Lt. John Tillman 238, 100 E. Broadway Sand Springs OK, 918-245-8777:

*Lt. Tillman, employed as a police officer for the City of Sand Springs, was so employed on 08/17/2010 at approx. 2017 hrs when he was dispatched
to the area of the unit block of W. 44th, City of Sand Springs Tulsa County, to investigate the report of a loose, aggressive dog described as a black
and white pit bull. On arrival to the location at approx. 2029 hrs he did and / or observed the following:

• He observed a large black white dog that appeared to be a pit bull mix loose (un-leashed and not in a fenced environment) standing in a
paved driveway at the West end of the residence of 8 W. 44th.
• He informed SSPD dispatch that he had located the animal and that he was attempting to find a way to go around the animal, which was
barking, growling, and slowly making an approach towards Lt. Tillman in the street, to make contact with any home occupants to have
them secure the dog.
• He walked, in the center of 44th, to the East edge of the property towards an un-paved drive and as he did the dog followed, in the un-
fenced front yard, continually barking and growling.
• He then decided to return to his patrol unit to try other methods of contact and as he was walking back to the patrol car, which was parked
just West of 8 W. 44th's paved driveway in the street, the porch light of the residence came on and a white female exited.
• He called to the white female, later identified as Kimberlee Hughes, who walked out to the center of the paved drive way on the West side
of the residence.
• He told her the dog was loose and that she needed to secure it immediately.
• He then continued walking West on 44th back towards his patrol car.
• The dog then began a full running charge towards him barking and growling.
• He had already deployed OC spray in his left hand and had his sidearm out in his right, prepared for a possible attack by the dog.
• The dog came at him so quickly he made an immediate decision that OC was not optimal for deployment and as the dog almost struck him
he fired two rounds downward toward the dog in fear for his safety. He and the dog were near the middle of West 44th at this time and the
aforementioned Kimberlee Hughes was still in the driveway approx. 40 ft to West and approx. 20 ft to the South of Lt. Tillman and the dog
and at no time was in the line of gun fire.
OFFENSE NARRATIVE

• The dog was struck once and one round impacted the asphalt near the feet of Lt. Tillman.
• The dog then retreated to the back yard of the residence followed by Hughes who had begun to yell profanities and threats of lawsuits at
Lt. Tillman.
• Lt. Tillman the requested additional units to the scene to help secure it and for additional officer presence in case of retaliatory acts by the
residents of the home.
• A white male, identified as Randall Lane, then exited the front door walking with crutches due to an apparent injury to his left leg. He
asked Lt. Tillman what had happened and when he was informed he too began to yell profanities at Lt. Tillman.
• Lt. Tillman then contacted his supervisor, Capt. Mars with SSPD, and informed him of the incident. He also contacted SSPD Det. Barnett
who arrived at the location and photographed the scene
• Two shots were fired by Lt. Tillman: The first one that missed the dog was found impacted on the road surface of 44th St. approx. 5 ft
North of the South curb line of 44th and approx. 40 ft. East of the center of the paved drive of 8 W. 44th. Two spent shell casing were
found, also in the roadway of W. 44th. One was approx. 3 ft North of the South curb line of 44th and the other was approx. 1 ft North of the
South curb line of 44th, both being approx. 40 ft East of the center of the paved drive of 8 W. 44th. The impacted round and shell casings
were photographed and recovered by Det. Barnett.
• SSPD Animal Control was contacted and AC Officer Tommy Wagner arrived and took the dog for treatment at McKinney Animal hospital
where the dog was to be treated and maintained for observation due to its aggressive behavior. The dog was found to have been in one of
the front legs and through the chest and body of the dog exiting near its rear. The dog is expected to fully recover at the time of this report.
• Two witnesses Jessica Owens, the person who initially called in on the dog, and a neighbor Jerry Honeycutt were spoke with. Witness
Owens provided a written statement. Witness Honeycutt stated that he did not see the incident but was “glad the dog got shot” because it
was “a menace”. He would not give a written statement saying that all the times he had called on the same dog to SSPD should be
statement enough.
• AC Officer Wagner issued a citation to Hughes who claimed all ownership and control of the dog.

*Note: The aforementioned Randall Lane, despite being on crutches to walk, continually exhibited combative behaviors. He continually yelled
profanities and threats at SSPD officers. He continued his threats and gestures after being told to stay on his porch by Lt. Tillman and while the
investigation was taking place he began coming at SSPD officers while threatening violence against them.
