In North Carolina, it is prohited for opposite sexes to occupy a same bedroom at hotel for
immoral purposes falsely registering as husband and wife. Under North Carolina General
Statute Chapter 14 Criminal Law, Article 26- Offenses against Public Morality and Decency,
Section 14-186, any man and woman found occupying the same bedroom in any hotel, public
inn or boarding house for any immoral purpose, or any man and woman falsely registering as,
or otherwise representing themselves to be, husband and wife in any hotel, public inn or
boarding house, shall be deemed guilty of a Class 2 misdemeanor.
The requisites for violating this state law are (1) any man and woman, (2) found occupying the
same bedroom or falsely registering as husband and wife, (3) in any hotel, public inn or
boarding houses (4) and such room is use for immoral purpose. The punishment for violating
this code is under Class 2 misdemeanor. It carries a maximum penalty of 60 days in jail and a
$1,000 fine. The Court of Appeals of North Carolina held in the case State v. Sanders that G.S.
14-186 fails to define with sufficient precision exactly what the term `any immoral purpose' may
encompass. One must necessarily speculate, therefore, as to what acts are immoral. If the
legislative intent of G.S. 14-186 is to proscribe illicit sexual intercourse the statute could have
specifically so provided.
