defamation case against anti-graft czar John Githongo
has been assigned a new judge.
Justice Joseph Sergon will now take over from
judge David Onyancha. The case will be concluded
in December, when hearings will take place for
two consecutive days. Onyancha retired last year.
Murungaru and Githongo wanted Onyancha
to explain why he pulled out, hence stalling the
hearings.

create some synergy between the
national government institutions

the county governments. Right now,
we have serious programmes at the
national level with regard to massive
irrigation projects, but some of these
projects are being implemented
within the counties when the county
governments are not aware. We

of consultation and co-operation
between the national government and
county governments at that level.
2014: An issue was raised within our
counties that the MCAs are unable to
develop legislation and Bills within
their counties. We need to build the
capacity of county assemblies within
our counties. I know that this is not
just with regard to Mombasa county,
but something that is replicated across
this country. My own MCAs in Nandi
have the same challenge in terms of
processing Bills within our county
assemblies.

have in terms of looking at Bills. I
want to encourage that once we have
a Bill of this nature that is referred
to a mediation process, the space for
public participation is critical.

Leaders in Naivasha have accused the Nakuru government of failing to allocate funds
to the subcounty offices. They say this has led to a financial crisis and some services
have been disrupted and stalled. County assembly implementation committee
chairman Simon Wanyoike said Naivasha subcounty leads in revenue collection. The
Lakeview MCA said the town has, however, not benefited from the revenue it collects.
Garbage trucks do not have fuel to run them. This has been going on for two weeks,
which is very shameful, Wanyoike said. Nominated MCA Esther Njeri asked what
criteria the county uses to allocate cash. Its time some of the funds are devolved to
the subcounty, she said. Naivasha Professionals Association CEO Absolom Mukuusi
said the subcounty faces many financial problems. A couple of months ago, the offices were left in darkness after the electricity supply was disconnected, he said.
Elgeyo Marakwet speaker Albert Kochei has said the equitable development law has
spurred development. He said the Equitable Development Act, passed in 2014, was
the first equity law in Kenya. Kochei said the law has earned the assembly recognition
in the country and beyond. Kaptarakwa MCA Thomas Kigen sponsored the Bill
together with our clerk Jane Mutai. I thank them for the wonderful work that has led
to our county assembly being invited to devolution summits, he said. Kochei spoke a
week ahead of an Equity Week summit in Nairobi, where he and Kigen are expected to
highlight the successes of the law. The law, which borrowed the CDF model, came into
force in the 2015-16 financial year. Kigen said the law was passed after realising some
wards were allocated more development funds than others. Governor Alex Tolgos
recently said the wards now control development funds.

said the government has started a
journey to achieve the SDGs.
He said his ministry has developed
a roadmap to guide in the process.
Kiunjuri said the guidelines will
be launched today at the Kasarani
Indoor Arena.

houses in riparian areas.
Urban Development director of
administration Mohamed Hussein
(pictured) yesterday said two developers
started reconstructing as soon as their
unsafe buildings were demolished. The
houses had been built on a riparian land.
We are facing a serious problem where
developers get approval from unknown
people to construct at the exact areas
where we demolished buildings, he said.
Hussein said the ministry has set up the
Directorate of Building Inspectorate to
assess unfit buildings. The directorate is
inspecting buildings to determine their
structural status.
Most of these buildings plans have
not been approved. Others have been
built on unsafe grounds, Hussein said.
He said the ministry is assessing the
houses to save those that can be corrected to meet structural standards.
Our intention is not to demolish
houses. We are looking at ensuring the
safety of the buildings. We are trying to
salvage where possible by reinforcing
the structures to meet the standards.

former Chief Justice Willy Mutunga

Given a chance to lead the judiciary,
she said, she will ensure lower cadre

secretaries, are vetted to deal with corruption.
Wanja said she was never asked for
bribe by judges or magistrates, neither
has she offered any. She said if successful, she will bar the media from
accessing the courts to protect judges
independence.
Wanja said she would seek permission from accused persons before
allowing the media to cover any case,
even those that draw public interest.
The media has in some instances
overemphasised cases and tried people in the public court, which in turn
interferes with the judges thinking. I
would ensure I ask litigants if or not
they want the media in their case, she
said.

is seen as accountable when he or she
locks media out of high profile corruption cases, she answered in the affirmative.

Listen and
learn
I saw a good meme the other day. It said
Never stop learning, because life never
stops teaching. This struck home with
me after two months of unexpected
loss, with an unwelcome number of
friends and acquaintances passing on
before their time. It also resonated last
Friday when I went to listen to a man
who isnt dead yet. A blessed relief as
he is a friend of longstanding, and someone who has demonstrated exceptional
ability in his successful business life. The
name of the man will be familiar. Roger
Steadman has built a business that
spanned Africa, first in media monitoring,
then in consumer research. So an encouraging number of young marketers
had gathered last Friday to attend a
fireside chat with Roger. Im sure that
if they were listening carefully they will
have learnt a great deal from the conversation, expertly facilitated by Dr Wale
Akinyeme. Not least that you always
get more out of a networking event if
you switch off your mobile phone, and
give the speakers the courtesy of your
attention. So Roger spoke, and Dr Wale
drew out the most important insights,
and most of us listened. The objective
was to understand what behaviours
drive long-term business success. We
live in a world that seems to admire
building an enterprise quickly before
flipping it for loads of money and moving on. The entrepreneurial equivalent of
the sound bite. So it is refreshing to listen
to someone who can hold a conversation let alone a business endeavour
on course for longer.
Roger Steadman has always been an
innovator. He has noticed gaps (primarily
in access to information) and moved to
fill them. He has been driven by, in his
words wanting to find out why. Along
the way he has helped marketers to ensure that the advertising space they buy
is delivered. He has helped media professionals understand which audiences
are captured by individual newspapers,
magazines and broadcast stations. In
my personal experience, he has clearly
identified media properties that deliver
very little beyond an ego boost for their
proprietors. I cant say he has managed
to make the selling of advertising space
any more professional, but that was
probably beyond his remit. Commercial
change doesnt happen unless the principals see a need. And in the case of East
African media, there are none so blind
Roger Steadmans innovations have
often proved unpopular by changing the
status quo. So another behaviour that
has clearly contributed to his success is
moral courage. His anecdotes were peppered with stories of business problems
that gave him sleepness nights, and
in every case he decided to take them
head on. Appearing among his detractors to make unexpected presentations
of rational arguments that confounded
prejudice. Doing so without delay, and
with the courage of his convictions. That
to me was truly admirable.

DEFINITION
The Persons Deprived of Liberty Act
2014 provides that an intersex means
a person certified by a competent
medical practitioner to have both
male and female reproductive organs.
Although this definition is extremely
shallow, it offers legal recognition of
the intersex members our society,
irrespective of whether they are
citizens or not.
However, The Children Act does not
define the intersex child. It, however
defines a child and what amounts to
parental responsibility.
Luckily, the Act does not make
any distinction when it comes to the
children. All children are equal. We must
then consider the intersex child to be
part of the children who must benefit
from the provisions of the Act, since
they are human beings.
Section 4 of the Act provides for the
best interest of the child principle. This,
no doubt, includes the intersex child.
The constitution has provided, in
Article 53, for the best interest of the
child principle, and specifically offers
insulation for all children. This must be
read to include intersex children.
Children have a host of rights, which
include the right to privacy and bodily
integrity and autonomy. On the other
hand, the parents have rights over the
children and they are supposed to make
decisions for the child.
Where do the two competing rights
meet? How are the parents and the
guardians of intersex children supposed
to exercise parental responsibility? How

wants the government to help him
access his retirement benefits, 10 years
after he quit. Macharia Nyingi (pictured)
said after serving for 26 years, he is
destitute and is unable to support his
family. Speaking to the Star on Monday,
he said he works at a quarry to feed his
family. Nyingi said his problems started
when he changed the names on his ID
from Jackson Thuo to Macharia Nyingi.
He said the changes were not updated.
The father of four says when he left, he
was told he could not get his benefits
because the names did not match.
Nyingi said he tried in vain to have the
Registrar of Persons rectify the mistake.
In 2013, the Registrar of Persons in
Muranga asked me for Sh40,000 to
help me change the names but I was
helpless, he said. After working at a
quarry for eight years, Nyingi said he is
optimistic the government will give him
his dues to retire from the tedious work
and comfortably support his family. It
has been difficult for me to raise school
fees for my children because what I earn
from this job is too meager, he said.
Macharias wife Julia Muthoni said she
hoped her husbands retirement benefits
would help them start a business, but
the wait continues. She said she started
making illicit brew, for which she was
arrested several times.

Open heart surgery at the Coast
Provincial General Hospital will resume
after a laboratory is completed, the
Mombasa government has said.
County Health director Shem Patta
on Saturday said the catheterisation lab
will have diagnostic imaging equipment
to visualise arteries and chambers of the
heart and treat abnormalities.
Last year, the hospital stopped
performing open heart surgery for lack
of enough staff and equipment.
We want to come up with a modern
cardiac centre before we resume the
surgeries, Patta said.
He spoke to the press on the sidelines
of the county public participation
forum to discuss the Finance Bill at the
Tononoka Social Hall. Patta said staff
will undergo training. Eight open heart
surgeries were performed at CPGH
last year with the help of doctors from
Kenyatta National Hospital.

SECURITY
More than 2,000 police reservists will be recruited starting in October and they will be
deployed in the North Rift region to fight banditry. Inspector General of Police Joseph
Boinnet said they will be hired under a plan to end cattle rustling once and for all.
Boinnet spoke after an extensive tour of the Kerio Valley at the weekend.
He said the government will also deploy three armoured personnel carriers for the
security personnel working in the area.
We already have two APCs on the ground and we will deploy one more soon,
Boinnet said.
He was accompanied by Elgeyo Marakwet Senator Kipchumba Murkomen and
Governor Alex Tolgos. He said banditry was perpetrated by a few individuals and not
communities. Its those few individuals we have to deal with and not communities,
he said.
Efforts to drill more geothermal energy wells in the Narasha area of Naivasha have
suffered a major setbackafter farmers from the Ngati Cooperative in Maella annulled
the sale of their 1,200 acres to KenGen. The members said they will not allow KenGen
to drill on the disputed land saying they were not involved by the previous directors.
They now want the power-generating company to hold fresh talks in purchasing the
land.
This emerged when the new directors of the land-buying company were ushered
into office in a meeting in Maella trading center. Last year, the farmers threw out their
directors for selling their land in a deal shrouded in mystery. Each of the more than
800 members receiving Sh415,000.

Busia Governor Sospeter Ojaamong and
his Mombasa counterpart Hassan Joho
have criticised the national governments move to cripple port and border
operations.
Joho said Jubilee has instead decided
to make Naivasha a special economic
zone. He spoke in Mombasa on Saturday
during ODMs 10th anniversary celebrations.
They want to cripple port operations
that affect the economy of the Coast,
Joho said.
More than 20,000 clearing and
forwarding agents and truck drivers
will lose jobs as a result of the standard
gauge railway and the Naivasha SEZ, the
Mombasa governor said.
On Monday, Ojaamong said Busia
is equally affected by the move to
centralise the clearance of goods in
Mombasa and Naivasha.
Thousands have lost their jobs at
the border points and the national government is doing nothing to salvage the
situation, he said. Trucks destined for
the Great Lakes region cannot stop on
the Kenyan side of the border, the Busia
governor said.

October 18-28 in Nairobi.
The team has been training at Nyayo Stadium outdoor facility and broke camp last Tuesday to allow
players to feature for their clubs in the national league over the weekend. The team, under the tutelage
of former national team player Catherine Mabwi, Kenya Prisons womens team assistant coach Josp
Barasa and KCB head coach Vernon Kainga are preparing for the event, which is a qualification round for
the FIVB Under-23s World Championships next year in Ljubljana and Maribo in Slovenia.
KVF technical director, David Lungaho, said their move to Kasarani is meant to help players get used
to the indoor facility. We were to begin training today but most players who traveled to Voi arrived
late in Nairobi and are fatigued. That is why decided to move the training sessions to Wednesday, said
Lungaho, who doubles up as the Kenya Prisons womens team head coach.
He added: I had the chance to observe all the players who form the provisional squad of 20 players
and they were impressive with their respective clubs. What they need now is motivation and I believe
when the 10-day event starts, they will be up to the task.
