Kindly clarify the overtime payment calculation for public holidays and weekly offs.
We had a session from Ministry of Manpower and we were informed that for working
on public holidays and weekly off days we should be paid double salary ie (1+2) or
two days compensatory leave. But our accounts department does not agree and are
paying us (1 + 1.25). What does the labour law say?
The text of Article (73) is reproduced here to clear all ambiguities. "The employer shall pay
the employee ... an additional wage equivalent to the wage he/she used to get (for the
additional work) plus a minimum of 25 per cent for additional day time working hours, and
50 per cent for the nocturnal working hours. If the work falls in the weekly off day or on
public holidays, the employee shall be entitled to a double wage for that day unless he is
given another day off in lieu of it during the following week."

For the purpose of simplification, the following are the main points in this article:
a. For normal overtime hours (during day time), the employee shall be paid an additional
wage equivalent to 125 per cent of his/her normal wages.

b. There shall be an additional 150 per cent of the wages, if the employee works overtime
during nocturnal (night) hours.
c. If the overtime work falls on weekly off days or approved holidays, the additional
payment shall be 200 per cent of the normal wages.
d. However, if the employee is compensated with off days equivalent to the overtime days,
condition in the previous paragraph will not be applicable.
